MINUTES BOARD OF ALDERMEN
CITY OF TOWN AND COUNTRY MAY 29, 2018
WORK SESSION
The work session meeting of the Board of Aldermen of the City of Town and Country was held at 6:30 PM on Tuesday, May 29, 2018. Present were: Aldermen Allen, Butler, Frautschi, Mange, Reuter and Wright. Aldermen Benigas and Meyland-Smith were absent. Mayor Dalton presided. City Attorney Steve Garrett was present to represent the City. 1. Discussion-Regular meeting agenda items Mayor Dalton announced his intent to form a Topping Road Trail Task Force led by Alderman Wright. He also stated he is seeking suggestions for residents to appoint to said task force. Alderman Mange noted the construction progress taking place at Town Square. No votes were taken. REGULAR MEETING The regular meeting of the Board of Aldermen of the City of Town and Country was held at 7:00 PM on Tuesday May 29, 2018 at the Municipal Center, 1011 Municipal Center Drive. PLEDGE OF ALLEGIANCE Ms. Forbringer, Ward 2 resident, led the Pledge of Allegiance. ROLL CALL The 7:01 PM roll call indicated Aldermen Allen, Butler, Frautschi, Mange, Reuter and Wright to be present. Aldermen Benigas and Meyland-Smith were absent. Mayor Dalton presided. City Attorney Steve Garrett was present to represent the City. MINUTES – 05/14/18 Alderman Mange moved for approval, seconded by Alderman Butler. Mayor Dalton called for any corrections or amendments. Alderman Bulter moved to amend the minutes (page 3, under Planning & Zoning: Ex-Officio Member) as follows: (deletions shown as strikethrough, additions shown as underline) Alderman Butler clarified for the record that according to our City Code that the Board of Aldermen are to select the Ex-Officio member and that this was further clarified by City Attorney Steve Garrett stating that it also is to be done that was according to the State Statute. Alderman Mange seconded the motion and a voice vote carried. Alderman Reuter moved to amend the minutes (page 3) as follows:

Alderman Reuter requested the Acting President service history of those on the Board. After brief discussion, Mayor Dalton directed the City Clerk to provide an appropriate list to Alderman Reuter as soon as it could be made available. Alderman Reuter noted that the request was received and for the record the Acting President has been held previously by Alderman Meyland-Smith four times prior to the meeting, Alderman Mange twice, Alderman Wright once and Alderman Benigas once. Alderman Frautschi seconded the motion and a voice vote carried. Hearing no further, the minutes of 05/14/18, as amended, were unanimously approved by voice vote. HEARING FROM CITIZENS Steve Krause, 13564 Royal Glen Drive, spoke in opposition of the Record Plat Amendment. He noted that a number of residents spoke at the Planning & Zoning Commission and shared details of damage on their properties created, in his opinion, by the Applicant through prior developments. Monica Gunther, 1924 Muir Woods Lane, spoke in opposition of the Record Plat Amendment and asked the Board to uphold the Planning & Zoning denial recommendation. She stated the current Plat protects the wooded character of the property that the City Code required five years ago. She suggested the developer negotiate with Mr. Morrell to obtain more property and protect more open space or build on the property as is. Jan Alisa Clayton, 2053 S. Mason Road, spoke in opposition against the Rehnquist development on Mason Road. She stated the proposal received no support at Planning & Zoning and cited damage Mr. Rehnquist has done to her property from another development. Laura Lowell, Planning & Public Works Admin, noted that letters from the following individuals have been received and will be attached to and made part of these minutes:

PUBLIC HEARING(S) APPOINTMENTS Mayor Dalton announced the establishment of a Topping Road Trail Task Force led by Alderman Wright. He also stated he is seeking suggestions for residents to appoint to said task force. COMMUNICATIONS AND REPORTS Alderman Frautschi Alderman Frautschi announced the Ward 2 Coffee was scheduled for June 9 at 8:00 AM, at the Starbucks in Mason Woods Village. She added that the Ward 2 Forum would be held at 9:30 AM on June 11, at the Longview Farm House. Finally, she announced that she, Alderman Butler and Alderman Reuter are part of the Parade Committee and the next meeting is 11:00 AM on June 25, at Longview Farm House, and the Parade will be held on October 6.

