    CITATION, APPLICABILITY, DEFINITIONS AND ABBREVIATIONS

    1. PROMULGATION:

    Pursuant t o Sect ion 30 of t he Civi l Aviat ion Act 2006, t he Nigerian Civi l Aviat i on

    Author i t y (hereinaf t er referred to as The Author i t y ) hereby makes t he fo l low ing

    regulat ions.

    2. CITATION AND APPLICABILITY:

    (i) These Regulat ions shall be cit ed as t he Nigeri an Civil Aviat ion Regulat ions

    2006 (Niger ian CAR).

    ( i i) These Regulat ions shall apply t o al l c ivi l aviat ion oper at i ons in Nigeria.

    3. DEFINITIONS:

    For the purpose of these Regulat ions, the fol lowing def init ions shallapply:

    Acceptance check list . A document used to assist i n carryi ng out acheck on the external appearance of packages of dangerous goods tobe carr ied on board an aircraft and their associated documents, todeterm ine that a l l appropr iate requirements have been met .

    Accountable Manager. The manager who has corporate authority forensur ing that a l l f l ight operat ions and maintenance act iv i t iesrequired by the aircraf t owner/ operat or can be f inanced and carr iedout to the standard required by the Author i ty . The AccountableManager may delegate to another person in the organisat ion, inwr i t ing, to become the accountable manager, when acceptable tothe Author i ty .

    Accountabl e Manager m eans Chief Execut i ve Off i cer/ President / Managing Direct or/ Direct or General/ General Manager etc. of t he

    organisat ion, who by vir tue of posit ion has overal l including, inpart icular, f i nancial responsibi l i t y, for running t he organisat i on. Inthe case of delegat ion to another person, the delegat ion must bewr i t ten into the accountable manager s statement of commitment .The Authority is concerned that any delegat ion of responsibi l i tyinc ludes a suf f ic iency of funding a l locat ion.

    Accountable Officer. The off icer who exercises authority on behalfof the Author i ty for ensur ing that a l l prescr ibed act ions areperformed t o the st andard required by the Author i ty .

    Accredited medical conclusion. The conclusion reached by one ormore medical experts, acceptable t o t he Author i t y , f or t he purposes

    of the case concerned, in consultat ion with other experts asnecessary.

    Advisory airspace. An airspace of def ined di mensions, or designatedroute, within which air t raf f ic advisory service is available.

    Aerial work. An aircraf t operat ion in which an aircraf t is used forspecialised services such as agriculture, construction, photography,surveying, observat ion and patrol, search and rescue, aerialadvert isement , etc.

    Aerobatic flight. An intent ional manoeuvre involving an abruptchange in an aircraf t s at t i tude, an abnormal at t i tude, or abnormalaccelerat ion, not necessary for normal f l ight.

    Aerodrome. A def ined area on land or water ( including anybuildings, instal lat ions and equipment) intended to be used eitherwhol ly or in par t for t he arr ival , departure and sur face movement ofa i rc ra f t .

    Aeronautical experience. Pi lot and f l ight engineer t ime obt ained inan aircraf t , or approved synthet ic t ra in ing device for meet ing thetraining and f l ight t ime requirements of these Regulat ions.

    Aeronautical product. Any aircraf t , a i rcraf t engine, propel ler , orsub assembly, appl iance, mater ia l , par t , or component to be

    inst al led t hereon.

    Aeroplane. A power-dr iven heavier- t han-air a i rcraf t , der iv ing i ts l i f tin f l ight chief ly from aerodynamic react ions on surfaces whichremain f ixed under given condi t ions of f l ight .

    Aerodrome Certificate. The cert i f icate to operate an aerodromeissued by t he Aut horit y subsequent t o t he approval of t heaerodrome operators manual.

    Aerodrome Facilities and Equipment. Facil i t ies and equipment,

    inside or around the boundaries of an aerodrom e, t hat areconst ructed or inst al led and maint ained for t he arr ival , departure,and sur face movement of ai rcraf t .

    Aerodrome Operators Manual. The operat ions manual that form spart of t he appl icat ion for an aerodrome cert i f icate pursuant t ot hese regulat i ons, includi ng any amendment s t heret o accepted andapproved by t he Author i t y .

    Aerodrome Operator . The owner or provider of an aerodrome t hatis cer t i f ied for operat ions by t he Author i t y .

    Aerodrome Beacon. Aeronaut i cal beacon used to indicate t helocat ion of an aerodrome f r om t he air .

    Aerodrome Elevation. The elevat ion of t he highest point of t helanding area.

    Aeronautical experience. Pi lot and f l ight engineer t ime obt ained inan aircraf t , or approved synthet ic t ra in ing device for meet ing thetraining and f l ight t ime requirements of these Regulat ions.

    Aeronautical product. Any aircraf t , a i rcraf t engine, propel ler , orsub assembly, appl iance, mater ia l , par t , or component to beinst al led t hereon.

    Aeroplane. A power-dr iven heavier- t han-air a i rcraf t , der iv ing i ts l i f tin f l ight chief ly from aerodynamic react ions on surfaces whichremain f ixed under given condi t ions of f l ight .

    Aerodrome Reference Point. The designated geographic al locat ionof an aerodrome.

    Aeroplane Reference Field Length. The minimum f i e ld l engt hrequired for take-of f at maximum cert i f ied t ake-of f mass, sea level ,st andard atm ospheric condit i ons, st i l l air , and zero runw ay slope, asshown in the appropriate aeroplane f l ight manual prescribed by the

    cert i f y ing author i t y or equivalent data f rom t he aeroplanemanufacturer .

    Aeronautical Study. A study of an aeronaut ical problem to ident i fypossible solut ions and select a solut ion that is acceptable withoutdegrading safet y.

    Agricultural aircraft operation. The operat ion of an aircraf t for t hepurpose of

    (a) Dispensing any econom ic poison,

    (b) Dispensing any ot her subst ance int ended for plantnour ishment , soi l t reatment , propagat ion of p lant l i fe,or pest control , or

    (c) Engaging in dispensing act i vit ies direct ly aff ect ingagr icul t ure, hor t icul t ure, or f orest preservat ion, but notincluding t he dispensing of l ive insect s.

    Air navigation facility. Any faci l i t y used in, available for use in, ordesigned for use in aid of air navigat ion, including aerodromes,landing areas, l ights, any apparatus or equipment for disseminat ingweather informat ion, for s ignal ing, for radio direct ional f inding, or

    for radio or other e lect r ical communicat ion, and any other st ructureor mechanism having a similar purpose for guiding or control l ingf l ight in t he air or landing and t ake-of f of a i rcraf t .

    Air Traffic Control. A service that promotes the safe, orderly, and

    expedi t ious f low of a i r t raf f ic at aerodromes and dur ing approach,departure, and in en rout e environments.

    Air Traffic Control (ATC) facility. A building holding the persons andequipment responsible for providing ATC services (e.g., airportt ower, approach cont rol , en route control centr e) .

    Aircraft. Any machine that can derive support in the atmospheref rom the react ions of the air other than the react ions of the airagainst t he eart h s surf ace.

    Aircraft category. Classif icat ion of aircraft according to specif iedbasic character is t ics (e.g. , aeroplane, hel icopter , g l ider , f reeballoon).

    Aircraft cert if icated for single-pilot operation. A type of a i rcraf twhich t he St ate of Regist ry has determ ined, dur ing t he cer t i f icat ionprocess, can be operated safely w it h a mini mum cr ew of one pi l ot .

    Aircraft component. Any component par t of an aircraf t up to andincluding a complet e powerplant and/ or any operat ional / emergencyequipment .

    Aircraft Maintenance Engineer Licence (AMEL) Course A trainingcourse for AMEL cat egories and r at ings.

    Aircraft Technical Log. A document carr ied on board an aircraf t forrecording defects and malfunct ions discovered during operat ion andfor recording detai ls of a l l maintenance carr ied out whi ls t theaircraft is operat ing between scheduled visits to the basemaintenance fac i l i t y . I t a lso contains operat ing informat ion relevant

    to f l ight safety and maintenance data that the operat ing crew needto know. A technical log contains two independent sect ions; a

    j ourney record sec t ion an d an ai rcraf t m ai nt enan ce record sec t ion.

    Aircraft type. All aircraf t of t he same basic design.

    Aircraf t required to be operated wi th a co-pi lot : A type of a i rcraf tthat is required to be operated wi th a co-pi lot as speci f ied in thef l ight manual or by an air operat or cer t i f icate.

    Airframe. The fuselage, booms, nacelles, cowlings, fair ings, air foi l

    surfaces ( including rotors but excluding propellers and rotat ing

    air fo i ls of a powerplant) , and landing gear of an aircraf t and theiraccessori es and cont rol s.

    Airmanship. The consistent use of good judgment and well-developed knowledge, ski l ls and att i tudes to accomplish f l ight

    object ives.

    Airmen: Persons involved in f ly ing, maintaining or operat ing aircraft .For the purpose of these regulat ions, these are pi lots, f l ightengineers, Air Traff ic Control lers, Fl ight Operat ions Off icers,Certifying Staff, Aircraft Maintenance Engineers, Repair Specialists,Parachut e Riggers and Cabin Crew .

    Airworthiness Release. The air operator s a i rcraf t are released toservice fol lowing maintenance by a person specif ical ly authorised bythe air operator or maintenance organisat ion on their own behalfrather t han by an individual . In ef f ect , t he person signing t herelease (Certif icate of Release to Service) acts as an authorisedagent for the operator and is cer t i fy ing that the maintenancecovered by the release has been accomplished according to the airoperat or s maint enance programme. Responsibi l i t y for each st ep oft he accomplished maint enance is borne by t he person signing for t hatstep and the airworthiness release cert i f ies the ent ire maintenancewor k package. Thi s arrangement in no w ay reduces t he responsibi l i t yof the Cert i fy ing StaffAircraft Maintenance or maintenanceorganisat ions for maintenance funct ions or tasks they perform or

    supervise. The air operator is obl igated to designate, by name oroccupat ional t i t le, each Cert i fy ing Staff or maintenance organisat ionauthorised to execute the airworthiness release. In addit ion, the airoperator should specify when a release is required. Normally, arelease is required fol lowing inspect ions prescribed by the airoperat or s specif ied maint enance act ivit ies involving inspect ions, andany other signif icant maintenance.

    Airship. A power-dr iven l ighter t han air a i rcraf t

    Air craft Stand. A designated area on an apron int ended t o be used

    for park ing an aircraf t .

    Appliance. Any inst rument , mechanism, equipment , par t , apparatus,appurtenance, or accessory, including communicat ions equipment,that is used or intended to be used in operat ing or control l ing anaircraf t in f l ight , i s inst al led in or at t ached t o the aircraf t , and is notpart of an air f rame, powerplant , or propel ler .

    Approved by the Authority. Approved by the Author i ty d i rect ly orin accordance w it h a procedure approved by t he Author i t y .

    Approved maintenance programme. A maintenance programmeapproved by t he St ate of Regist ry of an aircr aft .

    Approved data. Any information necessary to ensure that theaircraf t or a i rcraf t component can be maintained in a condi t ion sucht hat a i rw ort hiness of t he aircraf t , or serv iceabi l i t y of operat ional andemergency equipm ent as appropriat e, is assured.

