BETHEL SCHOOL DISTRICT RESOLUTION 32 (12-13) A RESOLUTION OF THE BOARD OF DIRECTORS, BETHEL SCHOOL DISTRICT NO. 403, DECLARING CERTAIN REAL PROPERTY LOCATED AT 26611 MERIDIAN STREET EAST, GRAHAM, WASHINGTON SURPLUS AND FOR SALE IN ACCORDANCE WITH RCW 28A.335.120. WHEREAS, Bethel School District (the “District’) is the owner of certain real property commonly known as Kapowsin Elementary School which is compromised of two parcels of land (approximately 29.15 acres) and known as Pierce County Parcel Nos. 0418273005 and 0418273014, as illustratively shown on the Aerial Map attached hereto as Exhibit A ; and WHEREAS, in the northeast corner of Parcel No. 0418273014, there exists a house and outbuildings which sits on approximately an acre of land (the “Kapowsin House”); and WHEREAS, the Kapowsin House and outbuildings have been vacant for some time; and WHEREAS, the District Administration obtained an MAI Appraisal of the House Land; and WHEREAS, in accordance with RCW 28A.335.120, the Board of Directors of the District (the “Board”) directed the Administration to publish Notice of a Public Hearing of the Board’s intent to declare the Kapowsin House surplus and for sale; and WHEREAS, the Public Hearing Notice, a copy of which is attached hereto as Exhibit B , was published for two consecutive weeks in the Tacoma News Tribune, a legal newspaper with a general circulation within the District’s boundaries; and WHEREAS, the Board held a Public Hearing on June 11, 2013 at Spanaway Middle School to take testimony regarding the Board’s intent to declare the Kapowsin House surplus and for sale; and WHEREAS, the District Administration recommended surplusing and selling the Kapowsin House as it is no longer needed for school purposes; and NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Bethel School District No. 403 that: (1) Notice was properly given and a Public Hearing was properly held to consider the Board’s intent to declare the Kapowsin House Surplus and For Sale in accordance with RCW 28A.335.120; 1

(2) The Kapowsin House is not needed for school purposes and is hereby declared Surplus to the needs of the District; and (3) The Kapowsin House is hereby declared For Sale. The foregoing Resolution was adopted in an open, public session at a Regular Meeting of the Board of Directors held this 11th day of June, 2013, the following members present and voting: Board of Directors:

NOTICE OF INTENTION TO SURPLUS CERTAIN REAL PROPERTY AND

NOTICE OF HEARING BY BETHEL SCHOOL DISTRICT TO SELL CERTAIN REAL PROPERTY

NOTICE IS HEREBY GIVEN THAT BETHEL SCHOOL DISTRICT NO. 403, pursuant to RCW 28A.335.120, will hold a public hearing, at its regularly scheduled Board Meeting on June 11, 2013 at 7:00 p.m. in the Cafeteria at Spanaway Middle School, 15701 “B” Street East, Tacoma, Washington 98445: (1) to declare, as surplus and no longer needed for school purposes, and (2) to sell a portion of that certain real property, including the house and other improvements thereon, located at 26611 Meridian Street East, Graham, Washington, and legally described as follows:
