Executive Summary

The Royal Government of Bhutan through the ADB funding is undertaking the construction of lateral road through the southern belt. This is aimed at curtailing the hassle of having to travel through India.

The Road Network Project II (RNP II) is the Nation's current major road improvement initiative

co-funded by the Asian Development Bank (ADB). The project is geographically dispersed

along the southern belt and has five National Highways and two Feeder Roads/Dzongkhag

Roads. The nature of works for the construction of these roads mainly comprises of the

following;

Upgrading, widening, formation cuttings, new construction and realignment of the five national

highways and new construction of two new feeder roads.

The overall Project length is 187.25 km and is divided into seven packages.

i) Manitar-Raidak National Highway (NH-01), Length=35.00km under Chukha Dzongkhag

ii) Raidak-Lhamoizingkha National Highway (NH-02) Length=18.00km, under Dagana

Dzongkhag

iii) Panbang-Nganglam National Highway Length of NH-03 = 25km under Pemagatshel

Dzongkhag

iv) Nganglam- Panbang National Highway (NH-04), Length of NH 04 = 30.60km

(Total Length for NH 03 and NH 04 =55.60km) under Pemagatshel Dzongkhag

v) Samdrupcholing-Samrang National Highway (NH-05), Length= 24.15km under

Samdrupjongkhar Dzongkhag

vi) Tsebar-Durungri-Mikuri Feeder Roads (FR-01 & FR-02) Length of FR – 01= 20.15km, FR –

02=33.90km, Total Length=54.50km under Pemagatshel Dzongkhag

One of the ultimate aims of these infrastructures is to give the people in rural areas better

opportunity, easy access to other infrastructures and services facilities and easy delivery of

farm produce to markets. The National Highways upon completion would result to an increase

in reliable freight transportation of goods to markets with reduction in travel time, thereby

reducing vehicle operating cost, maintenance costs and accidents. An indirect benefit is that

the local construction industry will be developed and strengthened through joint venture

companies.

Prior to commencement of construction activity, the affected families have been compensated as per Royal Government rates. Compensation and land replacement have been carried out by the project authorities and the respective Dzongkhags/Dungkhags. During the reporting period from September 2013 to September 2014, 24 households, 1 Communication and Information Centre (CIC) structure and 22 electric/telephone poles have been compensated. The CIC structure & 22 electric poles were compensated for Ngultrum 1.099,656.69, for FR-01 & FR-02 Seven (7) households were compensated for Nu. 343,395.70 and Seventeen (17) households have been compensated for Ngultrum 5,16,380.72 for construction of Raidak – Lhamoizhingkha NH-02. For those affected 177 households who have not yet received the land ownership certificates over 108.99 acres of land substitution, concerned authorities of the respective Dzongkhags/Dungkhags are processing the matter. Except for the issuance of land ownership certificate by the National Land Commission, which takes some time, the actual allotment of land in the field had long been done. Those affected households who loss fruit

trees or fodder trees also received the cash compensation along with the other households affected by the project. All the households whose land was affected and had to be replaced opted for land replacement instead of cash compensation. However the land Act 2007 clearly states that in case if the parcel of land that needs to be replaced is less than 10 decimals (4355.966 Sq. ft.), then the affected households have to accept cash compensation. This has been followed at the time of making the compensation to the affected households.

The compensations for all the five national highways and two feeder roads have been completed. However, five households who opted for Land for Land replacement at the mid section of Tsebar-Mikuri-Durungri, have been compensated with land replacement on dated February 27, 2014 except for Mrs. Sheru who later received cash compensationof Ngultrum 195,605.00 for loss of dry land. The compensation payment was made in presence of joint team from Dzongkhag Administration, Pemagatshel and the Road Network Project – II, DoR.

Restoration of the irrigation channelsat respective locations has been done before the onset of paddy plantations. The drinking water pipe line at Manitar (NH-01) from Ch 10+400 km to 15+600km was restored by the Nima construction Company Limited. Similarly, water tank and the water pipeline in NH-02 at Ch. 17.000 km were completed and drinking water to local community is made available.

363 households have been compensated along all the project roads so far. All compensations have been made both cash compensation as well as land for land replacement.

The Manitar – Raidak road stretch has affected 24 households out of which 3 households opted for land for land replacement, 5 households were given both cash & partial land substitution and the rest received cash compensation of Nu. 1,600,088.36 for the loss of cash crop land and structures.

For the Lhamoizingkha – Raidak road stretch 22 households have been affected out of which 7 households opted for cash compensation, 10 households opted for land for land replacement and the remaining 5 were given cash as well as partial land replacement. The total amount of Nu. 967,656.72 have been paid as cash compensation to the project affected people.

On the Pangbang –Nganglam (NH-03) road stretch, a total of 34 households are affected out of which 26 households opted for cash compensation amounting to Nu. 1,178,831.74 and the rest 8 households have been compensated through land replacement of 3.61 acres of land within the same Dungkhag.

On the Nganglam – Pangbang road (NH-04) 113 households have been affected out of which 9 households opted for cash compensation, 43 households opted for land for land replacement and the rest 61 households were given cash as well as partial land substitution. The total affected area of 71.13 acres of dry land cash compensation of Nu.11,730,337.47 for the loss of their properties.

On the Samdrupcholing – Samrang road stretch (National Highway – 05), there are 37 households who are affected by road construction work, out of which 10 households opted for cash compensation, 22 households opted for Land for land replacement and the remaining 5 households had been given cash as well as partial land compensation. Total land replacement of 11.64 acres were allotted in the same Dungkhag and total of Nu. 491,407.73 were given as cash compensation.

Tsebar – Mikuri – Durungri has 133 households affected by the road project out of which 106

households opted for cash compensation, 16 households opted for land for land replacement and the rest 11 HH were given cash as well as partial land substitution. Total Dry land 15.97 acres was compensated as land for land replacements and total cash of Nu. 20,672,296.19 were incurred for cash compensation.

The road construction work at Feeder Road – 02 (Yuri-Mikuri-Durungri), National Highway – 03 (Pangbang – Nganglam) and National Highway – 04 (Nganglam – Pangbang) road alignments fall on the exiting Bhutan Power Corporation Limited electricity poles at above citied locations. Out of 22 electricity poles 6 poles at FR-02 (Mikuri side) 4 poles from Nganglam side and 12 from Pangbang side. 22 numbers of electricity poles have been compensated by RNP-II to Bhutan Power Corporation to relocate the poles which amounts to Ngultrum 7,03,989.00.

One single storey semi permanent structure that houses Communication and Information Centre (CIC) for Nganglam Gewog was also compensated at Ngultrum 3,95,667.69 by RNP-II within the third reporting period.

During the reporting period from September 2013 to September 2014 the total amount of Ngultrum 1,959,433.11 has been paid as compensation to the project affected people by Road Network Project-II under Department of Roads for the loss of their land, fruit trees and structures. Additional Ngultrum fifty thousand (50,000) was provided by M/s Nima Abhyudaya Joint Venture as financial aid for laying of water supply pipelines for the villagers of Kezari and Kemalakha. Project share the first aid resources and simple medicine from first aid boxes to the needful people around project vicinity. Project also renders excavators for the excavation and leveling of residential houses foundations on request by the public. Project will be providing the financial, labours and machines as and when required/request by the public (project affected people)

The DOR, RNP-II Gedu Office has made all compensations in presence of officials and representatives from the respective Dzongkhags or Dungkhags. All the records of compensation have been maintained with the Gedu office. Land replacement has been coordinated with the land officials of the Dzongkhags and appropriate replacements have been made in consultation with the beneficiaries. All possible adjustments have been made on land allotment to the beneficiaries as per their request.

I. INTRODUCTION/ BACKGROUND

A. Brief project description

The Royal government of Bhutan through the ADB funding is undertaking the construction of lateral road through the southern belt. This is aimed at curtailing the hassle of having to travel through India.

