It is important that the public understands the different tenure types which exist at the site and respect the relevant rules and regulations surrounding these. The map above titled “Black Diamond Land Tenure Boundaries” depicts the different types of land tenure at the site and below is a description of land access rules and regulations pertaining to each type. While the Mining Rehabilitation Fund enabled funding to be allocated to improve safety for community, the site is not regulated, administered or managed by the Department of Mines and Petroleum. The work undertaken at Black Diamond included battering the southern pit wall to a safer angle and erosion management on the western end and northern side. Questions regarding the work undertaken at Black Diamond through the Abandoned Mines Program can be directed to the Abandoned Mines Team: [email protected]. All other questions relating to the site should be directed to the relevant land administrator/manager as indicated on the map provided. Private Land It is illegal to trespass onto private land and doing so can result in prosecution. Protections against trespassing in Western Australia fall under common law. As depicted in the map above, a number of private land lots exist at Black Diamond to the western end and northern side of the pit and in the pit lake itself. People need to be respectful of private land and property while visiting Black Diamond pit lake. Shire Managed Land Under the Local Government Act 1995 and the Activities in Thoroughfares and Public Places and Trading Local Law 2012 you are not permitted to light fires, leave rubbish, install any structures or hold any activities without a council issued permit. Crown Land Under the Land Administration Act 1997 (WA) it is generally an offence for a person to do the following things on Crown land without legal authority or permission: to reside on the land to remove water, vegetation (alive or dead) or other things to leave things (including litter) behind to use firearms to construct roads or buildings. Additionally, a licence may be required if you are proposing to hold an event or conduct any other activity on Crown land.
