i) I n view of the letter received on lgth December 2012 - Item No. 3(a) - Page No. 12 - MBA - Sr. No. 34, bearing No. 6627 - Camp Education Society's Institute of Management, Nigdi, Pune is cancelled. The Ad-hoc fee for Academic Year 2012-13 is already decided by the Samiti for such course and College/Institute can be charge the same for the Academic Year 2012-13.

ii) Item No. 3(a) - Page No. 18 - Polytechnic Sr. No. 2, bearing No. 1152 - Vidarbha Rural Reconstruction Foundation's Rajeshkumar Wadhawan Polytechnic Institute, Yavatmal there is error in calculation. While calculating fees the basis is taken of audited accounts for 2010-11 and fees approved Rs. 21,140/- for the Academic Year 2012-13. I n fact the audited accounts of 2011-12 are to be taken into consideration and if so considered fee comes to Rs. 33,100/-. I n view of this Samiti decides to approve the fee of Rs. 33,100/- for its Polytechnic course for the Academic Year 2012-13. Office to carry out the said corrections.

Item No. 3(a): To consider and decide on proposals where there are no discrepancies.

The Samiti considered the proposals of the following Colleges/Institutes for finalization of fee structure for the students who joined the course started during Acaderr~ic Year 2012-13. After deliberations, the Samiti decides to approve the final fee structure of the following Institutes/Colleges for the students who joined the course started during Academic Year 2012-13. Figures are arrived at after considering the calculations drawn in the worksheet - calculation sheets of the respective colleges/institutes prepared by a Chartered Accountant. The students admitted in the Academic Year 2012-13 and there after continuing their studies will pay an enhanced fee of 8% each successive year as per the norms for 2012-13 till completion of the course, For example if the fee approved is Rs. 1,00,000/- then 2"d year, 3rd year and 4th year's student will be Rs. 1,08,000/-. (Assuming course is of 4 years). Worksheet - Calculation sheets are available in the office.

The Samiti considered the proposals of the following Colleges/Institutes for finalization of fee structure for the students who joined the course started during Academic Year 2012-13. After deliberations, the Samiti decides to approve the final fee structure of the following Institutes/Colleges for the students who joined the course started during Academic Year 2012-13. figures are arrived at after considering the calculations drawn in the worksheet - calculation sheets of the respective colleges/institutes prepared by a Chartered Accountant. 'The students admitted in the Academic Year 2012-13 and there after continuing their studies will pay an enhanced fee of 8% each successive year as per the norms for 2012-13 till completion of the course, For example if the fee approved is Rs. 1,00,000/- then 2" year, 3rd year and 4th year's student will be Rs. 1,08,000/-. (Assuming course is of 4 years). Worksheet - Calculation sheets are available in the office.

I n view of this, Samiti decides that Colleges/Institutes which have failed to submit proposals for approval for 2012-13 to the Samiti office, Samiti dire& the said Colleges/Institutes to charge the fee as mentioned in last column for 2012-13 course. If any fee is recovered over and above the same to be refunded to the concerned students.

I n case where the Government has not fixed the fee for the course then the Colleges/Institutes can only charge the Ad-hoc fee fixed by the Samiti for such course. I n case, any fee is collected from the students over and above the same, it is to be refunded.

Samiti considered the letter dated 27/11/2012 received from Dr. Bhausaheb Nandurkar College of Engineering and Technology, Yavatml. The grievance made is that Social Welfare Department is granting 7% addition only on tuition fees and development fee is excluded from the total fee approved by the Samiti. We clarify that this is not correct. The fee is tuition fee and development fee, the total fee approval is say k. 48,008,/-. In that case the 7% is to be granted on entire fee approved for all reserved category students i.e. SC, ST, VJ, NT, SBC and 08C students. The office to communicate this resolution to the College/Institute and Social Welfare Department and Tribal Welfare Department.

Item No. 5161 : Com~laint dated 10/12/2012 received from Ramesh Goohne reqardins excess fees collected from the students for Academic Year 2006 to 2012 of Walchand Institute of Technolosv, Sola~ur.

Samiti perused the letter under reference.

The office to call Mr. Gofne and also the aforesaid College,'Institute for Rearing on the next date of meeting. The office to call for notice dated 20-10-2012 given by Advocate Bapusaheb B. Sarak

Dr. Bhamrel Dy. Director, Directorate of Technical Education, Mumbai stated that Directorate d Technical Mucation, Ma harashtra State is also calling for report in respect of this complaint and can be submit in the next meeting.

Samiti considered the letter dated 11/12/2012 received from the aforesaid Col lege/Instlt&e.

Sarniti heard Mr. S.K. Narayan Khedakar, Principal and Mr. V.G. Saigave, A.O.

Question is regarding refund of fee to the student viz. Vishal P. Joshi for Academic Year 2011-12. He applied for cancellation of admission on 27/08/2011. The terms commenced on 22/08/2011 as per Directorate of Technical Education, Maharashtra State. The cut-off-date was 29/09/2011. Admittedly one seat was filled after 27/08/2011 by the College/Institute. A is the case of the Institute that still Were were who vacancies and therefore they did not refund the fee.


The Rule No. 8.9 as per Directorate of Technical Education, M.S. brochure for 2011-12 is as follows.

"8.9 Refund of Tuition, Development and Other fees affer cancellation of admission secured through G4P rounds-I/II/IIr/IV, in Institute level Round(s) and Vacancy Round(s) of admissions in Government, Aided, Univetsiw Departments, etc. and Unaided Institutes:

The candidate who has been provisonall'y admitted may cancel admision by submiftig and application in duplicate, in the prescribed pro forma - 0 and may request for refund of fes. The refund of fees as applicable shall be made in due course. It I3 made clear that such appkation for cancellation will be considered if any only if the admisson is confimed by paflng the prescMed tuition fee and other fee /j7 fuII and by submitting the original documents. Refund shall be made affer deduction of the cancellation charges as shown below:

Certainly this case would fall under clause (ii). The Institute is harping upon use of the phrase "the Seat" to mean that seat of this student only. This is not correct because when admission is given to one student it is not against any particular seat. It is always 'admission' and hence at the most in this case the college can deduct Rs. 1,5001- under this clause and refund the balance.


We may suggest Directorate of Technical Education, Maharashtra State to amend clause (i) to provide that, if a seat is filled before the cut-off-date then entire fee less Rs. 1,000/- to be refunded in such a case and then clause no. (ii) would be redundant and can be deleted. Similarly, clause NO. (iii) can be amended to state that - Request for cancellation of admission is received after start of academic session but before the cut- off-date, but 'a seat' could not be filled by the College/Institute then there can be no refund. Samiti considered the letter dated 31/12/2012 received from Shri Adesh Janai. It is observed that frivolous and vague allegations made regarding contents of the proposal for approval of fee structure submitted to the Samiti by the aforesaid College/Institute. Samiti expects students/parents should have filed review appeal and pointing out the errors in the proposal. But this is not done. Office to call him in the next meeting and also the Principal of the aforesaid College/Institute.
