Find out how to think ahead to litigation when handling ADA issues. Discover how to prepare for—and respond to—common litigation challenges. Litigation topics include the discovery process, depositions and preserved evidence. ADA topics include reasonable accommodation, the interactive process, proving undue hardship, and disability discrimination.

Track 2: Session 2 - The High Cost of Getting Even: Understanding and Preventing Retaliation Claims

1.0 California Credit

Retaliation claims continue to be some of the riskiest and most expensive in the workplace; after all, they are easy to allege and can be easy to prove. Some employers have learned this the hard way, through costly litigation. According to EEOC statistics, retaliation claims have doubled in the past ten years. With the potential for million-dollar verdicts and expanded employee protections from the U.S. Supreme Court, retaliation claims remain a tricky and problematic issue for employers. Fortunately, there are many steps employers can take to reduce the risk of being accused of retaliation, and to fend off allegations when they are made. This session provides you with tips and tools to prevent these claims, including important updates on recent retaliation cases, and strategies for minimizing litigation risk.

This program helps employers understand the difference between employee social media activity that is inappropriate and that which is protected by the National Labor Relations Act. Finally, there is practical advice for California employers on employee work use of personal or company-owned smartphones and similar portable devices.

As the 113th Congress enters its fourth month in session, the slate of HR issues under consideration in Washington is growing, and 2013 could go down as one of the most active years for workplace policy reform in the past two decades. Already being considered are key proposals on: continued deficit reduction, comprehensive tax reform that could impact employer benefit decisions, and immigration reform. Couple those with the continued rollout of various regulatory actions, including those implementing the Patient Protection and Affordable Care Act, and HR has its hands full just trying to stay informed. This presentation includes a discussion of these legislative issues and provides an update on current federal regulatory activity.
