How to make a ClaimOur aim is to get Your car back on the road as quickly as possible. Webelieve that making a claim should be easy. Our Car Claims Teams areavailable 24 hours a day, 365 days a year to assist You with Your queriesyou can e-mail us at [email protected].

1.Telephone Our Car Claims Team on 01 8599700 with the firstnotification of Your claim. They will advise You what to do next andissue all appropriate documentation immediately.

2.Where Comprehensive Cover applies Our Approved Repairer Networkcan be availed of. In the event of the vehicle being unfit to drive theywill tow Your vehicle. This will safeguard the vehicle from any furtherdamage from vandals or against theft of parts. Repairs can commenceimmediately. If the Approved Repairers are not used, obtain anestimate and advise Us immediately and We can appoint an assessor ifnecessary. You may appoint an assessor to act in Your interest (anysuch appointment will be at Your expense).

3.When repairs have been completed pay any contribution for which Youmay be responsible (The Excess) and then take delivery of Your car.

Our Contract with You

This policy is a contract between us and you.

The contract is based on the information you gave as detailed in the statementof insurance. You must read the policy, the schedule, the declaration,certificate of motor insurance and any endorsements together as they allform part of the contract.

You are covered, subject to the cover selected as shown in the schedule, andthe terms conditions and exceptions to the policy, for liability, loss or damagethat occurs as long as you have paid, or agreed to pay the premium and wehave accepted your payment or agreement to pay.

Your cover is effective in the Republic of Ireland, the United Kingdom andabroad as specified in Section 4

Irish law will apply unless you and we have agreed otherwise.

The words and phrases defined havethe same meaning wherever they areused in this policy, the certificate ofmotor insurance or the schedule andare highlighted throughout in boldprint.

Definitions of Words Accessories Motoring equipment keptfor use with your car. This does notinclude a caravan or any other form oftrailer.

App An application you download toa mobile device

Audio Equipment Any radio, radiocassette, cassette player or compactdisc player permanently fitted to yourcar.

Car The motor car/vehicle shown onthe certificate of motor insuranceand described in the schedule.

Certificate of The document youmust have as proof that you have themotor insurance to comply with theMotor Insurance law.

Endorsement A change in the termsof the policy and is printed on theschedule.

Excess(es) The amount you will haveto pay towards a claim.

Insurer AIG Europe S.A.

Market value The cost of replacingyour car with a car of similar make,model, year, mileage, specificationand condition as your car wasimmediately before the loss ordamage you are claiming for.

Period of insurance The period youare covered for as shown in theschedule and any subsequentschedules.

Policy The documents consisting ofthis wording, the schedule, thecertificate of motor insurance andany endorsements.

Schedule The document that makesthe policy personal to you. It sets outthe period of insurance, the detailsof your car and the level of cover.

Statement of Insurance Thedocument that gives details of theperiod of insurance, you, otherpermitted drivers and all materialinformation relevant to the coverprovided. It forms the basis of yourcontract.

Terrorism Terrorism is any actincluding, but not limited to, thepreparation of, use of the threat of anyforce, violence or life threatening actby any person or group of personsacting alone or on behalf of or inconnection with any organisation orgovernment, whish appears to beintended to or from its nature and

Details of Policy Cover

Basis of Claims SettlementIf your car is damaged or stolen wewill, at our discretion, pay

a) the cost of repairing any damage toyour car; or

b) an amount in cash equivalent to thevalue of any loss or damage toyour car; or

c) the cost of replacing your car withone of a similar type and in similarcondition.

The maximum amount we will pay willbe the market value immediatelyprior to the loss or damage. However,this must not be more than theestimate of value you have given tous.

If, to our knowledge, your carbelongs to somebody else or is the

subject of a hire purchase or leasingagreement we will make any paymentto the legal owner. The maximum amount we will pay forloss or damage to audio/visualequipment, computer or computergames, telecommunications andnavigational equipment is €750,unless it is standard equipment foryour car when built.

We will pay the reasonable cost oftaking your car to the nearest suitablerepairer and, after repair, to youraddress as shown in the schedule.

New Car Replacement We will replace your car with a newone of the same make, model andspecification (provided it is stillavailable), if within 12 months of the

date of first registration as new andyou have been the first and onlyregistered keeper

n your car is stolen and notrecovered or;

n the cost of repair or damagecovered by this Policy exceeds 60%of the list price, inclusive of taxes,when your car was new.

n the recorded mileage on your carnot having exceeded 12,000 milesor 18,000 kilometres.

