On March 27 Government Gazette No. 43164 was issued by the Minister of Communications and Digital Technologies under Regulation 10(8) of the regulations made under the Disaster Management Act, 2002 (Act 57 of 2002) (Government Notice No. 318 published in Government Gazette No. 43107 of 18 March 2020)

5.1.1

6.1

All service providers of electronic communicationsnetworks and services (telecommunicationsinfrastructure and services) must ensure continuedservice provision

• Licensees confirmation that their networks are robust enough to cope through the disaster period

6.2

A service provider of electronic communications networks or services must, when requested to do so, rapidly deploy temporary electronic communications networks and services in areas identified after consulting with the relevant Ministers

6.3

For the purposes of easing network upgrades related to the Covid-19 disaster, a licenced entity may seek approval to deploy infrastructure without delay, in which case the Minister will engage with the affected Ministers to secure concurrence to allow Industry to deploy without delay




6.4Ministerial interventions in this regard may include temporary deferment of wayleaves and the payment of fees following agreement between relevant parties

6.5

No access fee may be charged by property owners to electronic communications network service licensees for deploying electronic communications networks or facilities in cases where the electronic communications networks or facilities are not intrusive, such as buried or overhead cabling, that does not constitute a cost to the property owner, or deprive the property owner of its own use of the land

6.6

Reasonable access fees may be charged incases where more intrusive electroniccommunications networks or facilities, suchas masts are erected on property. In suchcases any access fee must be reasonable inproportion to the disadvantage suffered andmust not enrich the property owner orexploit the electronic communicationsnetwork service licensee



6.7All licensees will be required to submit reportsduring the period of the disaster of newinfrastructure and network facilities to beinstalled in response to Covid-19 disaster to theAuthority

6.8 The Authority must keep a register ofinfrastructure and network facilitiescontemplated in paragraph 6.7 above



6.9

For the duration of the Covid-19 national disaster, theAuthority must prioritise the regulatory frameworkapplicable to the management and licencing of radiofrequency spectrum that would enable implementationof this direction on an urgent basis

• ICASA has assigned and issuedtemporary radio frequency spectrumto MNOs

• Liquid, MTN, Rain, Telkom andVodacom have been assigned thetemporary high demand spectrum (NB:Cell C did not apply)

• Mthinte Communications, Levin Globaland Morai Solutions have beenassigned temporary spectrum licensingin the TV white space channels.

6.10

To the extent possible, the Authority must relaxspectrum regulations to enable the temporary licensingof all available spectrum bands including theunassigned high demand spectrum for the duration ofthe Covid-19 national disaster

6.11

The temporary assignment of the unassigned highdemand frequency spectrum must be focused on thoselicensees that would be able to implement and use thetemporary assigned frequency spectrum for theduration of the Covid-19 national disaster on anexpeditious basis. Frequency coordination and planningwill be necessary to effect this assignment



7.1

The automatic type approval of network equipment and handset devices based on the applicants meeting predetermined criteria including:

• Type approval regulation issues by the ICASA

8.1

The Electronic Communications Network Service (ECNS) and Electronic Communications Service (ECS) Licensees, internet and digital sector in general, must provide location-based services in collaboration with the relevant authorities identified to support designated departments to assist and combat the spread of COVID-19

• CSIR continues to update the contact tracing database on receipt of information from NICD and MNOs

8.2

The South African Post Office must make available its national address system and any applicable database to assist the relevant authorities identified to track and trace individuals that have been infected and such other individuals that may have been in direct contact with such infected individuals. A database may be correlated with other sources from government and private sector.

9.1

Electronic Communications Services Licensees must provide zero-rated access to local educational content websites

9.2

Audio visual services especially the broadcasting service licensees must increase their educational programmes to support awareness of COVID-19

• Working with DBE to avail a virtual learning platform in collaboration with SABC in the already connected NHI sites in line with 152 sites to be zero rated (websites etc.)

• Proposed criteria for choosing sites shared with DBE; matter escalated for resolution• DCDT engaging with DBE to arrive at a suitable model implementing schools connectivity based on

10.1

All audio-visual services particularly broadcasting service licensees must support the health sector with programming and public announcements related to COVID-19 disaster

• DoH in partnership with the SABC to deliver 8-10 minutes prime time slots per day per radio station in official languages.

