COUNCIL COMMITTEE REPORTS: Council President Hauser reported that he attended a Joint Recreation meeting on September 26th with West Caldwell and there was some discussion on the netting situation and a suggestion was to send a letter to the landlord and document that we have in fact tried to put in place a solution which we purchased and were told to leave the property. Paul Carelli responded that the Mayor received an email asking to remove everything and thanks for your efforts and we don’t wish to partake in that solution. Greg Mascera responded that he feels that’s an acknowledgement and they understand that we have made that offer and they rejected that. They re-visited looking at the possibilities of offering a discounted combined pool membership and Community Center membership. They discussed the turf at EVS and the initial intent was to turf the Harrison School field and the Board of Ed chose not to participate and not to allow us in doing that so the applications for the EVS field, through the County, we were able to get the funding that is in place right now. West Caldwell would like to do a presentation on different scenarios by the end of this year or the beginning of next. They spoke about the lack of advertising that has come in for the Kiwanis Oval facility. The thought is to draft a resolution to go to an outside professional firm that would identify different companies that would participate. 10-208: RESOLUTION AUTHORIZING THE BOROUGH ADMINISTRATOR TO ADVERTISE AND RECEIVE PROPOSALS FOR ADVERTISING ON THE OVAL Moved by Council President Hauser, seconded by Councilman Capozzoli. Discussions Ensued. On roll call, all present voted in the affirmative. Resolution approved 10/07/14. Councilman Rodgers reported that the Caldwell Public Library Foundation presents the Downtown Abbey Murder Mystery fundraiser to benefit the Caldwell Public Library on Saturday, October 11th at Mt. St. Dominic Academy from 6:00PM – 10:30PM for ticket information go to caldwellpl.org/foundation or call 973-228-1908. REPORT OF MAYOR: Mayor Dassing thanked the Caldwell Women’s Club for installing a beautiful garden on the triangle at the intersection of Westville Avenue and Brookside Avenue. She gave a special thanks to Phyllis Kent who orchestrated the project and her son Jeff who is a landscape architect and works for Land Identity LLC of Westfield and he created the plans and she thanked Paul for orchestrating the purchasing of the plants with Jeff’s guidance there are 130 plants and twenty volunteers helping. The Mayor spoke to PSE&G in regards to the new top for our decorative lights in the downtown and they have been ordered and are awaiting shipment. She is waiting also on a price of the installation of the smaller decorative lights East of Dunkin Donuts to the Borough’s border and replacing the cobra lights that are currently on the telephone poles with wrought iron tear drop black so everything matches. She wished good luck to the cookie party new business that just moved into town we had a ribbon cutting there last week and all came home with homemade cookies. They have children birthday parties up to 24 and you bake cookies and decorate them. Council President Hauser reported that the Senior Transportation Committee had a meeting and there was a consensus that there is a need to get a new bus. Maria has sent Paul an email that possibly presenting jointly with Roseland and West Caldwell for grant money that would substantially cover for the bus. It is estimated $60,000 for a 24 seat bus and there is a need to plan on purchasing a bus in the next year.

