Well hey there! My name is R.B. and I am on the hunt. The hunt for what you ask? Well, rst of all, to nd out what my name stands for and a new family to call my own. I am a little shy and unsure, so I am looking for a calm and quite home with a comfy couch or two! I am sure you have done your research on my breed and you have found out that we have a tendency to chase after small things like cats, rabbits or squirrels… Well you would be right! I would do really well in a home as the only friend for you, but don’t you worry about the love thing, I have more than enough to give for you! What I am more than excited for is to go to “Polite Pooches” with you! My manners need a little work AND maybe it can help me become a bit more condent. If you think that I should stop my hunt for a new family for you, then you

Dear Working Wise:I work up to 10 hours a day as a delivery driver/shop helper. My boss says that I am not entitled to overtime unless I work over 10 hours a day, because I’m in the trucking industry. I do make deliveries, but I also work in the shop. Are there different overtime rules for truckers, and if so, am I considered a trucker? Signed, Distracted Driver
Dear Working Wise:
Working WiseWorking WiseWorking Wise
Do you have a work-related question? Send your questions to Working Wise, at [email protected]. Charles Strachey is a manager with Alberta Human Services. This column is provided for general informa-tion.
Dear Distracted:
Overtime rules vary by industry and situation, but for most employees, overtime is all hours worked in excess of eight hours a day or 44 hours a week. Overtime is calculated both on a daily and weekly basis. The higher of the two numbers is overtime hours worked in the week.
Some types of employees are exempt from the hours of work and overtime standards. Farm workers, domestic employees, salespeople, professionals, police, and managers are just a few examples of exempted occupations.
Other industries, such as the trucking industry, have dierent overtime rules. Truckers must be paid overtime after 10 hours a day or 50 hours a week. For a complete list of exempt occupations and industries with diering overtime rules, read the Overtime Hours and Overtime Pay Fact Sheet at: http://work.alberta.ca/es.
You asked if you are considered to be a truck driver. Your situation includes a lot of variables. Whether you drive long distances (across provincial boundaries), the type of company you work for, how much of your time you spend driving and the type of truck you drive all have an impact on whether you are working in the "trucking" industry.
I encourage you to call the Alberta Employment Standards contact centre toll-free at: 1-877-427-3731. The advisers will be able to dig down into the details of your situation and let you know if you are working in the trucking industry or not.
Regardless, the overtime that you work must be paid at the rate of at least 1.5 times your regular wage rate. The sole exception applies where the overtime is accumulated under an overtime agreement.
Some employers and employees agree to replace overtime pay wholly or partly with time o with pay. This is done through the use of an overtime agreement. An overtime agreement allows overtime hours to be banked and later taken o with pay, hour for hour, during regular work hours.
However, if banked time is not taken o within three months then it must be paid out at time and one half. Employers can not create a “use it or loose it” type rule for banked overtime. Overtime can not be lost or taken away even if your overtime agreement says that it can.
Employers must keep track of the banked overtime and how long it has been in the bank. However, the employer can tell the employee when to take their banked time o.
