    CalChamber Vote Record: Major Bills 2013This report for the first year of the20132014 legislative session focuses onCalifornia legislators floor votes onCalifornia Chamber of Commercepriority bills.

    This is the 39th vote record theCalChamber has compiled. The Cal-Chamber publishes this report in responseto numerous requests by member firmsand local chambers of commerce thatwould like a gauge by which tomeasure the performance oftheir legislators.

    To help readers assess

    legislators vote records, thecharts group bills into fiveareas: civil litigation, economicdevelopment, environmentalregulation, health insurancecosts, and labor and employ-ment mandates.

    Partial Picture

    No vote record can tell theentire story of a legislatorsattitude and actions on issuesof importance to business. Each year,legislators cast thousands of votes onthousands of proposed laws. To fully

    evaluate your legislative representative,consult the legislative journals andexamine your legislators votes incommittee and on floor issues.

    You can view these via links at www.calchambervotes.com.

    Many anti-business bills were rejectedby legislators in policy or fiscal commit-tees, thus stopping proposals before theyreached the floor for a vote. The voterecord does not capture these votes.

    Most bills in this report cover majorbusiness bills that are of concern to bothsmall and large companies.

    The CalChamber recognizes thatthere are many bills supported oropposed by business that are notincluded in this vote record andanalysis.

    Factors Considered

    The CalChamber considers the follow-ing factors in selecting vote record bills:

    The bills and votes reflect legisla-tors attitudes toward private enterprise,fiscal responsibility and the businessclimate.

    Each bill was a priority for theCalChamber in a particular field. Priority

    bills have appeared in the Status Reportsections ofAlert.

    The bills were voted upon by eitherthe full Senate or Assembly. This year thevote record covers 14 votes in the Senateand 14 votes in the Assembly.

    Unless otherwise noted, final floorvotes are shown. Concurrence votes andconference report votes are consideredfinal votes.

    When Not Voting Helps

    Sometimes a legislator is unwilling tovote against a colleague, but is willing tosupport the CalChambers opposition to abill. In such cases, a legislator mayabstain from voting, which will hinderpassage of a bill, just as a no vote does.

    To recognize that not voting can aidthe CalChambers opposition to a bill, thevote record includes the number of timeslegislators did not vote aye on aCalChamber-opposed bill in the total forthe column listing actions in accordwith the CalChambers position, if thelegislator was not absent for the day.

    Civil LitigationAB 227 (Gatto; D-Los Angeles)Stops Drive-by Lawsuits. Protects smallbusinesses from drive-by lawsuits byproviding a 14-day right to cure forallegations of a failure to post a Proposi-tion 65 warning related to chemicalsproduced during the cooking process,alcohol, second-hand smoke, and carexhaust.     AB 566 (Wieckowski; D-Fremont)

    Unnecessary Restrictions on TrialCourts. Unfairly limits the trial courtsability to minimize costs in light of thebudget reductions they have faced byplacing severe restrictions on their abilityto contract for services.     AB 729 (R. Hernndez; D-WestCovina)Employee-UnionAgent Evidentiary Privilege.Creates a new evidentiaryprivilege that is one-sided and

    will provide a union represen-tative with an unfair opportu-nity to preclude relevantevidence during litigationregarding labor disputes orcollective bargaining, that mayultimately result in the miscar-riage of justice. Passed Senate,September 3, 23-10. Assemblyconcurred in Senate amend-ments, September 6, 51-27.Vetoed. CalChamber Opposed.

    Economic Development

    AB 1173 (Bocanegra; D-Pacoima)Tax Reduction. Reduces the state taxpenalty imposed on employees fornonqualified deferred compensation from20% to 5%, as well as provides the abilityto utilize the film tax credit to offsetincome. Passed Senate, September 12,35-0. Assembly concurred in Senateamendments, September 12, 78-0. Signedby GovernorChamber 536. CalCham-ber Supported.

    AB 1400 (Committee on Jobs,Economic Development and theEconomy)Facilitate ExpeditiousExporting. Inappropriately expandsthe Coastal Commissions enforcementauthority by allowing the commission toimpose administrative civil penalties andincentivizes the imposition of fines andpenalties at the expense of due processthat occurs in the judicial system. PassedSenate, September 6, 21-17. Assemblyrefused to concur in Senate amendments,September 10, 34-30. CalChamberOpposed.

    AB 1323 (Mitchell; D-Los Angeles)Moratorium on Hydraulic Fracturing.Substantially hinders oil and gas produc-tion in the state, driving up fuel and energyprices and harming the job market in thesesectors, by prohibiting hydraulic fracturingand the use of fresh water in hydraulic

    fracturing until Cal/EPA re-authorizes thepractice under a new regulatory scheme, ifat all, in 2019. Failed passage in Assem-bly, May 30, 24-37. CalChamberOpposed/Job Killer.

    SB 691 (Hancock; D-Oakland)Dramatically Increases PollutionPenalties. Dramatically increasesexisting strict-liability penalties fornuisance-based, nonvehicular air-qualityviolations without adequately definingwhat types and levels of pollution wouldtrigger those penalties.     Health Insurance Costs

    AB 880 (Gomez; D-Los Angeles)Expansion of Discrimination Litigationand New Health Care CoveragePenalties. Discourages hiring of entry orre-entry workers, increases discriminationlitigation and increases costs by taxinglarge employers with a penalty if any oftheir employees who work as little as 8hours per week enroll in CaliforniasMedi-Cal program and expands the Labor

    Code to include a protected classificationfor any person who is enrolled inCalifornias Medi-Cal program or in theCalifornia Health Benefit Exchange.Failed passage in Assembly, June 27,46-27. CalChamber Opposed/Job Killer.

    AB 912 (Quirk-Silva; D-Fullerton)Increased Health Insurance Premiums.Increases medical costs, which will bepassed on to medium and large employersin the form of higher premiums, bymandating coverage of fertility preserva-tion services in certain medical treat-ments.     SB 353 (Lieu; D-Torrance)Increased Health Insurance Premiums.Increases costs for health plans, whichwill be passed on to employers in theform of higher premiums, by imposingsignificant new translation requirementon plans that advertise or market to newcommunities that speak languages otherthan English.     Labor and Employment Mandates

    AB 10 (Alejo; D-Salinas)Auto-matic Minimum Wage Increase.Unfairly imposes an automatic $2.00increase in minimum wage over the nextthree years, that will continue to increasecosts on employers of all sizes, regardlessof other economic factors or costs thatCalifornia employers are struggling withto sustain their business.     AB 1165 (Skinner; D-Berkeley)Increased Costs for Citation AppealProcess. Proposes a costly double-appealprocess for workplace safety citationsthat presumes guilt for employers,undermines due process with regards tocitations for workplace safety violationsand is unnecessary in light of recentlyadopted regulations for an expeditedappeals process for these situations.Passed Senate, September 11, 23-13.Assembly concurred in Senate amend-
