COMPLIANCE STATEMENT As a member of the NCAA, Bellarmine University is committed to complying with all rules and regulations of the NCAA in the conduct of its intercollegiate athletics department. The institution is responsible for monitoring all aspects of its athletics programs to ensure compliance and to identify and report to the NCAA any areas in which we may have failed to maintain compliance with NCAA rules and regulations. In such cases, Bellarmine must fully cooperate with the NCAA and take the appropriate corrective measures, if necessary. This responsibility is a collective endeavor that is shared by athletics department staff, student-athletes, other appropriate institutional personnel, and individuals and groups representing the athletics interests of the institution. It is each individual’s responsibility to ask questions, make no assumptions, and follow through on all compliance procedures and guidelines. Compliance with University and NCAA rules can only be obtained when every individual presents a positive, practical, and ethical attitude toward compliance. By acknowledging our role in institutional compliance, accepting responsibility for the integrity of our program, and making ourselves aware of the legislation, compliance with the University and NCAA rules is assured.

BELLARMINE COMPLIANCE COMMITTEE The compliance committee ensures that Bellarmine University is in compliance with NCAA and institutional rules and regulations. This group meets to discuss, interpret and recommend policies and procedures. The compliance committee is also charged with periodically evaluating the effectiveness of the eligibility certification process by spot checking

student-athlete transcripts. All recruiting compliance procedures will be evaluated by the Compliance Committee. The compliance committee consists of the Assistant Athletic Director for Compliance (Melanie Brunsdon), Faculty Athletic Representative (Dr. Ann Jirkovsky), Director of Financial Aid (Heather Boutell), Dean of Undergraduate Admission (Tim Sturgeon), Assistant Registrar (Jennifer Matzek), Bursar (Angela Walsh), and Academic Advisors for Student-Athletes (Andrew Schroeder and Erin Burke).

Compliance Responsibilities for Other Staff All Athletic Department Staff Members – All athletic department staff members are responsible for understanding NCAA rules and to report any potential violation of NCAA rules. Sports Medicine – The sports medicine staff is responsible for awareness of the NCAA drug testing program and medical rehabilitation services, as well as contributing to educating student-athletes in the areas of medical hardship waivers, use of banned substances and drug testing, and NCAA and institutional insurance programs. The sports medicine staff also assists compliance with monitoring daily and weekly countable athletically related hours limitations. Head/Assistant Coaches – These individuals are responsible for knowledge and implementation of NCAA rules and regulations, in the areas of amateurism, eligibility, recruiting, financial aid, playing and practice seasons, and awards and benefits. Coaches are expected to fully cooperate and participate in compliance-related policies and procedures, within University and NCAA guidelines. Bellarmine coaches must maintain an atmosphere of compliance by, specifically, but not limited to:

Attend and participate in monthly education meetings

Review NCAA rules with student-athletes when necessary and reinforce the importance of compliance

Facilitate the provision of all information necessary to determine prospective student-athlete eligibility

Provide complete off-campus contact and evaluation forms; monitor the permissible number of contacts utilized

Provide complete and accurate expense reports

Provide complete and accurate required information for all official visits

Declare playing and practice season to compliance for review and approval; ensure sport’s compliance with NCAA rules related to playing and practice seasons including monthly athletically-related activity logs

Responsible for the actions of all assistant coaches and staff and the sport’s compliance with NCAA rules

In cooperation with the Director of Athletics, monitor the scheduling process, verifying that the schedule meets NCAA and conference scheduling requirements

Annually pass the NCAA Recruiting Exam (recruiting coaches only)

Initiate the renewal and non-renewal of athletically-related financial aid process

Annually declare and receive approval from the Director of Athletics for athletically related income

Ensure compliance with Bylaw 12.5.4 regarding uniform logos

Ensure compliance with Bylaw 13.7.5.2 and 16.2 regarding complimentary tickets

Ensure compliance with Bylaw 13.13 regarding summer camps

RULES EDUCATION Rules education is a critical part of the compliance program at Bellarmine. Education and knowledge of University and NCAA rules is the first step in maintaining compliance and upholding the integrity of the University. Although coaches and staff are not expected to know every NCAA rule, they are expected to know the basic rules, to use the NCAA Manual as a reference point, and to ask for interpretations before acting when the rules or situation seems unclear. The rules education program is intended to prepare coaches and staff to identify areas where compliance problems may exist and to identify infractions, should they occur. The rules education program is also intended inform coaches and staff of proposals and changes to NCAA rules throughout the legislative process. In addition, the Assistant Athletic Director for Compliance will seek input from coaches and staff regarding legislation throughout the process that related to their specific sport or area.

Head Coaches and Full-Time Assistant Coaches. The Assistant Athletic Director for Compliance has the primary responsibility for educating coaches and providing compliance orientation for new coaches. Each coach will receive an NCAA manual annually. The Bellarmine University Athletic Compliance Manual will be available on the athletic department website. The Assistant Athletic Director for Compliance will schedule and conduct rules education throughout the year as follows:

A group compliance meeting will be held at the beginning of the academic year to cover new legislation and procedures for the upcoming year.

Monthly department meetings will be held to discuss important information relevant to the time of year, as well as new information or rules interpretations that have just developed.

Additional timely educational materials, interpretations of legislation and “hot topics” as defined by the NCAA will be distributed via email to coaches, as necessary.

Part-Time and Volunteer Coaches. Head Coaches are responsible for the education of their staff. The Assistant Athletic Director for Compliance is responsible for providing written educational materials, as needed. All assistant coaches will be provided with an NCAA Manual, as appropriate. The Bellarmine University Athletic Compliance Manual will be available on the athletic department website.

Staff Members. The Assistant Athletic Director for Compliance is primarily responsible for the education of athletic department staff members and other Bellarmine staff members with compliance responsibilities. Athletic department staff members and other Bellarmine staff members with compliance responsibilities are required to attend the departmental compliance meeting to be scheduled at the beginning of each academic year. This meeting will review appropriate legislation and newly adopted legislation for the upcoming academic year. The Assistant Athletic Director for Compliance is responsible for distributing educational materials to athletic department staff members and other Bellarmine staff members with compliance responsibilities, as needed. Athletic department staff members and other Bellarmine staff members with compliance responsibilities will receive an NCAA manual and will have access to the Bellarmine University Athletic Compliance Manual on the athletics website. Staff members with compliance responsibilities are encourage to attend NCAA Regional Rules Seminars every 2-3 years, particularly when the seminar is held within driving distance to Bellarmine.

