    ord Civil has been involved with GPR

    Lequipment for over 18 years and is proud to have developed and introduced the first GPR systems into

    Australasia. With our head office located in

    Christchurch and a branch in Sydney,

    LORD Civil services the Australian, Pacific

    Islands, and New Zealand markets. The

    company has been heavily involved for

    many years in supporting the development

    of expertise and practice related to the use

    of GPR, ranging from utility location, road

    bed studies, to concrete structure

    assessment, each of these making a

    major contribution post-earthquake.

    An award in 2014 of a patent in sub-

    surface utility location methods secured

    LORD Civil's leadership in this major area

    of market need. The technology was taken

    up by SCIRT and is also now integrated in

    the recent NZ Transport Agency's

    Minimum Standard for Zero Harm-Utilities.

    Based upon its intellectual property, LORD

    Civil developed an associated

    competency-assessed training course for

    SCIRT in utility location to prescribed

    outcome qualities and this remains the

    only such course in NZ or Australia.

    GPR solutions pioneered by LORD also

    include mapping of voids under houses

    with concrete slabs, this now being a

    major industry in Christchurch as grout

    can be directed correctly and quantity

    surveyed prior.

    An interesting fact is that the maturity of

    GPR technology coinciding with the scale

    and nature of the seismic events our

    community has experienced has provided

    the opportunity to apply all facets of GPR

    technology in a first world environment. As

    with many other facets of the rebuild; what

    has been discovered and accomplished

    by the use of GPR in Canterbury is world

    leading.

    How does it work?

    Ground Penetrating Radar in layman

    terms works in a similar manner to a Fish

    Finder; whereby a signal is transmitted into

    the target area and the reflected energy is

    recorded. Through software

    representation of the reflected energy we

    can determine a lot about what lies

    beneath the surface.

    How is it used some

    examples:

    For the constructor - GPR is used to

    scan an area before breaking ground to

    Be it locating sub surface pipes and cables, assessing concrete

    structures, carrying out archaeological investigations, or

    performing Geotechnical Analysis, Ground Penetrating Radar

    provides something that many other forms of Non-Destructive

    Testing cannotsafety and certainty.

    ensure the likelihood of hitting a buried

    utility is mitigated; we can all appreciate

    the difference between hitting a water line

    versus the worst case scenario of hitting a

    live cable or gas line whilst digging up the

    pavement; both have a financial cost but

    the latter two may well be deadly as

    opposed to an inconvenience.

    For the engineer Being able to scan

    an area of concrete to confirm the nature

    of construction (reinforcing bars being

    able to be imaged in 3D), arrangement

    and layout of reinforcing, post tension

    cables and fixings along with quantity and

    quality surveying data.

    For the tradesman Being able to

    better understand the nature and scope

    of a repair task and being able to record

    and communicate this to the home owner

    and other interested parties.

    For the property owner - Peace of

    mind; GPR when applied correctly in

    terms of the equipment type applied and

    the method utilised allows data on sub-

    floor voids to be collected reliably and

    comprehensively so that decisions are

    evidence based.

    As with any technology a skilled

    operator is essential. LORD Civil has

    specialised training courses for all

    applications and many contractors now

    offer the LORD solutions commercially.

    LORD Civil is also available to advise on

    applications and how they might best be

    commercially implemented.

    For those contemplating using GPR

    services it is essential that you ask if the

    operators hold any formal training

    certificates or competency 'tickets',

    particularly if they are locating utilities. Get

    references, ask to see examples of formal

    reports done on specialist work, and

    shop around for demonstrated

    professional service.

    Perhaps one of the coolest developments since the industrial revolution is the

    human ability to develop, fund and grow technology that protects both human

    life and the environment in which we live.

    This issue we profile some local projects which meet both briefs and they

    stand to change the way we design and build in the future.

    Part of the Government's local education renewal scheme, Pegasus Bay

    School is designed to achieve a NZ Green Building Council 5 Green Star

    Certification, and that's not even the coolest part.

    That honour would go to the fact that Pegasus Bay School is New Zealand's

    first 'net zero energy' school. While net zero energy doesn't mean zero cost,

    what it does mean is that the school produces as much energy as it uses,

    thanks to 560m2 of solar electric panels across its roof.

    This energy feeds the school's lighting, computers and underfloor heating

    system, with excess fed back into the national grid, while solar hot water

    systems meet the school's water heating needs.

    And the Ministry of Education isn't the only one turning tech into triumph.

