Sieur Kolly alleges tbat conformably to a statement drawn up in duplicate by bim and Sr. Wassy, onAugust 6, last, tbe latter is indebted to petitionerand his company in tbe sum of'1301#, 10 sols, exclusive of 159#, 3 sols, 9 deniers, in bank drafts
\ and merchandise; or a total of 14601, 13 sols, 9) deniers.
Petitioner has proposed to Sr. Wassy to offsetsaid amount against the balance due him by tbeSt. Reine concession, for tbe sale of his Chapitoulas(sic) plantation to tbe late Ceard, but said SieurWassy's terms are too onerous for peti tioner and bisassociates.
Wherefore, petitioner prays tbat Sieur Wassy besummoned before the Council, and that be be condemnedto pay, immediately, to Sieur Kolly, said 1460#, 13sols, 9 deniers, in bank drafts; or to order that compensation be allowed him upon tbe balance due defendantfrom tbe sale of said plantation.

Petitioner alleges that he owned a lot ofground adjoining property of defendant, who desired to purohase said lot for 500 livr.es; however, as the property did not meet the requirements of the Ordinanoe of Aug. 10, 1728, theauthorization of the Counoi1 was unobtainable.
Petitioner, furthermore, alleges that aftertaking oognizanoe of his oonfinement in a Hospital,and of his family responsibilities, the Counoi1kindly suggested that a transfer might be effeotuated by annexation of said lot to the Company'sdomain. whereupon petitioner proceeded to bindhimself'; consequently, Sr. D'Auseville is actuallyin possession of said lot, obtained through agrant in his nephew's nane j thereby abusing petitioner's good faith and profiting of his rankto deprive petitioner of 500 livres, by declaringhis own nephew the debtor.
Petitioner, finally, alleges that he cansubstantiate the foregoing statements, provingSr. D'Auseville to be the true debtor and contracting party.

As mosi; convincing proof of the falsity ofMr. Henry's assertions, Mr. D'Auseville wishes toinform his fellaH councillors that he attributestoday's eventualities to a disagreement of recentoccurrenoe between himself and Mr. Henry, regarding the latter's rental of a house situated onOrleans Street and owned by Mr. D'Auseville.

On April 3, 1729, Pierre Louis Labiohe,settler at Ft. Condi, of Mobile, reoeived severalknife wounds, resulting in his death forty dayslater. Counoillor Bru's appointee aooepted theviotim's dying deolaration, wherein Joseph Eraff(or Graff), his partner, was SUbsequent arrestedand brought to trial, at whioh time IIRterial irregularities were disolosed.
Wherefore, the Council reserves its verdiot,and orders a new investigation to be conducted onthe spot by the Attorney General, in the presenoeof Sieur Bru; upon the termination of whioh investigation, the aooused is to be oonduoted in safeoustody to "our prison," and the case tried uponrecollllll!lIidation of the Attorney General.

Peti tioner alleges . that a partnership formerl;yeXisted, in Mobile, between Joseph Gra!f and PierreLouis Labiche; that on jpril 3, 1729 said Labichereceived several knife wounds, and died fort;y ds;vslater; that investigation led to the arrest, trialand conviction of said Graff; who on Jul;y 19, 1729Was condemned to death b;y hanging and strangnlation;that on Ma;y 3, 1729 said Labiche made a "sort ofwill" bequeathing all of his prOpert;y in the Colon;yto said Greff: that said will is absolutel;y invalid,as it is"but natural that the lawful heirs of saidLabiche should be his beneficiaries. '
