You must meet the following minimum workexperience requirements to be eligible to apply as askilled worker:

•You must have at least one continuous year offull-time, paid work experience or the equivalentin part-time continuous employment.

•Your work experience must be in the categoryof Skill Type 0, or Skill Level A or B on theCanadian National Occupational Classification(NOC). You must have had this experience withinthe last 10 years.

National Occupational Classification

The NOC is a classification system for jobs in the Canadian economy. Itdescribes duties, skills, talents and work settings for occupations inCanada.

Your work experience must be in the category of Skill Type 0, orSkill Level A or B

CanadianExperience ClassIf you are a temporary foreign worker or a foreignstudent who graduated in Canada, you often have thequalities to make a successful transition fromtemporary to permanent residence. You are familiarwith Canadian society and can contribute to theCanadian economy. You should have knowledge ofEnglish or French and qualifying work experience.

You must meet these minimum requirements to applyfor permanent residence under the Canadian ExperienceClass. You must:

•be either:•a temporary foreign worker with at least twoyears of full-time (or equivalent) skilled workexperience in Canada, or•a foreign graduate from a Canadian post-secondary institution with at least one year offull-time (or equivalent) skilled work experiencein Canada

•have gained your experience in Canada with the properwork or study authorization•apply while working in Canada – or – within one year ofleaving your job in Canada

According to the Canadian National Occupational Classification(NOC), skilled work experience means:

•Skill Type 0 (managerial occupations) or•Skill Level A (professional occupations) or•Skill Level B (technical occupations and skilled trades)

Your application will be assessed on two requirements if youapply as a temporary foreign worker:

•your work experience and•your ability in English or French.

If you apply as a graduate of a Canadian post-secondaryeducational institution with Canadian work experience, it willbe assessed using the above requirements, as well as:

•your education.

Language RequirementsProof of your language abilities

If you have some abilities in both English and French, decide which of the twois your first official language. The other is your second official language.

You must prove your abilities in your first official language only. There arethree ways to do this. You can:

•take an IELTS test to prove your ability in English or

•take the TEF to prove your ability in French.

Note: IELTS and TEF are the only “designated language testing agencies.” Your score will thenbe related to the CLB – Canadian Language Benchmarks – a score of CLB5 or better is required

•Finally, you may provide other written evidence of your abilities.

Business ClassThe Business Immigration Program seeks to attract experienced business

people to Canada who will support the development of a strong andprosperous Canadian economy.

Business immigrants are expected to make a C$400,000investment or to own and manage businesses in Canada.

Canada has three classes of business immigrants:

•INVESTORS

•ENTREPRENEURS

•SELF-EMPLOYED PERSONS

Investors must:

•Have at least two years of business experience.

•Have a net worth of at least C$800,000 that was legally obtained,and be willing and able to make an investment of C$400,000.

• have enough money to support themselves and their dependantsafter they arrive in Canada.

•Obtain a minimum of 35 points in the selection grid.

•Meet medical and security requirements. They and their familymembers must pass a medical examination and security andcriminal checks.

•Meet any other requirements of Canadian or Quebec immigrationregulations.

Entrepreneurs must:

•have managed a qualifying business and have had control of apercentage of equity of the qualifying business for at least two years

• be able to satisfy a visa officer that the fair market value of all theirassets and the assets of their spouse or common-law partner wereobtained legally. Total assets must exceed the fair market value of alltheir liabilities and the liabilities of their spouse or common-law partnerby at least C$300,000.

• be able to prove that no portion of their net worth was obtained throughcriminal activity.

•have a score of 35 or better on the points grid

• pass a medical examination and security and criminal checks.

Self-employed persons must :

•have participated , be self employed, or be involved in managementat a world-class level in cultural activities, farming, or athletics

•pass a medical examination and security and criminal checks.

•show that they have enough money to support themselves and theirdependants

•meet any other requirements of Canadian and provincial orterritorial immigration regulations.

•Have at least two years of relevant experience and the intention andability to be self-employed in Canada and to make a significantcontribution to specified economic activities in Canada.

Provincial Nominees must:

•have been nominated by a province or territory

•make a separate application to Citizenship and ImmigrationCanada (CIC) for permanent residence.pass a medical examination and security and criminalchecks.

•show that they have enough money to support themselvesand their dependants

*Provincial nominees are not assessed on the six selection factors of theFederal Skilled Workers Program.

Family Class :A spouse, common-law or conjugal partner, or dependent children may be eligible toimmigrate to Canada as permanent residents if they have a sponsor.

The sponsor, and their relative must meet certain requirements.

•medical, criminal and background screening.

Sponsors must:

-be a Canadian citizen or a permanent resident of Canada.

-be 18 years of age or older.