    Approved Maintenance Organisation (AMO). An organisationapproved to per form speci f ic a i rcraf t maintenance act iv i t ies by theAuthority. These act ivit ies may include the inspect ion, overhaul,maintenance, repair and/ or modi f icat ion and release t o serv ice ofaircraf t or aeronaut ical products.

    Approved standard. A manufacturing, design, maintenance, orqual i ty s tandard approved by t he Author i t y .

    Approved training. Training carr ied out under special curr icula andsupervision approved by t he Aut horit y.

    Article. Any i tem, inc luding but not l imi ted to, an aircraf t , a i r f rame,aircraft engine, propeller, appliance, accessory, assembly,subassembl y, syst em, subsyst em, component , unit , pr oduct, or part .

    Authorised inst ructor. A person w ho

    (a) Holds a valid ground instr uct or li cence issued under Part2 of t hese regulat i ons when conduct ing ground t raining;

    (b Holds a current f l ight inst ruct or l icense issued under t hesaid Part 2 when conduct ing ground training or f l ightt ra in ing; or

    (c) Is authori sed by t he Aut horit y t o provide ground t rainingor f l ight t raining under Part 2 and Part 3 of theseregulat ions.

    Authority. The civi l aviat ion authority responsible for the oversightof civi l aviat ion in Nigeria.

    Aerodrome. A def ined area on land, including any building,inst al lat ions and equipment , int ended t o be used ei t her whol ly or inpart for the arr ival , depart ure, and sur face movement of a i rcraf t .

    Aerodrome Certificate. The cert i f icate to operate an aerodromeissued by t he Aut horit y subsequent t o t he approval of t heaerodrome operators manual.

    Aerodrome Facilities and Equipment. Facil i t ies and equipment,inside or around t he boundaries of an aerodrome, t hat areconst ructed or inst al led and maintained for t he arr ival , departure,and sur face movement of ai rcraf t .

    Cargo aircraft . Any aircraft carr ying goods or propert y but notpassengers. In t his context , t he fol low ing are not considered t o bepassengers:

    (a) A crewm ember.

    (b) An operat or s employee permit t ed by, and carr ied inaccordance with, the inst ruct ions contained in thatoperators Operations Manual

    (c) An authori sed represent at i ve of an Aut horit y.

    (d) A person wi t h dut ies in respect of a part icular shipm enton board.

    Category I (CAT I) Operation: With respect to the operat ion ofaircraft , means a straight- in ILS approach to the runway of an airportunder a category I ILS instrument approach procedure issued by theAuthor i t y or ot her appropr iate author i t y .

    Category II (CAT II) operations. With respect to the operat ion ofaircraft , means a straight- in ILS approach to the runway of an airportunder a Category II ILS instrument approach procedure issued by theAuthor i t y or ot her appropr iate author i t y .

    Category III (CAT III) operations. With respect to the operat ion ofaircraft , means an ILS approach to the runway of an airport using aCategory III ILS instrument approach procedure issued by the

    Author i t y or ot her appropr iate author i t y .

    Certify as airworthy. The required maintenance record entrycompleted by a proper ly author ised person af ter the modif icat ion,overhaul , repair , or the inspect ion of an aircraf t , or aeronaut icalproduct required by the Author i t y .

    Cert if ying Staff Aircraf t Maintenance: A person approved by theAuthor i ty to per form def ined maintenance on aeronaut ical productsor part s. The t erm Cert i f y ing St aff Aircr aft Maint enance as usedherein inc ludes appropr iately rated, repair special is t and cer t i fy ing

    engineer.

    Check Pilot (aircraft). A person who is qual i f ied, and permit t ed, toconduct an evaluat ion in an aircraft , or in a synthet ic training devicefor a par t icular type of a i rcraf t , f or a par t icular AOC holder.

    Check Pilot (simulator). A person who is quali f ied to conduct anevaluat ion, but only in a synthet ic t ra in ing device, for a par t icularaircraf t t ype for a part icular AOC holder.

    Commercial air transport operation. An aircraf t operat ion involv ingthe transport of passengers, cargo, or mail for remunerat ion orreward.

    Competency: A combinat ion of ski l ls, knowledge and att i tudesrequired t o per form a t ask t o t he prescr ibed st andard.

    Competency element. An act ion that const itutes a task that has a

    t r igger ing event and a terminat ing event that c lear ly def ines i tsl im it s, and an observable out come.

    Competency unit . A discret e funct ion consist ing of a number ofcompetency elem ents.

    Complex aeroplane. An aeroplane having ret ract able landing gear(except i n seaplanes), f laps, and a contr ol lable pr opell er.

    Composite. Structural materials made of substances, including, butnot l imi ted to, wood, metal , ceramic, p last ic , f iber-reinforcedmater ia ls , graphi te, boron, or epoxy, wi th bui l t - in s t rengtheningagents that m ay be in the f orm of f i l aments, f o i ls, pow ders, or f lakes,o f a d i f fe rent mat er ial .

    Computer system. Any electronic or automated system capable ofreceiving, storing, and processing external data, and transmitt ing andpresent ing such data in a usable form for the accomplishment of aspecif ic funct ion.

    Contracting States. All St ates that are signatories to t he Convent ion

    on Inter nat ional Civi l Aviat ion (Chicago Convent ion).

    Controlled flight . Any f l i ght w hich is subj ect t o an air t raf f i c controlclearance.

    Core curriculum. A set of courses approved by t he Aut horit y, f or useby an Aviati on Training Organisat ion (ATO) and it s sat ell it e ATO. Thecore curr iculum consists of t raining that is required for l icensing oraircraf t rat i ngs. I t does not include t raining for tasks andcircumstances unique t o a part i cular user.

    Course. A programme of inst ruct ion to obtain an airman l icence,rat ing, qual i f icat ion, aut hor isat ion, or currency.

