Application of Duke Energy Progress, LLC, for 3

approval of the transfer and sale of property in 4

Holly Springs, North Carolina. 5

COMMISSIONER ELAM: Since I’ve apparently 8

still got the floor and love the sound of my own 9

voice, on this particular filing by Duke Energy 10

Progress it concerns a 425-acre parcel of vacant 11

land not required for utility operations. A 12

contract to sell property to Shenandoah Homes for 13

$17 million, that’s what the contract is for, and 14

Shenandoah Homes is not affiliated with Duke Energy 15

Progress. The property was marketed by a DEP 16

employee, who is a licensed real estate broker and 17

who is familiar with property values in the market 18

for tracts like the property at issue. 19

The property has a tax value of $14,675,799. 20

As of May 25, 2017, the appraised value of the 21

property was $12,765,000, and the property has a 22

net book value of $591,622. 23

The original cost of the property will be 24

credited as a reduction of the amount carried under 25

Account 101, “Electric Plant in Service.” The 26

difference between the sales price and the original 27

cost of the non-depreciable property will be 28

applied to Account 421.10, “Gain on Disposition of 29

Property.” 30

And last but not least, ORS does not oppose 31

the sale. 32

of Pickens County, and request for approval of the 1

water system asset purchase agreement with Crawford 2

Falls Owners Association, Inc. 3

VICE CHAIRMAN RANDALL: Mr. Chairman, in 6

Docket No. 2018-28-W, I move that we approve the 7

expansion of JACABB Utilities, LLC’s existing water 8

service area to include certain portions of Pickens 9

County and that we approve the Water System Asset 10

Purchase Agreement with Crawford Falls Owners 11

Association, Incorporated. 12

There are several points on this to be noted. 13

ORS does not object to this. JACABB is currently 14

authorized to provide service in areas of Pickens 15

County, so this is consistent with what they’ve 16

been doing. JACABB requests that it be allowed to 17

provide water service in the expanded service 18

territory pursuant to rates and charges that were 19

approved in Docket No. 2008-173-W. The City of 20

Clemson will provide water via a master meter to 21

the Crawford Falls Subdivision and will be 22

responsible for the sewer and storm water service. 23

JACABB will be responsible for calculating and 24

collecting payment from individual customers for 25

sewer service and storm water service provided by 26

the City of Clemson. JACABB also requests that the 27

sewer and storm water service charges be approved 28

as pass-through charges with a monthly 29

administration billing fee of $4.50 to each 30

homeowner or customer. 31

Item 11 is Docket No. 2014-346-WS, the Application 13

of Daufuskie Island Utility Company, Incorporated, 14

for approval of an increase in water and sewer 15

rates, terms, and conditions, and we have a 16

Petition for Reconsideration on Commission Order on 17

Rehearing. 18

COMMISSIONER BOCKMAN: Mr. Chairman? 19

COMMISSIONER BOCKMAN: At the risk of 21

expanding my reputation for long-winded motions, I 22

do have one of that nature that I’d like to offer 23

in this matter. 24

CHAIRMAN WHITFIELD: Well, we’re ready, 25

Commissioner Bockman. You go right ahead. 26

COMMISSIONER BOCKMAN: Thank you, Mr. 27

Chairman. 28

Mr. Chairman, I move that Daufuskie Island 29

Utility Company’s Petition for Reconsideration of 30

Order No. 2018-68 be denied. 31

The company’s Petition first questions the 32

Commission March 21, 2018 13 Meeting #18-10

Order’s basis for supporting the ORS recommendation 1

excluding $699,361 in gross plant from rate base. 2

The Order cited specific testimony from ORS 3

auditors, which established that the amount 4

proposed for exclusion was derived after adding the 5

elevated tank site and related facilities to the 6

account for plant-in-service as discussed by the 7

Supreme Court’s opinion, and established that the 8

company failed to present evidence supporting the 9

value of the remaining excluded plant-in-service by 10

invoices or other probative evidence. Based on the 11

company’s own witness’s testimony, I believe ORS 12

furnished information that enabled the company to 13

identify specifics of the various items considered 14

in plant-in-service at issue, along with categories 15

of such plant. Specifically, in the original case, 16

Witness Guastella, on page five of his rebuttal 17

testimony, stated that ORS had provided DIUC with 18

work papers as a follow-up to the audit exit 19

conference call that enabled the company to 20

identify what it believes are the specifics of the 21

ORS adjustments. 22

The NARUC Uniform System of Accounts for both 23

water and wastewater companies requires that 24

property records be maintained by the utility. 25

Lacking such documentation, ORS properly excluded 26

the $699,361 in plant-in-service. Although the 27

company argued that, despite the absence of 28

verifiable property records, ORS should have 29

accepted the company’s own estimates of the values, 30