• Ongoing provision of health related content in the audio-visual platforms through broadcasting sites being implemented

10.2

Electronic Communications Service Licensees and Electronic Communications Network Service Licensees with access to the radio frequency spectrum must zero-rate all COVID-19 sites as identified by the Department of Health

• All Department of Health sites as shared are zero-rated

11.1

Broadband Infraco, Sentech, Transnet, Eskom, Prasa and SanralAll fibre-owning state owned companies must make their excess capacities available for the connection of key government installations including essential services in local government and SMMEs to ensure business continuity during COVID-19 pandemic

• All SoCs are on board. Ready and waiting to be told where access capacity is needed on the network

• All SOEs on board and sharing their available infrastructure capacity

11.2

Universal Service and Access Agency and the Universal Service FundAll funds earmarked for the provision of broadband must support the district and local municipalities to improve their broadband and digital government capabilities to mitigate the negative impact of COVID-19 on the provision of services to the citizens

• USAASA and DCDT engaging on the process to unlock the funds

• Funding secured to connect district virtual services



11.3State Information Technology Agency (SITA)SITA must ensure that government departments are able to function remotely

• Government employees enabled for Remote Access increased from 4826 to 5371 (VPNra & VPNC)

• A Government Private Cloud Video Conferencing Solution (TE Desktop), has been development and implemented by SITA and Partners in Industry, to enable government collaboration remotely. This included LTE / 5G connectivity and access to the solution through Video Conferencing Units, Laptops and other mobile devices from Government Officials homes / offices. The solution has enabled Cabinet, NCC, Cluster, NATJoint and other Ministerial engagements. The solution has realized a virtual government that has connected meetings in access of 50 government official with durations of up to 9 hours.

• The following solutions are available to government to enable remote working and encourage a digital government:

• e-Gov Portal: This serves as an online central point of entry for accessing and consuming government electronic services

• Enterprise Content Management: A digital service for securely managing, publishing, and accessing government content that provides a document workflow, and secure electronic or digital signature

• Electronic Document Distribution: A digital service to securely send and distribute documents, minimising effort relating to printing, posting, and couriering

• e-Recruitment Service: A digitalized recruitment service for advertising and applying for government jobs, digitalizing the current Z83 form/process

• All government departments functioning remotely contributing towards realizing a virtual government

11.4

South African Post Office and South African PostbankThe South African Post Office and South African Postbank must support the efforts of the Minister of Social Development and SASSA in the implementation measures to combat the spread of COVID-19, in so far as payment of social grants is concerned

• Postbank will not be an active participant given their active involvement in BASA, SASSA and Consumer Goods Council platforms of engagement.

• Will receive in terms of implementing the directive on SASSA grants and movement of cash across the country

• SAPO and Postbank effectively supporting payment of social grants

• Industry submissions received on the Risk-adjustedstrategy, more specifically on opening up sectors forlevel 4, including mitigation measures.

• The information was used to comment on the DTICSchedule of Services.

• The Minister of COGTA issued new Regulations thatinclude the level 4 industries and activities on 29 April2020.

• Regulation 4 gives authority to Ministers to issueDirections

• Directions on the Risk-Adjusted Strategy for theCommunications and Digital Technologies Sectorissued on 3 May 2020 (Gazette 43263, GovernmentNotice 484).

Clarifications to date:• Call centres critical for the support of newspaper, broadcasting and

telecommunication infrastructure and services included in categorisation ofessential services

• Airtime classified as an essential good• Cell-phone shops may not be open• Delivery of items (subscriber equipment) is not permitted

The following essential service was inserted as par 36, Annexure B, Part B of theRegulations issued under the Disaster Management Act on 16 April 2020:

• “Information and Communication Technology services rendered to entitiesand institutions engaged in delivering essential services in terms of theseRegulations”

• Response to letters shared – MTN, Multichoice, AWS, M-Planet and Vodacom• “ICT devices (such as desktops, laptops, modems and other devices) for

education purposes are designated as essentials goods and services for thefunctionality of higher education institutions. The transport of such goodsbetween suppliers and higher education institutions and between highereducation institutions and identified individuals and institutions is declaredan essential service” (Government Notice No. R 468, Gazette 43237, 17 April

2020)

Conclusion o As we move to the next alert level, the PMO workgroups have been reconfigured as

PLACEMENT OF EMPLOYEES ON THE START-UP STRUCTURE

• The transfer and placement of employees on the start-up structure of DCDT was completed inaccordance with PSCBC Resolution 1 of 2019 and placement template agreed on with labour in theDepartmental Task Team (DTT).

• To this end, transfer letters were furnished to all employees followed by placement letters againstposts on the DCDT start –up structure on 1 April 2020.

• Eight employees could not be matched and placed as a result of duplicates and were given a list ofvacant posts in department to identify suitable posts to be placed against.