    Courseware. Instruct ional material developed for each course orcurr iculum, including lesson plans, f l ight event descript ions,computer software programmes, audio-visual programmes, workbooksand handout s

    Co-pilot. A l icensed pi lot serving in any pi l ot ing capacit y other t hanas pi lot - in-comm and but excluding a pi lot w ho is on board t he aircraftfor t he sole purpose of receiving f l ight i nst ruct ion.

    Crew Resource Management (CRM). A programme designed toimprove the safety of f l ight operat ions by opt imising the safe,eff ic ient, and effect ive use of human resources, hardware andinformat ion through improved crew communicat ion and co-

    ordinat ion.

    Critical engine. The engine whose fai l ure woul d most adverselyaf fect t he performance or handl ing qual i t ies of an aircraf t .

    Critical phases of flight . Those port ions of operat ions involvingtaxi ing, takeof f and landing, and al l f l ight operat ions below 10,000feet , except cruise f l ight .

    Cross-country. A f l ight between a point of departure and a point ofarr ival fol lowing a pre-planned route using standard navigat ionprocedures.

    Cross-country time. That t ime a pi lot spends in f l ight in an aircraf twhich inc ludes a landing at a point other t han the point of depart ureand, for t he purpose of m eet ing t he cross-countr y t ime r equirementsfor a pr ivate pi lot l icence (except wi th a rotorcraf t rat ing) ,commercial p i lot l icence, or an inst rument rat ing, inc ludes a landingat an aerodrome which must be a straight- l ine distance of more than50 naut ical mi les f rom t he or iginal point of departure.

    Dangerous Goods. Articles or substances which are capable of posingsigni f icant r isk t o heal th, safety or propert y when t ransported by air .

    Dangerous goods accident . An occurrence associated wi t h andrelated to the transport of dangerous goods which results in fatal orserious inj ury t o a person or maj or propert y damage.

    Dangerous goods incident . An occurrence, other than a dangerousgoods accident, associated with and related to the transport ofdangerous goods, not necessarily occurring on board an aircraft,which results in injury to a person, property damage, f ire, breakage,

    spi l lage, leakage of f lu id or radiat ion or other ev idence that theint egrit y of t he packaging has not been maint ained. Any occurrencerelat ing to the transport of dangerous goods which seriously

    j eopar dises an ai r craf t or i t s occupan t s is deem ed t o const i t ut e adangerous goods inci dent .

    Dangerous goods transport document . A document speci f ied by t heICAO Technical Instructions for the Safe Transportation of DangerousGoods by Air. I t is complet ed by t he person who offer s dangerousgoods for air t ransport and contains information about thosedangerous goods. The document bears a signed declarat i on indicat ingthat the dangerous goods are ful ly and accurately described by theirproper shipping names and United Nations (UN) numbers (if assigned)

    Defined point before landing. The point , wi t h in t he approach andlanding phase, after which the Class 2 helicopters abi l i ty to cont inuethe f l ight safely, with one engine inoperat ive, is not assured and afor ced landing may be required.

    Designated Examiner (Designee). Any person authorised by theAuthor i ty to conduct a pi lot prof ic iency test or a pract ical test for af l ight crew l icence or rat ing. The designee when so authorised iscarrying out the assigned funct ions for the Authority and is not act ingon his or her ow n behalf .

    Directly in Charge. A person assigned to a posit ion in which he orshe is responsible for the work of a shop or stat ion that performsmaintenance, prevent ive maintenance or modi f icat ions, or other

    funct i ons af fect ing aircraf t a i rwort hiness.

    Dual inst ruct ion t ime. Flight t ime during which a person is receivingf l ight inst ruct ion f rom a proper ly author ised pi lot on board thea i rc ra f t .

    Economic poison. Any substance or mixture of substances intendedfor

    (a) Prevent ing, dest roying, repell ing, or mit igat ing anyinsects, rodents, nematodes, fungi, weeds, and other

    for ms of pl ant or animal l i f e or viruses, except viruses onor in l iv ing human beings or ot her animals, w hich Nigeriamay declare t o be a pest , and

    (b) Use as a plant regulat or, defol iant or desiccant.

    Effective length of the runway. The dist ance for landing f rom t hepoint at which the obstruct ion c learance plane associated wi th theapproach end of the runway intersects the centrel ine of the runwayt o the far end of t he runway

    Error: An act ion or inact ion by the f l ight crew that leads todeviat ions f rom organizat ional or f l ight crew intent ions expect at ions.

    Error Management: The process of detect ing and responding toerrors wi th countermeasures that reduce or e l iminate theconsequences of errors, and mit igat e t he probabi l i ty of fur t her errorsor undesired air craft st ates.

    Evaluator. A person employed by a cert i f ied Aviat ion TrainingOrganisat ion who performs tests for l icensing, added rat ings,authorisat ions, and prof iciency checks that are authorised by thecert i f icate holders training specif icat ions, and who is authorised byt he Aut horit y t o administer such checks and t est s.

    Extended Over-water Operation. With respect to aircraf t otherthan helicopters, an operat ion over water at a horizontal distance ofmore than 50 nm f rom the nearest shorel ine; and to hel icopters, anoperat ion over water at a hor izontal d is tance of more than 50 nmfrom the nearest shorel ine and more than 50 nm from an offshorehel ipor t st ructure.

    Facility. A physical plant, including land, bui ldings, and equipment,which provide the means for the performance of maintenance,prevent ive maintenance, or modi f icat ions of any ar t ic le.

    Fireproof material. A material capable of withstanding heat as wellas or better than steel when the dimensions in both cases areappropriate for the specif ic purpose.

    Flight crewmember. A Licenced crewmember charged with dut iesessent ia l t o the operat ion of an aircraf t dur ing f l ight t ime.