The Road Network Project II (RNP II) is the Nation's current major road improvement initiative

co-funded by the Asian Development Bank (ADB) (approx US$ 38.760 million) and the

Government of Bhutan (RGOB) contributed US$ 15.56 million to implement RNP-II. The

project is geographically dispersed along the southern belt and has five (5) Nos. National

Highways and two Feeder Roads, (2) Nos. total length of 187.25km. The nature of works for the

construction of these roads mainly comprises of the following;

i) Upgrading, widening, formation cuttings and new construction of realigned sections of the

Manitar-Raidak National Highway (NH-01), Length=35.00km

ii) Upgrading and new construction of Raidak-Lhamoizingkha National Highway (NH-02)

Length=18.00km,

iii) Upgrading and new construction of Panbang-Nganglam National Highway (NH-03 &NH-04),

Length of NH-03 = 25km NH 04 = 30.60km, Total Length=55.60km

iv) Upgrading and new construction of Nganglam- Panbang National Highway (NH-04), Length of

NH 04 = 30.60km (Total Length for NH 03 and NH 04 =55.60km)

v) Upgrading and new construction of Samdrupcholing-Samrang National Highway (NH-05),

Length=24.15km

vi) New construction of Tsebar-Durungri-Mikuri Feeder Roads (FR-01 & FR-02) Length of FR-

01=20.15km, FR-02=33.90km, Total Length=53.75km

The overall Project length is 187.25km and is divided into seven (7) packages.Competitive

bidding for the construction of these roads is through International Competitive Bidding (ICB)

by either Local Contractors alone or by Local Contractors as joint venture with International

Contractors. One of the ultimate aims of these infrastructures is to give the people in rural areas

B. Progress on Titling of Lands for the affected Households

Prior to commencement of construction activity, the affected families have been compensated as per government rates. Discussions with the affected households indicated that the affected households have received the compensation. It was also learned that the land for land replacement has been given to the 177 affected households and that the ownership certificate (Lag Thram) for all the affected households is under process with their respective Dzongkhags. Except for the issuance of land ownership certificate by the National Land Commission, which takes some time, the actual allotment of land in the field had long been done. Allotment of land ownership certificate is done by the government in phase wise for different Dzongkhags, and since the project covers six Dzongkhags/Districts, all the 177 household compensated with land replacement appears that they will not get their ownership certificate at one go. However,

on consultation with one of the Land Record Officers (Pemagatshel District), he expects that all the 177 households would receive their ownership certificate within 2015.Those affected households who loss fruit trees or fodder trees also received the compensation along with the other households affected by the project.

C. LAND ACQUISITION/ INVOLUNTARY RESETTLEMENT

A Total amount of Nu. 37,464,691.38 have been paid as compensation to the project affected people. All compensation paid to the project affected peoples was coordinated with the Dzongkhag administration, in line with the rules and regulations of the Royal Government of Bhutan.

408 households have been compensated so far along the project roads. A summary of compensation made is tabulated below:

D. Reconfirmation of Performance Monitoring & Evaluation Targets and Indicators (Travel time)

Average travel time along project roads reduced by at least 50%

Currently the time taken to travel from Norbugang to Nganglam is around 4 hours but with the project road the time will be reduced to 2 hours. Similarly the time along the Lhamoizingkha-Raidak stretch will be reduced by 3.5 hours. The travel time on road stretch along Tsebar-Mikuri-Durung-Ri will be reduced by about 10 hours.

The travel time along the project roads is estimated to be reduced by 50%. This has been estimated for all the project roads. There will be no need for vehicles to ply through the Indian roads because of which travel time will be saved.

The travel-time between the different NHs as of today are as follows;

Once the project is completed it is estimated that the travel time is envisaged to be reduced at least by 60%.

