Area, including the Basalt Creek area, and annexations since the last update. Amendments include addition of approximately 470 acres of land to the City’s urban planning area boundary. Authorization for UPAA ordinances was granted by the Board as part of the 2018 Long Range Planning Work Program, adopted March 6, 2018. III. BACKGROUND State law allows local governments to enter into agreements that outline and acknowledge the responsibilities for coordinating comprehensive planning activities within the Regional Urban Growth Boundary (UGB). Additionally, Statewide Planning Goal #2 (Land Use Planning) requires that governmental plans related to land use must be consistent with adopted County and city comprehensive plans and regional plans. To this end, in 1983 Washington County began the process of developing individual UPAAs with cities within the County’s UGB. These describe and map each city’s site-specific urban planning area and include policies for coordinating comprehensive planning and development within the planning area in compliance with state planning goals and laws. The adopted UPAAs are included as an element of the County Comprehensive Plan. From time to time, amendments have been made to the various UPAAs to expand or modify a city’s planning area boundary and/or provide updates to the policies regarding coordination. The Washington County - Wilsonville UPAA was originally adopted in 1983. The last UPAA amendment was adopted in 2007 via Ordinance No. 680 and signed in December 2007. The 2007 UPAA update included changes to the city’s urban planning area to include areas that Metro added to the Regional UGB, including the Coffee Creek Correctional Facility (added in 2001) and the Coffee Creek Master Plan Area (added in 2002). Changes Since 2007 The Basalt Creek and West Railroad Planning Areas, generally located between Tualatin and Wilsonville, were added to the UGB by the Metro Council in 2004 through Ordinance No. 04-1040B. That ordinance included a condition that these areas undergo Title 11 concept planning, as defined in Metro Code Chapter 3.07 of the Urban Growth Management Functional Plan (UGMFP). The County, Wilsonville, Tualatin, and Metro entered into an Intergovernmental Agreement (2011 IGA) to consider the Basalt Creek and West Railroad Areas in a single concept planning effort and refer to the two areas generally as the Basalt Creek Planning Area. Basalt Creek concept planning occurred from this time until adoption by both cities in August, 2018. During concept planning, the County worked with the cities on a number of topics, including planning for the transportation system to serve the area. The first addendum to the 2011 IGA, approved in 2013, was to acknowledge the Basalt Creek Transportation Refinement Plan, a collaborative transportation planning effort that identified the major transportation projects for the Basalt Creek Planning Area.

In late 2018, both Tualatin and Wilsonville adopted the completed Basalt Creek Concept Plan, which included the necessary transportation and land use planning for the area as well as an agreement on the boundary between Tualatin and Wilsonville. Updates to the UPAA are required to reflect the established planning areas of the two cities as well as the need for continued multijurisdictional coordination on the major multimodal transportation investments that have been identified to serve the area. With House Bill 4078-A in 2014 and House Bill 2047 in 2015, the Oregon legislature validated and acknowledged the Metro-led process for developing Urban and Rural Reserve land designations for the region. This included approximately 1,565 acres of Urban Reserve land within the unincorporated areas east of Tualatin (I-5 East Washington County, and Elligsen Road North). Title 11 of Metro’s UGMFP identifies the planning responsibilities and guiding policies and requirements for the Urban Reserve areas as they transition from rural to urban uses. Ordinance Notification Notice 2019-03 regarding proposed Ordinance No. 850 was mailed February 22, 2019 to parties on the General and Individual Notification Lists (community participation organizations, cities, special service districts, and interested parties). A copy of the notice and ordinance was provided to the Planning Commission at that time. A display advertisement regarding the ordinance was published March 6, 2019 in The Oregonian newspaper. IV. ANALYSIS County staff worked with Wilsonville and Tualatin staff to craft amendments to the respective UPAAs to address the factors that have changed since 2007, primarily the advent of urban reserves and Basalt Creek concept planning. Because the UPAA was last updated prior to this concept planning and the Urban and Rural Reserve land designation process, amendments are necessary to address these actions. The 2007 Washington County - Wilsonville UPAA did not identify the concept planning responsibilities or likely urban service providers for coordinating concept planning in the Basalt Creek area described above. The 2019 UPAA proposes a new Section IV (Comprehensive Planning and Development Policies for Urban Planning Areas) including processes and policies for coordinating comprehensive planning in the Urban Planning Area and improved notification policies for development review. It also includes policies regarding implementation of concept plans and related agreements. A new Section III (Concept Planning for Urban Reserve Areas) is added that describes and defines the Urban Reserve lands, outlines the planning responsibility for concept planning and includes a description of the general expectations of the concept plan to fully comply with UGMFP, Title 11. The County has an interest in assuring that the planning for the unincorporated area meets the expectations for road funding, access management, any potential jurisdictional transfer of roadways and appropriate serviceability to the area in compliance with

Title 11. Thus, the 2019 UPAA amendment provides the opportunity to clearly identify and coordinate planning responsibilities and a process that will guide the concept planning expectations for the Urban Reserve area in a timely manner. At this time, the city has no area identified as an “Urban Reserve Planning Area”. The area to the east of the current city boundaries is in an Urban Reserve and is identified as “Urban Reserve Planning Area – Planning Responsibility Undefined” on Exhibit A of the proposed UPAA. The area to the east will eventually be planned by either Wilsonville or Tualatin, and further discussions regarding the area to the west are underway between Wilsonville and the City of Sherwood. These areas will potentially be added to the UPAA as “Urban Reserve Planning Area” once the cities agree on the boundaries. Several special policies are added in a new Section V (Special Policies) primarily related to ongoing transportation planning and funding actions that are required. These policies are in both Wilsonville and Tualatin’s UPAAs to ensure ongoing coordination on these important facilities. Other updates include removing outdated provisions concerning notice and coordination requirements in the comprehensive planning process, providing more flexibility in the timing of amendments to the current UPAA and clarifying the annexation process for unincorporated lands with County land use designations. Finally, the Wilsonville Urban Planning Area map, Exhibit A, is updated to reflect the new Urban Planning Area, addition of the Urban Reserve Planning Area – Planning Responsibility Undefined, and recent city annexations.

Summary of Proposed Changes Ordinance No. 850 proposes to amend the 2007 Washington County - Wilsonville Urban Planning Area Agreement, an element of the County Comprehensive Plan. Key provisions:

Adds a new Section IV (Comprehensive Planning and Development Policies for Urban Planning Areas) with processes and policies for coordinating comprehensive planning in the Urban Planning Area and improved notification policies for development review

Adds a new Section III (Concept Planning for Urban Reserve Areas) of the UPAA that includes a process for coordinating concept planning in the Urban Reserve Area

Deletes Exhibit A of the 2007 UPAA, the Wilsonville Urban Planning Area map, and replaces it with a new Exhibit A reflecting the new Urban Planning Area, addition of the Urban Reserve Planning Area – Planning Responsibility Undefined, and recent city annexations

(UPAA) Theresa Cherniak, principal planner and Michelle Miller, senior planner from the Community Planning group of LRP provided a PowerPoint presentation regarding Ordinance No. 850. Staff provided updates and background information on Wilsonville’s UPAA history. Wilsonville’s first UPAA was adopted in 1983, and other updates occurred in 1986, 1988, and 2007. The updates in 2007 included addition of the Coffee Creek Master Plan area to Wilsonville’s planning area and provisions for conditional planning authority pending selection of a preferred alternative for I-5/Hwy 99W connector alignment. Changes since 2007 include completion of the Basalt Creek Concept Plan. The following ordinance key provisions were discussed.
