Information supplied for the purposes of obtainingBTI will be stored on a database of the Commissionof the European Communities and may be used byCustoms authorities throughout the Community toensure uniform application of the Customs Tariff.
If you disagree with the classification given on theBTI you may apply to the Revenue Commissionersto have the decision reviewed.
BTI may be invoked only by the holder or an agentacting in the name and on behalf of the holderm akin g a custo ms e ntry in respe ct o f g oo dscovered by that BTI.
Where the holder or agent wishes to invoke BTI, itshould be declared on the Single AdministrativeDocument (SAD) to which it relates by inserting
code C626 and the BTI Reference No. in Box 44.
In addition, a copy of the BTI document should beattached to the hard copy of the SAD.
In the ordinary course, BTI will be valid for a periodo f s ix y ea rs f ro m t he da te of i ss ue . I t m ay,however, be invalidated earlier in circumstancesw her e, f or ex am pl e, i t i s aff ec ted by E U or international Customs tariff measures or by ajudge men t of the Eur ope an Cou rt of Justice.
Where the validity of BTI is affected in this way,there is provision whereby it may continue to beinvoked, for a period of up to six months, to takeaccount of binding contracts entered into by theholder and for the duration of any import or exportlicence or advance-fixing certificate. Temporaryextensions of application of BTI in such cases mustbe approved by Revenue.
A BTI wil l be treated as void if it is found that it wasprovided on the basis of inaccurate or incompletedata from the applicant.

Binding Tariff Information (BTI) is a Community-wides ys te m w hi ch p ro vi de s t ra de rs w it h t ar if f classification decisions which are legally bindingthroughout the EU.

where a BTI is invalidated due, for example, to a
change in Community legislation traders may beentitled to a period of grace in order to completeany binding contracts entered into on the basis of
that BTI,
it promotes uniform application of the rules of
classification throughout the Community for tradersregardless of the Member State in which theyoperate,

changes occur which affect their BTI.

Application for Binding Tariff Information (BTI)
General Information
Please read the following information carefully before completing your BTI application.
1. For specific guidance on the completion of this form, please see the general informationopposite.
2. BTI is issued in accordance with Council Regulation (EEC) No. 2913/92 of 12 October 1992 and
Commission Regulation (EEC) No. 2454/93 of 2 July 1993. 3. An application for BTI may only be made in respect of an import or export operation actuallyenvisaged.
4. A cannot be used for importations or exportations that have already taken place or wherecustoms formalities are still in progress.
5. A separate application must be made for each product.
6. BTI may onlybe usedby the holderor anagentacting inthename and onbehalf ofthe holder.
7. Information entered in boxes 2 and 9 of the application form will be treated as confidential andcovered by the obligation of professional secrecy.
8. BTI is provided free of charge. Where customs have incurred specific costs in analysis, obtainingexpert advice on samples or returning samples, these may be passed on.

9. You may be requested to supply a translation of any attached document into the official languageor one of the official languages of the Member State concerned.
10. In cases where the application contains incorrect or incomplete information, the BTI based onsuch indications may be annulled.