Grievance Redressal Committee. Considering the social issues within the project vicinity, RNP – II has been constantly monitoring

the local communities on timely manner and till date, there has been no major adverse issues raised against the project by the local communities. In-order to monitor the social issues closely within project premises till the completion of project, RNP-II has established Grievance Redressal Committee consisting of following committee before the execution of road project.

a. Dasho Dzongda of concern Dzongkhag.

b. Land Record Officer of concern Dzongkhag.

c. Gup and Tshokpa of concern Dzongkhag/Gewogs.

d. Project Coordinator/Project Managers of DoR.

e. Sociologist/Environmental Specialist of CSC.

f. Environmental Focal Person from Contractor and CSC of each road construction site.

g. Affected People from the affected localities.

The local people express their gratitude to the project management unit for the social benefits that they derived from the construction of project roads. RNP – II conducts timely consultation with the public of the project vicinity to address the project related issues and disseminates awareness on various project activities. The RNP - II will be able to promote economic development and poverty reduction in the southern east-west corridor through road linkage to economic hubs and administrative centers.

Income Restoration Program/economic rehabilitation. The affected local people have been compensated as per the RGoB compensation rates by RNP-II for the loss of their properties. The compensation was made in-presences of representatives from the Government, DoR and the affected local people. All the compensations were made on time and project also employed the local people at the work site. As we drive through the newly constructed road, we can notice few shops established along the road site. Project affected people could build their new houses from the amount that they have received from compensation. With regard to their loss of land to project, only a small portion of land has been acquired by project and land for land replacement has been compensated. It is quit impossible to conduct the training, since our road project starches from west to east of the Country over 187.50 km and more over most of the road construction runs through scattered areas and jungles.

I. Manitar – Raidak Road compensation

The Manitar – Raidak road stretch has affected 24 households out of which 3 households had been given land for land replacement, 5 households cash as well as partial land replacement and the rest project affected households received cash compensation in total Nu.1,600,088.36 for the loss of their properties due to road construction. All compensations have been paid as per the prevailing land and other property rates as per the Land Act 2007 and revised in 2009. The compensation details as follows;

National Highway – 01 has contributed financial of Ngultrum 50,000, materials, and labour support to various public works to the project affected people. The details as follows;

II. Lhamoizingkha – Raidak Road compensation

For the Lhamoizingkha – Raidak road stretch 22 households have been affected out of which 7 households opted for cash compensation, 10 households opted for land for land replacement and the remaining 5 households were given cash as well as partial land replacement. The total amount of Nu. 967,656.72 have been paid as cash compensation to the project affected people. In addition to the 5 household compensated earlier, within the year from September 2013 to September 2014, Seventeen (17) households have been compensated which amounts to Ngultrum 5,16,380.72 for the loss of their structures, crops and land to the Road Network Project-II. Out of 17 households 10 received land replacement, 5 have been given cash compensation and 2 were given cash as well as partial land replacement. Compensation was made because of road re-alignment near Kalikhola River. The road re-alignment was done due to geotechnical issues in formation of the bridge foundation at right bank and subsequent shifting of Kalikhola bridge axis towards upstream. IV. Nganglam – Pangbang Road Compensation (Nganglam Side) On the Nganglam – Pangbang road (NH-04) 113 households have been affected out of which 9 households opted for cash compensation, 43 households opted for land for land replacement and the rest 61 households were given cash as well as partial land substitution. The total affected area of 71.13 acres of dry land cash compensation of Nu.11,730,337.47 for the loss of their properties. Semi permanent structure (Communication and Information Centre) for Nganglam Gewog was also compensated at Ngultrum 395,667.69. Additional compensation of Nu. 128,366.00 have been made to Bhutan Power Cooperation Limited for relocation of electric and telephone line poles. The DOR, RNP Gedu Office has made all compensations in the presence of officials and representatives from the respective Dzongkhags or Dungkhags. All the thump impressions of household heads receiving compensations have been sought and maintained with the Gedu office. Land replacement has been coordinated with the land officials of the Dzongkhags and appropriate replacements have been made in consultation with the beneficiaries. Adjustments have been made on land allotment to the beneficiaries as per their request where ever it was possible. The monitoring was carried out as per the ADB guidelines and compliances.