- promise to support them financially/meet income requirements to prove support is available

-sign a sponsorship agreement that commits them to provide financial support for their relative(for three years from the date they become a permanent resident.

They must provide financial support for a dependent child for 10 years, or until the child turns 25,whichever comes first. )

Relatives must:

-sign a sponsorship agreement that commits them to make every effort to support her or himself.

Spouse (must be over 16 years of age)

-You are a spouse if you are married to your sponsor and your marriage is legallyvalid.

-You can apply to sponsor your same-sex partner as a spouse if:

you are a Canadian citizen and permanent resident and you were married in Canadaand issued a marriage certificate by a Canadian province or territory / as long as themarriage is legally recognized according to both the law of the place where themarriage occurred and under Canadian law.

-You are a common-law partner—either of the opposite sex or same sex—if:

you have been living together in a conjugal relationship for at least one year in acontinuous 12-month period that was not interrupted. (You are allowed shortabsences for business travel or family reasons, however.) You will need proof thatyou and your common-law partner have combined your affairs and set up ahousehold together.

-Conjugal partner

This category is for partners—either of the opposite sex or samesex—in exceptional circumstances beyond their control thatprevent them from qualifying as common-law partners or spousesby living together. - have maintained a conjugal relationship withtheir sponsor for at least one year and have been prevented fromliving together or marrying because of: an immigration barrierprior marital status (for example, you are married to someone elseand living in a country where divorce is not possible) or yoursexual orientation (for example, you are in a same-sexrelationship and same-sex marriage is not permitted where youlive) you can provide evidence there was a reason you could notlive together (for example, you were refused long-term stays ineach other’s country).

Dependent children

-is under the age of 22 and does not have a spouse orcommon-law partner

is a full-time student and is substantially dependent ona parent for financial support since before the age of22, or since becoming a spouse or common-lawpartner (if this happened before age 22) or isfinancially dependent on a parent since before the ageof 22 because of a disability.

Refugee Class

Refugees and people needing protection are people in oroutside Canada who fear returning to their home country. Inkeeping with its humanitarian tradition and internationalobligations, Canada provides protection to thousands of peopleevery year.

Canada offers refugee protection to people in Canada who fearpersecution or whose removal from Canada would subjectthem to a danger of torture, a risk to their life or a risk of crueland unusual treatment or punishment.

Convention Refugee

•are people who are outside their home country or the country wherethey normally live, and who are unwilling to return because of awell-founded fear of persecution based on:

race - religion -political opinion - nationality or membership in aparticular social group, such as women or people of a particularsexual orientation.

Person in need of protection

•A person whose removal to their home country or country wherethey normally live would subject them personally to:

a danger of torture;

a risk to their life; or

a risk of cruel and unusual treatment or punishment.

Safe Third Country Agreement

Under an agreement with the United States, refugee claimantsmust seek asylum (protection) in the first safe country where theyarrive. For example, if you entered Canada at a land border fromthe United States, you will not be able to claim refugee protectionin Canada. Sometimes there are exceptions (such as those whoalready have family in Canada).

Becoming a Canadian citizen!

To be eligible to become a Canadian citizen, you mustmeet the requirements in all of the following areas:

Age

•You must be at least 18 years old to apply for Canadiancitizenship.

•for a child under 18, the following conditions are met:

•the person applying is the child’s parent, adoptive parent orlegal guardian

•the child is a permanent resident, but does not need to havelived in Canada for three years and

•one parent is already a Canadian citizen or is applying tobecome a citizen at the same time. This also applies to adoptiveparents.

Permanent resident status

To become a Canadian citizen, you must have permanent residentstatus in Canada, and that status must not be in doubt. This meansyou must not be the subject of an immigration investigation, animmigration inquiry or a removal order (an order from Canadianofficials to leave Canada).

Time lived in Canada

To become Canadian citizens, adults must have lived in Canada forat least three years (1,095 days) in the past four years beforeapplying. Children do not need to meet this requirement.

Language abilities

Canada has two official languages—English and French. Theyneed to be able to speak one of these two languages well enoughto communicate with people.

Criminal history (prohibitions)You cannot become a citizen if you:

•have been convicted of an indictable (criminal) offence or an offenceunder the Citizenship Act in the three years before you apply

•are currently charged with an indictable offence or an offence underthe Citizenship Act are in prison, on parole or on probation

•are under a removal order (have been ordered by Canadian officials toleave Canada)

•are under investigation for, are charged with, or have been convictedof a war crime or a crime against humanity

•have had Canadian citizenship taken away in the past five years.

To become a citizen, you must know the rights andresponsibilities of citizens, such as the right and responsibility tovote. You must also know some things about Canada’s historyand geography, and about its political system.