Student-Athletes. The Assistant Athletic Director for Compliance is responsible for educating student-athletes. The Assistant Athletic Director for Compliance will conduct a rules education meeting at the beginning of each semester with each team. This meeting will review important NCAA and Bellarmine regulations, including the summary of NCAA Regulations, academic eligibility, the Student-Athlete Handbook, amateurism guidelines, sports wagering, drug testing, and playing and practice seasons. Student-athletes will also complete all required paperwork at or in advance of the annual meeting. The Assistant Athletic Director for Compliance will attend at least one Student-Athlete Advisory Committee meeting each year with a rules education agenda, and will seek input on proposed legislation when applicable.The Assistant Athletic Director for Compliance and the Head Coach are responsible for providing student-athletes with written materials regarding relevant rules and interpretations. Bellarmine’s Division I lacrosse program will receive additional rules education from the Assistant Athletic Director for Compliance. The lacrosse fall orientation meeting will include extra information that is applicable to Division I athletes. The lacrosse team will also receive timely email communication from the Assistant Athletic Director for Compliance as he/she deems important. Prospective Student-Athletes. Educational materials directed to prospective student-athletes are available at the Bellarmine athletics website. Rules education via the website for prospects will include recruiting rules and organized competition legislation, among other topics. The Assistant Athletic Director for Compliance and the Head Coach are responsible for providing prospective student-athletes with written materials regarding relevant rules and interpretations. Community/Representatives of Athletics Interests. The Assistant Athletic Director for Compliance is responsible for education representatives of athletics interests and other community members. An educational letter will be sent with

basketball season tickets annually, official booster clubs will receive annual rules education, and other educational outreach pieces will be created periodically as needed.

RECRUITING

Certification Test All Head Coaches and Assistant Coaches are required to follow all NCAA Bylaw 13 pertaining to recruiting. Each year, all coaches who engage in recruiting must pass the NCAA Recruiting Certification Test. As a form of rules education, all coaches must take the NCAA Recruiting Certification Test, even if the coach does not plan on engaging in recruiting activities. The certification test will be administered each summer by the Faculty Athletic Representative. A coach must have a passing score before he/she can recruit off-campus. Certification test scores are automatically sent to the GLVC, and the GLVC compiles results and sends them to the Assistant Athletic Director for Compliance. In the event that a coach fails the certification test (answers less than 80% of the questions correctly) Division I coaches must wait 30 days before retaking the test; Division II coaches must wait 14 days before retaking the test. Only coaches who have passed the certification test as confirmed by the Great Lakes Valley Conference may recruit off campus; representatives of athletics interests may not engage in recruiting activity.

Contact Periods Head Coaches and Assistant Coaches are required to follow all Contact, Evaluation, Dead, and Quiet Periods that pertain to their sports. These are listed in the NCAA Manual and on the NCAA website. Coaches may begin in-person, off-campus recruiting contacts on June 15 immediately preceding the prospect’s junior year in high school (July 1 immediately preceding the prospect’s senior year for lacrosse). Coaches must keep a record of the first two contacts using ACS. Lacrosse coaches must use ACS to keep a record of all contacts and evaluations in keeping with Division I legislation.

Official Visits Visits by prospective student-athletes are carefully monitored. In accordance with NCAA rules, Bellarmine will provide only one official visit to a prospective student-athlete. Additional visits by a prospective student-athlete must be made at his or her own expense. Official visits may not exceed 48 hours. All questions about official visit rules should be directed to the Assistant Athletic Director for Compliance. Official Visit Triggers An official visit is triggered whenever Bellarmine provides a visit expense to a prospective student-athlete. Typical examples of visit expenses include the following:

Transportation expenses (transportation to view practice and competition facility is permitted on unofficial visit)

Entertainment expenses (beyond complimentary admission)

Meals (Division II allows one meal off campus on unofficial visit; Division I may provide one on campus meal during an unofficial visit)

Official Visit Prerequisites

The prospective student-athlete must present a high school transcript (official or unofficial).

The prospective student-athlete must be registered with the NCAA Eligibility Center.

The prospective student-athlete must be placed on the Bellarmine IRL with the Eligibility Center. Official Visit Procedures

1. Coach submits Official Visit Approval Form to the Assistant Athletic Director for Compliance at least 24 hours prior to the start of the official visit. A copy of the form is given to the Office Manager for any payments or reimbursements; a copy is also provided to the coach who submitted the form.

2. Assistant Athletic Director for Compliance confirms that official visit prerequisites are met and then confirms that recruit is on institutional IRL.

3. Coach reviews Official Visit Prospect + Host Form with prospect and student host who then sign form.

4. Documentation for all official visits is on file in the Compliance Office. Official Visit Student Host Policies

The student-athlete must be enrolled full-time and be a Qualifier or Partial Qualifier, per NCAA regulations.

Only one student host may be provided a free meal if attending a restaurant.

The student host shall only receive money to entertain the prospect, the prospect’s parents or spouse and the student host, or any staff member accompanying the prospect.

A maximum of $30.00 per day will be provided to cover all entertainment expenses. An additional $15.00 per day may be provided for each additional prospect being hosted by one student-athlete.

A student host may not purchase alcoholic beverages regardless of whether the host or the prospects are of legal drinking age.

No cash may be given to the visiting prospect.

A student host may not use entertainment funds to purchase gifts for the prospect.

A student host may not use transportation provided or arranged by a Bellarmine staff member or booster of the athletics program

A student host may not transport the prospect or friends/family more than 10 miles from campus.

A student host should not allow recruiting conversations to occur, on or off campus, between a prospect and a booster.

A student host will be responsible for turning in any and all receipts the day after the visit.

Correspondence and Telephone Calls Coaches may begin to send written correspondence and email to prospects beginning on June 15 prior to the prospect’s junior year in high school. Coaches may begin to make telephone calls to prospects on June 15 immediately prior to the prospect’s senior year in high school; lacrosse coaches may begin to make telephone calls to prospects on July 1 following the prospect’s junior year in high school. Division I coaches must track all outgoing phone calls in ACS; Division II coaches must track the first two outgoing phone calls in ACS.