    Flight Duty Period. The to t a l t im e f rom the moment a f l igh tcrewmember commences duty, immediately subsequent to a restper iod and pr ior to making a f l ight or a ser ies of f l ights, to themoment the f l ight crewmember is re l ieved of a l l dut ies havingcomplet ed such f l i ght or series of f l ight s.

    Flight plan. Speci f ied inform at ion provided t o air t raf f ic serv ices

    uni ts , re lat ive to an intended f l ight or por t ion of a f l ight of anaircraf t . The t erm f l ight p lan is used t o mean var iously, fu l linformat ion on al l i tems contained in the f l ight p lan descr ipt ion,cover ing the whole route of a f l ight , or l imi ted informat ion requiredwhen the purpose is to obtain a clearance for a minor port ion of af l ight such as to cross an airway, to take of f f rom, or to land at acontrol led aerodrome.

    Flight Services Specialist - A person assigned and trained to assistpi lots in pref l ight p lanning, inc luding pi lot br ief ings, recorded data,f l ight plan f i l ing/ processing, and aircraf t operat ional reservat i ons;provide enroute service, including services to airborne aircraft , suchas NAVAID monitoring and restoration, delivery of ATC clearances,

    advisories or requests, issuance of military f l ight advisory messages,NOTAMs, Search And Rescue communications searches, f l ight planhandling, t ranscribed or l ive broadcasts, weather observat ions,PIREPs, and pi lot br ief ings; and handle emergency situat ions wherel i fe or property is in immediate danger, whi le per forming their dut iesat a Flight Service Station.

    Flight simulator. A Flight Sim ulat ion Training Device t hat

    (a) Is a ful l-size aircraf t cockpit repl ica of a specif i c t ype ofaircraf t or make, model , and ser ies of a i rcraf t ;

    (b) Includes t he hardware and soft ware necessary t orepresent the aircraft in ground operat ions and f l ightoperat ions;

    (c) Uses a for ce cueing syst em t hat provides cues at leastequivalent to those cues provided by a 3 degreefreedom of mot ion syst em;

    (d) Uses a visual syst em t hat provid es at least a 45 degree

    hor izontal f ie ld of v iew and a 30 degree ver t ical f ie ld ofview sim ult aneously for each pi lot ; and

    (e) Has been evaluated, quali f ied, and approved by t heAuthor i ty .

    Flight time.     Foreign air operator . Any operat or, not being a Nigerian airoperat or , w hich undert akes, w hether di r ect ly or i ndirect l y or by leaseor any other arrangement, to engage in commercial air t ransportoperat ions within the borders or airspace of Nigeria, whether on ascheduled or charter basis.

    Foreign Authority. The civi l aviat i on authori t y t hat issues andoversees t he Air Operator Cert i f icat e of t he foreign operator .

    Freight container . A f re ight container is an ar t ic l e of t ransport

    equipment for radioact ive mater ia ls , designed to fac i l i tate thetransport of such materials, either packaged or unpackaged, by oneor more m odes of t ransport .

    Frangible Object. An object of low mass deigned to break, distort ,or y ie ld on im pact so as t o present t he minimum hazard t o aircraf t .

    General aviation operation. An aircraf t operat ion other t hancommercial a i r t ransport operat ion (air l ines) or mi l i tary operat ion.This includes business f ly ing (corporate or execut ive), agriculturalaviat ion, personal f ly ing for sport or pleasure, f l ight school and f ly ingclubs. Manufacturers of the aircraf t and the maintenance fac i l i t iest hat service t hem are also a part of general aviat ion.

    Glider. A non-power-dr iven heavier- than-air a i rcraf t , der iv ing i ts l i f tin f l ight chief ly from aerodynamic react ions on surfaces which remainf ixed under given condi t i ons of f l ight .

    Handling agent . An agency whi ch perform s on behalf of t he operat orsome or al l of the lat ter s funct ions including receiving, loading,unloading, transferr ing or other processing of aircraft , passengers or

    cargo.

    Helicopter. A heavier- t han-air a i rcraf t supported in f l ight chief ly bythe react ions of the air on one or more power-dr iven rotors onsubst ant i al ly ver t ical axis.

    (a) Class 1 heli copter. A hel icopter wi t h per form ance suchthat , in case of cr i t ical engine fa i lure, i t is able to landon the rejected take-of f area or safely cont inue thef l ight to an appropriate landing area, depending onwhen the fai lure occurs.

    (b) Class 2 heli copter. A hel icopter wi t h per form ance sucht hat , in case of cr i t ical engine fa i lure, i t is able to safelycont inue the f l ight , except w hen the fa i lure occurs pr iort o a def ined point af t er take-of f or af t er a def ined pointbefore landing, in which case a forced landing may berequired.

    (c) Class 3 heli copter. A hel icopter wi t h per form ance suchthat , in case of engine fa i lure at any point in the f l ightprof i le, a forced landing must be performed.

    movement of hel icopters.

    High-performance aeroplane. An aeroplane wi t h an engine of moret han 200 horsepower.

    Holdover time. The est imat ed t ime de- ic ing/ ant i - ic ing f l u id wi l lprevent t he format ion of f rost or ice and the accumulat ion of snow ont he prot ected sur faces of an aircraf t . Holdover t ime begins f romwhen t he f i nal appl icat ion of de- ic ing or ant i - ic ing f lu id is made andexpires when the de- ic ing or ant i - ic ing f lu id appl ied to the aircraf tloses it s ef fe ct iveness.

    Housing. Buildings, hangars and other structures to accommodatet he necessary equipm ent and mat erial s of a m aint enance organisat i ontha t

    (a) Provide wor king space for the perform ance ofmaintenance, prevent ive maintenance, or modi f icat ionsfor which the maintenance organisat ion is cer t i f icatedand rated;

    (b) Provide st ructures for t he proper protect ion of a i rcraf t ,air f rames, aircraft engines, propell ers, appliances,components, parts and subassemblies thereof during

    Human performance. Human capabil i t ies and l imi t at i ons whi ch havean impact on the safety and eff ic iency of aeronaut ical operat ions.