Alderman Butler Alderman Butler announced that the Conservation Commission would meet at 6:00 PM on June 4, at Longview Farm House. Alderman Mange Alderman Mange announced that the Public Art Commission would meet at 7:00 PM on June 4, at Longview Farm House. Alderman Allen Alderman Allen stated that she anticipates a meeting of the Ways & Means Commission sometime in the middle of June but is waiting on a specific date. She added that she has had a meeting with Finance Director Pam Reitz and City Administrator Bob Shelton and has spoken to a number of Commission members.
UNFINISHED BUSINESS
BILL NO. 18-38, AN ORDINANCE GRANTING PROMISE CHRISTIAN ACADEMY A TIME EXTENSION TO RECORD THE FINAL SITE DEVELOPMENT PLAN AND COMMENCE CONSTRUCTION OF A PRIVATE SCHOOL PURSUANT TO ORDINANCE NO. 4088 (sponsored by Alderman Benigas & Allen) (1st reading 05/14/18) Mayor Dalton called for a second reading, without objection. Without objection, Bill No. 18-38 was read for the second time and placed upon its final passage. Alderman Allen explained that the Applicant previously stated they have received 75% of the funds since the passing of the original ordinance. She also noted that she has received no opposition to the extension request. Alderman Frautschi moved for approval, seconded by Alderman Wright. The roll call vote was as follows: AYE, Aldermen Allen, Butler, Frautschi, Mange, Reuter and Wright; NAY, none; ABSTAIN, none; ABSENT, Aldermen Benigas and Meyland-Smith. The motion carried unanimously and Bill No. 18-38 became Ordinance No. 4197. BILL NO. 18-39, AN ORDINANCE AUTHORIZING A HOLD HARMLESS AND USE AGREEMENT WITH THE PRINICIPIA REGARDING USE OF THEIR PROPERTY AT 13201 CLAYTON ROAD FOR THE CITY’S 2018 FIRE & ICE EVENT (sponsored by the Board as a Whole) (1st reading 05/14/18) Mayor Dalton called for a second reading, without objection. Without objection, Bill No. 18-39 was read for the second time and placed upon its final passage. Alderman Allen moved for approval, seconded by Alderman Wright. Alderman Frautschi moved for approval, seconded by Alderman Allen. The motion carried unanimously and Bill No. 18-40 became Ordinance No. 4199. BILL NO. 18-41, AN ORDINANCE APPROVING AN AMENDED RECORD PLAT FOR MORRELL MANOR SUBDIVISION IN THE CITY OF TOWN AND COUNTRY, AND AUTHORIZING THE AMENDED PLAT TO BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY (sponsored by Alderman Mange) (1st reading 05/14/18) Rise Williamson, 1839 Woodmark Road, spoke in opposition of the Amended Record Plat and the clearing that has already taken place on Mr. Morrell’s property. She added that the zoning regulations are in place to protect residents and properties and they have not changed since Mr. Rehnquist purchased the property. John Burney, 1881 Nettlecreek Drive, spoke in opposition of the proposed Amended Record Plat as it proposes to remove a number of woodland areas. He explained that trees are a natural storm water mitigation tool. Cynthia Pavelka, 1519 Mason Hill Court, spoke in opposition of the Rehnquist development on Mason Road. She cited, in her opinion, a number of neighboring properties negatively impacted by other Rehnquist developments and possible contributing factors. She stated that if approved, additional conditions should be added to prevent further damage to neighbors. Her statement and pictures were submitted and have been attached hereto and made a part of these minutes. Dave Hough, 13201 Thornhill Drive, spoke in opposition of the Rehnquist development on Mason Road. He expressed concern about the City’s supervision of stormwater issues along the Mason Road corridor. His statement was submitted and has been attached hereto and made a part of these minutes. Hal Rutherford, 1518 Mason Valley Road, spoke in opposition of the Rehnquist development on Mason Road. He added that he has heard of no support for the Rehnquist development and asked for the Record Plat to remain as is. Mayor Dalton called for a second reading, without objection. Without objection, Bill No. 18-41 was read for the second time and placed upon its final passage. Alderman Mange moved to continue the item to the June 11, 2018 meeting, seconded by Alderman Allen. Mayor Dalton explained that the proposal is not ready to move forward and the Board is waiting on additional information before voting on the item. Alderman Mange stated that everyone has the right to appear before the Board and have their case or argument heard. He added that the continuance is at the advice of legal counsel. The motion to continue carried 5-1, with Alderman Butler voting nay, by voice vote. BILL NO. 18-42, AN ORDINANCE AUTHORIZING CHANGE ORDER NO. 7 WITH BRINKMANN HOLDINGS, LLC, IN RELATION TO THE TOWN SQUARE PROJECT, ACCEPTING A DONATION FOR THE COST OF SAME, AND AMENDING THE 2018 BUDGET BY INCREASING CAPITAL IMPROVEMENTS FUND EXPENDITURE AND