    We look at Trimble Navigation's new award winning local base and the quake-

    safe technology which make it one of the first of its kind in Australasia.

    But the technology that sets this building aside from the rest goes beyond the

    core structural system, with building tenants and designers collaborating to

    install a smart building monitoring system.

    behaviour of land or structures, information which enables tenants to make

    informed decisions to address potential problems, ensure structural integrity

    - The Influencers

    I've made a number of visits to Christchurch over

    recent months and each time it's pleasing to see the

    visible signs of progress being made on the rebuild.

    Over the past few months in Christchurch, I've opened

    the new tram line, turned the first sod on the $112

    million gateway roading project, attended the opening

    ceremony and first match of the ICC Cricket World

    Cup, as well as opened the new purpose built facilities

    for Tait Communications.

    The $112 million gateway roading project will expand

    the Western Corridor to four lanes and provide much

    better links throughout greater Christchurch, which is

    critical for the growth of not only Canterbury, but the

    South Island.

    Last month, the Government also announced another

    350 public servants will relocate into a major new

    development in central Christchurch.

    A new office building will be built on the corner of

    Hereford Street and Cambridge Terrace the site of

    the former central police station and house staff from

    the Ministry of Education, Housing New Zealand and

    the Ministry of Health.

    This is in addition to the 1100 staff from 13

    government agencies that the Government announced

    last year would move into three new central city

    buildings by the end of 2016.

    Further developments will take shape in the central city

    over the next few months, as more than 200 buildings

    are either underway or have been consented to at a

    value of $438 million. Later this month, the city's new

    $53 million Bus Interchange is also expected to open.

    While I acknowledge there are genuine frustrations

    from some people due to ongoing insurance

    settlement disputes, the perceived slow progress on

    some projects or other issues, overall there is much to

    be excited about as the rebuild momentum builds.

    The National-led Government is committed to

    continuing to support the rebuilding of Christchurch

    and to making it an even better place to live, work and

    raise a family in.

    We need an efficient Lyttelton Port but the public

    also need a proper say in what happens in and

    around Lyttelton Harbour.

    It's very disappointing that the Government is using

    Christchurch's emergency legislation to push through the

    Port Company's expansion plans.

    Environment Canterbury's (ECan) Lyttelton Port Recovery

    Plan proposes a major 27 hectare reclamation of land to

    extend the container port. This will change the shape of the

    coast and potentially affect tidal flows and sedimentation in

    the harbour.

    The reclamation will require large amounts of rock to be

    blasted from nearby cliffs. This will have significant impact

    on the landscape and biodiversity values, and create noise

    issues for the people living in and using the harbour basin.

    The community cannot scale back the 27 hectare size of the

    reclamation because the Government's appointed ECan

    commissioners have made it a controlled rather than

    discretionary activity. This means the Council must agree to

    it.

    The public only gets a month to make submissions and has

    to wade through volumes of technical reports that took the

    Council and the Port Company more than six months to

    prepare.

    The process under the emergency powers means Minister

    Brownlee signs it off. There is no opportunity for the public

    to challenge the plan in the Environment Court as there is

    under the usual Resource Management Act (RMA) plan

    process.

    Emergency powers have also been used to reduce public

    input on the re-opening of the Lyttelton-Sumner Road. The

    Council and the New Zealand Transport Agency are

    proceeding with the most expensive option with major

    blasting of cliffs in a scenic reserve on public conservation

    land. This conveniently produces the most rock for the port

    reclamation.

    It's time for emergency powers to end. The earthquake

    emergency is long gone. Normal RMA planning rules should

    apply.

    The public should be able to influence what happens to

    their harbour and nearby public conservation land.

    Another tough Canterbury winter can be a daunting

    prospect but Cantabrians are a hardy lot and, the

    great thing is, there is plenty to look forward to in

    Christchurch when we emerge from the colder months.

    One of the things I am most looking forward to is the

    opening of the new Margaret Mahy Family Playground in

    time for the Christmas holidays.

    Located between Madras, Manchester, and Armagh

    Streets and Oxford Terrace this is much more than your

    average playground. In fact, it will be one of the largest in

    the world and I think, one of the most exciting.

    With familiar themes like the Canterbury Plains and Port

    Hills, it is designed to attract the whole family into the

    central city to have fun together, socialise, and see what

    else is on offer in this fast-developing city.

    Not far from the playground, in an area known as the

    North Frame, there is exciting potential for a new

    community garden. Earlier this year there were

    workshops about the possibilities of a garden beside

    Cambridge Terrace, to the west of the former PGC site.