If we replace your car we will thenown your old car.

Towage and Storage. The maximum limit we will pay for allfees connected with towage andstorage of your car provided you notifyus within 48 hours of any accident orloss will be €300.

If you notify us more than 48 hoursafter any accident or loss we willdetermine the amount we deemreasonable to pay you for feesaccumulated.

Replacement Locks If the car keys or lock transmitter arestolen or lost of your car are stolenduring the period of insurance we willpay for the cost of replacing: n the door locks and / or boot

lock;

n the ignition / steering lock; n the lock transmitter and central

locking interface. Provided it can be established that theidentity of the garaging address ofyour car is known to any persons inreceipt of such keys or transmitters.

The maximum amount we will pay is€500.

n The first €300 of any claim n In addition the following accidental damage excesses also apply:

- €300 whilst your car is being driven by or in the charge of an insureddriver aged 21 - 24 or an insured driver who has held a full Irish or UKlicence for less than 12 months - €200 whilst your car is being driven by or in the charge of an insureddriver aged 25 or over with a full UK/EU or Irish Licence held for less than12 months.

n Damage to tyres caused by braking or by punctures cuts or bursts n Loss or damage where the windows are left open or the doors left unlockedn Mechanical, electrical, electronic or computer fault, failure, malfunction or

breakdown n Loss of use or consequential loss of any kind n Any reduction in the market value of your car following repair n Wear and tear or depreciation n That part of the cost of any repair or replacement which improves your car

beyond its condition before the loss or damage occurred n The cost of parts in excess of the manufacturer’s last list price n Loss or damage to your car as a result of fraud or trickery of any kind n Cassette tapes and compact discs n Loss or damage as a result of confiscation or detention by Customs or other

officials, any government public or local authority n Loss or damage caused by moth, vermin, insects or infestation or by

domestic petsn Loss or damage arising from your car being filled with the wrong fueln Loss or damage arising from the use of substandard or contaminated fuel,

lubricants or parts. n Loss or damage arising out of an accident where the driver was convicted,

or has a prosecution pending, under any Road Traffic legislation relating tothe level, concentration or quantity of alcohol or drugs in the body

Section 2 - Liability To Others We Cover

n Loss or damage caused by aninsured person to their ownproperty, or property for which theyare responsible, or which is in theircustody or control.

n Loss or damage to your car or anyborrowed vehicle.

n Death or bodily injury to any personarising out of that person’semployment by an insured person.

n Any decision of a court outside ofthe Republic of Ireland, unless theproceedings are brought orjudgement is given in a foreigncourt solely because your car was

used in that country and we hadagreed to cover it there.

n any amount exceeding€30,000,000, inclusive of costs andexpenses, in respect of loss ordamage to property for any claim orseries of claims arising from oneevent.

n Loss or damage arising from yourcar being taken or driven by aperson who is not an insured driverbut is a member of the policyholder’sfamily or household, or being takenor driven by an employee or ex-employee.

Section A. Legal Liability toOthersWe will pay the amount of damages,claimant’s costs and expenses andany other costs agreed between us inwriting arising from: n death or bodily injury to any

person; n accidental damage to the property

of any person; for which theinsured person is liable at lawresulting from an accident duringthe period of insurance involvingyour car.

Section B. Legal Costs andExpensesWe will pay the following costs andexpenses arising from an accidentoccurring during the period ofinsurance, as agreed in writing,which may result in a claim underthis insurance: n solicitor’s fees for representation at

any coroner’s inquest or fatalaccident inquiry or court ofsummary jurisdiction;

n reasonable legal costs fordefending a charge ofmanslaughter or reckless drivingcausing death

Section 3 - Additional CoversA. Glass in Windscreens and

WindowsA. We Cover

If the windscreen or windows in yourcar are damaged we will pay for thecost of repair or replacement and therepair of any resulting scratching tosurrounding bodywork

If this is the only damage you areclaiming your no claim discount willno t be affected

A. We do not cover - Also pleasesee General Exceptions on pages23-24

n Loss or damage to sunroofsn any amount over €225 if the repair

or replacement is not carried out byour approved glass replacementcompany.

