BILL NO. 900 ORDINANCE NO. 900

AN ORDINANCE REPEALING AND REPLACING CHAPTER 76 OF THE CODE OF THE CITY OF MOSCOW MILLS, MISSOURI, REGULATING TRAFFIC AND MOTOR

VEHICLES IN ACCORDANCE WITH MISSOURI STATE LAW BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF MOSCOW MILLS, MISSOURI, AS FOLLOWS: Chapter 76 of the Code of Moscow Mills, Missouri, is hereby repealed and replaced with the following: 76.010. Definitions. As used in this chapter, the following terms shall mean: (1) "Alley" or "alleyway", any street with a roadway of less than twenty feet in width; (2) "Business district", the territory contiguous to and including a highway when within any six hundred feet along the highway there are buildings in use for business or industrial purposes, including but not limited to hotels, banks, or office buildings, railroad stations and public buildings which occupy at least three hundred feet of frontage on one side or three hundred feet collectively on both sides of the highway; (3) "Controlled access highway", every highway, street or roadway in respect to which owners or occupants of abutting lands and other persons have no legal right of access to or from the same except at such points only and in such manner as may be determined by the public authority having jurisdiction over the highway, street or roadway; (4) "Crosswalk",

(a) That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs from the edges of the traversable roadway; (b) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface;

(5) "Highway", any public thoroughfare for vehicles, including state roads, county roads and public streets, avenues, boulevards, parkways or alleys; (6) "Intersection",

(a) The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which join one

another at, or approximately at, right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict; (b) Where a highway includes two roadways thirty feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two roadways thirty feet or more apart, then every crossing of two roadways of such highways shall be regarded as a separate intersection;

(7) "Motor vehicle", any self-propelled vehicle not operated exclusively upon tracks, except farm tractors; (8) "Motorcycle", a motor vehicle operated on two wheels; (9) "Motorized bicycle", any two-wheeled or three-wheeled device having an automatic transmission and a motor with a cylinder capacity of not more than fifty cubic centimeters, which produces less than three gross brake horsepower, and is capable of propelling the device at a maximum speed of not more than thirty miles per hour on level ground; (10) "Official traffic control devices", all signs, signals, markings and devices not inconsistent with this ordinance placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic; (11) "Operator" or "driver", any person who operates or drives a motor vehicle; (12) "Park" or "parking", the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers; (13) "Pedestrian", any person afoot; (14) "Person", any natural person, corporation, or other legal entity; (15) "Police officer", every officer of the municipal police department or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations; (16) "Private road" or "driveway", every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons; (17) "Right-of-way", the entire width of land between the boundary lines of a state highway, including any roadway; (18) "Roadway", that portion of a state highway ordinarily used for vehicular travel, exclusive of the berm or shoulder;

(19) "Safety zone", the area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone; (20) "School bus", any motor vehicle used solely to transport students to or from school or to transport students to or from any place for educational purposes; (21) "Sidewalk", that portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines, intended for use of pedestrians; (22) "Stand" or "standing", the halting of a vehicle, whether occupied or not, otherwise than for the purpose of and while actually engaged in receiving or discharging passengers; (23) "Stop" or "stopping", when prohibited, any halting even momentarily of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal; (24) "Stop", when required, complete cessation from movement; (25) "Street" or "highway", the entire width between the lines of every way publicly maintained when any part thereof is open to the uses of the public for purposes of vehicular travel. "State highway", a highway maintained by the state of Missouri as a part of the state highway system; (26) "Traffic control signal", any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and to proceed; (27) "Traffic", pedestrians, ridden or herded animals, vehicles, streetcars and other conveyances either singly or together while using any highway for purposes of travel; (28) "Trailer", any vehicle without motive power designed for carrying property or passengers on its own structure and for being drawn by a self-propelled vehicle, except those running exclusively on tracks, including a semitrailer or vehicle of the trailer type so designed and used in conjunction with a self-propelled vehicle that a considerable part of its own weight rests upon and is carried by the towing vehicle. The term trailer shall not include cotton trailers as defined in this section and shall not include manufactured homes as defined in section 700.010, RSMo; (29) "Truck", a motor vehicle designed, used, or maintained for the transportation of property; (30) "Vehicle", any mechanical device on wheels, designed primarily for use, or used, on highways, except motorized bicycles, vehicles propelled or drawn by horses or human power, or vehicles used exclusively on fixed rails or tracks, cotton trailers or motorized wheelchairs operated by handicapped persons.[JG1]

TRAFFIC REGULATIONS 76.100. Speed Limits.[JG2] It shall be unlawful for any person to operate a motor vehicle within the city at a rate of speed in excess of the posted rate. The maximum speed limits are:

(1) Upon the following highways, as posted by the Missouri department of transportation:

(a) Upon US Route 61, sixty (60) miles per hour; (b) Upon Route C, thirty (30) miles per hour, increasing to thirty-five (35) miles per hour; (c) Upon Route MM, thirty (30) miles per hour, increasing to forty-five (45) miles per hour, and increasing to fifty-five (55) miles per hour; (d) Upon Route U, forty-five (45) miles per hour; (e) Upon John Deere Drive and College Campus Drive, thirty-five (35) miles per hour;

(2) Upon Elm Tree Road and Hampel Road, thirty-five (35) miles per hour; (3) Upon Tropicana Village Drive:

(a) Between US Route 61 and Industrial Court, thirty-five (35) miles per hour; (b) Between Industrial Court and Blackburn Court, twenty-five (25) miles per hour;

(4) Upon Humphrey Drive and the streets within the Moscow Meadows and Tropicana Village mobile home parks, fifteen (15) miles per hour; (5) Upon all other streets not provided for herein, twenty (20) miles per hour.

76.105. Certain Vehicles Prohibited on City Streets. When signs are erected giving notice thereof, no person shall operate a vehicle of a gross vehicle license weight rating in excess of twenty-four thousand (24,000) pounds upon any of the streets or parts of the streets so designated, except local trucks making deliveries to residents thereon of goods, including household moving trucks, and also excepting any persons who reside on the street driving a motor vehicle to and from their home in order to commute to and from work.[JG3] 76.106. Off-road vehicles. 1. As used in this section, the following terms mean:

(1) “All-terrain vehicle”, “recreational off-highway vehicle”, and “utility vehicle” as defined in section 301.010, RSMo. (2) “Off-road vehicle” is defined as any vehicle designed for or capable of cross-country travel on or immediately over land, water, ice, snow, marsh, swampland, or other natural terrain without benefit of a road or trail:

(a) Including, without limitation, the following:

a. All-terrain vehicles, recreational off-highway vehicles, and utility vehicles (which include vehicles commonly referred to as “four-wheelers,” “side-by-sides,” and “gators”); b. Off-road jeeps; dune buggies; go-carts; multi-wheel drive or low-pressure tire vehicles; vehicles using an endless belt, or tread or treads, or a combination of tread and low-pressure tires; dirt bikes, trail bikes, mini-bikes and related vehicles; and any other means of transportation deriving power from any source other than muscle or wind; and

(b) Excluding the following: Registered motorboats; aircraft; any military, fire or law enforcement vehicle; farm-type tractors and other self-propelled equipment for harvesting and transporting farm or forest products; any vehicle being used for farm purposes, earth moving, or construction while being used for such purposes on the work site; self-propelled lawnmowers, or lawn or garden tractors, or golf carts, while being used exclusively for their designed purpose; and any vehicle being used for the purpose of transporting a handicapped person short distances on city streets.

2. No person shall operate an off-road vehicle, as defined in this section, upon the streets, alleys, or sidewalks of the City, except as follows:

(1) Off-road vehicles owned and operated by a governmental entity for official use; (2) Off-road vehicles operated for agricultural purposes or industrial on-premises purposes between the official sunrise and sunset on the day of operation; and (3) Off-road vehicles operated by handicapped persons for short distances occasionally only on the city’s streets when operated between the hours of sunrise and sunset.

3. Any person operating an off-road vehicle shall maintain proof of financial responsibility in accordance with section 303.160, RSMo, or maintain any other insurance policy providing equivalent liability coverage for an off-road vehicle. 4. No person shall operate an off-road vehicle within any stream or river in this state, except that off-road vehicles may be operated within waterways which flow within the boundaries of land which an off-road vehicle operator owns, or for agricultural purposes within the boundaries of land which an off-road vehicle operator owns or has permission to be upon, or for the purpose of

fording such stream or river of this state at such road crossings as are customary or part of the highway system. 5. A person operating an off-road vehicle on a highway pursuant to an exception covered in this section shall have a valid operator's or chauffeur's license, except that a handicapped person operating such vehicle pursuant to subdivision (3) of subsection 2 of this section, but shall not be required to have passed an examination for the operation of a motorcycle, and the vehicle shall be operated at speeds of less than thirty miles per hour. 6. No persons shall operate an off-road vehicle:

(1). In any careless way so as to endanger the person or property of another; or (2). While under the influence of alcohol or any controlled substance.