REVENUE ACCOUNTS AND APPROPRIATING FUNDS ACCORDINGLY (sponsored by Alderman Wright & Benigas) (1st reading 05/14/18) Alderman Mange moved to continue the item to the June 11, 2018 meeting. Alderman Reuter seconded and a voice vote carried unanimously.
NEW BUSINESS APPROVAL OF A PURCHASE ORDER Alderman Mange moved to approve a purchase order to T. Hill Construction for the 14200 Cedar Springs Stormwater Maintenance Project, in the amount of $7,284.38. Alderman Wright seconded the motion and a voice vote carried. Mayor Dalton called for first reading, without objection. Without objection, Bill No. 18-43 was read for the first time by title only. Mayor Dalton declared Bill No. 18-43 continued to the meeting of Monday, June 11, 2018 for the second reading and consideration. WARRANT LIST – 05/29/17 Alderman Mange moved for approval, seconded by Alderman Butler. Mayor Dalton called for any amendments. Hearing none, a voice vote was taken and the warrant list of May 29, 2018, in the amount of $199,687.13 was unanimously approved. OTHER ADJOURN Motion was made by Alderman Mange and seconded by Alderman Wright to move to closed session pursuant to Section 610.021 (1) to discuss legal action and attorney/client communications. The roll call vote was as follows: AYE, Aldermen Allen, Butler, Frautschi, Mange, Reuter and Wright; NAY, none; ABSTAIN, none; ABSENT, Aldermen Benigas and Meyland-Smith. My name is Jean Mennes. I live at 13595 Featherstone Dr. in Town & Country.
I could not make the recent Board of Alderman Meeting so I am writing to you with these pictures which I would like
read and copied on the record and sent to the board of alderman and mayor.
I am writing to show what happens when you allow Rebnquist Development to come into T & C, clear the land of all
vegetation, regrade with no plan for stornn water runoff or the damage it causes to the surrounding neighbors. He
literally built a spillway at Mason Heights so the storm water would drain onto the Meyers' property and eventually
onto my property. The silt that came a'fter his bulldozing filled up the natural sink holes on our (Meyers/ Mennes)
property so they could not drain(nor do they drain to this day) forming swamp land and mosquito farms and
unbelievable debris which remains. His silt clogged up the drainage system around my pool which I had to dig up and
replace not to mention the clean up of the pool and pool area x 2. He was not held responsible for any of this damage.
Would you like him to build around you? Do you not have concern for what he might do with the 30 acres he plans to
develop in T & C? I do and so do the residents that live around that new building site, with good reason I might add. I
thought it was against the law to build while damaging property around you yet Mr. Rehnquist can. Why?
I have lived in T & C for 40 years. I have never had this type of damage to my property until Rehnquist Development
came along. I am 72 years old and would like to downsize. Would any of you like to buy my property for its' appraised
value?
Please look at the pictures below that attest to what happens when Rehnquist Development builds in Town & Country.
Mason Heights is 9 acres. His new building site is 30 acres. Please consider what could happen.

wanted to show was the river from the spillway which Mr Rehnquist built to flow onto my neighbors' land and
eventually onto mine. 2. June 14, 2014-my yard & pool area 3. December 26, 2016-same area 4. April 5, 2017- my
backyard adjacent my fence 5. April 30, 2017- again that is my fence rail and area behind. It came within inches of
flooding my pool area again. 6. I just took another picture but do not know how to include it on this email but it looks