B. Personal Accident B. We Cover

If you or your spouse are accidentallyinjured as a result of an accidentoccurring during the period ofinsurance: n while getting into, out of, or travelling

in any car and within three months ofthe date of the accident, the injury isthe sole cause of:

n death; n total and permanent loss of all sight

in one or both eyes;

n total loss of one or more limbs; n total and permanent loss of use of

one or more limbs; we will pay a lump sum of €10,000for each person following any oneaccident. If you or your spouse have any othermotor insurance with us, the maximumpayment we will make is limited to€7500.

B. We do not cover - Also pleasesee General Exceptions on pages23-24

n Injuries arising if: - the injured person is over the age

of 75 years; - the injury is as a result of

intentional injury, suicide orattempted suicide;

- the driver of the car arising out ofan accident was convicted, or hasa prosecution pending, under anyRoad Traffic legislation relating tothe level, concentration or quantityof alcohol or drugs in the body

- following a post mortemexamination found to have ahigher level of alcohol, or drugs inhis/her body than is prescribed inthe Road Traffic legislation of theterritory where the accidentoccurred

- the injury is caused by earthquake;- the injury is caused by riot or civil

commotion, other than in theRepublic of Ireland.

C. Personal Belongings C. We Cover

We will pay for accidental loss ordamage to personal belongingsoccurring during the period ofinsurance while in or on your car.This includes the contents of ahandbag.

The maximum amount we will pay is€300 in respect of any claim or claimsarising from one occurrence.

- mobile telephones - compact discs or cassettes - Money, stamps, tickets, documents

and securities. - Personal belongings in an open

top or convertible car unless in alocked boot or locked glovecompartment.

- Goods, samples or equipmentcarried in connection with anytrade or business.

- Personal belongings insured underany other policy of insurance.

- Any consequential loss of any kind- The theft or attempted theft of

personal belongings, if you carhas been left unlocked, left withthe keys in it or left with a windowor roof open

D. Medical Expenses We cover

We will pay for medical expensesoccurring as a result of injuriessuffered in an accident incurred duringthe period of insurance while inyour car.

The maximum amount we will pay is€150 for each person injured

E. Fire Brigade ChargesWe Cover

We will pay all charges levied by a fireauthority in accordance with theprovisions of the Fire Services Act1981 in respect of any event whichmay be the subject of indemnity underthis policy subject to a limit of €1,500in respect of any one accident.

F. DriverPlusWe Cover

We will pay for the insured driver toreceive advice and assistance from amedical and rehabilitationprofessional along with medicaltreatment costs from an approvedmedical care provider in the event ofan injury following an accident whiledriving up to a maximum value of€300.

We CoverA. Damage to Your Car Whilst

Travelling Outside the Republic ofIreland or the United Kingdom

This policy operates throughout theRepublic of Ireland and the UnitedKingdom including travel by seabetween ports in the Republic OfIreland. The cover under your policy isautomatically extended when your caris being driven or used in any of thefollowing countries for a maximum 45days in any one period ofinsurance:

n any other country which is amember of the European Union;

n Switzerland, Iceland, Norway andCroatia.

Cover applies while your car is beingtransported (including loading andunloading) along a recognised sea,air or rail route between any of theabove countries provided that theduration of the journey does notexceed 65 hours under normalconditions.

If you cannot drive your car becauseof loss or damage covered by thispolicy, we will pay the reasonablecost of delivering it to your address inthe Republic of Ireland. We will alsopay the amount of customs duty youhave to pay as a result of loss ordamage.

If your car will be driven in any of theabove countries for a periodexceeding 45 days in any one periodof insurance, cover will only beextended if you notify us in advanceof your car leaving the Republic ofIreland.

B. Legal Liability Whilst TravellingOutside the Republic of Ireland orThe United Kingdom

If your car is being driven or usedoutside the Republic of Ireland or theUnited Kingdom and cover has notbeen arranged with us in accordancewith Section A above, we will providethe minimum cover required by locallaw to allow an insured person todrive or use your car in:

n any country which is a member ofthe European Union;

n any other country whosearrangements meet therequirements of and are approvedby the Commission of the EuropeanUnion.

A. No Claim Discount

If you do not make a claim within theperiod of insurance the premium foryour car will be reduced inaccordance with our No ClaimsDiscount scale applicable at the time.

If a claim arises during the period ofinsurance, at renewal date we willreduce the No Claims Discount in linewith our no-claims bonus scaleapplying at renewal date.