Page 3 of 3 BOROUGH ADMINISTRATOR: Paul Carelli reported on the following:
On the topic of the bus, in December the applications are due for CDBG grants and historically the maximum we will get is in the neighborhood of $55,000 so we will need to discuss as to whether that would be an option or if we will have three towns participate.
Phone System is installed. Water Filtration has been installed. UV disinfectant will be installed tomorrow. The Chief and Paul have been looking at a security plan for the Borough complex. Cameras have
been installed and the TV in the Clerk’s office and we still need to install more cameras in the Parking lot. They are looking at the Reverse 911 emergency contact system. Also, an intercom system for the Borough employees, Caldwell Community Center and Library.
2015 DOT Grant is due next week and Brookside is one of the streets we are looking to apply for. The water work is completed at Erwin Place. The 2nd phase of paving Erwin, Hatfield and Elm will be in the spring. There was a pre-construction meeting for the demolishing of Knights of Columbus building and
they will be knocking it down at the end of the month. A pre-construction meeting is required by the County for the Chair lift. For the next Council Meeting he will like to put on a Capital plan. The police department is in
need of a SUV and some equipment for the Public Works. They are looking at LED lights for the pool area and the problem is with the fixtures but they
have someone who is going to come to do a lighting study. They will be doing a test with one or two fixtures that are easily accessible because you will have to bring in scaffolds and shut the pool.
Council President Hauser asked where things stand with the technology process with West Caldwell and the Board of Education. Paul responded that he didn’t think it was feasible for the Borough because the expenses for Technology are very low and we pay someone by the hour and now we have all new equipment. Council President Hauser responded that it is the same tax dollars so if we don’t need to pay out money then let’s not pay out the money. He encourages Paul to look into it. Council President Hauser asked about the status of the triangle on Brookside and Westville and Paul responded that he was under the direction of the Council not to do anything and they may be able to address it when they pave Brookside. REPORT OF POLICE CHIEF: James Bongionro reported that an arrest was made in connection to the armed robbery. He thanked Detective Apicella, Detective Sgt. Palatucci and Lt. Andrinopolous. They started with eight (8) auxiliary officers and five (5) have since left for police jobs. They are starting with a class tomorrow night for five (5) new auxiliary police and they will be graduating in November. The Resolution on tonight for put Brakes on Fatalities Day is this Friday, October 10th and it is a national initiative just to increase awareness about safe driving. OPEN PUBLIC MEETING: Moved by Councilman Durkin, seconded by Council President Hauser to open meeting to the Public. Hilda Moore, 23 Personette Street, she has concerns about the garbage that is left at the side of the Knights of Columbus building and wants to know when it will be removed. She asked if there is something that can be done to adding seconds to the crosswalks. She asked about bus stops and if there was anyway of obtaining more spots. There being no additional business to be conducted a motion to adjourn the meeting was made by Councilman Capozzoli, seconded by Councilman Durkin unanimously affirmed by all members present, the meeting was adjourned at 9:03P.M. RESOLUTION APPROVING A REFUND FOR A SEWER CONNECTION FEE Block 2000, Lot 2, 3,5,&6 ON THE TAX MAP OF THE TOWNSHIP OF WEST CALDWELL TO THE VILLAS AT WEST CALDWELL, LLC, 517 PASSAIC AVENUE WEST CALDWELL, NJ 07006 IN THE AMOUNT OF $18,900.00
WHEREAS, The Villas at West Caldwell, LLC was approved for a Sewer Connection Application by Resolution
#1-41 on January 22, 2008; and WHEREAS, the property is located at 517 Passaic Avenue, West Caldwell, New Jersey and is known as Block
2000, Lots 2,3,5 & 6 on the Tax Map of the Township of West Caldwell; and WHEREAS, the approved sewer connection fee for the construction of the age restricted complex was calculated
as 27,444 SF consisting of 30 – 2 bedroom units to be 24.75 equivalent connections; and WHEREAS, the connection fee was calculated as follows: 24.75 EDU x $3600/EDU = $89,100; and WHEREAS, a connection fee of $108,000 for this project was paid by The Villas at West Caldwell, LLC, 1122
Clifton Avenue, Clifton, NJ 07013 on May 4, 2007; and WHEREAS, the applicant has informed the Borough Administrator that an overpayment in the amount of
$18,900.00 was made and a refund is requested. NOW THEREFORE BE IT RESOLVED that the Caldwell Sewer Director has agreed and hereby approves a refund of the Sewer Connection Fee of $18,900.00
BE IT FURTHER RESOLVED that the Mayor and Council of the Borough of Caldwell authorize the Borough Administrator to refund the Sewer Connection Fee of $18,900.00 to The Villas at West Caldwell, LLC, 1122 Clifton Avenue, Clifton, NJ 07013