Tryouts

Conditions and Procedures for Conducting Tryout with Prospective Student-Athlete (sports other than

lacrosse)

Only one tryout per prospect

Tryouts are limited to two hours

The tryout may be conducted for high school juniors or seniors who are not in the traditional season for the sport occurs or who have completed high school eligibility. If the prospect is a transfer student, his/her sport season must be completed. In the case of a four-year transfer, written permission must be granted from the Director of Athletics or designee of his or her school before he/she can be contacted.

Prospective student-athlete must present proof of medical insurance and have had a physical evaluation within the preceding six months.

Effective 8/1/2012, the prospective student-athlete must undergo a sickle cell solubility test, unless documented results of a prior test are provided to Bellarmine, or the individual declines the test and signs a Sickle Cell Test Waiver.

The prospective student-athlete must complete a Prospective Student Athlete Health History Form and the Acceptance of Risk for Tryouts & Evaluations Form.

The head coach must complete and submit a Tryout Request Form and a copy of the prospect’s physical to the compliance office prior to the tryout.

The prospective student-athlete must complete a Prospective Student Athlete Health History Form and the Acceptance of Risk for Tryouts & Evaluations Form.

The head coach must complete and submit a Tryout Request Form and a copy of the prospect’s physical to the compliance office prior to the tryout.

Student-Athletes – Transferring from Bellarmine If a student-athlete is denied permission to contact another institution regarding transferring and competing in intercollegiate athletics, he or she has the right to appeal that decision. The institution must notify the student-athlete within 14 calendar days if permission to contact another institution has not been granted.

1. To start the process, the student-athlete must write a letter of appeal within 14 calendar days of the date of notification to the Assistant Athletic Director for Compliance requesting a hearing about not receiving permission to contact a particular institution.

2. The Assistant Athletic Director for Compliance sets up an appeal hearing within 30 days and notifies the student-athlete and respective coach of the date and time of the hearing. The ad hoc committee hearing the appeal will be chaired by the Faculty Athletic Representative and comprised of two other members of the Bellarmine University Athletics Compliance Committee. The Assistant Athletic Director for Compliance will not be part of the ad hoc committee.

3. The student-athlete and the respective coach are required to attend the hearing to present his or her case to the committee regarding permission to contact. If any party is unavailable to meet in-person, it is permissible to present via teleconference. The student-athlete and coach may bring additional documentation to support his or her case. The student-athlete and coach will present their cases separately (coach will not be in the room when the student-athlete presents; the student-athlete will not be in the room when the coach presents). The Assistant Athletic Director for Compliance will attend both presentations to answer any questions that the ad hoc committee may have regarding legislation.

4. Once all information has been reviewed, the ad hoc committee will make a decision and inform the student-athlete and coach via email. The decision is based on a majority vote by the ad hoc committee members. The student-athlete must be notified of the decision within 30 calendar days of receiving the student-athlete’s written request for the hearing. The decision of the committee is not reviewable by any other individual or group and is a final decision with no opportunity for an additional appeal.

If a student-athlete is denied the use of the one-time transfer exception upon transferring to another four-year institution, he or she has the right to appeal that decision. The institution must notify the student-athlete within 14 calendar days if the opportunity to use the one-time transfer exception has been denied.

1. Coaches must provide the Assistant Athletic Director for Compliance with lists of prospective student-athletes they are recruiting; this list will be shared with the Dean of Admission, and Academic Advisor for Athletics, and the Director of Financial Aid.

2. The Assistant Athletic Director for Compliance certifies that the student-athlete has registered with the NCAA Eligibility Center and confirms the student-athlete is placed on Bellarmine’s IRL. Coaches have the ability to add and delete prospective student-athletes from their sport-specific IRL. They are also tasked with monitoring the progress of academic and amateur certification.

3. The Assistant Athletic Director for Compliance certifies that the student-athlete has completed the required NCAA, GLVC /ECAC/SoCon and institutional forms, and attended an orientation meeting.

4. The Assistant Athletic Director for Compliance certifies that the student-athlete is enrolled full time. Full time enrollment is obtained through a report in Jenzabar; the athletic department runs a weekly real-time report listing the number of credits all student-athletes are enrolled in. (With Bellarmine adapting Colleague for the 2016-17 academic year, there may be a hold placed on student-athletes to prevent them from dropping a class without permission from the Academic Advisor for Athletics or Assistant Athletic Director for Compliance.)

5. The Head Athletic Trainer certifies that the student-athlete has completed all medically-related paperwork and physical examinations.

6. If a student-athlete has NOT met any of the requirements for practice, the Assistant Athletic Director for Compliance or the Head Athletic Trainer (depending on the deficiency) notifies the coach and the student that the student is not eligible for practice, and lists the steps the student must take to become eligible.

7. When the student-athlete(s) is deemed eligible for practice, the appropriate notation is made in ACS, where coaches can track progress in real time.

Eligibility for Competition

1. The Assistant Athletic Director for Compliance certifies that the student-athlete is a qualifier and an amateur via the NCAA Eligibility Center.

2. The Assistant Athletic Director for Compliance certifies the student-athlete has completed all required NCAA, GLVC/ECAC/SoCon and institutional forms.

3. The Assistant Athletic Director for Compliance completes the NCAA Eligibility Form, which indicates each student-athlete’s eligibility status. The GLVC Eligibility Form is reviewed and signed by the Head Coach, the Faculty Athletic Representative, the Athletic Director, and the Assistant Athletic Director for Compliance, and is submitted to the GLVC prior to the team’s first date of competition. For lacrosse, in addition to the NCAA Eligibility Form, the NCAA Squad List is produced and both are sent to the Southern Conference prior to the first competition.

Certifying Transfer Eligibility

Eligibility for Practice

1. Once a coach becomes aware of a possible transfer to Bellarmine, the coach must immediately provide the Assistant Athletic Director for Compliance with the transfer student-athlete’s name and the previous or current school’s name. The Assistant Athletic Director for Compliance will send a transfer tracer form to the school requesting information. In the case of a transfer from a four-year school, permission must be granted from the other school before a coach can make contact with the student-athlete or discuss the possibility of transferring. The Assistant Athletic Director for Compliance will notify the coach once permission has been granted.