If a claim arises during any period ofinsurance, we will reduce your noclaims bonus as followsIf two or more claims arise in any

period of insurance, we will reduceyour no-claims bonus to zero at yournext renewal

Your no-claims discount will not beaffected by

n Payment under Section 3aWindscreens and Windows

n Payment under Section 1, Section Bfor a single Fire & Theft Claim

n Payments for emergency treatmentthe law says we must pay

n Payments(together with associatedcosts and expenses) which we laterget back in full

n Payments for personal belongingsand replacement locks

Introductory bonusIf we have reduced your first premiumusing an introductory or acceleratedNo Claims Discount, we will removethe reduction if a claim arises duringthe period of insurance. We will dothis when you renew the policy.

You cannot transfer your no claimdiscount to anyone else and it canonly be used on one vehicle at a time.

B. Protected No Claim Discount

This cover only applies if yourschedule states that you haveProtected No Claim discount.

In the event of a claim under any partof this Private Motor Policy your noclaim discount will not be reducedunless you make more than 2 claimsin any 5 consecutive periods ofinsurance.

If 3 or more claims occur your NoClaim Discount will be reduced at thenext renewal.

If you carry passengers for social,domestic and pleasure includingcommuting to and from your or yourpassengers’ usual place of work andreceive a contribution towards yourcosts, we will not regard this asconstituting the carriage of passengersfor hire or reward, or regard your caras being hired provided that:a) your car is not constructed or

adapted to carry more than 7passengers, other than the driver;

b) the passengers are not beingcarried in the course of a businessof carrying passengers;

c) the total contributions received forthe journey concerned do notinvolve an element of profit.

Should you be in any doubt whetheryour car sharing arrangements arecovered by this Policy you should seekconfirmation from us immediately.

Section 6 – Car Sharing

If your Certificate of Insurance saysso, we will also cover you, thepolicyholder, in the event of anemergency, for your liability to otherpeople while you are driving anyother private motor car which you donot own or have not hired or leased,as long as;

1. the vehicle is not owned by youremployer or hired to them under ahire-purchase or lease agreement

2. you currently hold a Full EuropeanUnion (EU) Licence

3. the use of the vehicle is covered inthe Certificate of Insurance

4. cover is not provided by any otherinsurance

5. you are not connected in any waywith the Motor or Licence Trade

6. you have the owners permission to

drive the vehicle7. the vehicle is in a roadworthy

condition; and8. you still have your vehicle and it is

not damaged beyond cost-effectiverepair

9. The vehicle driven must be of thesame size and cylinder capacity asthe insured vehicle or alternativelyno higher than a 2000cc vehicle

This extension applies while beingdriven within the territorial limits andonly to private passenger vehicles. Itdoes not include;

n Vansn Car – Vansn Jeep – type vehicles with no seats in

the back; orn Vans adapted to carry passengers

We will pay for the following kinds ofbreakdown. Mechanical breakdown,fire, theft or attempted theft, maliciousdamage, punctures that need help tofix or to replace a wheel, lost keys,stolen keys and keys broken in thelock or locked in the car.

Cover applies in the 32 counties ofIreland, and in England, Scotland andWales. However, we do not cover thebenefits ‘Finishing the journey’ or‘Theft of your car’ while your car is inEngland, Scotland or Wales (apartfrom as set out below).

The following benefits are available.

1. Roadside and drivewayassistance

We will send a competent repairer tohelp you at the scene. If your vehiclecan be repaired immediately, we willprovide up to one hour free labour.You must be with the car when therepairer arrives. If you are not with thecar and we cannot help you, youmust pay for any help you then need.

2. Towing We will cover the cost of towing thecar to: n the nearest competent repairer; or n your own garage; whichever is closer.

3a) Finishing the journey in the 32counties of Ireland.

(Cover only applies when you aremore than 30 kilometres from yourhome.) If repairs cannot be carried outat the scene, we will pay for: n transport for you and your

passengers to your intendeddestination; or

n a replacement car for up to 48hours and transport back to collectyour car when repaired; or

n bed-and-breakfast accommodationwhile you and your passengers arewaiting for repairs to be finished (upto €35 for each person, and €150in total).

3b) Finishing the journey inEngland, Scotland or Wales.

If the repairer is not able to carry outrepairs at the scene of the breakdown,we will provide a replacement car forup to 48 hours. The most we will payfor this is £100 stg. If your car cannotbe repaired before your departuredate, we will pay for your car to betowed to the port in England, Scotlandor Wales you are leaving from. Themost we will pay for this is £250 stg.

