ORDER

Sh. Dheeraj Kumar, SDO City Sub Division, DHBVN, Fatehabad, has personally filed an

appeal on 24.07.2018 against the CGRF, DHBVN, Hisar, orders dated 9.7.2018, passed in case

no. 2174 of 2018.

The appeal has been registered as Appeal No.17 of 2018. Since the SDO City

Sub Division, Fatehabad, was present in person, as such, an opportunity to plead the case was

granted to him.

While pleading, the SDO City Sub Division, Fatehabad, submitted in writing that he has

been directed by the XEN/Operation Division, DHBVN, Fatehabad, to file the appeal and

requested to admit the same.

The case was examined with reference to the section of 42(6) of the Indian Electricity

Act 2006 which provides that “any consumer, who is aggrieved by non-redressal of his

grievances under sub-section (5), may make a representation for the redressal of his grievance

to an authority to be known as Ombudsman to be appointed or designated by the State

Commission”. Further, the pre conditions/limitations for entertaining the

representation/appeal by the Electricity Ombudsman have been defined in the Regulation 3.16

of the HERC Regulation No. HERC/37/2016, notified on 29th July, 2016. As per the ibid

Regulations, the aggrieved complainant (consumer) may file an appeal before the Electricity

Ombudsman.

Keeping in view the above and material on record, the appeal filed by the SDO City Sub

Division, Fatehabad, is not maintainable before the undersigned, as the SDO is not a consumer.

The Appellant may take up the matter with the appropriate authority under the law.

File may be consigned to the record.