2. An official transcript must be sent to the Registrar’s Office in order to have a transfer evaluation completed. This will determine the academic eligibility of the transfer.

3. The Assistant Athletic Director for Compliance certifies that the student-athlete has registered with the NCAA Eligibility Center and confirms the student-athlete is placed on Bellarmine’s IRL. Coaches have the ability to add and delete prospective student-athletes from their sport-specific IRL. They are also tasked with monitoring the progress of academic and amateur certification.

4. In the case of a student-athlete transferring from a Division I institution, the Assistant Athletic Director for Compliance must submit a Division I Transfer Form to the GLVC and receive verification that the transfer has been certified.

5. The Assistant Athletic Director for Compliance completes the NCAA Eligibility Form, which indicates each student-athlete’s eligibility status. The GLVC Eligibility Form is reviewed and signed by the Head Coach, the Faculty Athletic Representative, the Athletic Director, and the Assistant Athletic Director for Compliance, and is submitted to the GLVC prior to the team’s first date of competition. For lacrosse, in addition to the NCAA Eligibility Form, the NCAA Squad List is produced and both are sent to the Southern Conference prior to the first competition.

Certifying Continuing Eligibility

Squad List Management. In May, all head coaches will be provided a current squad list to the Assistant Athletic Director for Compliance. Head coaches will indicate whether each individual on the squad list will return to the team and return the roster to the Assistant Athletic Director for Compliance. The squad list will be maintained by the Assistant Athletic Director for Compliance in the CA and ACS databases. Any student-athlete participating on a team must have met all

institutional, conference and NCAA requirements and must be on the squad list. Any changes to the squad list (additions or deletions, change of status, etc.) must be communicated to the Assistant Athletic Director for Compliance via email. Required Student-Athlete Forms. There will be mandatory student-athlete orientation meetings at the beginning of the fall term. All necessary NCAA and GLVC/ECAC/SoCon paperwork will be completed prior to or during this meeting. All student-athletes must attend this meeting in order to be certified for the academic year. It is the head coach’s responsibility to make sure that all of his/her student-athletes attend the meeting. All Head Coaches will be notified of the time and place of the meeting. The following information will be distributed prior to or during the meeting:

The NCAA Student-Athlete Statement, which must be signed by the student-athlete and kept on file in the Director of Athletics’ Office.

The NCAA Student-Athlete Affirmation of Eligibility, which must be signed by the student-athlete and kept on file in the Director of Athletics’ Office.

The NCAA Drug Testing Consent Form, which must be signed by the student-athlete and kept on file in the Director of Athletics’ Office, and the NCAA list of banned drugs and supplements.

The Bellarmine Student-Athlete Information Sheet.

The Bellarmine Historical Questionnaire for incoming freshmen and transfers.

The NCAA Eligibility Form for International Student-Athletes, signed by international student-athletes competing for the first time, and kept on file in the Director of Athletics’ Office.

The GLVC Sportsmanship Form and Health Insurance Portability and Accountability Act Form (HIPAA).

The Bellarmine Financial Aid Declaration.

Progress Toward Degree. The Faculty Athletic Representative and Assistant Athletic Director for Compliance will perform a preliminary fall eligibility evaluation for all returning student-athletes at the completion of the spring term. Transcripts of all student-athletes will be reviewed for good academic standing, progress toward degree, six-hour rule, and GPA requirements. At Bellarmine, “good academic standing” means the student has attained a cumulative GPA of 2.0 or better, has a semester GPA of 1.6 or better, and has not earned two or more F’s in the previous semester; this will be certified at the end of each semester and after summer term. Student-athletes’ transcripts will be compared to the course catalog to ensure that the 40/60/80 rule is met by all lacrosse student-athletes. The Faculty Athletic Representative will verify the certification, paying specific attention to lacrosse student-athletes, student-athletes who have changed their major, and student-athletes who are within six credits of eligibility/ineligibility. A list of student-athletes who do not appear to be eligible will be sent to the head coach, the sport administrator and the academic advisor. The student is expected to attempt to regain academic eligibility by taking summer classes. The Eligibility Checklist will be completed and signed by the Faculty Athletic Representative, the Director of Athletics, the Assistant Athletic Director for Compliance and the head coach each semester. Declaration of Major. All student-athletes must declare a major by the beginning of their fifth full-time term of collegiate enrollment. This includes terms enrolled at other institutions. When performing the fall eligibility certifications, the Faculty Athletic Representative and the Assistant Athletic Director for Compliance will verify that all student-athletes entering their fifth semester have declared a major. Verification of Full-Time Enrollment. All student-athletes must be enrolled in at least 12 credit hours in order to practice or compete, except for those student-athletes granted an exception during their final semester of enrollment under NCAA Bylaw 14.1.7.1.7.3(DII) or NCAA Bylaw 14.2.2.1.3 (DI). The athletic department receives a daily report indicating student-athletes’ withdrawal from classes and a second report if student-athletes drop below 12 credits. Student-athletes are not permitted to drop a class until they speak with and receive permission from the Academic Advisor, the Faculty Athletic Representative or the Assistant Athletic Director for Compliance. Upon certification of all of the items above (student-athlete forms, progress toward degree, declaration of major and full-time enrollment), the Assistant Athletic Director for Compliance completes the Eligibility Checklist via NCAA

Compliance Assistant, which indicates each student-athlete’s eligibility status. The Eligibility Checklist is reviewed and signed by the Head Coach, the Faculty Athletic Representative, the Athletic Director and the Assistant Athletic Director for Compliance, and is submitted to the GLVC prior to the team’s first date of competition. For lacrosse, the Squad List is also prepared, then reviewed and signed by the Head Coach, the Faculty Athletic Representative, the Athletic Director, the Director of Financial Aid and the Assistant Athletic Director for Compliance.

Outside Competition Prior to participating in any outside competition, team or event, student-athletes must complete an Outside Competition Approval Form. This form must be submitted at least 48 hours prior to the start of the event to ensure that the student-athlete’s participation is within NCAA and Bellarmine rules.

Managers Coaches must complete the Manager Form to confirm who will be serving the team in that capacity. This will allow the athletic department staff to track the academic standing, progress towards degree, payment (etc). of each manager.