4. Theft of your car If your car has been stolen and notrecovered within 24 hours, we willprovide a replacement car: n for up to five days; or n until your car is recovered;

This cover only applies in the 32counties of Ireland. You must alsoreport the theft to us and the Gardaíimmediately.

If you have an accident Only benefit number 2 applies if youhave an accident.

Messages We will pass on up to two urgentmessages on your behalf.

Exclusions to Section 8 We will not pay for the following. 1. Any liability or loss arising from

any act carried out in providingthe assistance service.

2. Expenses you can claim from anyother source.

3. Any claim arising where the car iscarrying more passengers ortowing a greater weight than itwas designed for, or arisingdirectly from unreasonable drivingon an unsuitable surface.

4. Any accident or breakdownresulting from a deliberate act.

5. The costs of repairing the car,other than as described in thebenefits section.

6. The costs of any parts, keys,lubricants, fluids or fuel needed tobe able to drive the car again.

7. Any claim caused by fuels, oils or

other flammable materials,explosives or toxins transported inthe car.

Limit of responsibility We will not be responsible to you ifwe are not able to provide theservices set out in this section.

The commercial conditions for hiring areplacement car apply. Theseconditions include, but are not limitedto, the following: n The driver must provide a full

driving licence, which must be freeof endorsements.

n The driver must provide a cash orcredit card deposit.

n The car must be returned to thepick-up point.

We will not be responsible to you ifwe fail to meet any of ourresponsibilities as a result of: n government control, restrictions or

prohibitions; n any other act or failure to act of any

public authority (includinggovernment), whether local,national or international;

n the fault of any supplier, agent orother person;

n labour disputes or difficulties; or n any other event beyond our

reasonable control.

18 Car Insurance Policy

These General Conditions apply to allsections of this Policy.

1. General We will provide the coverdescribed in this insurance if: a) any person claiming

indemnity or on whose behalfindemnity is claimed hascomplied with all of the termsand conditions of the policy

b) your car is being used ordriven in accordance with theterms of the Certificate ofInsurance

2. Your Duty to Prevent Loss orDamagea) You must maintain your car

in a safe and roadworthycondition and take allreasonable steps to safeguardagainst any loss, damage orbodily injury. Your car mustbe covered by a valid (NCT)certificate if one is required bylaw. In the absence of a valid NCTcertificate all cover underSection 1 is excluded

b) You Must maintain all tyres onyour car within the legal treaddepth requirements.If your tyres are below theminimum legal tread depthall cover under Section 1 isexcluded.

3. Material Facts If the details upon which thisinsurance was entered intochange you must advise us assoon as reasonably possible.These facts are shown in thestatement of insurance thatforms part of this policy.

4. Special Conditions Any Special Conditions shown inyour schedule apply to allsections of this policy unlessspecifically stated otherwise.

5. Cover When in the Hands of theMotor Trade Your car (or any borrowed vehiclewhere allowed by yourCertificate of Motor Insurance)must only be driven or used aspermitted by your Certificate ofMotor Insurance. Regardless ofthis, when your car is in thehands of a member of the motortrade for servicing or repair, thisinsurance continues to operate toprotect you.

6. Kilometres We reserve the right to establishthe kilometres on your car at anytime as your premium has beencalculated using the annualkilometres provided by you.Where the annual mileage hasbeen exceeded your premium willbe increased to reflect the correctkilometres driven and you will be

responsible to repay the shortfallin premium.

7. Driving Licence Conditions, Limits& Restrictions. n Any driver who is covered by

the terms of the motorcertificate must adhere to anyrestriction and/or conditions ontheir driving licence. Thisincludes conditions on thelicence relating to the class ofvehicle being driven.

n Any learner permit licenceholder who is covered underthe terms of the motorcertificate must adhere to therequirement to beaccompanied while driving atall times by another driverholding a Full Irish, UK or EUlicence

8. Payments Under CompulsoryInsurance If we are required to make apayment solely because of thecompulsory insurance law of acountry to which your policyapplies, you must repay thisamount to us.