Municipal Aid 2015
The scope of work for the Brookside Avenue Improvements project includes milling and
resurfacing the roadway from Bloomfield Avenue to Westville Avenue, both County roads.
All handicap ramps will be upgraded to ADA compliance, including installation of
detectable warning surfaces and construction of proper ramp slopes. Catch basins will be
reset or reconstructed, as needed to improve drainage, in addition to the installation of
NJDEP compliant curb pieces and bicycle safe grates to replace the non-NJDEP compliant
ones. Additionally, damaged sections of sidewalk and driveways in disrepair will be
replaced in kind. Traffic striping, markings and signage will be replaced in accordance
with MUTCD standards. Constructing these improvements will complete the entire Brookside
Avenue project, as the remainder of Brookside Avenue - Section 2 (from Westville Avenue to
the Borough limit) was constructed under the 2012 Municipal Aid Grant Program.

Brookside Avenue is a frequently used local road that connects Westville Avenue
and Bloomfield Avenue, two heavily traveled County roads. A large County park,
Grover Cleveland County Park, abuts Brookside Avenue and the park is accessed
via Brookside. Also within 0.5 miles of the project limits are multiple
churches and places of worship, Grover Cleveland Middle School, Trinity Academy,
Lincoln Elementary School, Mount Saint Dominic Academy, Caldwell University, and
numerous restaurants, businesses, and shops along Bloomfield Avenue.

Municipal Aid 2015
The scope of work includes the milling and resurfacing of the ageing, and
subsequently failing, roadway as well as resetting and reconstruction of
existing inlet grates and manhole covers to provide a safer travel way for
motorists. All existing non-compliant curb ramps will be reconstructed in
conformance with current ADA standards, which will benefit the numerous
pedestrians who utilize the sidewalk and ramps that connect them. These new
curb ramps will particularly benefit children attending the several schools
shown on the attached Location Map as well as those that walk to and from Grover
Cleveland County Park. MUTCD compliant traffic striping and markings will be
installed after paving to provide motorists with clear direction when traveling
along the roadway. These improvements will improve upon the overall safety for
vehicular and pedestrian traffic alike.

WHEREAS, the Borough and Teamsters Local 97 have been in negotiations for a successor collective
negotiations agreement; and WHEREAS, pursuant to those negotiations, the Borough and Teamsters Local 97 have reached a Memorandum of
Understanding concerning the terms and conditions of employment for Caldwell Department of Public Works employees represented by the Teamsters Local 97; and
WHEREAS, the successor collective negotiations agreement will be effective from January 1, 2014 through
December 31, 2016; and WHEREAS, Borough Administrator has recommended ratification of the Memorandum of Understanding
reached with Teamsters Local 97; and WHEREAS, the Borough Council having reviewed the Memorandum of Understanding and finding ratification of

No. P2267 Dear Mr. Carelli: Crew Engineers, Inc. (Crew) is pleased to submit this revised Proposal for providing Professional Engineering Services for milling and resurfacing, striping, new detectable warning surfaces, drainage improvements, and intersection improvements for Elm Road, Hatfield Street, and Erwin Place in the Borough of Caldwell. The project will include field survey, final design and approvals, bidding services, and construction-related services. Erwin Place is part of an improvements of the Borough water system currently being designed by Crew. Crew will supplement survey and design information obtained for the water system improvement project to prepare the survey and design for the Erwin Place portion of the roadway improvements. On May 22, 2014, the undersigned met at the site with Borough Engineer Glenn Beckmeyer, P.E. to review the project. This revised proposal addresses our telephone conversation of September 19, 2014 regarding the project schedule and the removal of the proposed sidewalk on Erwin Place from this Proposal. Proposed Improvements/Project Understanding At the May 22, 2014 site visit and subsequent telephone conversation of September 19, 2014, the following was concluded:
New catchbasins will be included, where needed. Crew will arrange to meet with Mr. Beckmeyer and Director of Public Works Mario Bifalco after completion of preliminary design to review areas where existing catchbasins are known to have deteriorated.
Existing roadway widths and curb heights will be maintained throughout the project.
Striping, in general, will be similar to existing crosswalk, centerline, edge of pavement striping, and other miscellaneous pavement markings. Final location and type of striping and marking will be reviewed with Borough representatives after completion of preliminary design.
New skid-resistant detectable warning surface pads with truncated domes will be added at all intersections where existing or proposed sidewalks are present and existing detectable warning surfaces do not meet current Americans with Disability Act (ADA) and New Jersey Department of Transportation (NJDOT) standards.
Crew will make review submittals to the NJDOT. Submittal to the Hudson-Essex-Passaic Soil Conservation District will not be required since the area of disturbance will be less than 5,000 square feet.
Depending on workload, the survey work will be done by our staff or we will make use of a Subconsultant, Jeffrey B. Doolittle, P.E. & L.S., Mahwah, New Jersey, for the surveying services described in the Scope of Services. Mr. Doolittle is a Licensed Surveyor in the State of New Jersey and has worked with us on other projects in Caldwell and other roadway improvements projects in Northern New Jersey.