7. The following restrictions apply to all-terrain vehicles:

(1) No persons shall operate an all-terrain vehicle without a securely fastened safety helmet on the head of an individual who operates an all-terrain vehicle or who is being towed or otherwise propelled by an all-terrain vehicle, unless the individual is at least eighteen years of age. (2) When operated on a roadway, an all-terrain vehicle shall have a bicycle safety flag, which extends not less than seven feet above the ground, attached to the rear of the vehicle. The bicycle safety flag shall be triangular in shape with an area of not less than thirty square inches and shall be day-glow in color.

8. The following restrictions apply to recreational off-highway vehicles:

(1) An individual shall not operate a recreational off-highway vehicle upon the streets, alleys, or sidewalks of the city without displaying a lighted headlamp and a lighted tail lamp. (2) A person may not operate a recreational off-highway vehicle upon streets, alleys, or sidewalks of the city unless such person wears a seat belt. (3) When operated on the streets, alleys, or sidewalks of the city, a recreational off-highway vehicle shall be equipped with a roll bar or roll cage construction to reduce the risk of injury to an occupant of the vehicle in case of the vehicle's rollover.

9. No operator of an off-road vehicle shall carry a passenger unless the seats of such vehicle are designed to carry more than one person.[JG4] 76.110. Slow Moving Vehicles Prohibited. 1. No person shall drive a motor vehicle at such a slow speed as to impede or block the normal and reasonable movement of traffic, except when reduced speed is necessary for

safe operation or in compliance with law. Police officers may enforce the provisions of this section by directions to drivers, and in the event of apparent willful disobedience to this provision and refusal to comply with direction of an officer in accordance herewith, the continued slow operation by a driver is unlawful. 2. No vehicle shall be operated at a speed of less than forty miles per hour on any highway which is part of the interstate system of highways, unless:

(1) A slower speed is required for the safe operation of the vehicle because of weather or other special conditions; or (2) Agricultural implements, self-propelled hay-hauling equipment, implements of husbandry and vehicles transporting such vehicles or equipment may be operated occasionally on interstate highways for short distances at a speed of less than forty miles per hour if such vehicle or equipment is operated pursuant to a special permit issued by the chief engineer of the state department of transportation pursuant to section 304.200, RSMo, and the regulations established pursuant to such section.

76.115. Careful & Prudent Driving. Every person operating a motor vehicle within the city shall drive the vehicle in a careful and prudent manner and at a rate of speed so as not to endanger the property of another or the life or limb of any person and shall exercise the highest degree of care.

76.120. Drive on Right Half of Roadway – Traffic Lanes – Signs[JG5]. 1. All vehicles not in motion shall be placed with their right side as near the right-hand side of the highway as practicable, except on streets of municipalities where vehicles are obliged to move in one direction only or parking of motor vehicles is regulated by ordinance.[JG6] 2. Upon all streets and highways of sufficient width a vehicle shall be driven upon the right half of the roadway, except as follows:

(1) When overtaking and passing another vehicle proceeding in the same direction pursuant to the rules governing such movement; (2) When placing a vehicle in position for and when such vehicle is lawfully making a left tum in compliance with other traffic regulations of the city; (3) When the right half of a street is closed to traffic while under construction or repair; (4) Upon a street designated by local ordinance as a one-way street and marked or signed for one-way traffic.

3. It is unlawful to drive any vehicle upon any street or highway which has been divided into two or more roadways by means of a physical barrier or by means of a dividing section or delineated by curbs, lines or other markings on the roadway, except to the right of such barrier or dividing section, or to make any left turn or semicircular or U-turn on any such divided street, except at an intersection or interchange or at any signed location. The provisions of this subsection shall not apply to emergency vehicles, law enforcement vehicles or to vehicles operated by a governmental entity for official use.[JG7] 4. The city may erect signs temporarily designating lanes to be used by traffic moving in a particular direction, regardless of the center line of the street, and police officers may direct traffic in conformance with such signs. When authorized signs have been erected designating off-center traffic lanes, no person shall disobey the instructions given by such signs. 5. Whenever any street or highway has been divided into three or more clearly marked lanes for traffic, the following rules in addition to all others consistent herewith shall apply:

(1) A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety; (2) Upon a street or highway which is divided into three lanes a vehicle shall not be driven in the center lane, except when overtaking and passing another vehicle where the street ahead is clearly visible and such center lane is clear of traffic within a safe distance, or in preparation for a left turn or where such center lane is at the time allocated exclusively to traffic moving in the direction the vehicle is proceeding and is sign-posted to give notice of such allocation; (3) Upon all streets and highways, any vehicle proceeding at less than the normal speed of traffic thereon shall be driven in the right-hand lane for traffic or as close as practicable to the right-hand edge or curb; (4) Official signs may be erected directing slow-moving traffic to use a designated lane or allocating specified lanes to traffic moving in the same direction and drivers of vehicles shall obey the directions of every such sign. (5) Drivers of vehicles proceeding in opposite directions shall pass each other to the right, and except when a street has been divided into traffic lanes, each driver shall give to the other at least one-half of the main traveled portion of the roadway whenever possible.

6. All vehicles in motion upon a street or highway having two or more lanes of traffic

proceeding in the same direction shall be driven in the right-hand lane except when overtaking and passing another vehicle or when preparing to make a proper left turn or when otherwise directed by traffic markings, signs or signals. 76.125. Passing Rules. 1. The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction, subject to the limitations and exceptions hereinafter stated:

(1) The driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle; and (2) Except when overtaking and passing on the right is permitted; the driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle and shall not increase the speed of such driver’s vehicle until completely passed by the overtaking vehicle.

2. The driver of a motor vehicle may overtake and pass to the right of another vehicle only under the following conditions:

(1) When the vehicle overtaken is making or about to make a left turn; (2) Upon a city street with unobstructed pavement of sufficient width for two or more lines of vehicles in each direction; (3) Upon a one-way street. (4) Upon any highway outside of a city with unobstructed pavement of sufficient width and clearly marked for four or more lines of traffic. The driver of a motor vehicle may overtake and pass another vehicle upon the right only under the foregoing conditions when such movement may be made in safety. In no event shall such movement be made by driving off the paved or main traveled portion of the roadway. The provisions of this subsection shall not relieve the driver of a slow-moving vehicle from the duty to drive as closely as practicable to the right-hand edge of the roadway.[JG8]

3. Except when a street or highway has been divided into three traffic lanes, no vehicle shall be driven to the left side of the center line of a roadway in overtaking and passing another vehicle proceeding in the same direction unless such left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit such overtaking and passing to be completely made without interfering with the safe operation of any vehicle approaching from the opposite direction or any vehicle overtaken. 4. No vehicle shall at any time be driven to the left side of a street or highway under the

following conditions:

(1) When approaching the crest of a grade or upon a curve of the roadway where the driver’s view is obstructed within such distance as to create a hazard in the event another vehicle might approach from the opposite direction; (2) When the view is obstructed upon approaching within one hundred feet of any bridge, viaduct, tunnel or when approaching within one hundred feet of or at any intersection or railroad grade crossing.

76.130. Following Too Close Prohibited.

1. The driver of a vehicle shall not follow another vehicle more closely than is reasonably safe and prudent, having due regard for the speed of such vehicle and the traffic upon and the condition of the roadway.

2. The driver of any non-emergency vehicle shall not follow any emergency vehicle traveling in response to an emergency call closer than five hundred feet. 76.135. Dimming Lights. Every person driving a motor vehicle equipped with multiple-beam road lighting equipment, during the times when lighted lamps are required, shall use a distribution of light, or composite beam, directed high enough and of sufficient intensity to reveal persons and vehicles at a safe distance in advance of the vehicle, subject to the following requirements and limitations: Whenever the driver of a vehicle approaches an oncoming vehicle within five hundred feet, or is within three hundred feet to the rear of another vehicle traveling in the same direction, the driver shall use a distribution of light or composite beam so aimed that the glaring rays are not projected into the eyes of the other driver, and in no case shall the high-intensity portion which is projected to the left of the prolongation of the extreme left side of the vehicle be aimed higher than the center of the lamp from which it comes at a distance of twenty-five feet ahead, and in no case higher than a level of forty-two inches above the level upon which the vehicle stands at a distance of seventy-five feet ahead. 76.140. Signals for Turning, Slowing, and Stopping. 1. No person shall stop or suddenly decrease the speed of or turn a vehicle from a direct course or move right or left upon a roadway unless and until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided herein.

(1) An operator or driver when stopping, or when checking the speed of the operator’s vehicle, if the movement of other vehicles may reasonably be affected by such checking of speed, shall extend such operator's arm at an angle below horizontal so that the same may be seen in the rear of the vehicle;

(2) An operator or driver intending to tum the operator’s vehicle to the right shall extend such operator’s arm at an angle above horizontal so that the same may be seen in front of and in the rear of the vehicle, and shall slow down and approach the intersecting street or highway as near as practicable to the right side of the street or highway along which such operator is proceeding before turning; (3) An operator or driver intending to turn the operator’s vehicle to the left shall extend such operator’s arm in a horizontal position so that the same may be seen in the rear of the vehicle, and shall slow down and approach the intersecting street or highway so that the left side of the vehicle shall be as near as practicable to the center line of the street or highway along which the operator is proceeding before turning. (4) The signals herein required shall be given either by means of the hand and arm or by a signal light or signal device in good mechanical condition of a type approved by the state highway patrol; however, when a vehicle is so constructed or loaded that a hand and arm signal would not be visible both to the front and rear of such vehicle then such signals shall be given by such light or device. A vehicle shall be considered as so constructed or loaded that a hand and arm signal would not be visible both to the front and rear when the distance from the center of the top of the steering post to the left outside limit of the body, cab or load exceeds twenty-four inches, or when the distance from the center of the top of the steering post to the rear limit of the body or load thereon exceeds fourteen feet, which limit of fourteen feet shall apply to single vehicles or combinations of vehicles. The provisions of this subdivision shall not apply to any trailer which does not interfere with a clear view of the hand signals of the operator or of the signaling device upon the vehicle pulling such trailer; provided further that the provisions of this section as far as mechanical devices on vehicles so constructed that a hand and arm signal would not be visible both to the front and rear of such vehicle as above provided shall only be applicable to new vehicles registered within this state after the first day of January, 1954.