    Inspection. The examinat ion of an aircraf t , aeronaut ical product andoperat ional programmes to establish conformity with a standardapproved by t he Author i t y .

    Instrument approach chart. An approach procedure prescribed byt he Author i t y having jur i sdict ion over t he aerodrome.

    Instrument time. Time in which cockpit instruments are used as thesole means for navigat ion and cont rol.

    Instrument training. Training which is received from an authorisedinst ructor under actual or s imulated inst rument meteorologicalcondit ions.

    Instrument flight time. Time dur ing which a pi lot is p i lot ing anaircraf t sole ly by reference to inst ruments and wi thout externalreference points.

    Instrument ground time. Time dur ing which a pi lot is pract ising, ont he ground, simulat ed inst rument f l ight in a f l ight simulat ion t ra in ingdevice approved by t he Licensing Aut horit y.

    Interchange agreement . A leasing agreement whi ch perm it s an airoperator to dry lease and take or rel inquish operat ional control of anaircraf t at an airpor t .

    Journey log. A f orm signed by the Pil ot In Comm and (PIC) of eachf l ight that records the aircraf t regist rat ion, crewmember names and

    duty assignment s, t he type of f l ight , and the date, p lace, and t ime ofarr ival and departure.

    Knowledge test. A test on the aeronaut ical knowledge areasrequired for an airman l icence or rat ing that can be administered inwr i t ten form or by a computer .

    Landing decision point . The point used in det erm ining landingperformance f rom w hich an engine fa i lure occurr ing at t h is point , t helanding may be safely cont inued or a balked landing init iat ed.

    Large aeroplane. An aeroplane having a maximum cert i f icated take-off mass of 5,700 kg. (12,500 lbs) or more

    Landing Area. The part of a movement area intended for the landingor take-of f o f a i rcra f t .

    Lighting System Reliability. The probabi l i ty that the complete

    l ight ing instal lat ion operates within the specif ied tolerances and thatt he syst em is operat ionall y usable.

    Level 1 Aviation Training Organisation (ATO). A f l i ght t ra in ingfaci l i ty which conducts al l or substant ia l ly a l l of each f l ight t ra in ingcourse using aircraft .

    Level 2 ATO. A f l ight t ra in ing fac i l i ty which conducts al l orsubstant ial ly al l of each f l ight t raining course using simulat ion mediawhich are qual i f ied and approved by t he Author i t y .

    Licensing Authori ty. The Aut horit y designated by a Cont ract ing St ateas responsible for the licensing of personnel.

    Lighter-than-air aircraft. Any aircraf t supported chief ly by i tsbuoyancy in t he air.

    Line operating flight time. Fl ight t im e recorded by t he PIC orSecond In Comm and (SIC) wh il e in reven ue servi ce for an AOC hold er.

    Line Oriented Flight Training (LOFT). Training in a simulat or wi t h a

    complete crew using representat ive f l ight segments which containnormal, abnormal and emergency procedures that may be expectedin l ine operat ions.

    Line-Oriented simulation. Simulat ion conducted using operat ional-or iented f l ight scenar ios that accurately repl icate interact ion amongf l i ght crew m embers and between f l ight crew members and dispatchfaci l i t ies, other crewmembers, a i r t raf f ic control and groundoperat ions.

    Maintenance release. A document contain ing a cer t i f icat ion that

    inspect ion and maintenance work has been performed sat isfactori lyin accordance wit h the m et hods prescribed by t he Aut horit y. This alsoapplies to a maintenance organisat ion document signed by anauthorised maintenance organisat ion representat ive that states thatthe art ic le worked on is approved for release to service for themaintenance, prevent ive maintenance, or modi f icat ion performed.

    Maintenance. Tasks required to ensure the cont inuing airworthinessof an aircraft or aeronaut ical product including any one orcombinat ion of overhaul , repair , inspect ion, replacement ,modif icat ion, and defect rect i f icat ion.

    Master Minimum Equipment List (MMEL). A l ist established for apart icular a i rcraf t type by the manufacturer wi th the approval of theState of Design containing i tems, one or more of which is permit tedto be unserviceable at the commencement of a f l ight. The MMEL maybe associated with special operat ing condit ions, l imitat ions or

    procedures. The MMEL provides t he basis for d evelopment , r eview,and approval by t he Aut horit y of an individual operat or s MEL.

    Medical Assessment . The evidence issued by the Authori t y that t hel icence holder m eet s specif i c requirem ent s of medi cal f i t ness.

    Minimum Equipment List (MEL). A l ist approved by the Authoritywhich provides for the operat ion of a i rcraf t , subject to speci f iedcondi t ions, wi th par t icular equipment inoperat ive, prepared by anoperat or in conformit y wi t h, or more rest r ic t ive t han, t he MMELestabl ished for the aircraf t type by the aircraf t manufacturer , andapproved by the State of Design.

    Modification: A modif icat ion to an aeronaut ical product means achange t o t he t ype design which is not a repair.

    (a) Major. A major modif icat ion means a type designchange not l is ted in the aircraf t , a i rcraf t engine orpropeller specif icat ions:

    (1) t hat might appreciably af fect the mass and

    balance l imi ts , s t ructural s t rength, per formance,powerplant operat ion, f l ight character is t ics orother quali t ies affect ing airworthiness orenvironmental characterist ics;

    (2) t hat wi l l be embodied in t he product according t onon-st andard pract ices.

    (b) Minor. A minor modif icat ion means a modif icat ion othert han a maj or modi f icat ion.

    Movie. For t he purposes of t hese Regulat ions movie shall i ncludef i l m, v ideos, and l ive broadcast in any form at , and t hepreparat ion and rehearsal for t hose operat ions.

