    INTERPRETATION DFINITIONS

    Definitions 1.(1)The definitions in this subsectionapply in these Regulations.

    ActLoi

    Act means the Controlled Drugs andSubstances Act.

    adult adulte

    adult means an individual of 18 years ofage or older.

    advertisementpublicit

    advertisement, in respect of a targetedsubstance, includes any representation byany means for the purpose of promoting,

    directly or indirectly, the sale or other dis-posal of the targeted substance.

    common-lawpartner conjoint de

    fait

    common-law partner in relation to an in-dividual, means a person who is cohabitingwith the individual in a conjugal relation-ship, having so cohabited for a period of atleast one year.

    Department ministre

    Department means the Department ofHealth.

    designated drugoffence

    designated drug offence means

    (a)an offence against section 39, 44.2,44.3, 48, 50.2 or 50.3 of the Food andDrugs Act, as those provisions read im-mediately before May 14, 1997;

    (b)an offence against section 4, 5, 6,19.1 or 19.2 of theNarcotic Control Act,as those provisions read immediately be-fore May 14, 1997;

    (c)an offence under Part I of the Act,except subsection 4(1); and

    (d)a conspiracy or an attempt to com-mit, being an accessory after the fact inrelation to, or any counselling in relationto, an offence referred to in paragraphs(a) to (c).

    (a)is licensed, approved or designatedas a hospital by a province under thelaws of the province to provide healthcare or treatment to persons or animals;or

    (b)is owned or operated by the govern-ment of Canada or of a province and thatprovides health services.

    import permitpermisdimportation

    import permit means a permit issued un-der section 37.

    internationalobligation obligationinternationale

    international obligation means an obliga-tion relative to a targeted substance set outin a convention, treaty or other multilateralor bilateral instrument that Canada has rati-

    fied or to which Canada adheres.licenseddealer distributeurautoris

    licensed dealer means the holder of adealers licence issued under these Regula-tions.

    package emballage

    package includes anything in which atargeted substance is wholly or partly con-tained, placed or packed.

    pharmacistpharmacien

    pharmacist means an individual who

    (a)is registered or otherwise authorizedunder the laws of a province to practise

    pharmacy; and(b)is practising pharmacy in thatprovince.

    prescription ordonnance

    prescription means, in respect of a tar-geted substance, an authorization from apractitioner stating that a specific amount

    a)toute infraction vise aux articles 39,44.2, 44.3, 48, 50.2 ou 50.3 de la Loi surles aliments et drogues, dans leur ver-

    (2)A pharmacist, a practitioner or theindividual in charge of a hospital may de-

    stroy a targeted substance if

    (a)before the destruction, the pharma-cist, practitioner or individual records in-formation with respect to the destruc-tion, including the name, strength perunit and quantity of the targeted sub-stance to be destroyed;

    (b)the targeted substance is destroyedusing a method of destruction that con-forms with all applicable federal, provin-cial and municipal environmental legis-lation;

    (c)the person records the date of de-struction;

    (d)subject to subsection (3), the de-struction is witnessed by a pharmacist ora practitioner; and

    (e)immediately following the destruc-tion, the person who destroyed the tar-geted substance and the witness referredto in paragraph (d) sign and print theirnames on a joint statement, indicatingthat they witnessed the destruction andthat the targeted substance destroyed hasbeen altered or denatured to such an ex-tent that its consumption has been ren-dered impossible or improbable.

    Possession (2)The following persons may possessa targeted substance set out in Part 2 ofSchedule 1:

    (a)a person who requires the targetedsubstance for their business or profes-sion and is

    (i)a licensed dealer acting in accor-dance with their licence,

    (ii)a pharmacist, or(iii)a practitioner who is registeredand entitled to practise in the provincein which the practitioner has such pos-

    session;(b)a practitioner who is registered andentitled to practise in a province otherthan the province in which the practi-tioner has such possession and such pos-session is for emergency medical pur-poses only;

    (c)a hospital employee or a practitionerin a hospital and such possession is forthe purposes of and in connection with

    such employment;(d)a person who has obtained the tar-geted substance for their own use or forthe benefit of another person or an ani-mal under their care

    (i)from a practitioner in the course oftreatment for a medical condition, or

    (ii)from a pharmacist pursuant to aprescription issued or obtained in con-formity with these Regulations;

    (e)a person who has imported the tar-geted substance in accordance with sec-tion 68 for the persons own use or forthe benefit of another person or an ani-mal under their care;

    Inspection ofpremises

    12.In order to confirm any informationcontained in an application for a licencemade under these Regulations or an

    amendment or a renewal of a licence, aninspector may, at a time during normalbusiness hours that is convenient for theapplicant and with the reasonable assis-tance of the applicant, inspect the premisesfor which the licence, amendment or re-newal is requested.