76.145. Yield to Emergency Vehicles. 1. Upon the immediate approach of an emergency vehicle giving audible signal by siren or while having at least one lighted lamp exhibiting red light visible under normal atmospheric conditions from a distance of five hundred feet to the front of such vehicle or a flashing blue light authorized by section 307.175, RSMo, the driver of every other vehicle shall yield the right-of-way and shall immediately drive to a position parallel to, and as far as possible to the right of, the traveled portion of the street or highway and thereupon stop and remain in such position until such emergency vehicle has passed, except when otherwise directed by a police officer. 2. Upon approaching a stationary vehicle displaying lighted red or red and blue lights, or a stationary vehicle displaying lighted amber or amber and white lights, the driver of every motor vehicle shall:

(1) Proceed with caution and yield the right-of-way, if possible with due regard to safety and traffic conditions, by making a lane change into a lane not adjacent to that of the stationary vehicle, if on a roadway having at least four lanes with not less than two lanes proceeding in the same direction as the approaching vehicle; or (2) Proceed with due caution and reduce the speed of the vehicle, maintaining a safe speed for road conditions, if changing lanes would be unsafe or impossible.

3. An “emergency vehicle” is a vehicle of any of the following types:

(1) A vehicle operated by the state highway patrol, the state water patrol, the Missouri capitol police, a conservation agent, or a state park ranger, those vehicles operated by enforcement personnel of the state highways and transportation commission, police or fire department, sheriff, constable or deputy sheriff, federal law enforcement officer authorized to carry firearms and to make arrests for violations of the laws of the United States, traffic officer or coroner or by a privately owned emergency vehicle company; (2) A vehicle operated as an ambulance or operated commercially for the purpose of transporting emergency medical supplies or organs; (3) Any vehicle qualifying as an emergency vehicle pursuant to section 307.175, RSMo; (4) Any wrecker, or tow truck or a vehicle owned and operated by a public utility or public service corporation while performing emergency service; (5) Any vehicle transporting equipment designed to extricate human beings from the wreckage of a motor vehicle; (6) Any vehicle designated to perform emergency functions for a civil defense or emergency management agency established pursuant to the provisions of Chapter 44 of the Missouri Revised Statutes; (7) Any vehicle operated by an authorized employee of the department of corrections who, as part of the employee’s official duties, is responding to a riot, disturbance, hostage incident, escape or other critical situation where there is the threat of serious physical injury or death, responding to mutual aid call from another criminal justice agency, or in accompanying an ambulance which is transporting an offender to a medical facility; (8) Any vehicle designated to perform hazardous substance emergency functions established pursuant to the provisions of sections 260.500 to 260.550, RSMo; (9) Any vehicle owned by the state highways and transportation commission and operated by an authorized employee of the department of transportation that is

marked as a department of transportation emergency response or motorist assistance vehicle; or (10) Any vehicle owned and operated by the civil support team of the Missouri National Guard while in response to or during operations involving chemical, biological, or radioactive materials or in support of official requests from the state of Missouri involving unknown substances, hazardous materials, or as may be requested by the appropriate state agency acting on behalf of the governor.

4. The driver of any vehicle referred to in subsection 3 of this section shall not sound the siren thereon or have the front red lights or blue lights on except when such vehicle is responding to an emergency call or when in pursuit of an actual or suspected law violator, or when responding to, but not upon returning from, a fire.[JG9] 76.150. Turning at Intersections.

1. The driver of a vehicle intending to turn at an intersection shall do so as follows:

(1) Right turns. – Both the approach for a right tum and a right tum shall be made as close as practicable to the right-hand curb or edge of the roadway. (2) Left turns. – The driver of a vehicle intending to tum left at any intersection shall approach the intersection in the extreme left-hand lane lawfully available to the traffic moving in the direction of travel of such vehicle and, after entering the intersection, the left tum shall be made so as to leave the intersection in a lane lawfully available to traffic moving in such direction upon the roadway being entered. (3) Official traffic-control devices may be placed within or adjacent to intersections and thereby require and direct that a different course from that specified in this section be traveled by vehicles turning at an intersection, and when such devices are so placed no driver of a vehicle shall tum a vehicle at any intersection other than as directed and required by such devices.

2. It shall be unlawful for the driver of any vehicle to tum such vehicle so as to proceed in the opposite direction at any intersection controlled by a traffic signal or police officer; nor shall such turn be made at any place unless the movement can be made in safety and without interfering with other traffic. The driver of a vehicle shall not tum such vehicle around so as to proceed in the opposite direction upon any curve or upon the approach to or near the crest of a grade, or at any place upon a roadway where such vehicle cannot be seen by the driver of any other vehicle approaching from either direction along the roadway within a distance of three hundred feet, or where the same may create a traffic hazard.

76.155. Right-of-Way at Intersections, 1. The driver of a vehicle approaching an intersection shall yield the right-of-way to a vehicle which has entered the intersection from a different street or highway, provided, however, there is no form of traffic control at such intersection. 2. When two vehicles enter an intersection from different streets or highways at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the driver of the vehicle on the right. This subsection shall not apply to vehicles approaching each other from opposite directions when the driver of one of such vehicles is attempting to or is making a left turn. 3. The driver of a vehicle within an intersection intending to turn to the left shall yield the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard. 4. Except when directed to proceed by a police officer or traffic-control signal, every driver of a vehicle approaching a stop intersection, indicated by a stop sign, shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic in the intersecting roadway before entering the intersection. After having stopped, the driver shall yield the right-of-way to any vehicle which has entered the intersection from another roadway or which is approaching so closely on the roadway as to constitute an immediate hazard during the time when such driver is moving across or within the intersection. 5. The driver of a vehicle approaching a yield sign shall in obedience to the sign slow down to a speed reasonable to the existing conditions and, if required for safety to stop, shall stop at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway. After slowing or stopping the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another highway so closely as to constitute an immediate hazard during the time such traffic is moving across or within the intersection. 6. The driver of a vehicle about to enter or cross a street or highway from an alley, parking lot, or any private road or driveway shall yield the right-of-way to all vehicles approaching on the highway to be entered. 7. The driver of a vehicle intending to make a left tum into an alley, parking lot, private road or driveway shall yield the right-of-way to any vehicle approaching from the opposite direction when the making of such left turn would create a traffic hazard. 76.160. Passengers in the Unenclosed Bed of Truck Prohibited.

1. No person shall operate any truck within the limits of the city when any person[JG10] is riding in the unenclosed bed of such truck. No person under eighteen years of age shall ride in the unenclosed bed of such truck when the truck is in operation within the city limits. 2. The provisions of this section shall not apply to:

(1) The operation of a truck solely on privately-owned property. (2) An employee engaged in the necessary discharge of the employee’s duties where it is necessary to ride in the unenclosed bed of the truck; (3) Any person while engaged in agricultural activities where it is necessary to ride in the unenclosed bed of the truck; (4) Any person riding in the unenclosed bed of a truck while such truck is being operated in a parade, caravan or exhibition which is authorized by law; (5) Any person riding in the unenclosed bed of a truck if such truck has installed a means of preventing such person from being discharged or such person is secured to the truck in a manner which will prevent the person from being thrown, falling, or jumping from the truck; (6) Any person riding in the unenclosed bed of a truck if such truck is being operated solely for the purposes of participating in a special event and it is necessary that the person ride in such unenclosed bed due to a lack of available seating. “Special event”, for the purposes of this section, is a specific social activity of a definable duration which is participated in by the person riding in the unenclosed bed; (7) Any person riding in the unenclosed bed of a truck if such truck is being operated solely for the purposes of providing assistance to, or ensuring the safety of, other persons engaged in a recreational activity; or (8) Any person riding in the unenclosed bed of a truck if such truck is the only legally titled, licensed and insured vehicle owned by the family of the person riding in the unenclosed bed and there is insufficient room in the passenger cab of the truck to accommodate all passengers in such truck. For purposes of this subsection, the term “family” shall mean any persons related within first degree of consanguinity.

No person shall ride on any part of a motor vehicle while the same is in motion, except on the seats that are provided for that purpose. Riding on a fender, running board, or any other part of a motor vehicle while the same is in motion, or riding with any part of the body protruding beyond the limits of the vehicle is prohibited. 76.170. Cell Phones and Texting Restrictions.