Scope of Services Crew proposes that the services be provided as follows: Task 1 – Field Survey
Crew will prepare a survey of the project area that will include:
On streets designated for milling and resurfacing, Crew will include roadway widths, curbs, sidewalks, utility covers, intersecting roads and driveways, existing traffic striping and pavement markings, and detectable warning surfaces. No additional surveying is needed on these streets for such items as existing spot elevations or contours, underground utilities and existing trees or plantings, walls, and other natural or manmade structures within the roadway right-of-way that will not directly affect the proposed construction activities.
In the area on Hatfield Street in the vicinity of Grover Lane designated for drainage improvements, Crew will perform the following tasks.
- Establish roadway horizontal and vertical alignment, including centerline, edge of pavement, and curb height elevations.
- Locate all trees, shrubs, utilities, walks, driveways, and structures 30 feet on each side of centerline.
- Rim and invert elevations of all existing storm and sanitary sewers in areas of proposed storm drain improvements.
At the intersection of Hatfield Street and Mountain Avenue, the survey will extend 200 feet west on Hatfield Street and 200 feet north and south on Mountain Avenue from the intersection of the roadway centerlines for the purpose of establishing anticipated traffic lanes and routing. The survey will include centerline, edge of pavement, interim pavement elevations, and curb elevations at 25-foot intervals. All existing manmade and natural topographic features 10 feet beyond the right-of-way will be obtained.
Task 2 – Design
Crew will meet with Borough officials at the conclusion of the field survey and after we have prepared an initial roadway design improvement drawings to discuss the proposed improvements, and to make modifications to the preliminary design.
Crew will be available throughout the project via telephone or written communication to discuss project status and review areas of concern.
Crew will prepare drawings and specifications for two separate phases of construction.
Phase 1 will include all proposed improvements, except for the milling and resurfacing of project roads that will be completed by a construction contract awarded by the Borough of Caldwell. The milling and paving work will be included in a Morris County Co-op Paving Program for various streets in Morris and Essex Counties.

Phase 1 will include:
1. Drainage improvements on Hatfield Street from Grover Lane to existing drainage facilities east of Smull Avenue.
2. New catchbasins to replace deteriorated catchbasins.
3. Intersection improvements at Hatfield Street and Mountain Avenue to better direct traffic and reduce speed for vehicular traffic approaching the intersection.
4. New detectable warning surfaces at all intersecting streets where sidewalks exist or are proposed, and where existing detectable warning surfaces do not meet ADA and NJDOT standards.
5. Roadway striping and pavement markings. This will be done after the completion of Phase 2.
Phase 2 will include:
1. Full-width milling of all streets within the project area to a typical depth of 2 inches. Where required, additional milling will be specified to achieve curb face of 6 inches throughout project area. The extent of milling will be clearly marked on the drawings.
2. Construction of hot-mix asphalt (HMA) surface course in milled areas. The thickness of hot-mix asphalt will typically be 2 inches. Where pavement thickness greater than 3 inches is required, the specifications will require placement of hot-mix asphalt in layers that do not exceed 3 inches.