    Night. The hours between the end of evening c iv i l twi l ight and thebeginning of morning c iv i l twi l ight or such other per iod betweensunset and sunrise. Civi l twi l ight ends in the evening when the centreof the suns disc is 6 degrees below the horizon and begins in themorning when the centre of the suns disc is 6 degrees below thehorizon.

    Obstruction clearance plane. A plane sloping upward from therunway at a s lope of 1:20 to the hor izontal and tangent ia l to or

    clearing al l obstruct ions within a specif ied area surrounding therunw ay as shown in a prof i le view of t hat area. In t he plane view,the centrel ine of the speci f ied area coincides wi th the centrel ine ofthe runway, beginning at the point where the obstruct ion c learanceplane intersects the centrel ine of the runway and proceeding to a

    point at least 1,500 feet f rom the beginning point . Thereaf ter , thecentrel ine coincides wi th the takeof f path over the ground for therunway ( in the case of takeof fs) or wi th the inst rument approachcounterpart ( for landings) , or w here t he appl icable one of t hese pathshas not been est ablished, i t proceeds consist ent wi t h t urns of at least4,000 foot radius unt i l a point is reached beyond which theobstruct ion clearance plane clears al l obstruct ions. This area extendslateral ly 200 feet on each s ide of the centrel ine at the point wherethe obstruct ion clearance plane intersects the runway and cont inuesat t h is widt h to t he end of t he runway; t hen i t increases uni forml y to500 feet on each side of t he cent rel ine at a point 1,500 feet f r om t heintersect ion of the obstruct ion c learance plane wi th the runway;thereaf ter , i t extends lateral ly 500 feet on each s ide of thecentrel ine.

    Operat ing posit ion. An ai r t ra f f ic cont ro l funct ion per formed wi th inor d i rect l y associat ed wi t h a contr ol fac i l i t y .

    Operational control. The exerc ise of author i ty over the in i t iat ion,cont inuat ion, d iversion or t erminat i on of a f l i ght in the int erest of t hesafety of t he aircraf t and the regular i t y and ef f ic iency of t he f l ight .

    Operational flight plan. The operat or s plan for t he safe conduct ofthe f l ight based on considerat ions of aircraft performance, otheroperat ing l imi tat ions and relevant expected condi t ions on the routet o be f o l lowed and at t he aerodromes or hel ipor t s concerned.

    Operations manual. A manual containing procedures, inst ruct ionsand guidance for use by operat ional personnel in the execut ion oft heir dut ies.

    Operators Maintenance Management Exposition. A manual

    containing procedures, instruct ions and guidance for use bymaint enance and concerned operat i onal personnel in t he execut ion oft heir dut ies.

    Overhaul . The rest orat ion of an aircraf t or other aeronaut i calproduct using methods, techniques, and pract ices acceptable to theAuthority, including disassembly, cleaning, and inspect ion asperm it t ed, repair as necessary, reassembl y and t est ing in accordancewi t h approved st andards and t echnical data, or in accordance wi t hcurrent s tandards and technical data acceptable to the Author i ty ,which have been developed and documented by the State of Design,holder of the type cer t i f icate, supplemental type cer t i f icate, or amaterial, part , process, or appliance approval under Parts

    Powered-lift. A heavier- than-air a i rcraf t , capable of ver t ical take-of f . Vert ical landing, and low speed f l ight t hat depends pr inc ipal ly onengine-dr iven l i f t devices or engine thrust for the l i f t dur ing thesef l ight regimes and on non-rotat ing aerofoi l(s) for l i f t during horizontalf l igh t .

    Powerplant. An engine that is used, or intended to be used forpropell ing aircraft . I t includes turbo-superchargers, appurtenancesand accessories necessary for its functioning, but does not includepropellers.

    Practical test. A competency test on the areas of operat ions for al icence, cer t i f icate, rat ing, or author isat ion that is conducted byhaving t he applicant respond t o quest ions and/ or demonst rat emanoeuvres in f l ight, in an approved synthet ic t raining device.

    Precision tool and/or test equipment. Tooling and equipmentnecessary to measure, cal ibrate or test an aircraft , air f rame, aircraftengine, propeller, appliance, accessory, component or a part thereoft o an approved st andard.

    Pre-flight inspection. The inspect ion carr ied out before f l ight toensure that t he aircraf t is f i t for t he intended f l ight .

    Pressurised aircraft. Means an aircraft that has a service cei l ing ormaximum operat ing al t i tude, whichever is lower, above 25,000 feet

    sea level .

    Preventive maintenance. Means simp le or minor preservat i onoperat ions and the replacement of small standard parts not involvingcomplex assembly operations.

    Problematic use of substances. The use of one or m ore psychoact ivesubst ances by aviat i on personnel in a way t hat:

    a) const itutes a direct hazard to the user or endangers the l ives,heal t h or wel f are of ot hers; and/ or

    b) causes or worsens an occupational, social, mental or physicalproblem or disorder.

    Propeller. A device for propell ing an aircraft that has blades on apowerplant dr iven shaf t and that , when rotated, produces by i tsact ion on t he air , a t hrust approximat ely perpendicular t o i t s p lane ofrotat ion. I t inc ludes control components normal ly suppl ied by i tsmanufacturer, but does not include main and auxil iary rotors orrotat ing air f o i ls of pow erplants.

    Proper shipping name. The name to be used to describe a part icularart ic le or substance in al l shipping documents and not if icat ions and,wher e appropriat e, on packaging.

    Psychosis. A ment al disorder in which t he individ ual has manif est eddelusions, hallucinations, grossly bizarre or disorganised behaviour, orother commonly accepted symptoms of th is condi t ion; or theindividual may reasonably be expected to manifest delusions,hallucinat ions, grossly bizarre or disorganised behaviour, or other

    commonl y accept ed sympt oms of t his condit ion.