1. Except as otherwise provided in this section, no person twenty-one years of age or younger operating a moving motor vehicle within the city shall by means of a hand-held electronic wireless communications device, send, read, or write a text message or electronic message. 2. Except as otherwise provided in this section, no person shall operate a commercial motor vehicle while using a hand-held mobile telephone. 3. Except as otherwise provided in this section, no person shall operate a commercial motor vehicle while using a wireless communications device to send, read, or write a text message or electronic message. 4. The provisions of subsection 1 through subsection 3 of this section shall not apply to a person operating:

(1) An authorized emergency vehicle; or (2) A moving motor vehicle while using a hand-held electronic wireless communications device to:

(a) Report illegal activity; (b) Summon medical or other emergency help; (c) Prevent injury to a person or property; or (d) Relay information between a transit or for-hire operator and that operator’s dispatcher, in which the device is permanently affixed to the vehicle.

5. Nothing in this section shall be construed or interpreted as prohibiting a person from making or taking part in a telephone call, by means of a hand-held electronic wireless communications device, while operating a noncommercial motor vehicle upon the highways of this state. 6. As used in this section, “electronic message” means a self-contained piece of digital communication that is designed or intended to be transmitted between hand- held electronic wireless communication devices. “Electronic message” includes, but is not limited to, electronic mail, a text message, an instant message, or a command or request to access an internet site.

7. As used in this section, “hand-held electronic wireless communications device” includes any hand-held cellular phone, palm pilot, blackberry, or other mobile electronic device used to communicate verbally or by text or electronic messaging, but shall not apply to any device that is permanently embedded into the architecture and design of the motor vehicle. 8. As used in this section, “making or taking part in a telephone call” means listening to or engaging in verbal communication through a hand-held electronic wireless communication device. 9. As used in this section, “send, read, or write a text message or electronic message” means using a hand-held electronic wireless telecommunications device to manually communicate with any person by using an electronic message. Sending, reading, or writing a text message or electronic message does not include reading, selecting, or entering a phone number or name into a hand-held electronic wireless communications device for the purpose of making a telephone call. 10. The provisions of this section shall not apply to:

(1) The operator of a vehicle that is lawfully parked or stopped; (2) Any of the following while in the performance of their official duties: a law enforcement officer; a member of a fire department; or the operator of a public or private ambulance; (3) The use of factory-installed or aftermarket global positioning systems (GPS) or wireless communications devices used to transmit or receive data as part of a digital dispatch system; (4) The use of voice-operated technology; (5) The use of two-way radio transmitters or receivers by a licensee of the Federal Communications Commission in the Amateur Radio Service.

76.175. Stopping for School Buses. 1. The driver of a vehicle upon a street or highway upon meeting or overtaking from either direction any school bus which has stopped on the roadway for the purpose of receiving or discharging any school children and whose driver has in the manner prescribed by law given the signal to stop, shall stop the vehicle before reaching such school bus and shall not proceed until such school bus resumes motion, or until signaled by its driver to proceed. 2. The driver of a vehicle upon a street or highway with separated roadways need not stop upon meeting or overtaking a school bus which is on a different roadway, or which is proceeding in the opposite direction on a highway containing four or more lanes of traffic,

or which is stopped in a loading zone constituting a part of, or adjacent to, a limited or controlled access highway at a point where pedestrians are not permitted to cross the roadway. 3. The driver of any school bus driving upon the highways of this state after loading or unloading school children, shall remain stopped if the bus is followed by three or more vehicles, until such vehicles have been permitted to pass the school bus, if the conditions prevailing make it safe to do so. 4. If any vehicle is witnessed by a police officer or the driver of a school bus to have violated the provisions of this section and the identity of the operator is not otherwise apparent, it shall be a rebuttable presumption that the person in whose name such vehicle is registered committed the violation. In the event that charges are filed against multiple owners of a motor vehicle, only one of the owners may be convicted and court costs may be assessed against only one of the owners. If the vehicle which is involved in the violation is registered in the name of a rental or leasing company and the vehicle is rented or leased to another person at the time of the violation, the rental or leasing company may rebut the presumption by providing the police officer or prosecuting authority with a copy of the rental or lease agreement in effect at the time of the violation. No prosecuting authority may bring any legal proceedings against a rental or leasing company under this section unless prior written notice of the violation has been given to that rental or leasing company by registered mail at the address appearing on the registration and the rental or leasing company has failed to provide the rental or lease agreement copy within fifteen days of receipt of such notice. 76.180. Funeral Processions. 1. Definitions:

(1) “Funeral director”, a person licensed as a funeral director pursuant to the provisions of Chapter 333, RSMo. (2) “Funeral lead vehicle” or “lead vehicle”, any motor vehicle equipped with at least one lighted circulating lamp exhibiting an amber or purple light or lens or alternating flashing headlamps visible under normal atmospheric conditions for a distance of five hundred feet from the front of the vehicle. A hearse or coach properly equipped may be a lead vehicle. (3) “Organized funeral procession”, two or more vehicles accompanying the remains of a deceased person from a funeral establishment, church, synagogue or other place where a funeral service has taken place to a cemetery, crematory or other place of final disposition, or a funeral establishment, church, synagogue or other place where additional funeral services will be performed, if directed by a licensed funeral director from a licensed establishment.

(1) Except as otherwise provided for in this subsection, pedestrians and operators of all other vehicles shall yield the right-of-way to any vehicle which is a part of an organized funeral procession. (2) Notwithstanding any traffic control device or right-of-way provision prescribed by state or local law, when the funeral lead vehicle in an organized funeral procession lawfully enters an intersection, all vehicles in the procession shall follow the lead vehicle through the intersection. The operator of each vehicle in the procession shall exercise the highest degree of care toward any other vehicle or pedestrian on the roadway. (3) An organized funeral procession shall have the right-of-way at all intersections regardless of any traffic control device at such intersections, except that operators of vehicles in an organized funeral procession shall yield the right-of-way to any approaching emergency vehicle pursuant to the provisions of section 304.022, RSMo, or when directed to do so by a law enforcement officer.

3. Participants:

(1) All vehicles in an organized funeral procession shall follow the preceding vehicle in the procession as closely as is practical and safe under the conditions. (2) No person shall operate any vehicle as part of an organized funeral procession without the flashing emergency lights of such vehicle being lighted.

4. Non-participants:

(1) Any person who is not an operator of a vehicle in an organized funeral procession shall not:

(a) Drive between the vehicles comprising an organized funeral procession while such vehicles are in motion and have the flashing emergency lights lighted, except when required to do so by a law enforcement officer or when such person is operating an emergency vehicle giving an audible or visual signal; (b) Join a funeral procession for the purpose of securing the right-of-way granted in this section; or (c) Attempt to pass any vehicle in an organized funeral procession, except where a passing lane has been specifically provided.

(2) When an organized funeral procession is proceeding through a red signal light as permitted in this, a vehicle not in the organized funeral procession shall not enter the

intersection unless such vehicle may do so without crossing the path of the funeral procession.

76.181. Observance of traffic-control devices.[JG11] 1. The driver of any vehicle shall obey the instructions of any official traffic-control device applicable thereto placed in accordance with the provisions of the law, unless otherwise directed by a traffic or police officer, subject to the exceptions granted the driver of an authorized emergency vehicle in the law. 2. No provision of the law for which official traffic-control devices are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official device is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not state that official traffic-control devices are required, such section shall be effective even though no devices are erected or in place. 3. Whenever official traffic-control devices are placed in position approximately conforming to the requirements of the law, such devices shall be presumed to have been so placed by the official act or direction of lawful authority, unless the contrary shall be established by competent evidence. 4. Any official traffic-control device placed pursuant to the provisions of the law and purporting to conform to the lawful requirements pertaining to such devices shall be presumed to comply with the requirements of this chapter, unless the contrary shall be established by competent evidence. 76.182. Rules for traffic where controlled by light signals — right turn on red light, when.[JG12] 1. Whenever traffic is controlled by traffic control signals exhibiting different colored lights, or colored lighted arrows, successively one at a time or in combination, only the colors green, red and yellow shall be used, except for special pedestrian signals carrying a word legend, and said lights shall indicate and apply to drivers of vehicles and pedestrians as follows:

(1) Green indication

(a) Vehicular traffic facing a circular green signal may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic, including vehicles turning right or left, shall yield the right-of-way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited;

(b) Vehicular traffic facing a green arrow signal, shown alone or in combination with another indication, may cautiously enter the intersection only to make the movement indicated by such arrow, or such other movement as is permitted by other indications shown at the same time. Such vehicular traffic shall yield the right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection; (c) Unless otherwise directed by a pedestrian control signal, pedestrians facing any green signal, except when the sole green signal is a turn arrow, may proceed across the roadway within any marked or unmarked crosswalk.

(2) Steady yellow indication

(a) Vehicular traffic facing a steady yellow signal is thereby warned that the related green movement is being terminated or that a red indication will be exhibited immediately thereafter when vehicular traffic shall not enter the intersection; (b) Pedestrians facing a steady yellow signal, unless otherwise directed by a pedestrian control signal, are thereby advised that there is insufficient time to cross the roadway before a red indication is shown and no pedestrian shall then start to cross the roadway.