I am writiJ today to express my adamant opposition to the Rehnquist proposal tobuild more homes on South Mason Road. In addition, I would like to register my totaldismay and dis@uit with the obliterated open and @sen spaces as well as the mstytrees that have been destroyed on both the 8tonemont/Rehnquist and Morrellproperties. I aannot fathom how the city of Town and Country allowed thisdevastation of the landsaape to oaaur nor aan I understand how there was noapparent consideration taken into the impact all tJus heavy aonstruation would haveon loJ time residents living in the viaimty.
My late husband, Vern Roden, and I bou@t our home at aOll 8. Mason Road in 1989.At that time, there wasn't even a stopli@t at Manohester and Mason. We @ewtomatoes and planted flowers of every kind. We had no major problems with deeruntfl Xanahester Xaadows bou@t around 80 acres or so hom MaGraw Hin to bufldtheir mall. That is when the deer started invaang nei@bo yards with avan@anae. We @ave up growing tomatoes beaause the deer gobbled them up beforethey were ripe for piakJf. Until this reaent massive new aonatmation began, I could still eqjoy the quiet,privaay, and beautiful trees. Wow, however, there is almost aonatant noise fromta'ueks, bulldozers, and hammering as well as enou@ dust stirred up on many days tobe aonsidered air pollution. rho aesthetiaally appalling views of XanchesterXeadows businesses from both Mason Road and my kitahen windows and saraenedporah are pretty hideous, suad the dust stirred up by all the tmaks driviJ in and outprevents me from even using my porch without hosiQ, everything down first.
I am aertain that I am not alone m having these aomplaints and aonaerns. The qualityof life around here has diminished profoundly. Vivian Meyer's Speech Please place in the record and, if possible, read it outloud at tonightmeeting.
I cannot attend this meeting tonight in person. My husband is in the hospital and I must take care of
his needs first. Therefore, I am sending this letter to be read and inserted in the minutes to register
my objection to the plans submitted by Robert Rehnquist for his planned subdivision on the MorrellManor Subdivision property.
First of all, Mr. Rehnquist submits plans that disregards any neighboring property. He manipulates his
numbers so it looks like he is in conformance with MSD rules. Now T&C has more stringent
ordinances for water runoff and sediment than MSD. Why were your 0% water runoff and sediment
deposits not heeded. Why was he allowed to run 1 00% of his water and countless tons of sediment
from Mason Heights to my property? Why was he allowed to cut a SPILLWAY.from his property to
mine? Did anybody in the T&C office really study his plans before they approved them? Neither
Mason Heights nor Stonemont are in compliance with T&C ordinances for storm water runoff. He
clear cuts these properties and grades them and brings in fill dirt and debris. What does this do to the
neighbors? All these properties were covered with vegetation that absorbed all rain water on the
properties themselves. There was no runoff.
According to your ordinances there should be 1 00% retention on these properties. That is not true at
all.
Now the city has a Storm Water Project that will install sewers from his Mason Heights all the way
across my property to the opposite corner, down along Jean Meness's property to connect to the
storm sewer on Peacock Farm Road in Mason Valley Subdivision. This project will cost the city
dearly and Robert Rehnquist has pocketed his millions of profits at your expense.
In the proposal before you he wants to rescind a study done on the Morrell Manor Subdivision so he
can do the same there. P&Z has already has vetoed that proposal. So he resubmits his plans to the
full Board of Aldermen, without revision or any provision for the water run-off. If you approve these
you are giving him license to do exactly as he pleases, just as he did to Mason Heights and
Stonemont. At some point the entire watershed has to be considered when these plans are
submitted. That should be the responsibility of first, the builder, and then T&C engineers. Is this ever
done?
Now is the time for you to put a stop to his shenanigans and vote no on this project. This is beautiful
country-like property. Where is the 'Country' in T&C anymore? This name of this city was chosen to
mix 'town' and 'country' properties in this little burg in St. Louis County. How much 'country' can you
find in T&C anymore. It is just like any other city around here. Please register your NO vote to
Robert Rehnquist's proposal.

I am contacting you today to voice my opinion on Item #4, Bill No. 18 - 41 of Unfinished Business for tonight's BOAmeeting.
I strongly oppose allowing Rehnquist Design and Build to amend the existing plat for Morrell Manor Subdivision reducing
the permanent open space/protect mature woodlands from 32 acres to 15 acres.
As a long time resident of Town and Country I believe one of the greatest assets our city has are the beautiful, natural
woodland areas. Preserving these areas is of great importance and is why our city has codes protecting them.
I ask you, as stewards of our town to heed the earlier recommendation of the Planning and Zoning Commission and not
allow the existing plat for Morrell Manor to be amended reducing the existing protected woodlands.

I am writing today to ask that yori deny tl"ie appeal by Rob Rel'u'iqriist to reduce tlie amoru'it of
permanent open space on 1919 and 1955 S. Mason Rd.
Mr. Rel'uqquist lias already been denied by tl'ie Planning and Zoning Commission, and liis appeal
to yori is simply an attempt to circumvent tliat decision.
One of tlie best parts of living in Town & Country is the size of orir lots and tlie wonderful green
space that surrounds them. We don't need or want any development
that infringes Ol'l tliat. We certainly don't want developers who cannot or will not operate witl"iin
tlie guidelines tl'iat TOWII & Corintry has set out.

With regard to Rehnquist Design and Build's appeal to the Board of Aldermen for development 1919 & 1955 S
Mason, I would like to voice my concern over this request and ask that this appeal be denied. Allowing Mr.
Rehnquist to proceed with the proposed development would set a dangerous precedent and undermine the
spirit of the municipal code. It would effectively allow for wholesale deletion of protected open space through
multiple subdivisions of existing acreage.
Rehnquist Design and Build is free to develop 1919 S. Mason, if they comply with our municipal code.
Rehnquist Design and Build purchased the property knowing the restraints on development on this plat, and
despite the active and ongoing opposition by Town & Country residents through the Planning and Zoning
process.
This appeal should be denied.