9. Your Duty in the Event of a Claim In the event of a claim you must: a) notify us as soon as

reasonably possible with fulldetails of any incident, whichmay result in a claim and;

b) notify the Gardai as soon as

you are aware of any insuredproperty that has been lost orstolen;

c) take all reasonable steps torecover any lost or stolenproperty and notify us if suchproperty is recovered and / orreturned to you;

d) forward to us every claimform, writ, summons, legaldocument, or othercommunication in connectionwith any claim, or incidentthat may give rise to a claim,unanswered and withoutdelay;

e) provide us with all thenecessary information andassistance that we mayrequire;

f) not admit liability or make anoffer of payment without ourwritten consent;

g) not abandon any property tous;

h) provide all reasonableevidence to support yourclaim.

10. Our Rights in the Event of a Claim You must recognise our right to: a) take over and deal with the

defence or settlement of anyclaim in your name;

b) take proceedings in yourname, but at our expense, torecover for our benefit theamount of any paymentmade under this policy;

c) exercise full discretion overthe conduct of anyproceedings and in thesettlement of any claim.

d) we will withhold any claimssettlement payments until allbalances on your policyhave been settled in full.

11. Fraudulent or False Claims If any claim or part of a claim is inany respect fraudulent or if anyfraudulent means are used toobtain payment, includinginflation or exaggeration of theclaim or involve the submission offorged or falsified documents,then this policy shall become voidand any claim under it will beforfeited. If we have alreadymade any payment this must berepaid to us.

12. Law and Jurisdiction This policy is subject to Irish Lawand to the exclusive jurisdiction ofthe Irish Courts.

13. Cancellation a) If you find that this policy

does not meet your needs,return the documents to uswithin 14 days of receipt.

b) You may cancel this policy atany time and all cover willimmediately cease from thatdate. You must immediatelyreturn the Certificate ofMotor Insurance to us.

Any premium refund will becalculated on a pro-ratabasis provided no claim hasbeen made or has arisenunder this policy prior to suchcancellation during thecurrent period of insurance.

c) We may cancel this policy bygiving you 10 days writtennotice to your last knownaddress. All cover will ceasefrom that date. You mustimmediately return thecertificate of motorinsurance to us. Any premium refund will becalculated on a pro-ratabasis provided no claim hasbeen made or has arisenunder this policy prior to such cancellation during the current period ofinsurance.

e) In the event of a total lossclaim under this policy, allremaining premiums for theperiod of this policy willimmediately become due. Wereserve the right to deduct thisamount from the claimssettlement.

14. Other Insurance If at the time of any incident whichresults in a claim under this policythere is any other insurancecovering the same loss, damageor liability, we will only pay ourrateable share.

15. Payment by InstalmentsIf you pay your premium byinstalments under a creditagreement you must pay eachinstalment when it is due. Wehave only agreed to receive thepremium from your credit supplieron the condition that, if youdefault in payment of any of theinstalments due to the creditsupplier, and fail to comply withthe resulting statutory notice, wewill have the option to cancel thepolicy in accordance with thecancellation condition set outabove. If we do so, the sum duefrom you will be recalculated pro-rata based on the actual durationof cover. You must pay anybalance outstanding. If there hasbeen any overpayment by you,this will then be refunded.

16. Insurance Act 1936All monies which become or maybecome due and payable by usunder this policy shall inaccordance with Section 93 of theInsurance Act 1936 be payableand paid in the Republic of Ireland

17. Finance Act 1990The appropriate Stamp Duty hasbeen or will be paid inaccordance with the provisions ofSection 113 of the Finance Act1990.

18. Temporary Replacement vehicle

If the insured vehicle is out of useas a result of a claim for loss ordamage insured under this policywe will cover you for any hiringcharges you have to pay in gettinga temporary replacement car fromour recognised list of currentapproved repairers. Under this endorsement we willnot pay more than €200 for anyone event. This will not applywhere the only damage is brokenglass in the windscreen orwindows of the insured vehicle

19. Proof of DocumentationWe have the right to request atany time proof of documents(NCT, residency, licence etc) tosupport the Statement ofInsurance. Failure to producethese could result in your policybeing cancelled or specialconditions imposed

20. Conditions of XLNTdriver appa) The XLNTdriver app must be

downloaded by thepolicyholder to either an IOSor Android mobile devicewithin the first 7 days of thepolicy inception date.

Failure to download the Appby day 7 following policyinception, may result in yourpolicy being cancelled underGeneral Conditions 13"Cancellation".

b) If data from your XLNT DriverApp indicates that you aredriving dangerously or inexcess of 160km/h on anyroad, public, or private, AIGmay declare your insurancecontract void or this mayresult in your policy beingcancelled under GeneralConditions 13 "Cancellation".