It is understood that the Phase 2 work will be included as part of the Morris County Cooperative paving project. Crew will prepare administrative front-end and technical specifications for this portion of the project, as required for submission to the NJDOT.
An Opinion of Probable Construction Cost for this project will be prepared after design drawings have been completed using Morris County bid prices. Final quantities will be shown on both the individual drawings and totaled on the Cover Sheet.
Crew will make the required submissions to the NJDOT needed to receive NJDOT funding for the project. The submission will include combined Phases 1 and 2 drawings and an estimated quantity sheet that shows combined Phases 1 and 2 estimated quantities and separate estimated quantities for Phases 1 and 2. Bidding Services
Provide 20 copies of drawings and specifications for Phase 1 for issuance to prospective bidders. As on previous projects, our office will issue Contract Drawings and Specifications to prospective bidders.
Provide 5 copies of drawings for Phase 2 to Morris County for their issuance to prospective bidders or a selected contractor. Additional copies, if needed, can be provided at cost.
Respond to bidders’ questions and issue Addenda, as needed.
Assist Borough in taking bids for Phase 1, review bids, develop bid tabulation sheet, check references, and issue letter to Borough recommending award.
Construction-Related Services
General administration and correspondence, including providing assistance to the Borough Attorney and insurance representative in completing bond and insurance reviews, and serving as a liaison between the Borough and Contractor.

Arrange for and attend Preconstruction Meeting and prepare minutes.
Review and approve Shop Drawings.
Provide full-time construction observer during construction to assure compliance with Contract Drawings and Specifications, including observation of the following Contractor’s activities:
- Observe the construction of new drainage improvements.
- Observe the construction of landscaped intersection and traffic lane alignment at Hatfield Street and Mountain Avenue.
- Observe the traffic striping after it is completed to assure the Borough that it is completed in accordance with the plans and specifications. The Contractor will be required to provide coating containers and manufacturer’s certifications to assure full compliance with the specified materials.

Review payment requests from Contractor. It is estimated that four requests for payment will be received.

Construction-related services are dependent on the rate of progress of the Contractor, which is beyond our control. Our on-site Construction Observer will be present throughout the day on which work is being done. Our estimate for the time to be allocated for construction observation is shown above. The billing rate for the Construction Observer will be $75 per hour, including travel expenses. In addition, construction-related services will include monitoring the work of the on-site Construction Observer, review Contractor’s payment requests, and provide liaison between our office and the Borough during normal construction activities. Any services provided outside the Scope of Work presented in this Proposal will be performed only after receiving explicit permission from the Borough

The hourly billing rates indicated above are for the calendar year and are subject to revision and adjustments as of January 1 of each calendar year. ■ Crew will bill the CLIENT monthly, with net payment due in 45 days. Past due invoices will be subject
to a service charge at the rate of 1-1/2 percent per month. The bill shall consist of a summary of direct labor hours by personnel, plus a listing of reimbursable costs incurred. Unless CLIENT provides Crew with a written statement of any objections to the bill within 15 days of receipt, CLIENT shall be deemed to accept the bill as submitted.
■ The above rates include all employees' wages, payroll burdens, overhead, and profit. ■ CLIENT is charged for time actually spent on the project. Timesheets are available for inspection by
prior arrangement. ■ Non-project stenographic, general clerical and accounting work, general office expense, and general
administrative costs are included in overhead. These costs are not billed separately. ■ Normal and reasonable time for contract negotiations are also covered in overhead; however,