FINANCIAL AID

Athletics Financial Aid Award Requests All athletic financial aid awards, cancellations, reductions, renewals, and non-renewals must be sent to the Assistant Athletic Director for Compliance. All head coaches desiring to request an athletics financial aid award must follow the following procedures.

Procedure for Awarding Financial Aid to Incoming Freshmen

1. Head coach emails the Assistant Athletic Director for Compliance the names and amount of athletic aid to be awarded to each incoming freshman.

2. The Assistant Athletic Director for Compliance ensures that the PSA is registered with the Eligibility Center, is placed on Bellarmine’s Institutional Request List (IRL), has been admitted to Bellarmine and that the PSA's high school transcripts and test scores are on file.

3. The Assistant Athletic Director for Compliance creates and obtains signatures of the Director of Athletics on the National Letter of Intent, and the Director of Athletics and the Director of Financial Aid (or designee) on the Bellarmine Grant-in-Aid Letter. Coaches have the option of mailing the forms themselves or the forms can be emailed by compliance. The PSA receives two copies of each form, and the compliance office keeps one copy on file. The Office of Financial Aid retains a copy of the Grant-in-Aid Letter.

4. After receiving the signed NLI and Grant- in-Aid Letter from the student-athlete, the Assistant Athletic Director for Compliance sends the grant-in-aid letter and NLI to the GLVC, who validates them. The Assistant Athletic Director for Compliance then notifies the sports information director and coach that the PSA may be publicized.

5. All financial aid is disbursed by the Director of Financial Aid one week after the first day of classes. If at that time any student-athletes have not been certified by the NCAA Eligibility Center, the Assistant Athletic Director for Compliance notifies the Director of Financial Aid, and the Director of Financial Aid holds the athletics aid for those student-athletes until they have been certified and are eligible to receive it.

Procedure for Renewing, Non-Renewing, or Adjusting Aid for Returning Student-Athletes

Any student-athlete receiving athletics financial aid during the academic year with eligibility remaining must be notified prior to July 1 of the next academic year whether his/her athletics aid will be renewed, not renewed, or adjusted. This

also includes those individuals who may no longer be a member of the team. A letter of cancellation does not need to be sent to any student-athletes that have graduated.

1. In May, the Assistant Athletic Director for Compliance will send each coach an Athletic Aid Renewal Form, which is a squad list that indicates the amount of athletic aid each returning student-athlete received that year and the amount that the incoming freshmen will receive. The head coach will indicate on that form whether each student-athlete’s aid will be renewed, non-renewed, or adjusted. The head coach must give a reason for any change or cancellation. The completed Athletic Aid Renewal Form will be due by June 15.

2. The senior staff will review and approve all Athletic Aid Renewal Forms. 3. All returning student-athletes will be notified of their athletic aid status (renewal, nonrenewal or adjustment) in

writing (letter or email) not later than July 1. The Assistant Athletic Director for Compliance will create the communication, and the Director of Financial Aid will sign all nonrenewal and reduction letters prior to the letter being sent to the student-athlete.

A student-athlete has the right to appeal if his or her athletic aid has been cancelled or reduced.

5. To start the process, the student-athlete must write a letter of appeal within 14 calendar days of the date of notification to the Director of Financial Aid requesting a hearing regarding the change in athletic aid.

6. The Director of Financial Aid sets up an appeal hearing within 30 days and notifies the student-athlete and respective coach of the date and time of the hearing. The ad hoc committee hearing the appeal will be chaired by the Faculty Athletic Representative and comprised of two other members of the Bellarmine University Athletics Compliance Committee. The Assistant Athletic Director for Compliance will not be part of the ad hoc committee.

7. The student-athlete and the respective coach are required to attend the hearing to present his or her case to the committee regarding the reduction or cancellation of aid. If any party is unavailable to meet in-person, it is permissible to present via teleconference. The student-athlete and coach may bring additional documentation to support his or her case. The student-athlete and coach will present their cases separately (coach will not be in the room when the student-athlete presents; the student-athlete will not be in the room when the coach presents). The Assistant Athletic Director for Compliance will attend both presentations to answer any questions that the ad hoc committee may have regarding legislation.

8. Once all information has been reviewed, the ad hoc committee will make a decision and inform the student-athlete and coach via email. The decision is based on a majority vote by the ad hoc committee members. The student-athlete must be notified of the decision within 30 calendar days of receiving the student-athlete’s written request for the hearing. The decision of the committee is not reviewable by any other individual or group and is a final decision with no opportunity for an additional appeal.

Non-Athletic Institutional Aid In addition to athletic scholarships, Bellarmine awards other institutional aid. Most students receive a Bellarmine Grant, which counts against individual and team financial aid limits. Most students also receive either a Treece Scholarship or Horrigan Grant. Treece and Horrigan are academic awards and may be exempted from counting toward team limits if student-athletes meet the criteria outlined in Division II Bylaw 15.02.4.3 or Division I Bylaw 15.5.3.2.2.1.1. Details of these and other institutional awards are given in the chart below. The awards listed in the chart can be exempted from team limits.

Outside Scholarships When student-athletes who receive athletic aid also receive funds from outside sources, the Office of Financial Aid reviews each outside scholarship to make sure that the additional funds are added to the students’ packages and adjustments are made to their aid, if necessary. The Office of Financial Aid runs a report from Regent every two weeks to see the list of student-athletes receiving outside funds. A form about the NCAA rules and regulations is sent to each agency for every student receiving outside funds. The outside agency will have to answer a few questions concerning the basis on which the funds were awarded, and return the form back to the Office of Financial Aid. The Office of Financial Aid notifies the Assistant Athletic Director for Compliance meets the criteria set forth in (DII) 15.2.2.3. and (DI) 15.2.6.3. The Office of Financial Aid maintains a spreadsheet with the list of all student-athletes receiving outside scholarships, the name of scholarships, the address of the outside agency and the date the form was sent out. After the form is returned from the agency, the spreadsheet is updated. The forms are kept in the NCAA folder for documentation. If an agency fails to respond after two letters have been sent, the Assistant Athletic Director for Compliance will attempt to contact the agency directly. If Bellarmine is unable to get a response from the agency, it will be assumed that the outside aid is impermissible.

