On October 21,2005, pursuant to the authority granted by Section 91.103 of the Los Angeles Municipal Code, the Department of Building and Safety ( the "Department") investigated and identified code violations at: 11131 West Wyandotte Street, Los Angeles, California (the "Propetty"). A copy of the title report which includes a full legal description of the property is attached as Exhibit A.

Following the Department's investigation an order or orders to comply were issued to the property owner and all interested parties. Pursuant to Section 98.0411 (a) the order warned that "a proposed noncompliance fee may be imposed for failure to comply with the order within 15 days after the compliance date specified in the order or unless an appeal or slight modification is filed within 15 days after the compliance date.~' The owners failed to comply within the time prescribed by ordinance. The Department imposed non­compliance fee as follows:

3. Appllcation or Payments. Unless applicable law provides otherwise, all payments received by Lender under lhe Note and paragraphs I and 2 hereof shall be applied by Lender first in payment of amounts payable to Lender by Borrower under paragraph 2 hereof, then to interest payable on the Note, and then to the principal of the Note.

4. Prior Mortgages and Deeds of Trust; Charges; Lletl$. Borrower shall perform all of Borrower's obligations under any mortgage, deed of trust or other security agreement with a lien which has priority over this Deed of Trust, including Borrower's covenants to make payments when due. Borrower shall pay or cause to be paid all taxes. assessments and other charges, fines and impositions attributable to the Property which may attain a priority over this Deed of Trust. and leasehold payments or ground rents, if any.

S. Hazard tnsuranee. Borrower shall keep the Improvements now existing or hereafter erected on the Property insured against loss by fire, hazards included within the term "extended coverage," and such other hazards as Lender may require and in sueh amounts and for such periods as Lender may require.