If Client desires a limit of liability greater than that provided above, Client and Crew shall include a separate paragraph under this Agreement, stating the amount of such limit and the additional compensation to be paid to Crew for assumption of such additional risk. IN NO EVENT AND UNDER NO CIRCUMSTANCES SHALL CREW BE LIABLE TO CLIENT FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES. 12. ACCESS. Client shall provide Crew safe access to any premises necessary for Crew to provide the Services. 13. REUSE OF PROJECT DELIVERABLES. Reuse of any documents or other deliverables, including electronic media, pertaining to the Project by Client for any purpose other than that for which such documents or deliverables were originally prepared, or alteration of such documents or deliverables without written verification or adaptation by Crew for the specific purpose intended, shall be at the Client's risk. Client agrees to defend, indemnify, and hold harmless Crew from all claims, damages, and expenses, (including reasonable litigation costs), arising out of such reuse or alteration by Client or others acting through Client. 14. AMENDMENT. This Agreement, upon execution by both parties hereto, can be amended only by a written instrument signed by both parties. 15. ASSIGNMENT. Except for assignments (a) to entities which control, or are controlled by, the parties hereto or (b) resulting from operation of law, the rights and obligations of this Agreement cannot be assigned by either party without written permission of the other party. This Agreement shall be binding upon and inure to the benefit of any permitted assigns. 16. STATUTES OF LIMITATION. To the fullest extent permitted by law, parties agree that, except for claims for indemnification, the time period for bringing claims under this Agreement shall expire one year after Project completion. 17. PREVAILING PARTY LITIGATION COSTS. In the event any actions are brought to enforce this Agreement, the prevailing party shall be entitled to collect its litigation costs from the other party. 18. NO WAIVER. No waiver by either party of any default by the other party in the performance of any particular section of this Agreement shall invalidate any other section of this Agreement or operate as a waiver of any future default, whether like or different in character. 19. NO THIRD-PARTY BENEFICIARY. Nothing contained in this Agreement, nor the performance of the parties hereunder, is intended to benefit, nor shall inure to the benefit of, any third party, including Client's contractors, if any. 20. SEVERABILITY. The various terms, provisions and covenants herein contained shall be deemed to be separate and severable, and the invalidity or unenforceability of any of them shall not affect or impair the validity or enforceability of the remainder. 21. Mapping
For use when messages need to be geographically targeted, the Web-based mapping
interface, written by ECN, is both intuitive and easy to use. CodeRED utilizes ESRI mapping as a foundation and has created area selection tools that range from polygons to simple paint brush tools, allowing users to quickly become familiar with the map’s features. ECN hosts all components of the mapping interface, relying on no third party providers.
ECN includes local mapping with the license of CodeRED, and additionally has the ability to provide custom maps by using client supplied GIS layers, or by integrating
client supplied street layer mapping to the ESRI foundation. With CodeRED there is no requirement for client communities to purchase GIS software and also no need to utilize internal resources to host, maintain or update maps.

Calling data
Each client accesses a database which is populated by drawing from multiple sources. All compiled data is verified and addresses are assigned lat/long coordinates by ECN’s custom multi-layer geo-coding service.
ECN provides initial calling data for immediate use; this allows communities to be up and running quickly. Data is acquired through various commercial sources and includes residential and business data as well as some mobile phones and VoIP numbers. This data is provided at no additional cost and serves as the foundation for each client’s database.
The middle tier is supplied by the client. Communities using CodeRED typically provide data from their local utilities as well as their 911 data. ECN geo-codes all client supplied data as part of the database building process.
And finally, the most accurate layer of the pyramid is created by entries on the Community Notification Enrollment (CNE) page. ECN provides a custom web page for each community that allows residents and businesses to directly submit additional calling data, text and email addresses, as well as TDD/TTY requirements to further populate the database. All information added to CNE is instantly available for use in CodeRED.

Grit and screenings are not categorized as a specific type of solid waste with an ID number under the New Jersey solid waste regulations at N.J.A.C. 7:26-2.13. The generator may dispose of the grit and screenings at any New Jersey landfill permitted to accept such waste, or at any out-of-state facility, in accordance with the requirements of the District Solid Waste Management Plan for the district in which the waste was generated.