Other Athletics Aid Rules Athletic aid can only be guaranteed for one year. However, the award can be renewed based upon the

recommendation of the head coach and approval of the Director of Athletics.

Initial athletics award offers to student-athletes may be mailed, express mailed, emailed, faxed or picked up on campus. They cannot be hand delivered off-campus.

During the period of an athletics scholarship, the award cannot be increased, reduced, or cancelled on the basis of athletics ability, performance, or contribution to the team’s success, because of injury or illness that prevents the student-athlete from participating, or for any other athletics reason.

Athletics scholarships may be immediately reduced or cancelled during the term of an award if the student-athlete:

o Becomes ineligible for intercollegiate competition, o Gives false or misleading information on his/her application, NLI, or financial aid agreement, o Engages in serious misconduct that brings disciplinary action from the institution, or o Voluntarily withdraws from the team.

If the head coach decides to cancel a student-athlete’s athletic scholarship during the term of the award due to the student-athlete voluntarily withdrawing from the team, the head coach, student-athlete, and Assistant Athletic Director for Compliance must complete and sign the Voluntary Withdrawal of Athletic Financial Aid Form. An email from the student-athlete stating his/her decision to quit the team and knowledge of his/her forfeiture of athletic aid will also be accepted. The student-athlete’s athletics aid will not be cancelled without proper, written documentation from the student-athlete stating that he/she has decided to voluntarily withdraw from the team.

For all student-athletes who receive institutional aid that is granted without regard in any degree to athletics ability, a Noncounter Certification Form must be signed by the Faculty Athletic Representative and the Director of Financial Aid and kept on file in the athletic department and the Office of Financial Aid (for Division I).

The Director of Financial Aid will review each squad list and sign off on the squad list to verify review and confirmation.

AWARDS AND BENEFITS

Complimentary Admissions

Complimentary admissions to Bellarmine Athletics Events shall be monitored by the Assistant Athletic Director for Compliance and the Director of Event Management for Athletics.

Student-Athletes. Enrolled student-athletes in sports which charge admissions are eligible for a maximum of four complimentary admissions to a home athletics event through a pass list only. The coaching staff is responsible for submitting the Player Pass List to the Director for Athletics Event Managment at least 24 hours prior to the athletics event. Individuals receiving a complimentary admission to an athletic event are required to sign the pass list in order to receive admission to the event. The Player Pass List will be submitted to the Assistant Athletic Director for Compliance for review after the event. Prospective Student-Athletes. Prospective student-athletes on an official or unofficial visit may receive a maximum of three complimentary admissions to a home athletics event through a pass list only. Complimentary admissions are only permissible for the prospective student-athlete and those persons accompanying the prospect on the official/unofficial visit on a single game basis. The head coach or designee is responsible for submitting the Recruit Pass List to the Director for Athletics Event Management at least 24 hours prior to the athletics event. The prospective student-athlete and those accompanying the prospect are required to sign the pass list to receive admission to the event. The pass list will be submitted to the Assistant Athletic Director for Compliance for review after the event.

High School, Preparatory School and Two-Year College Coaches. High school, prep school and two-year college coaches may receive a maximum of two complimentary admissions to a home athletics event through a pass list only. Additional tickets may not be reserved for the purpose of purchase by the high school, prep school or two-year college coach. The head coach or designee is responsible for informing the Director for Athletics Event Management of the complimentary admissions to be included on the pass list. The coach is required to sign the pass list to receive admission to the event. The pass list will be submitted to the Assistant Athletic Director for Compliance for review after the event.

Occasional Meals A student-athlete or the entire team in a sport may receive an occasional meal in the locale of Bellarmine on infrequent and special occasions from an institutional staff member, and the staff member may provide transportation to student-athletes to attend such meals. A student-athlete or an entire team in a sport may also receive an occasional family home meal from a representative of athletics interests provided the meal is in the individual’s home (not a restaurant), on campus, or at a facility that is regularly used for home competition and may be catered. The representative of athletics interests may provide reasonable local transportation to student-athletes to attend such meals. The host of the meal must complete and submit an Occasional Meal Approval Form to the Assistant Athletic Director for Compliance prior to the meal, and the meal must be approved by the sport administrator and the Assistant Athletic Director for Compliance.

Awards Student-athletes may receive annual awards for participation, championships, and special achievements. Prior to providing any award to student-athletes, coaches must submit an Award Approval Form to the compliance office. The Award Approval Form must be signed by the sport administrator and the Assistant Athletic Director for Compliance prior to distribution of the awards. Please refer to Figure 16-3 in the NCAA Manual for permissible award types and maximum values.

MEDICAL HARDSHIP WAIVERS A head coach may request a Medical Hardship Waiver (medical “redshirt”) for a student-athlete to be granted an additional year of competition for an incapacity resulting from an injury or illness that occurred under all of the following conditions:

The injury or illness occurred in one of the four seasons of competition at a collegiate institution;

The injury or illness resulted in incapacity to compete for the remainder of that playing season; and

The injury or illness occurred when the student-athlete had not participated in more than two contests or 20% (whichever number is greater) of the scheduled or completed contests (excluding scrimmages and exhibitions) in the student-athlete’s sport. In lacrosse, the injury or illness occurred when the student-athlete had not participated in more than three contests or 30% (whichever number is greater) of the scheduled or completed contests (excluding scrimmages and exhibitions) in the student-athlete’s sport. Also, for Division I, the injury took place in the first half of the squad’s season.

Head coaches must make a request for a Medical Hardship Waiver to the Assistant Athletic Director for Compliance. The head coach is responsible for obtaining the team’s schedule for the appropriate season and the team statistics for that season which show the student-athlete’s participation. The Assistant Athletic Director for Compliance will request the following documentation from the Athletic Trainer:

Date of onset of the injury or illness and date that the student-athlete could return to practice and competition. This should include the dates that the physician saw/treated the student-athlete, as well as the date of prognosis of unable to compete for the remainder of the season was made.

A statement to be completed after the traditional playing segment, signed by the attending physician, indicating that the injury or illness resulted in the student athlete’s incapacity to compete for the remainder of the

traditional segment. Also, this information should clarify whether the student-athlete underwent any rehabilitation for the injury or illness.