Morrell Manor Subdivision - May 29'h Board of Aldermen Meeting
My name is Cynthia Pavelka of 1519 Mason Hill Court in the Mason Valley
Subdivision. I am a professional engineer and registered geologist in the State of
Missouri and review storm water management plans for a major national
corporation.
I provide these credentials, because after reviewing the Site's Plans and
Testimonials, it is appalling that past and present Rehnquist developments have
caused substantial damage to three households downstream of the Rehnquist
Town & Country development sites. These three residential sites were located at
13595 Featherstone Drive (Mason Heights Impacts), 1536 S. Mason Road (Mason
Heights Impacts) and the Mason Green Condo Community (Stonemont Estates
Impacts).
Multiple items contribute to these disasters:
@ Erosion Control Plans are not robust and actually allow significant rain
events to bypass controls. Stonemont Estates is permitted under the
State's Storm Water Permit and has received a Warning Letter due to the
impacts they have caused Mason Green Condo.
@ Drainage Ways are permanently filled (ephemeral and intermittent streams
are regulated by the USACE)
@ Hydrologic Pre & Post-Development Run-off Calculations are required.
Flaws in the Run-off Models look at fully developed conditions versus the
intermediate phases of a property (Calculations treat all forests as mature
trees - not young trees as are being proposed)
* Run-off Models assume the soil is in its natural state with permeable soils
that have been developed over millions of years. I would like to present
two exhibits that show the trees recently installed at Stonemont Estates. In
the run-off models, the trees planted are given storm water credits because
they will uptake rain and prevent runoff. However, the model assumes that
the trees are planted in their natural state, in permeable soils that act like a
sponge. The berms were NOT made with top soil in it's natural state.
These were made with compacted clay. The compacted clay doesn't act
like a sponge, the water runs off. The model assumes the trees are mature
not young trees. Young trees were planted instead of preserving the
mature trees that were originally there.
If you decide to move forward on this Record Plan for Morrell Manor Subdivision,
additional conditions should be added to review water quality, channel
protection, and flood protection prior to approval.
With respect to our three neighbors that have had serious damage to their
facility, this is NOT Little League Tball - "three times a charm." This is the
Professional League - "Three Strikes and You're Out. Rehnquist developments
should be "Out" of Town & Country.

Life has taught us that Mother Nature always wins. We want nature to be in harmonywith the elements. This is why we take the steps we do to do what ever it takes to plan,manage and control the use and care of our land - and to keep the country in T&C.
Tonight we are once again voting about care, management and behavior. Let's look atwhat we know.
Before Mr Rehnquist developed Mason Heights there were no obvious stormwaterproblems downstream. The sink holes, vegetation and mother nature appeared to bedoing their job. They were perceived to be in harmony. I say perceived because the cityalready knew of a potentially serious drainage problem nearly 10 years ago and wascurently in the process of proposing a $300,000+ stormwater piping solution to connectMason Heights with the existing stormwater system in Mason Valley. Nevertheless, Mr.Rehnquist proceeded with the clear-cutting of the entire parcel in violation of Section405.130A of the Town and Country Municipal Code which prohibits the removal of anyliving tree with a caliper of 3" or more or the clear cutting of any trees within awoodland area. The result was considerable damage to other citizen's property downstream. A civil court case was won against My. Rehnquist but the award was no wherenear enough to fix the cause or repair any of the resulting damage.
The city is now left with the responsibility (and costs) to fix the problem. This shouldnot be much of a surprise as they have been involved with the Meyers for several yearsin obtaining the necessary easements associated with it's rath"er complicated andexpensive resolution. Surely, Mr Rehnquist has been advised of this as well, or has he?The other questions on my mind, and therefore the questions that should be on the city'smind include the following
When is comes to new development, what are the city's priorities and who's interestscome first: those of the prospective owners and the developer, or those of thesurrounding property owners that will have to live with the consequences?
Is the silting of Mason Green's detention ponds and the destruction of the Clayton'swater line, both part of the Stonemont project just a tip of other Rehnquist icebergs wedon't know about?
What is he really up to with the project before us? How is it different?
Each time I prepare for a meeting on this project I have learned something new. Myunderstanding of what it going on or that has transpired becomes less and less clear andmore and more confusing. The only thing I am sure of is that we are not providing thebest of oversight and management at the city level as Mr. Rehnquist continues todemonstrate his disregard for our rules and concern about this and his other sitedevelopments.
Questions, questions, questions. Until we have the answers, we need to vote no on thisand any pending or future development until we do. Once again, thank you for listening