    What I love about this kind of idea is it promotes

    sustainable central city living and, with the playground,

    will bring people together in our central city.

    Te Papa tkaro / Avon River Precinct will have moved a

    long way forward by spring with an inviting new

    promenade developing along the river. The Terraces will

    be taking shape too, near the Bridge of Remembrance,

    with grassed areas, tiered seating, and ramps and decks

    leading down to the river.

    Recently I was privileged to attend the reopening of the

    Antigua footbridge. I remember riding my bike across the

    bridge as a kid, and it's great that the young and the

    young at heart can use the bridge once again.

    The footbridge is another significant step in Christchurch

    getting back on its feet literally in this case.

    Stay safe over the winter months and remember there's

    plenty to look forward to throughout the year.

    While the Christchurch central city occupies centre

    stage in the rebuild, the industrial property sector is

    the unsung hero of the market and is continuing to

    attract enormous interest.

    We believe that considerable unsatisfied demand this year is

    set to further fuel the sector's already stellar performance

    and we expect to see continued pressure on investment

    yields.

    Interest rates are cyclically low and early indications in 2015

    suggest they are likely to be lower for longer yet. This has

    enabled a re-rating of risk margins. Average prime industrial

    yields pushed below 7 percent at the end of 2014, the first

    time in our 20-year historical time series. Investors and

    owner-occupiers have bolstered the market's exuberance,

    both confident that industrial property is a solid bet at current

    margins.

    In Canterbury, arguably the biggest beneficiary of post quake

    activity is Hornby and Rolleston, both from a residential and

    industrial perspective. The Rolleston area is booming and

    business parks, such as Izone and the new Carter Group

    Development, are in increasing demand. Such activity is in

    no small part helped by the $900 million upgrade of

    Canterbury's motorways, part of the national roads of

    significance project.

    The completion of Stage 1 of the Southern Motorway is

    certainly fuelling interest in the area, as freight transport is

    made easier from Lyttelton Port right through to Rolleston.

    Construction of Stage 2, which includes widening the

    existing highway to just north of Rolleston, will be tendered

    early in 2016.

    In industrial leasing, we've seen rentals begin to plateau as

    the market has become more competitive with increasing

    availability of existing and new stock. For instance, Goodman

    Property Trust has recently built two spec units of 1600m2

    and 2000m2 in its Glassworks Industry Park which have both

    been leased by Colliers. We expect this competitive trend to

    continue.

    It is useful from time to time to think ahead and

    consider our positioning in the future and what it might

    all mean to us.

    This is very important in the context of the Christchurch

    rebuild.

    Here are ten questions we might be asking ourselves in

    2026:

    1) Why didn't we appreciate the scale of the rebuild and

    the consequential impacts of tipping $40+ billion

    dollars into a population of 360,700?

    2) Why were we so optimistic about timeframes?

    3) Do we remember just how well insured we were?

    4) Did we underestimate the long term psycho-social

    impacts of the earthquakes?

    5) Why didn't we settle earlier, on a common aspiration

    for our city, our region and our island?

    6) Did we get Central Government, Local Government

    and our community really working towards agreed

    common objectives?

    7) Did we put enough emphasis on the economic

    interdependencies between our city and our region?

    8) Did we recognise early enough the importance of

    ensuring Council owned strategic asset sales were

    finalised in a way that made Christchurch more

    internationally significant?

    9) Did we get our transport infrastructure right; easy

    access in and around our city and parking in the

    central city?

    10) Why did we ever doubt that we would create the

    most attractive and liveable city in Australasia post-

    earthquake?

    Every month we seem to hear of more exciting new

    builds in our CBD and we are able to celebrate the

    completion of new buildings.

    The new Deloitte House on the corner of Armagh and

    Cambridge Terrace was opened by our Prime Minister on

    April 16. It is a real credit to Stephen Collins who

    commissioned and built it. To me it sets a very high

    benchmark for all other new builds to aspire to.

    Ngi Tahu also announced their $150 million office

    apartment and car park complex on the old Police building

    and King Edwards barracks site. It will house up to 1,500

    workers from various Government departments plus EY's

    (formerly Ernst&Young) new offices.

    The big engineering firm Aurecom is also to move into this

    development, the first to contain residential apartments in

    the core CBD. I was thrilled to see Ngi Tahu also realises

    the critical need for CBD parking by incorporating a 600+

    car parking building.

    The brand new Tait Electronic offices also were opened in

    April. This is a fantastic Canterbury growth business that

    exports communications equipment to the four corners of

    the world in a very fast changing and competitive

    environment. Well done Tait.