21. SanctionsThe Insurer shall not be deemedto provide cover and the Insurershall not be liable to pay anyclaim or provide any benefithereunder to the extent that theprovision of such cover, paymentof such claim or provision of suchbenefit would expose the Insurer,its parent company or its ultimatecontrolling entity to any sanction,prohibition or restriction underUnited Nations resolutions or thetrade or economic sanctions, lawsor regulations of the EuropeanUnion or the United States ofAmerica.

These General Exceptions apply to allsections of this policy.

1. Use and Driving We will not pay for any loss,damage or bodily injury whilstyour car is being driven or used; a) other than for the purposes as

specified in your Certificateof Motor Insurance

b) by anyone who does not holda licence to drive your car oranyone who has held but iscurrently disqualified fromholding or obtaining such alicence

c) by anyone driving withoutyour permission

d) in an unsafe condition.e) by any person other than

those specified in theCertificate of MotorInsurance

f) anyone who fails to fulfil theterms and conditions of thisinsurance

2. Agreements Made by You We will not pay for any loss,damage, bodily injury, illness ordisease that arises as a result ofany written or verbal agreemententered into by any insuredperson unless the liability for suchloss, damage, bodily injury, illnessor disease would have appliedhad the agreement not existed.

3. Territorial Limits We do not cover any accident,injury, loss, damage or liabilityarising outside the Republic ofIreland, Northern Ireland, GreatBritain, Channel Islands or the Isleof Man other than as provided forin Section 4 - “Foreign Travel.”

4. Deliberate Acts We will not pay for any loss,damage bodily injury, illness ordisease arising from anydeliberate, wilful or malicious actsby you or an insured person.

5. Defective Materials We will not pay for any loss ordamage arising from faultyworkmanship, defective design orthe use of defective materials.

6. Terrorism We will not pay for any harm ordamage to life or to property (orthe threat of such harm ordamage) by nuclear and / orchemical and / or biological and/ or radiological means resultingdirectly or indirectly from or inconnection with Terrorismregardless of any othercontributing cause or event,except as required by the RoadTraffic Acts.

7. War Risks We will not pay for any expense,consequential loss, legal liability

n the order of any government,public or local authority.

8. Sonic Bangs We will not pay for any loss ordamage caused by pressurewaves from aircraft or other aerialdevices travelling at or above thespeed of sound.

9. Pollution & ContaminationWe will not pay for any loss ordamage directly or indirectlycaused by pollution and / orcontamination.

10. Radioactive Contamination andExplosive Nuclear Assemblies We will not pay for any expense,consequential loss, legal liabilityor any loss or damage to propertydirectly or indirectly caused by orarising from or contributed to by: n ionising radiations or

contamination by radioactivityfrom any nuclear fuel or fromany nuclear waste or from the

combustion of nuclear fuel; n the radioactive, toxic, explosive

or other hazardous propertiesof any explosive nuclearassembly or nuclearcomponent thereof.

11. Earthquake We will not pay for any injury lossor damage (Except under Section2 - Liability to Others) caused byEarthquake.

12. Riot and Civil Commotion We will not pay for any injury lossor damage (except under Section2 - Liability to Others) caused byriot or civil commotion occurringother than in the Republic ofIreland, Northern Ireland, GreatBritain, Channel Islands or the Isleof Man.

13. Airside We will not pay for any lossdamage or liability while your caris parked or is being driven in anypart of an airport or airfield setaside for: n moving taking off or landing of

aircraft; n aircraft parking areas and

associated roads and groundequipment parking,maintenance or refuellingareas.

WHAT TO DO AFTER ANACCIDENT?The following actions are required bylaw: -a) You must stop - it is a serious

offence not to do so.b) You must give Your name and

address to anyone involved in theIncident, together with details ofYour car and the insurer.

c) If You are unable to notify thepolice at the scene of theaccident, you must report it tothem as soon as possible, and inany case within 24 hours.

d) You must show Your Certificate ofMotor Insurance to the garda ifthey need to see it.

How do You notify us of Yourclaim?First check Your Schedule to makesure You are covered for the loss ordamage You are claiming for.

You will be asked to do thefollowing:-a) Supply as much information

as You can concerning theIncident. This may be- completing a Motor