The Assistant Athletic Director for Compliance will complete the Medical Hardship Waiver Request and submit the request and supporting documentation to the GLVC or Southern Conference, which processes the request. The conference office will notify the Assistant Athletic Director for Compliance whether or not the Medical Hardship Waiver is granted.

PLAYING AND PRACTICE SEASONS All head coaches must complete a Declaration of Playing Season Form prior to the beginning of their season and submit it to the Assistant Athletic Director for Compliance, along with the team’s schedule. It is the head coach’s responsibility to notify the Assistant Athletic Director for Compliance of any changes to the schedule. This is required so all necessary eligibility forms can be completed in time for the first dates of practice and competition, and to verify that the playing season is in compliance with NCAA rules. Note: The first competition date is the first date on which student-athletes represent Bellarmine in ANY contest against outside competition, regardless of how the competition is classified (e.g., scrimmage, exhibition, or joint practice session with another institution’s team). Countable Athletically-Related Activity Logs are due to the Assistant Athletic Director for Compliance one week after the end of each month. The CARA Logs must include an accurate account of all athletics activities for the given time period. All countable athletically related activities must be logged using the ACS software. The maximum hours of athletically related activity per week is 20 hours with one day off per week in-season, and 8 hours with two days off per week out-of-season. Practice time must be limited to 4 hours or less per day in-season, and 2 hours or less per day out-of-season. No practice is permitted after competition. Countable athletically related activities include any meeting, activity, or instruction involving sports-related information and having an athletics purpose, held for student-athlete(s) at the direction of, or supervised by, any member of the coaching staff. Outside of the playing season during the academic year, student-athletes are permitted participation in weight-training, conditioning and individual skill instruction (maximum 2 hours per week), for no more than eight hours per week. Outside of the playing season all countable athletically related activities are prohibited one week prior to the start of final exams. Outside of the playing season during an institutional vacation period (e.g., summer vacation, winter break, etc.), student-athletes are not permitted participation in any countable athletically-related activities.

CAMPS AND CLINICS

Camp Definitions. An institutional sport camp or clinic shall be any camp or clinic owned or operated by a member institution or by an employee of a member institution’s athletics staff, either on or off campus. Ownership constitutes at least 51% of the camp or clinic. An institutional sport camp must be open to the public, with the only constraints being on gender, number, and age. Coaches are precluded from participating in privately owned camps not open to the public, or that give free or reduced admission to athletics award winners.

Employment. For sports other than lacrosse, Bellarmine may employ prospects who are seniors in high school and have completed all competition for the academic year at institutional sports camps or clinics. A prospect who has signed an NLI may only be employed at an institutional sports camp or clinic by the institution with which he/she has signed. Division I lacrosse prospects may not be employed at Bellarmine camps or clinics. Enrolled and prospective student-athletes’ camp employment must meet the following criteria:

1. Compensation provided to the enrolled or prospective student-athlete is only for work actually performed and at a rate commensurate with the going rate in that locality for similar services;

2. The student-athlete or prospect must perform duties that are of a general supervisory nature in addition to any coaching or officiating assignments; and

3. A student-athlete or prospect who only lectures or demonstrates may not receive compensation for his or her appearance.

Bellarmine may also employ high school, preparatory and two-year college coaches, provided their compensation is commensurate with the going rate for camp counselors with like teaching abilities and camp experience and the coach may not be paid based on his/her reputation or on the number of campers the coach sends to the camp. Coaches must have all camp brochures approved by the Assistant Athletic Director for Compliance prior to distribution, and submit a Camp/Clinic Approval Form to the Assistant Athletic Director for Compliance at least one week prior to the start of each camp or clinic. All camp employees will need to undergo Bellarmine’s sexual harassment prevention training.

PROCEDURES FOR NCAA QUESTIONS/INTERPRETATIONS The interpretation process is essential for compliance with NCAA legislation. In many cases, the NCAA manual does not provide a definitive answer to questions and an interpretation is required. It is the responsibility of all coaches and staff to seek an accurate interpretation before acting. The procedures for interpretation of NCAA rules are designed to provide accurate and timely answers to questions as they arise for all those involved with Bellarmine athletics. All coaches and staff members must direct rule and interpretation questions to the Assistant Athletic Director for Compliance via email, in person or by phone. If the Assistant Athletic Director for Compliance or Faculty Athletics Representative cannot provide a certain and accurate interpretation, the question will be forwarded to the GLVC and/or NCAA Membership Services staff. Once an official interpretation has been received, the Assistant Athletic Director for compliance will provide the interpretation to the requestor via email and the sport supervisor, retaining a copy in a separate email file. If relevant, the interpretation will be disseminated to all coaches and staff. Coaches are prohibited from calling the NCAA. If a question regarding NCAA regulations arises, the Assistant Athletic Director for Compliance or Faculty Athletics Representative need to be contacted. They are the only two individuals permitted to contact the NCAA for interpretations.

POLICY FOR INVESTIGATING AND REPORTING NCAA VIOLATIONS In accordance with NCAA regulations, all suspected NCAA violations shall be investigated, and any confirmed violations must be self-reported to the NCAA. Any individual (e.g., athletics department staff member, student-athlete, Bellarmine employee, community member) may report an alleged, rumored, or suspected violation. The individual may report the alleged, rumored, or suspected violation verbally or in writing. If an alleged or rumored violation is conveyed to any athletics department staff member, the staff member is required by the NCAA regulations to notify the Faculty Athletics Representative, the Assistant Athletic Director for Compliance, or the Director of Athletics of the violation immediately. Assistant coaches must be aware that it is not sufficient to report a violation to the head coach; the report must be made to the Faculty Athletic Representative, the Assistant Athletic Director for Compliance or the Director of Athletics. Once informed of an alleged violation, the Assistant Athletic Director for Compliance will conduct a preliminary investigation to ascertain the basic facts surrounding the incident. The parties involved in the incident will be contacted directly and asked about the matter. The sport supervisor for the sport or department involved will be notified at this

time. If the potential violation could implicate a staff member, the Faculty Athletic Representative and/or Bellarmine’s legal representation will be included in the process. The Assistant Athletic Director for Compliance is responsible for determining whether the evidence establishes the occurrence of a violation. To make this determination, he/she may request the assistance of the Director of Athletics and/or the FAR. If, after an evaluation of the facts and relevant NCAA legislation, it is determined that a violation has occurred, the Assistant Athletic Director for Compliance will initiate a comprehensive investigation. During this discovery period, all parties involved will be interviewed and written notes of the interviews and the investigation will be kept. The investigation file will be housed in the Compliance Office. The Assistant Athletic Director for Compliance will keep the Director of Athletics informed of all events surrounding the investigation. At the conclusion of the investigation, the Assistant Athletic Director for Compliance will meet with the Director of Athletics and sport supervisor of the involved sport to review the matter and determine the appropriate corrective actions. Once the corrective actions have been determined, the Assistant Athletic Director for Compliance will prepare a written report which will be signed by the Director of Athletics. The self-report will include, at a minimum, the following information:

The date and relevant timeline of the violation.