    The start of the Memorial Avenue/Russley Road flyover

    system also started in April and this two year project will

    act as the premier gateway from our airport for most

    visitors to Christchurch. Not only will it serve to solve the

    traffic congestion of this intersection, but it will have some

    huge architectural arches spanning this flyover as a

    powerful statement to our visitors.

    These extra arches will cost $7 million and are purely for

    aesthetics. Great to see transport NZ is also wanting to

    make Christchurch feel really special. Roads and bridges

    can all too often be a bit boring.

    The pace of the rebuild is really on in the CBD with so

    many buildings now off the drawing board and into

    construction. It's worth having a wander down Tuam Street

    east of High Street to see the new Vodafone building and

    Kathmandu buildings also rising out of the ground here.

    From 1 January this year new protection measures

    came into force under the Building Act 2004 (Act).

    The effect of the change is to provide more

    information and protection to parties who enter into

    residential building contracts for building work to

    household units where the value of the work exceeds

    $30,000.00.

    The Act defines building work as construction,

    alterations, demolition and removal of a building, site

    works and for work in connection with those activities. A

    household unit is defined as being a building or group

    of buildings intended to be used only or mainly for

    residential purposes by one household and excludes

    hostels, boarding houses and other specialised

    accommodation.

    The changes to the Act require contractors to provide

    a disclosure statement and checklist to their clients prior

    to the clients signing the contract. Examples include

    details about the building contractor, information as the

    contractor's key contact person including their

    qualifications, skills and experience, details of insurance

    policies and information about guarantees and

    warranties the contractor is offering.

    All residential contracts for such building work must

    now be in writing and include the following details:

    ! Description of the work site and building work

    ! Start and completion dates

    ! Contract price and payment mechanisms

    ! Provisions for variations and delays

    ! How defects will be remedied (including an implied

    12 month defect liability period) and

    ! Dispute resolution provisions and how notices are

    served.

    The Act also contains implied warranties concerning

    the nature of the building work, the materials to be

    supplied and that the building work will be carried out in

    accordance with all laws and legal requirements relating

    to the building work. Further implied warranties require

    that the building work will be carried out with reasonable

    care and skill, completed by the time stated, and where

    a purpose for the building work is included that it will be

    reasonable fit for that purpose.

    Contractors are also required to provide further

    information after completion of the works. This

    information includes copy guarantees and warranties

    that apply to the building work and any maintenance

    information required.

    Failure to comply with these changes to the Act is an

    offence under the Act.

    The rapid up-scaling of contractor firms due to the

    huge increase in work from the Canterbury rebuild

    has resulted in many difficulties related to

    employment of staff. Builders and other tradies, who for

    years operated perfectly well by themselves, have been

    required to take on employees to cope with the

    workload and consequently have been drawn into the

    mine field of employment law.

    Having appropriate employment agreements,

    disciplining staff, sorting out pay and PAYE obligations

    are particularly difficult areas. The use of trial periods

    and knowing when they are enforceable can also trip up

    unwary employers.

    With shortages of skilled labour it can be a real benefit

    to employers to take on workers on a trial basis. The

    current employment legislation allows this and arguably

    encourages it by making it unlawful for employees to

    bring personal grievances if they have been dismissed

    during the trial period except on certain grounds such

    as discrimination.

    But there are real fish hooks associated with trial

    periods. The Employment Courts have strictly

    interpreted the legislation so it is vital to get everything

    absolutely correct in order to obtain the statutory

    protection. In particular:

    ! The trial period only applies to new employees

    ! The trial period must be part of a written

    employment agreement

    ! The intending employee must be given an adequate

    opportunity to read and take advice on the contract

    before they sign it

    ! The agreement must be signed before the

    employee commences work. Even a contract

    signed later on the first day of work has been held

    to be insufficient as they were already an employee

    and therefore not new when they signed!

    ! The trial period clause in the agreement must be

    worded properly to achieve the protection

    ! The over-riding requirement to use good faith in

    employment dealings means that the employee

    being dismissed should be at least told of the

    reasons why

    ! The notice of dismissal must be given during the

    trial period although it may expire after the trial

    period.

    These principles apply equally to casual and part time

    staff. It is therefore vital that employers get appropriate

    advice on their employment agreements and ensure that

    these are up to date and compliant with the legislation.

    The process of employment must be understood.

    Money spent on this now will save much more

    expense later if it all goes wrong and a personal

    grievance lands in your mail