(3) Steady red indication

(a) Vehicular traffic facing a steady red signal alone shall stop before entering the crosswalk on the near side of the intersection at a clearly marked stop line but, if none, then before entering the intersection and shall remain standing until an indication to proceed is shown except as provided in paragraph (b); (b) The driver of a vehicle which is stopped as close as practicable at the entrance to the crosswalk on the near side of the intersection or, if none, then at the entrance to the intersection in obedience to a red signal, may cautiously enter the intersection to make a right turn but shall yield the right-of-way to pedestrians and other traffic proceeding as directed by the signal at the intersection, except that the state highways and transportation commission with reference to an intersection involving a state highway, and local authorities with reference to an intersection involving other highways under their jurisdiction, may prohibit any such right turn against a red signal at any intersection where safety conditions so require, said prohibition shall be effective when a sign is erected at such intersection giving notice thereof; (c) Unless otherwise directed by a pedestrian control signal, pedestrians facing a steady red signal alone shall not enter the roadway.

(4) In the event an official traffic control signal is erected and maintained at a place other than an intersection, the provision of this section shall be applicable except as to those

provisions which by their nature can have no application. Any stop required shall be made at a sign or marking on the pavement indicating where the stop shall be made, but in the absence of any such sign or marking the stop shall be made at the signal.

76.183. Rules for pedestrians controlled by special signs.[JG13] Whenever special pedestrian-control signals exhibiting the words "Walk" or "Don't Walk" are in place such signals shall indicate as follows:

(1) Walk. Pedestrians facing such signal may proceed across the roadway in the direction of the signal and shall be given the right-of-way by the drivers of all vehicles. (2) Don't Walk. No pedestrian shall start to cross the roadway in the direction of such signal, but any pedestrian who has partially completed his crossing on the "walk" signal shall proceed to a sidewalk or safety island while the "don't walk" signal is showing.

76.184. Rules for vehicular traffic controlled by flashing signals. 1. Whenever an illuminated flashing red or yellow signal is used in a traffic sign or signal it shall require obedience by vehicular traffic as follows:

(1) Flashing red (stop signal). When a red lens is illuminated with rapid intermittent flashes, drivers of vehicles shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign; (2) Flashing yellow (caution signal). When a yellow lens is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection or pass such signal only with caution.[JG14]

76.185. Alteration or removal of traffic-control devices prohibited.[JG15] No person shall, without lawful authority, attempt to or in fact alter, deface, injure, knock down or remove any official traffic-control device or any railroad sign or signal or any inscription, shield or insignia thereon, or any other part thereof. 76.186. Fines for moving violations — fines for violations in work or construction zones — signs required for assessing fines — penalty for passing in work or construction zones.[JG16] 1. Upon conviction or plea of guilty by any person for a moving violation as defined in section 302.010, RSMo, or any offense listed in section 302.302, RSMo, the court shall assess a fine of

thirty-five dollars in addition to any other fine authorized to be imposed by law, if the offense occurred within a construction zone or a work zone.[JG17] 2. Upon conviction or plea of guilty by any person for a speeding violation under section 76.100, or a passing violation under subsection 4 of this section, the court shall assess a fine of two hundred fifty dollars in addition to any other fine authorized by law if the offense occurred within a construction zone or a work zone and at the time the speeding or passing violation occurred there was any highway worker in such zone.[JG18] However, no person assessed an additional fine under this subsection shall also be assessed an additional fine under subsection 1 of this section, and no person shall be assessed an additional fine under this subsection if no signs have been posted under subsection 3 of this section. 3. The penalty authorized by subsection 2 of this section shall only be assessed by the court if [JG19]there have been erected signs upon or around a construction zone or work zone which are clearly visible from the highway and which state substantially the following message: "Warning: Minimum $250 fine for speeding or passing in this work zone when workers are present." 4. The driver of a motor vehicle may not overtake or pass another motor vehicle within a work zone or construction zone as provided in this subsection.

(1) This subsection applies to a construction zone or work zone located upon a highway divided into two or more marked lanes for traffic moving in the same direction and for which motor vehicles are instructed to merge from one lane into another lane and not pass by appropriate signs or traffic control devices erected[JG20]. (2) This subsection also prohibits the operator of a motor vehicle from passing or attempting to pass another motor vehicle in a work zone or construction zone located upon a two-lane highway when highway workers or equipment are working and when appropriate signs or traffic control devices have been erected[JG21].

5. As used in this section, the term "construction zone" or "work zone" means any area upon or around any highway, which is visibly marked as an area where construction, maintenance, incident removal, or other work is temporarily occurring. The term "work zone" or "construction zone" also includes the lanes of highway leading up to the area upon which an activity described in this subsection is being performed, beginning at the point where appropriate signs or traffic control devices are posted or placed. The terms "worker" or "highway worker" as used this section shall mean any person who is working in a construction zone or work zone on a highway or the right-of-way of a highway, any employee of the state department of transportation who is performing duties under the department's motorist assist program on a highway or the right-of-way of a highway, or any utility worker performing utility work on a highway or the right-of-way of a highway.[JG22]

76.187. Distance to be maintained when overtaking a bicycle. The operator of a motor vehicle overtaking a bicycle proceeding in the same direction on the roadway shall leave a safe distance when passing the bicycle, and shall maintain clearance until safely past the overtaken bicycle.[JG23] 76.188. Limitations on backing. The driver of a vehicle shall not back the same unless such movement can be made with reasonable safety and without interfering with other traffic.[JG24] 76.189. Controlled access. No person shall drive a vehicle onto or from any controlled access roadway except at such entrances and exits as are established by public authority.[JG25] 76.190. Parades and processions. No procession or parade, except the forces of the United States Army or Navy, the military forces of this state and the forces of the police and fire departments, shall occupy, march or proceed along any street except in accordance with a permit issued by the chief of police and such other regulations as are set forth herein which may apply.[JG26] 76.191. Cutting Corners Prohibited. No driver shall operate a motor vehicle on any private road or driveway, parking lot or any area which is not a highway, road or street as defined herein, for the purpose of avoiding travel upon the right-of-way between one highway, road or street and the same or another highway, road or street. This violation may be referred to as "cutting a corner."[JG27]

PEDESTRIANS’ RIGHTS AND DUTIES 76.192. Pedestrians' right-of-way in crosswalks. 1. When traffic control signals are not in place or not in operation the driver of a vehicle shall yield the right-of-way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger. 2. No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield.

3. Subsection 1 shall not apply under the conditions stated in subsection 2 of section 76.195. 4. Whenever any vehicle is stopped at a marked crosswalk or at any unmarked crosswalk at an intersection to permit a pedestrian to cross the roadway, the driver of any other vehicle approaching from the rear shall not overtake and pass such stopped vehicle.[JG28] 76.193. Pedestrians to use right half of crosswalks. Pedestrians shall move, whenever practicable, upon the right half of crosswalks.[JG29] 76.194. Crossing at right angles. No pedestrian shall cross a roadway at any place other than by a route at right angles to the curb or by the shortest route to the opposite curb except in a crosswalk.[JG30] 76.195. When pedestrian shall yield. 1. Every pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway. 2. Any pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the right-of-way to all vehicles upon the roadway. 3. The foregoing rules in this section have no application under the conditions stated in section 76.196 when pedestrians are prohibited from crossing at certain designated places.[JG31] 76.196. Prohibited crossing. 1. Between adjacent intersections at which traffic control signals are in operation, pedestrians shall not cross at any place except in a crosswalk. 2. No pedestrian shall cross a roadway other than in a crosswalk in any business district. 3. No pedestrian shall cross a roadway other than in a crosswalk upon any street designated by ordinance. 4. No pedestrian shall cross a roadway intersection diagonally unless authorized by official traffic control devices; and, when authorized to cross diagonally, pedestrians shall cross only in accordance with the official traffic control devices pertaining to such crossing movements.[JG32]

76.197. Pedestrians walking along roadways. 1. Where sidewalks are provided it shall be unlawful for any pedestrian to walk along and upon an adjacent roadway. 2. Where sidewalks are not provided any pedestrian walking along and upon a highway shall when practicable walk only on the left side of the roadway or its shoulder facing traffic which may approach from the opposite direction.[JG33]

PARKING 76.200. Limits on Parking for Certain Vehicles. The following types of vehicles shall not be parked, stopped, or left standing on the city streets, alleys, easements, or rights-of-way any longer than necessary for occasional loading and unloading. In no case shall any such vehicle be parked longer than two hours on a city street, alley, easement, or right-of-way: Vehicles requiring what is commonly called a “commercial license” under the laws of the State of Missouri, vehicles licensed over twenty four thousand pounds (24,000 pounds) under the laws of the State of Missouri, semi-tractor trailer trucks, construction motor vehicles, delivery panel-type trucks, dump trucks or other open-fender motor vehicles, campers, recreational vehicles, boats or trailers of any kind. 76.205. Disabled Parking Spaces.