The identities of the involved individuals (prospects, student-athletes, coaches, staff members, etc.) who played a role in the violation.

The means by which the institution became aware of the violation.

An explanation of the circumstances surrounding the violation, including any mitigating factors.

The cause(s) of the violation.

A list of corrective and/or punitive actions taken by the institution in response to the violation. If the secondary violation falls within the list of those secondary violations identified with specifically-prescribed sanctions, the self-report will be submitted to the GLVC/SoCon via RSRO. If the violation is not included in that listing, the self-report will be forwarded to the proper department(s) at the NCAA office. Copies of the self-report will be sent to the Faculty Athletics Representative, the sport administrator, the head coach, and other involved staff members and/or student-athletes. The report will also be shared with the Compliance Committee and the Athletic Committee, and will be filed in the compliance office. The Assistant Athletic Director for Compliance is responsible for ensuring that all corrective actions are clearly communicated to the appropriate individuals and that they are carried out. Copies of all subsequent correspondence with the NCAA and/or the GLVC/SoCon are permanently filed in the Compliance Office. If, based on the evaluation of facts gathered during the internal investigation, the potential for a major violation exists, the Director of Athletics, Assistant Athletic Director for Compliance, and other senior staff members selected by the Director of Athletics, will hold an immediate meeting to initiate an appropriate investigation. This meeting may include the University's General Counsel, FAR and/or a representative from the President's office. NCAA and/or GLVC/Southern Conference investigatory assistance will be solicited as circumstances warrant. Reports of major violations are filed in the compliance office and in the employee’s file in the office of human resources. Alleged Violations Involving Other NCAA Institutions. If an individual has knowledge of an alleged violation that involves another NCAA member institution, he/she may report the alleged violation to the Assistant Athletic Director for Compliance. The Assistant Athletic Director for Compliance will discuss how best to address the situation with the individual who has lodged the accusation and other departmental staff members, as necessary. After evaluating the allegation, the Assistant Athletic Director for Compliance or Director of Athletics may then contact the Director of Compliance at the accused member institution to request that the alleged violation be investigated. In some cases, the Assistant Athletic Director for Compliance or the Director of Athletics may choose to communicate directly with the GLVC office or NCAA enforcement staff and request that they contact the accused institution or that institution's conference.

As a prospective student-athlete, we want you to enjoy your time here and experience the best of what Bellarmine has to offer. During your 48-hour stay, you and your student host will be responsible for following the NCAA guidelines listed below.

HOST: Thank you for agreeing to host a prospective student-athlete during his/her official visit. As you know, this responsibility is important to the success of our teams. During this visit, you have the opportunity to present the prospect with the experience of a typical day in the life of a student-athlete. You are representing your team and all of Bellarmine University. Your conduct should reflect appropriate behavior and ethical standards. It is your responsibility to review and follow the guidelines listed below as mandated by the NCAA.

About Sickle Cell Trait:

Sickle cell trait is an inherited condition of the oxygen-carrying protein, hemoglobin, and the red blood cells.

Sickle cell trait is a common medical condition most predominate in African Americans, but people of all races and

backgrounds may test positive.

Sickle cell trait is generally benign, and most of the 3 million Americans with sickle cell trait live healthy normal lives.

However, during maximal exercise the oxygen levels in muscles can decrease sufficiently to cause some of the red

blood cells to change from the normal disk shape to a crescent or sickle shape. These red cells can block blood vessels

in muscles, kidneys and other organs resulting in severe damage to the involved tissues and in even death.

Sickle Cell Trait Testing The NCAA mandates that all NCAA student-athletes and tryout candidates have knowledge of their sickle cell trait status

before the student-athlete participates in any intercollegiate athletic event, including strength and conditioning sessions,

practices, competitions, tryouts, etc.

If you have already been tested for sickle cell trait, please provide a copy of the written results to the Sports Medicine Staff.

If you have not been previously tested and do not agree to test, please review the waiver below.

Bellarmine University offers sickle cell trait testing for all student-athletes and tryout candidates. The Sports Medicine Staff

will assist you with schedule the test if you choose to be tested.

OUTSIDE COMPETITION PRIOR APPROVAL FORM

A student-athlete must obtain prior written approval from the Assistant Athletic Director for Compliance prior to practicing or competing in an event while not representing Bellarmine University during or between terms. In order to protect the eligibility of all student-athletes, prior approval must be completed for any competition not scheduled through Bellarmine or while not representing BU at any time (i.e. national team participation, summer competition.) This form must be received by compliance at least 48 hours prior to the start of the practice/competition.

VOLUNTARY TERMINATION OF FINANCIAL AID Department of Athletics

STUDENT-ATHLETE: This form, if signed by you, verifies that you relinquish your right to athletically-related financial aid and

understand the process for requesting a hearing.

Bylaw 15.3.4.1 Reduction or Cancellation Permitted. Institutional financial aid based in any degree on athletics ability may be reduced or canceled during the period of the award, if the recipient: (a) Renders himself or herself ineligible for intercollegiate competition; (b) Fraudulently misrepresents any information on an application, letter of intent or financial aid agreement; (c) Engages in serious misconduct warranting substantial disciplinary penalty (see Bylaw 15.3.4.1.2); or (d) Voluntarily withdraws from a sport at any time for personal reasons; however, the recipient's financial aid may not be awarded to another student-athlete in the term in which the aid was reduced or canceled. Further, if the financial aid is canceled before a regular academic term (e.g., preseason practice period), the aid may not be provided to another student-athlete during the ensuing academic term.
