When you are going through a divorce as a parent
child custody and support issues are going to be important.

In this presentation we will look at some basic information that you need to know.

CHILD CUSTODY
![Page 5: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/5.jpg)
The matter of child custody does not fit
under a single umbrella.
![Page 6: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/6.jpg)
1
•Legal Custody
2
•Physical Custody
There are two distinct types of custody that must be considered:
![Page 7: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/7.jpg)
Legal Custody
Legal custody is oftentimes going to be
shared by both parents.
![Page 8: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/8.jpg)
This type of custody gives a parent the
power to make decisions that are relevant to the welfare of the child.
![Page 9: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/9.jpg)
These would include
educational and health-related
decisions.
![Page 10: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/10.jpg)
Physical Custody
Physical custody is for the most part self-explanatory. This form of custody involves the
child's physical place of residence.
![Page 11: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/11.jpg)
With a joint physical custody arrangement the child would spend a relatively equal amount of time living
with each parent.
![Page 12: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/12.jpg)
Primary physical custody would involve the child residing with one parent. The other parent would generally have visitation rights.
![Page 13: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/13.jpg)
WHO GETS CUSTODY?
![Page 14: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/14.jpg)
Custody arrangements can be agreed upon by both parents with the best interests of the children in mind.
![Page 15: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/15.jpg)
If the parents simply cannot come to an agreement the court will be forced to make
custody decisions.
![Page 16: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/16.jpg)
CHILD SUPPORT
![Page 17: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/17.jpg)
Under California law
both parents of a child are responsible
for his or her financial support.
![Page 18: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/18.jpg)
Either party may be required to pay child support to the other.
![Page 19: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/19.jpg)
However, in most cases the custodial parent will be the recipient
of child support payments.
![Page 20: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/20.jpg)
How Is Child Support Calculated?
![Page 21: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/21.jpg)
The amount of child support that must be paid is calculated based on a
rather complex formula.
![Page 22: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/22.jpg)
This formula is partially based on the income that is earned by each individual.
![Page 23: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/23.jpg)
This formula is partially based on the income that is earned by each individual.
The other factor is the percentage of time that the child
spends residing with each parent.
![Page 24: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/24.jpg)
Child Support Agreements
![Page 25: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/25.jpg)
The divorcing parents can come to a
private agreement with regard to child support payments.
![Page 26: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/26.jpg)
However, to protect the well-being of
the child the court must approve of this agreement.
![Page 27: California Child Custody and Support](https://reader034.vdocument.in/reader034/viewer/2022052618/554c42aab4c90570648b4f4a/html5/thumbnails/27.jpg)
This is a very brief overview. If you are going through a divorce as a
parent you would do well to discuss everything with a licensed attorney.