1. Designated disabled parking spaces may only be used when a disabled person, who has been issued disabled license plates or windshield hanging placards pursuant to the provisions of section 301.142, RSMo or by those states with which Missouri has entered into reciprocity agreements as provided in section 301.142, RSMo, is then, or immediately preceding being parked, was an occupant of the motor vehicle bearing the disabled license plate or windshield hanging placard or in cases where the motor vehicle bearing the disabled license plates or windshield hanging placard is then being used to deliver or collect one or more of the disabled persons for whom the disabled license plates or windshield hanging placard was issued. 2. The driver, or any occupant, of a motor vehicle bearing disabled license plates or a windshield hanging placard which is parked or has been observed to have been parking in a duly designated disabled parking space shall, upon request from any law enforcement officer or other duly constituted peace officer upon identification as such, produce the disabled registration certificate issued to the disabled person or entity as provided for in section 301.142, RSMo, or such other authorization to show that the driver or any occupant of the vehicle is lawfully entitled to use a designated disabled parking space. The driver or any occupant of the motor vehicle shall, in addition to the certificate, produce other identification with a photograph of the disabled person for whom the disabled plates or windshield hanging placard was issued. 3. If the driver, or an occupant, of a motor vehicle which is parked or has been observed to

have parked in a designated disabled parking space is unable to, or cannot, produce the certificate as provided for in section 301.142, RSMo, or other proper authorization showing that the vehicle is being used, or has been lawfully parking in a disabled parking space, the operator is guilty of an ordinance violation. However, no person shall be found guilty of violating this section if the operator produces such a certificate to the court that was valid at the time of the citation for a person who was using the vehicle. 4.The windshield hanging placard shall only be used when the vehicle is parked in a disabled parking space. It shall be unlawful for any person to operate or drive a motor vehicle with a windshield hanging placard hanging for the inside rearview mirror. 76.210. Stopping, standing or parking prohibited. 1. Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic control device, no person shall:

(1) Stop, stand or park a vehicle:

(a) On the roadway side of any vehicle stopped or parked at the edge or curb of a street; (b) On a sidewalk; (c) Within an intersection; (d) On a crosswalk; (e) Between a safety zone and the adjacent curb or within thirty feet of points on the curb immediately opposite the ends of a safety zone, unless the (traffic authority) indicates a different length by signs or markings; (f) Alongside or opposite any street excavation or obstruction when stopping, standing, or parking would obstruct traffic; (g) Upon any bridge or other elevated structure upon a highway or within a highway tunnel; (h) On any railroad tracks; (i) At any place where official signs prohibit stopping.

(2) Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers:

(a) In front of a public or private driveway; (b) Within fifteen feet of a fire hydrant;

(c) Within twenty feet of a crosswalk at an intersection; (d) Within thirty feet upon the approach to any flashing signal, stop sign, or traffic control signal located at the side of a roadway; (e) Within twenty feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within seventy-five feet of said entrance (when properly signposted); (f) At any place where official signs prohibit standing.

(3) Park a vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers:

(a) Within fifty feet of the nearest rail of a railroad crossing; (b) At any place where official signs prohibit parking.

2. No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such a distance as is unlawful. 76.215. Parking near emergency vehicles prohibited. The driver of any non-emergency vehicle drive into or park such vehicle within the block where fire apparatus has stopped in answer to a fire alarm or otherwise park to interfere with emergency operations. 76.220. Standing or parking close to curb. Except as otherwise provided herein, every vehicle stopped or parked upon a roadway where there are adjacent curbs shall be so stopped or parked with the right-hand wheels of such vehicle parallel to and within eighteen inches of the right-hand curb. 76.225. Parking not to obstruct traffic. No person shall park any vehicle upon a street, other than an alley, in such a manner or under such conditions as to leave available less than ten feet of the width of the roadway for free movement of vehicular traffic. 76.230. Parking in alleys. No person shall park a vehicle within an alley in such a manner or under such conditions as to leave available less than ten feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand, or park a vehicle within an alley in such position as to block the driveway entrance to any abutting property.

76.235. Parking for certain purposes prohibited. No person shall park a vehicle upon any roadway for the principal purpose of:

(1) Displaying such vehicle for sale; or (2) Repair such vehicle except repairs necessitated by an emergency.

76.240. Standing or parking on one-way roadways. In the event a highway includes two or more separate roadways and traffic is restricted to one direction upon any such roadway, no person shall stand or park a vehicle upon the left-hand side of such one-way roadway unless signs are erected to permit such standing or parking. The city is authorized to determine when standing or parking may be permitted upon the left-hand side of any such one-way roadway and to erect signs giving notice thereof.[JG34] 76.245. Opening and closing vehicle doors. No person shall open the door of a motor vehicle on the side available to moving traffic unless and until it is reasonably safe to do so, nor shall any person leave a door open on the side of a motor vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers.[JG35] 76.250. Exemptions for certain vehicles. The provisions of sections 76.200 to 76.245 governing the stopping, standing, or parking of vehicles shall not apply to law enforcement vehicles or vehicles operated by a governmental entity while on official business. The foregoing exemption shall not protect the driver of any vehicle from the consequences of his willful disregard of the safety of others.[JG36]

SAFETY AND EQUIPMENT REQUIREMENTS

76.305. Seat Belts Required. 1. As used in this section, the term “passenger car” means every motor vehicle designed for carrying ten persons or less and used for the transportation of persons; except that, the term “passenger car” shall not include motorcycles, motorized bicycles, motor tricycles, and trucks with a licensed gross weight of twelve thousand pounds or more. 2. Each driver, except persons employed by the United States Postal Service while performing duties for that federal agency which require the operator to service postal boxes from their vehicles, or which require frequent entry into and exit from their vehicles, and front seat passenger of a passenger car manufactured after January 1, 1968, operated on a street or highway in this city, and persons less than eighteen years of age operating or riding in a truck, as defined in section 301.010, RSMo, on a street or highway of this city shall wear a properly adjusted and

fastened safety belt that meets federal National Highway Transportation and Safety Act requirements. No person shall be stopped, inspected, or detained solely to determine compliance with this subsection. The provisions of this section and section 307.179, RSMo, shall not be applicable to persons who have a medical reason for failing to have a seat belt fastened about their body, nor shall the provisions of this section be applicable to persons while operating or riding a motor vehicle being used in agricultural work-related activities. Noncompliance with this subsection shall not constitute probable cause for violation of any other provision of law. The provisions of this subsection shall not apply to the transporting of children under sixteen years of age, as provided in section 307.179, RSMo. 3. Each driver of a motor vehicle transporting a child less than sixteen years of age shall secure the child in a properly adjusted and fastened restraint under section 307.179, RSMo. 4. Except as otherwise provided for in section 307.179, RSMo, each person who violates the provisions of subsection 2 of this section is guilty of an ordinance violation for which a fine not to exceed ten dollars may be imposed. All other provisions of law and court rules to the contrary notwithstanding, no court costs shall be imposed on any person due to a violation of this section. 5. If there are more persons than there are seat belts in the enclosed area of a motor vehicle, then the passengers who are unable to wear seat belts shall sit in the area behind the front seat of the motor vehicle unless the motor vehicle is designed only for a front-seated area. The passenger or passengers occupying a seat location referred to in this subsection is not in violation of this section. This subsection shall not apply to passengers who are accompanying a driver of a motor vehicle who is licensed under section 302.178, RSMo.[JG37] 76.306. Child Restraints.[JG38] 1. As used in this section, the following terms shall mean:

(1) "Child booster seat", a seating system which meets the Federal Motor Vehicle Safety Standards set forth in 49 C.F.R. 571.213, as amended, that is designed to elevate a child to properly sit in a federally approved safety belt system; (2) "Child passenger restraint system", a seating system which meets the Federal Motor Vehicle Safety Standards set forth in 49 C.F.R. 571.213, as amended, and which is either permanently affixed to a motor vehicle or is affixed to such vehicle by a safety belt or a universal attachment system; (3) "Driver", a person who is in actual physical control of a motor vehicle.

2. Every driver transporting a child under the age of sixteen years shall be responsible, when transporting such child in a motor vehicle operated by that driver on the streets or highways of this city, for providing for the protection of such child as follows:

(1) Children less than four years of age, regardless of weight, shall be secured in a child passenger restraint system appropriate for that child;

(2) Children weighing less than forty pounds, regardless of age, shall be secured in a child passenger restraint system appropriate for that child; (3) Children at least four years of age but less than eight years of age, who also weigh at least forty pounds but less than eighty pounds, and who are also less than four feet, nine inches tall, shall be secured in a child passenger restraint system or booster seat appropriate for that child; (4) Children at least eighty pounds or children more than four feet, nine inches in height shall be secured by a vehicle safety belt or booster seat appropriate for that child; (5) A child who otherwise would be required to be secured in a booster seat may be transported in the back seat of a motor vehicle while wearing only a lap belt if the back seat of the motor vehicle is not equipped with a combination lap and shoulder belt for booster seat installation; (6) When transporting children in the immediate family when there are more children than there are seating positions in the enclosed area of a motor vehicle, the children who are not able to be restrained by a child safety restraint device appropriate for the child shall sit in the area behind the front seat of the motor vehicle unless the motor vehicle is designed only for a front seat area. The driver transporting children referred to in this subsection is not in violation of this section. This subsection shall only apply to the use of a child passenger restraint system or vehicle safety belt for children less than sixteen years of age being transported in a motor vehicle.

