Director’s Report submitted by: Lara Lorenzi December 2016 Library Board of Trustees Meeting Informational Updates:

• Reminder: The library will be closed on Saturday December 24th and Monday December 26th for the Christmas holiday.The library will also be closed on Saturday December 31st and Monday January 2nd for the New Year holiday. The librarywill be closed on Monday January 16th for Martin Luther King Jr. Day.

• The Foundation will not be meeting in December. Their next meeting will take place on Tuesday January 17th.• A nationwide halt has been put in place for the Overtime final rule. I have included information about this in the board

packet. The Labor Department is filing an appeal on the preliminary injunction placed on the rule. I will keep you allup to date with this case as we know more.

• We have had an issue of DVD theft with a person who has been coming into the library. The police are aware of thesituation and will help us take care of this issue. We will be giving this person a letter notifying them that they are nolonger allowed to utilize our library and all the services it provides due to their actions. We do not have a name orcontact information for this person, so we have to wait and see if they come back into the library.

• The Phoenixville Community Health Foundation is beginning a new initiative in 2017 and continuing into 2018: TheAssessment of Program Outcomes. All grantees are required to attend this all day program to learn more aboutoutcome based measurements. Mike English, Lauren Coy and I will be attending this training.

Personnel Updates: Nothing to report at this time. Facilities Update:

• Routine maintenance of the grounds has been performed, changing of lights has occurred as well.• Over the Thanksgiving holiday we had another instance of the front door lock failing and we had a patron enter the

building while we were closed activating the alarm system and sending the police to the building. A staff member arrivedand walked the building, alarmed and secured the building. After speaking with Ron Miller, PASD sent over a locksmithto look at the door/lock. The front door lock was replaced the week of November 28th. We will be keeping an eye onthis item but I expect that replacing the lock will take care of this issue.

• The second avenue road was ground and repaved on Thursday December 1st and Friday December 2nd. There was noparking allowed on Second Ave. for most of the week. With this phase of the project completed, we do not expect anymore extended road closures or no-parking notifications.

• The upper level of our library was decorated for the season by Barbara Shepsko. She created the lovely decorations andput it all together. Her son donated the live wreaths on the old front doors of the library. She has volunteered her timeand talents to help make our library more festive and it looks wonderful. She also made decorations out of discardedbooks from our library- they are amazing. I just wanted to acknowledge her talent and all the time she invested to makeour space beautiful.

This is a -21% decrease from the previous year.• Door Count Current month:

This is a 13% decrease from the previous year. This is a 3% increase from last months (October 2016) door count numbers. We are starting to see an increase in our door count again. This is good news after the various factors

that were hampering our patrons from coming in in September and October. I expect a slowdown inDecember due to the holidays, December is traditionally a slower month out of the year.

Chester County Library System Updates: Computer updates: The winter roll out of leased computers will begin Tuesday December 13th. We have various staff and public PC’s that are being replaced. The next rollout of computers will take place in June 2017. State Updates:

• None at this time.

Young Adult • Fall Estimation Game:

Future Programming-December • North Pole Fun, Saturday, December 10, 2016, 3:00-3:45 PM. All ages & families. Come along and

share some holiday fun this winter season as puppets Jampot, Beanpole, and Bayberry, North Pole friends, prepare for the perfect holiday by sharing Holiday songs and finding out that the pleasure of giving makes the time of getting all the better. This puppet show celebrates the diversity of winter celebrations and includes elements of Christmas, Hanukkah, and Kwanzaa. Registration required.

GRANTS

There is a wide world of grants. There are numerous types of grants, ranging from

restricted to capital to operating. However, the amount of grants that public libraries can

apply to have dwindled over the years.

In years past, it seemed like you received lots of monies for grants. While that is true, there

is a caveat to that statement.

Majority of the funds received were restricted funds, solely for the use in the Children’s

department. The monies were received via EITC (Educational Improvement Tax Credit)

which is offered through the state of PA to large businesses/corporations.

For monies donated, they get a sizeable tax write-off/deduction.

Also, the monies MUST be spent in that department alone. They may NOT be used for

operating, capital or any other department expenses.

There is plenty of research time that goes into seeking out grants. It is not as simple as just

apply for the monies requested.

The process to decide if we are eligible is as follows:

- research grant opportunities (via foundations, organizations, etc.)

- do the organization’s online application/survey to see if eligible

- email the grants department to find out their eligibility standards, if it’s not listed

on their website

- other times you must send a letter of intent, stating your inquiry into a certain

grant

- there is also a huge amount of waiting time during this as well, to even find out

if you’re eligible

The Future

It’s going to be an exciting year for the Phoenixville Public Library! With the addition of

the spring Author event “A Novel Lunch” and the Spring Beer & Wine Festival, we are

going to be out and about in the community more than ever!

I also hope to add to our social media presence, by using video posts/vlogs, a possible

blog and lots more excellent photographs.

The photos will be used on and off social media, as well as in print and on our newly

revamped website(and most swanky website of the CCLS system).

There are also a few other exciting things I have been thinking about for the Library.

Wage and Hour Division (WHD) Important information regarding recent overtime litigation in the U.S. District Court of Eastern District of Texas On November 22, 2016, U.S. District Court Judge Amos Mazzant granted an Emergency Motion for Preliminary Injunction and thereby enjoined the Department of Labor from implementing and enforcing the Overtime Final Rule on December 1, 2016. The case was heard in the United States District Court, Eastern District of Texas, Sherman Division (State of Nevada ET AL v. United States Department of Labor ET AL No: 4:16-CV-00731). The rule updated the standard salary level and provided a method to keep the salary level current to better effectuate Congress's intent to exempt bona fide white collar workers from overtime protections.

On December 1, 2016, the Department of Justice on behalf of the Department of Labor filed a notice to appeal the preliminary injunction to the U.S. Circuit Court of Appeals for the Fifth Circuit.

Since 1940, the Department's regulations have generally required each of three tests to be met for the FLSA's executive, administrative, and professional (EAP) exemption to apply: (1) the employee must be paid a predetermined and fixed salary that is not subject to reduction because of variations in the quality or quantity of work performed (“salary basis test”); (2) the amount of salary paid must meet a minimum specified amount (“salary level test”); and (3) the employee's job duties must primarily involve executive, administrative, or professional duties as defined by the regulations (“duties test”). The Department has always recognized that the salary level test works in tandem with the duties tests to identify bona fide EAP employees. The Department has updated the salary level requirements seven times since 1938.

The Department strongly disagrees with the decision by the court. The Department’s Overtime Final Rule is the result of a comprehensive, inclusive rule-making process, and we remain confident in the legality of all aspects of the rule.

Trustee openings

• Reminder: In Feb. 2017 we will need to announce and advertise the board openings that willoccur when terms are reached in June 2017.

• We currently have 2 trustees whose terms will end at that time. Larry Way and Mark Gerner.• If you are interested in being on the board for another 3 year term, please let the search

committee know. You will need to submit a resume and letter of intent after theannouncement is made publicly.

• Applications are due the first Friday in April. This year that is April 7th.• The board will need to set up a search committee to review the applications, set up interviews

with the applicants and have recommendations for the full board.• Interviews will also take place at PASD in a public forum. This happens in May- dates and

times are set by the PASD board and communicated to us through Dr. Fegley.•