the Commission cannot accept estimates in regard 31

to the rate-base items in question without proper 32

documentation of relevant, sufficient, and reliable 1

data on which to decide the company’s revenue 2

requirements. The company has not established a 3

process for preparing accounting estimates that can 4

be audited by an independent third party, such as 5

the ORS. Therefore, the company must provide 6

proper documentation for such items in future 7

proceedings, if it seeks approval of them. Such 8

documentation can be provided by various sources, 9

such as obtaining duplicate invoices from vendors, 10

presenting cancelled checks as proof of payment, 11

obtaining copies of cancelled checks from banking 12

institutions when necessary, supplying copies of 13

paid contracts, and/or obtaining independent third-14

party estimates for questioned items. 15

I also believe that the evidence presented by 16

ORS supports the adjustment made for capital costs 17

and legal costs associated with plant-in-service, 18

which we adopted in Order No. 2018-68, and company 19

allegations to the contrary must also be rejected. 20

With regard to DIUC’s allegations regarding 21

accumulated depreciation and depreciation expense, 22

it is clear that ORS updated these “fall out” 23

adjustments and presented them during the rehearing 24

of this case. Therefore, the Commission Order 25

adopting these adjustments was proper and need not 26

be reconsidered. 27

Considering the rate-case expense issue, we 28

recognized in our Order on Rehearing that ORS 29

Witness Hipp completed a thorough review of all 30

invoices from Guastella Associates, and found them 31

to lack specific detail in many respects. Although 32

the company failed to meet its burden regarding 1

sufficiency of evidence, the Commission has made it 2

clear that the company is not foreclosed from 3

providing sufficient evidence on this issue in its 4

next rate case. Accordingly, this allegation of 5

error in the Order on Rehearing is without any 6

substantial basis. 7

This motion summarizes my proposed resolution 8

of the company’s Petition. If the Commission 9

adopts this motion, I further move that a full 10

order should follow that provides full details of 11

the rationales for the decision. 12

In summary, again, I move that we deny the 13

relief the company requests in the Petition for 14

Reconsideration in its entirety. Finally, in its 15

filing on February 4, 2018, the company noted that, 16

pursuant to our Order on Rehearing, it is 17

collecting $955,136 in additional annual revenue, 18

rather than the $950,166 in additional revenue that 19

we approved in that Order. I move that we require 20

the company to make appropriate adjustments to 21

cease the collection of the annual revenue which 22

exceeds the authorized level of $950,166. 23

Mr. Chairman, that concludes my motion, and I 24

so move. 25

Bockman’s lengthy motion, as he described it, in 29

recall, I was one of two on this panel who filed a 1

dissent from this Order. I’m going to support Mr. 2

Bockman’s motion. As part of the Staff’s filling 3

in the details, I hope that it is re-emphasized 4

that an examination of the appropriate used-and-5

useful rate base can be addressed in the next 6

proceeding. I believe it should have been in this 7

proceeding, but it has to be open to the next 8

proceeding. 9

In addition to that, I support the finding in 10

Commissioner Bockman’s motion on the rate-case 11

expenses, and when we’re talking about north of 12

$½ million in rate-case expenses for a company of 13

this small size, when rate-case expenses become a 14

significant percentage of the increase in rates, I 15

think that just becomes unconscionable. And for 16

those reasons, I would support Commissioner 17

Bockman’s motion. 18

Island Utility Company’s Motion for Order Regarding 21

Bonds be held in abeyance. 22

ORS reports that it’s not completed its review 23

to ensure that the company is complying with the 24

Commission’s Order 2018-68 that stated, “The 25

company shall refund the difference between the 26

amount it collected under bond and the amount this 27

Commission approves...to the customers that paid 28

the excessive rates at an interest rate of 12 29

percent per annum.” However, according to ORS’ 30

response to the Motion, its review thus far has 31

raised questions regarding the amounts refunded, 32

the status of refunds to former customers of DIUC, 1

and the methodology used to calculate those 2

amounts. ORS, therefore, argues that the issuance 3

of refunds is not settled and that issuing an order 4

authorizing the surety to release the letter of 5

credit would place ratepayers at risk. 6

I agree with the ORS that releasing the letter 7

of credit at this time would be premature. I move 8

that we request ORS to complete its review by April 9

30th, or upon such additional time as it might 10

reasonably need and request. DIUC’s Motion will be 11

taken up again by this Commission subsequent to the 12

filing of the ORS review. 13