3. Any driver who violates subdivision (1), (2), or (3) of subsection 2 of this section is guilty of an ordinance violation and, upon conviction, may be punished by a fine of not more than fifty dollars and court costs. Any driver who violates subdivision (4) of subsection 2 of this section shall be subject to the penalty in subsection 4 of section 76.305[JG39]. If a driver receives a citation for violating subdivision (1), (2), or (3) of subsection 2 of this section, the charges shall be dismissed or withdrawn if the driver prior to or at his or her hearing provides evidence of acquisition of a child passenger restraint system or child booster seat which is satisfactory to the court or the party responsible for prosecuting the driver's citation. 4. The provisions of this section shall not apply to any public carrier for hire. The provisions of this section shall not apply to students four years of age or older who are passengers on a school bus designed for carrying eleven passengers or more and which is manufactured or equipped pursuant to Missouri Minimum Standards for School Buses as school buses are defined in section 301.010, RSMo. 76.310. Helmets Required. Every person operating or riding as a passenger on a motorcycle or motor tricycle upon the streets or highways of the city shall wear protective headgear at all times the vehicle is in

motion. The protective headgear shall meet reasonable standards and specifications established by the Director of Revenue. 76.315. Lighted Lamps Required to Be Illuminated. Lighted lamps, as defined and required in Chapter 307, RSMo, are required to be illuminated when operating a motor vehicle within the city limits during the time period from a half-hour after sunset to a half-hour before sunrise and at any other time when there is not sufficient light to render clearly discernible persons and vehicles on the roadways at a distance of five hundred feet ahead. Lighted lamps shall also be required any time the weather conditions require usage of the motor vehicle’s windshield wipers to operate the vehicle in a careful and prudent manner as defined in section 304.012, RSMo. The provisions of this section shall be interpreted to require lighted lamps [JG40]during periods of fog even if usage of the windshield wipers in not necessary to operate the vehicle in a careful and prudent manner. Each person who violates the provisions of this section is guilty of an ordinance violation for which a fine not to exceed ten dollars may be imposed. All other provisions of law and court rules to the contrary notwithstanding, no court costs shall be imposed on any person due to a violation of this section. 76.320. Secure Loads. All motor vehicles, and every trailer, operating upon the streets and highways of this city and carrying goods or materials or farm products which may reasonably be expected to become dislodged and fall from the motor vehicle or trailer as a result of wind pressure or air pressure and/or by the movement shall have a protective cover or be sufficiently secured so that no portion of such goods or materials or farm products can become dislodged and fall from the vehicle or trailer while being transported or carried. 76.325. Mud Flaps. Trucks, semitrailers, and trailers, except utility trailers, without rear fenders, attached to a commercial motor vehicle registered for over twenty-four thousand pounds shall be equipped with mud flaps for the rear wheels when operated on the public highways of this city. If mud flaps are used, they shall be wide enough to cover the full tread width of the tire or tires being protected; shall be so installed that they extend from the underside of the vehicle body in a vertical plane behind the rear wheels to within eight inches of the ground; and shall be constructed of a rigid material or a flexible material which is of a sufficiently rigid character to provide adequate protection when the vehicle is in motion. No provisions of this section shall apply to a motor vehicle in transit and in process of delivery equipped with temporary mud flaps, to farm implements, or to any vehicle which is not required to be registered. 76.330. Headlamps. Every operator of a motor vehicle operated upon the streets or highways of the city shall be required to equip the vehicle with headlamps as defined and required under Chapter 307, RSMo.

76.335. Taillamps and Reflectors. Every operator of a motor vehicle operated upon the streets or highways of the city shall be required to equip the vehicle with taillamps, registration marker lamps[JG41], and reflectors as defined and required under section 307.075, RSMo. 76.340. Other Equipment. Every operator of a motor vehicle operated upon the streets or highways of the city shall be required to equip the vehicle in accordance with 307.170 and 307.173, RSMo.

BICYCLES AND MOTORIZED BICYCLES 76.350. Rights and duties of bicycle and motorized bicycle riders. Every person riding a bicycle or motorized bicycle upon a street or highway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle, except as to special regulations in sections 76.351 to 76.355 and except as to those provisions which by their nature can have no application. 76.351. Brakes required on bicycles. Every bicycle and motorized bicycle shall be equipped with a brake or brakes which will enable its driver to stop the bicycle or motorized bicycle within twenty-five feet from a speed of ten miles per hour on dry, level, clean pavement. 76.352. Lights and reflectors on bicycles. Every bicycle and motorized bicycle when in use on a street or highway during the period from one-half hour after sunset to one-half hour before sunrise shall be equipped with the following:

(1) A front-facing lamp on the front or carried by the rider which shall emit a white light visible at night under normal atmospheric conditions on a straight, level, unlighted roadway at five hundred feet; (2) A rear-facing red reflector, at least two square inches in reflective surface area, or a rear-facing red lamp, on the rear which shall be visible at night under normal atmospheric conditions on a straight, level, unlighted roadway when viewed by a vehicle driver under the lower beams of vehicle headlights at six hundred feet; (3) Reflective material and/or lights on any part of the bicyclist's pedals, crank arms, shoes or lower leg, visible from the front and the rear at night under normal atmospheric conditions on a straight, level, unlighted roadway when viewed by a vehicle driver under the lawful lower beams of vehicle headlights at two hundred feet; and

(4) Reflective material and/or lights visible on each side of the bicycle or bicyclist and visible at night under normal atmospheric conditions on a straight, level, unlighted roadway when viewed by a vehicle driver under the lawful lower beams of vehicle headlights at three hundred feet. The provisions of this subdivision shall not apply to motorized bicycles which comply with National Highway Traffic and Safety Administration regulations relating to reflectors on motorized bicycles.

76.353. Riding to right, required for bicycles and motorized bicycles. Every person operating a bicycle or motorized bicycle at less than the posted speed or slower than the flow of traffic upon a street or highway shall ride as near to the right side of the roadway as safe, exercising due care when passing a standing vehicle or one proceeding in the same direction, except when making a left turn, when avoiding hazardous conditions, when the lane is too narrow to share with another vehicle, or when on a one-way street. Bicyclists may ride abreast when not impeding other vehicles. 76.354. Bicycle to operate on the shoulder adjacent to roadway. 1. A person operating a bicycle at less than the posted speed or slower than the flow of traffic upon a street or highway may operate as described in section 76.353 or may operate on the shoulder adjacent to the roadway. 2. A bicycle operated on a roadway, or on the shoulder adjacent to a roadway, shall be operated in the same direction as vehicles are required to be driven upon the roadway. 3. For purposes of this section and section 76.353, "roadway" is defined as and means that portion of a street or highway ordinarily used for vehicular travel, exclusive of the berm or shoulder. 76.355. Bicycle required to give hand or mechanical signals. The operator of a bicycle shall signal as required in section 76.140, except that a signal by the hand and arm need not be given continuously if the hand is needed in the control or operation of or to control or operate the bicycle. An operator of a bicycle intending to turn the bicycle to the right shall signal as indicated in section 76.140 or by extending such operator's right arm in a horizontal position so that the same may be seen in front of and in the rear of the bicycle. 76.356. License required for motorized bicycle. 1. No person shall operate a motorized bicycle on any highway or street in this state unless the person has a valid license to operate a motor vehicle. 2. No motorized bicycle may be operated on any public thoroughfare located within this state which has been designated as part of the federal interstate highway system.[JG42]

76.357. Riding bicycle on sidewalks, limitations — motorized bicycles prohibited. 1. No person shall ride a bicycle upon a sidewalk within a business district. 2. Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian. 3. No person shall ride a motorized bicycle upon a sidewalk.[JG43]

LICENSE, REGISTRATION AND INSURANCE 76.400. Driver License Required.

Unless otherwise provided for by law, it shall be unlawful for any person to operate any motor vehicle upon any street or highway of the city unless he or she has a valid license for such operation. It is unlawful for any person to operate a motor vehicle upon the streets of the city without the required endorsements on his or her driver’s license or[JG44] unless he or she is at the time complying with any restrictions placed upon his or her driver's license by the Department of Revenue. 76.401. Driving while license or driving privilege is cancelled, suspended or revoked. A person commits the offense of driving while revoked if such person operates a motor vehicle on a highway when such person's license or driving privilege has been cancelled, suspended, or revoked under the laws of this state or any other state and acts with criminal negligence with respect to knowledge of the fact that such person's driving privilege has been cancelled, suspended, or revoked.[JG45] 76.405. Vehicle Inspection Required. The operator of every motor vehicle operated upon the streets or highways of the city shall have a certificate of inspection pursuant to 307.350, RSMo, and said certificate of inspection shall be displayed on the motor vehicle as prescribed by the regulations of the State of Missouri. 76.410. Vehicle Registration Required. It shall be unlawful for the owner of a motor vehicle or trailer, which shall be operated or driven upon the highways of this city, to fail to annually file an application for registration as required by section 301.020, RSMo, except as otherwise provided therein. 76.415. License Plates Required. No motor vehicle or trailer shall be operated on any highway of this city unless it shall have displayed thereon the license plate or set of license plates issued to same. Each such plate

and issued registration tabs shall be fastened and displayed according to the provisions of section 301.130, RSMo. 76.416. Plates removed on transfer or sale of vehicles — use by purchaser. Upon the transfer of ownership of any motor vehicle or trailer, the certificate of registration and the right to use the number plates shall expire and the number plates shall be removed by the owner at the time of the transfer of possession, and it shall be unlawful for any person other than the person to whom such number plates were originally issued to have the same in his or her possession whether in use or not;[JG46] except that the buyer of a motor vehicle or trailer who trades in a motor vehicle or trailer may attach the license plates from the traded-in motor vehicle or trailer to the newly purchased motor vehicle or trailer. The operation of a motor vehicle with such transferred plates shall be lawful for no longer than specified in section 301.140, RSMo.[JG47] 76.420. Financial Responsibility. It shall be unlawful to operate a motor vehicle within the city limits without being in compliance with Chapter 303, RSMo, the Motor Vehicle Financial Responsibility Law. However, no person shall be found guilty of violating this section of the operation demonstrates to the court that he or she met the requirements of Chapter 303 at the time the police officer wrote the citation.

THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM THE DATE OF ITS PASSAGE FORWARD.

2020 BUDGET MESSAGE

Income and expenditures met 2019 guidelines.

STATUS OF 2019 GOALS

Maintenance Dept:

1. Several asphalt roads that were deteriorating were patched, sections of concrete were replaced, and several streets were overlaid. These included Humphrey Drive, a portion of Second Street, a portion of Elm Tree Road, a portion of Kathy Avenue, and all of Janet Drive.

2. The Maintenance Superintendent attended the annual MIRMA and MRWA conferences in an effort to stay in compliance with new regulations to keep premium costs down.

3. Some worn road and traffic control signs were updated/replaced.

4. No steps have been taken to obtain easements, bid, and construct the water loop from the Hoelting property to Winchester Place.

5. The work continued with the upgrades and improvements as agreed to in the Administrative Order for Compliance upon Consent with the Environmental Protection Agency and the project was in operation by the end of 2019. The semi-annual reports with EPA and DNR were submitted.

6. Water testing equipment, meter pit pumps, a DO meter, a flow meter, sewer testing equipment, a trash pump, a salt spreader, a snow plow, safety barrier kits, a vactron, a tractor, winch and plow for the Arctic Cat, and two storm warning sirens were purchased. The microscope and digital cylinder scales were purchased at the end of 2018. The safety harnesses, cable machine, concrete mixer, and mower were not purchased in 2019.

7. Some of the items to start a sewer lab testing facility were purchased.

Police Dept:

8. The police training fund was efficiently utilized to keep all police personnel POST certified.

9. Shotgun/rifle mounts for the vehicles, taser holsters, computer docking stations for the vehicles, a radar unit, Airsoft masks, patrol rifles, and optics for patrol rifles were purchased. The lease payments on the two 2018 vehicles were made and a new vehicle was purchased for Chief Foster's use. Fire extinguishers for the vehicles, duty bags for the vehicles, cameras for evindencee, body armor vests, lockers for the officers, and metal detector were not purchased. The Airsoft pistols and rifels were purchased in 2018.

Office Dept:

10. The City Clerk attend the MCCFOA Spring Conference and MIRMA Annual Conference. The Fall Regionals and MML Annual Conference were not attended due to scheduling conflicts.

11. Two printers, solid state drives, and a new color copier were purchased.

17. Grant funding was received one half of the EPA Compliance project, up to $860,000.

18. A total of $18,000 was remitted for the Site Lease/Lease Purchase agreement on the Mette Road facilities. The remaining water taps collected in 2019 are being retained for replacement of aging, outdated, undersized cast iron mains in old town.

19. The budget was reviewed by the Board of Aldermen on a quarterly basis.

20. Policies and procedures and city codes were updated as necessary. An employee handbook was created.

21. Some additional renovations were completed on the City Hall, Police, and Court building located at 995 Main Street.

22. The seven tablets for use at City meetings were not purchased.

Budgetary Restrictions for 2019

23. The hiring freeze remained in effect for all departments unless prior permission was given by the Board of Alderman.

24. Overtime and compensatory time was kept to a minimum.

25. Department heads carefully scrutinized all purchases and expenditures.

26. Monthly expenses were reviewed by the Board of Alderman to determine budget compliance.

27. No amounts were expended from the restricted cash accounts in General Revenue, Water Works, Sewer, Street, and the Street Repair/Replacement fund without prior approval of the Board of Aldermen.

28. Beginning 2019 restricted cash balances for the General Revenue fund, Water Works fund, Sewer fund, and Street fund were set at the unencumbered beginning checking balance as of January 1, 2019, unless the attached budget required partial use of that amount. $86,493.54 was transferred from the Street Fund to the Street Repair and replacement fund as of 1/2/19.

29. The restricted cash reserve amount in the General Revenue fund remained above the minimum $521,000 during the 2019 budget year.

RESOLUTION NO. 904

A RESOLUTION REGARDING VIDEOCONFERENCE POLICY FOR PUBLIC MEETINGS

BE IT RESOLVED BY THE BOARD OF ALDERMAN OF THE CITY OF MOSCOW MILLS, MISSOURI, AS FOLLOWS:

1. Policy Statement: While it is legally permissible for members of the City’s Board of

Aldermen to attend meetings and vote via video conference transmission, a member’s use

of video conference attendance should occur only sparingly. Because it is good public

policy for citizens to have the opportunity to meet with their elected officials face-to-face,

elected members of the Board of Aldermen should endeavor to be physically present at

all meetings unless attendance is unavoidable after exercising due diligence to arrange for

physical presence at the meeting. The primary purpose of attendance by video

conference connection should be to accommodate the Board of Aldermen as a whole to

allow meetings to occur when circumstances would otherwise prevent the physical

attendance of a quorum of the Board’s members. A secondary purpose of attendance by

video conference should be to ensure that all members may participate in business of the

Board of Aldermen that is emergency or highly important in nature and arose quickly so

as to make attendance at a regular meeting practically impossible. Except in exigent

circumstances, all efforts should be expended to ensure that a quorum of the members of

the Board of Aldermen be physically present at the normal meeting place of the Board.

2. Video Conference Defined: For purposes of this section “video conference” or

“videoconferencing” shall refer to a means of communication where at least one member

of the Board of Aldermen participates in a public meeting via an electronic connection

made up of at least three components: (1) a live video transmission of the member of the

Board of Aldermen not in physical attendance; (2) a live audio transmission allowing the

member of the Board of Aldermen not in physical attendance to be heard by those in

physical attendance; and (3) a live audio transmission allowing the member of the Board

of Aldermen not in physical attendance to hear those in physical attendance at a meeting.

If at any time during a meeting one or more of these elements of a video conference

becomes compromised (e.g., if any participants are unable to see, hear, or fully

communicate), then the video conference participant is deemed immediately absent and

this absence should be reflected in the minutes. A video conference participant’s absence

may compromise a quorum in which case the applicable Missouri laws shall take effect

regarding a broken quorum.

3. Frequency of Use of Video Conference Attendance: A member of the Board of

Aldermen shall not attend more than ___ meetings via video conference in any twelve-

month period. In keeping with the policy sated in Subsection 1 above, attendance via

video conference should only occur sparingly and for good cause. Such good cause shall

be at the discretion of the member seeking to attend by video conference in keeping with

this policy.

4. Physical Location: Members of the public may not participate in a public meeting of

Board of Aldermen via video conference unless the meeting is not being held at a

physical location, i.e., is being held solely by video conference due to emergency

circumstances. In such circumstances, members of the public must be able to see and

hear all members of the Board of Aldermen and must be able to be heard by all

participants in the meeting.

5. Voting: Elected members of the Board of Aldermen attending a public meeting via video

conference are deemed present for purposes of participating in a roll call vote to the same

effect elected members of the Board of Aldermen in physical attendance at a public

meeting of the Board are deemed present.

6. Closed Meetings: In a meeting where a member of Board of Aldermen is participating

via videoconferencing and the meeting goes into a closed session, all provisions of

Missouri law and city ordinances relating to closed sessions apply. Upon the Board of

Aldermen’s vote to close the meeting, no members of the general public shall be present.

Likewise, a member of the Board of Aldermen participating via videoconferencing must

ensure there are no members of the public present at their location to see, hear, or

otherwise communicate during the closed session. The member must also take all

reasonable precautions to guard against interception of communication by others.

7. Minutes: In the meeting, whether in open or in closed session, the minutes taken should

reflect the members, if any participating via video conference; the members in physical

attendance; and the members, if any, absent.

8. Emergency Circumstances: In the event that emergency circumstances create an

impossibility for all members of the Board of Aldermen to physically attend a public

meeting, the Board of Aldermen, as a whole, may meet, and if necessary, vote by video

conference. To the extent possible in such circumstances, the Board shall use reasonable

efforts to provide for public participation.

RESOLUTION APPOINTING AND DEFINING TERMS OF INDIVIDUAL MEMBERS ON THE PLANNING AND ZONING COMMISSION

WHEREAS, Chapter 31, Section 31.020 provides for the appointment of

seven resident citizens appointed by the Mayor and approved by the Board of Aldermen,

and WHEREAS, there are two vacant seats on the Planning and Zoning

Commission due to resignations, THEREFORE, be it resolved by the Board of Aldermen that the following

members are appointed to fulfill the following terms: Vacant Seat-Term expiring 12/31/2022 has been replaced with-Cody Quist-Term expiring 12/31/2022 Vacant Seat-Term expiring 12/31/2020 has been replaced with- No replacement at this time-Term expiring 12/31/2020