    (f)in the case of the importation of atargeted substance, has an import permitissued under section 37; and

    (g)in the case of the exportation of atargeted substance, has an export permitissued under section 43.

    (a)in the case of a hospital, a pharma-cist practising in the hospital or a practi-tioner authorized to place orders for thesubstance on behalf of the hospital;

    (b)in the case of a licensed dealer, aperson who is authorized to place an or-der for the substance on behalf of the li-censed dealer; or

    (c)in any other case, the person towhom the substance is to be sold or pro-vided in accordance with the Act andthese Regulations.

    Qualifications (2)The qualified person in charge and,if applicable, the alternate qualified personin charge must

    (a)be familiar with the provisions ofthe Act and the regulations that apply tothe dealers licence held by their em-ployer and have a sufficient knowledgeof chemistry and pharmacology and ex-perience in those fields to properly carryout their duties;

    (b)be a pharmacist or a practitioner au-thorized or entitled to practise by aprovincial professional licensing author-

    ity or possess a degree in an applicablescience such as pharmacy, medicine,dentistry, veterinary medicine, pharma-cology, organic chemistry or chemicalengineering awarded by a Canadianuniversity or by a foreign university rec-ognized by a Canadian university or aCanadian professional association; and

    (c)not have been convicted, as an adult,in the previous 10 years, of

    (i)in Canada, a designated drug of-fence, or(ii)in a country other than Canada,an offence that, if committed inCanada, would have constituted a des-ignated drug offence.

    )the name, date of birth and gender ofthe individual in charge of the premises

    referred to in subparagraph (a)(ii);

    (i)the brand name of each product orcompound,

    (ii)the specified name of the targetedsubstance in each product or com-pound,

    (iii)the strength per unit of the target-ed substance in each product or com-pound,

    (iv)the quantity or package sizes ofeach product or compound, and

    (v)if the product or compound wouldbe made or assembled by or for anoth-

    (ii)the quantity, other than a productor compound that contains a con-trolled substance that is included inSchedule 1, that the applicant expectsto produce under the dealers licenceand the period during which thatquantity would be produced, and

    (iii)if the substance would be pro-duced for another licensed dealer un-der a custom order, the name, addressand licence number of that other deal-er;

    (h)a description of the security mea-sures, as determined in accordance withthe Security Directive, at the applicants

    premises referred to in subparagraph(a)(ii);

    (i)a description of the method that theapplicant proposes to use for recordingtheir targeted substance transactions; and

    (j)for any activity set out in subsection15(1), other than the activities describedin paragraphs (f) and (g), the specifiedname of the targeted substance and thepurpose for carrying out the activity.

    (a)the applicant is not an eligible per-son described in section 18;

    (b)an inspector, who has requested aninspection, has not been given the op-portunity by the applicant to conduct aninspection under section 12;

    (c)false or misleading information orfalse or falsified documents were sub-mitted in or with the application;

    (f)the applicant does not have in placethe security measures set out in the Se-curity Directive in respect of an activityfor which the licence is requested;

    (g)the applicant is in contravention ofor has contravened in the past 10 years

    (i)a provision of the Act or any regu-lations made or continued under theAct, or

    (ii)a term or condition of anotherdealers licence or an import or exportpermit issued to it under any regula-tions made or continued under theAct;

    (h

    )the issuance, renewal or amendmentof the licence would likely create a risk

    to security, public health or safety, in-cluding the risk of the targeted substancebeing diverted to an illicit market or use;

    (i)the individual in charge of thepremises, the qualified person in chargeor, if applicable, the alternate qualifiedperson in charge has been convicted, asan adult, in the previous 10 years, of

    (i)in Canada, a designated drug of-fence, or

    (ii)in a country other than Canada,an offence that, if committed inCanada, would have constituted a des-ignated drug offence;