    Psychoactive substances. Alcohol, opioids, cannabinoids, sedat ivesand hypnot i cs, cocaine, ot her psychost im ulant s, hal lucinogens, andvolat i le solvent s, w hereas coff ee and tobacco are excluded.

    Quality system. Document ed organisat i onal pr ocedures and policies;int ernal audit of t hose policies and procedures; m anagement reviewand recommendat ion for qual i t y improvement .

    Rating. An authorisat ion entered on or associated with a l icence orcer t i f icate and forming part thereof , s tat ing special condi t ions,pr iv i leges or l im i t at ions pert a in ing t o such l icence or cer t i f icate.

    Rated air traffic controller. An air t raf f i c cont rol ler holding a l icenceand valid r at i ngs appropriat e t o the pr ivi leges t o be exercised.

    Rebuild. The rest orat ion of an aircraf t or other aeronaut icalproducts by using methods, techniques, and pract ices acceptable tothe Authority, when it has been disassembled, cleaned, inspected aspermit ted, repaired as necessary, reassembled, and tested to the

    same tolerances and l imits as a new item, using either new parts orused parts that conform t o new part t o lerances and l imi t s. This workwi l l be performed by only the manufacturer or an organisat ionapproved by the manufacturer and authorised by the State ofRegistry.

    Register: means the register of Nigerian Civi l Aircraft referred to inpart 4 of t hese regulat i ons.

    Rendering (a licence) valid. The act ion taken by the Authority, as analt ernat ive t o issuing i t s own l icence, i n accept i ng a l icence issued by

    any other Contract ing State as the equivalent of the Authoritys ownlicence.

    Repair. The rest orat ion of an aircraf t / aeronaut ical product t o aserviceable condit ion in conformity with an approved standard.

    (a) Major. A major repair means a design change which isintended to restore an aeronaut ical product to anairwort hy condi t ion:

    where the damage being repaired might appreciablyaf fect t he st ructural st rengt h, per formance,powerplant operat ion, f l ight character is t ics, or other

    quali t ies affect ing airworthiness or environmentalcharacter ist ics; or wi l l be embodied in the productusing non-standard practices.

    (b) Minor. A minor repair means a repair other t han a major

    repair .

    Required inspection items. Maintenance i t ems and/ or a l terat ionsthat require dupl icate inspect ions which must be carr ied out by aperson other t han the one performi ng the w ork, and inc lude at leastthose that could resul t in a fa i lure, malfunct ion, or defectendanger ing the safe operat ion of the aircraf t , i f not proper lyperformed or i f improper par t s or m ater ia ls are used.

    Rest period. A per iod f ree of al l rest raint , duty or responsibi l i t y forpersonnel of an AOC holder conduct ing commercial air t ransportoperat ions.

    Safe f orced landing: unavoidable l anding or dit ching wit h reasonableexpectancy of no inj ur ies t o persons in t he aircraft or on the surf ace.

    Safety programme: An integrated set of regulat ions and act ivit iesaimed at improving safety.

    Safety management system: A systematic approach to managingsafety, including the necessary organizat ional structures,

    account abil i t ies, p ol icies and procedures.

    Satellite ATO. An ATO at a locat ion ot her than primary locat i on oft he ATO.

    Second-in-command (SIC). A l icensed pi lot serving in a pi lot ingcapacity other than as pi lot- in-command, who is designated assecond in command and who meets second in commandrequir ement s of Part 8 of t hese regulat i ons.

    Serious injury. An injury which is sustained by a person in an

    accident and which:

    (a) Requires hospit al isat i on for more t han 48 hours,commencing within seven days from the date theinjury was received;

    (b) Result s in a fr actur e of any bone (except sim plefr actures of f ingers, t oes or nose); or

    (c) Involves lacer at ions w hich cause severehaemorrhage, nerve, m uscle or t endon damage; or

    (d) Involves inj ury t o any int ernal organ; or

    (e) Involves second or t hird degree burns, or any burnsaff ect i ng more t han 5% of t he body surf ace; or

    (f) Involves verif ied exposure t o inf ect ious subst ances

    or in j ur ious radiat ion.

    (g) Involves loss of l i mb .

    Signature. An individuals unique ident if icat ion used as a means ofauthent icat ing a maintenance record entry, maintenance record,f l ight release and journey log. A signature may be hand-writ ten,elect ronic, or any other form acceptable t o the Author i t y .

    Sign a maintenance release (to). To cert i fy that maintenance workhas been completed sat isfactori ly in accordance with the applicableStandards of airworthiness, by issuing the maintenance releaseref erred t o in Annex 6.

    Small aeroplane. An aeroplane having a maximum cert i f icated take-of f m ass of l ess t han 5,700 kg. (12, 500 lbs. ).

    Solo flight. Fl ight t ime dur ing which a student p i lot is the soleoccupant of the aircraf t , or that f l ight t ime dur ing which the studentacts as a PIC of a gas balloon or an airship requiring more than one

    f l ight c rewmember .

    Solo flight time. Flight t ime during which a student pi lot is the soleoccupant of an aircraf t .

    Special situation passengers. include armed securit y personnel,deportees, persons in custody and persons with special medicalneeds.

    Specialised maintenance. Any maintenance not normal ly per form edby an AMO (e.g. , t i re ret hreading, p lat i ng, etc. )

    Speciality curriculum. A set of courses t hat i s designed t o sat isfy arequirement of the Nigerian Civi l Aviat ion Regulat ions and isapproved by the Authority for use by a part icular Level 2 ATO orsatel l i t e Level 2 ATO. The special i t y curr icul um includes t rainingrequir ement s unique t o one or more Level 2 ATO cl ient s.

    State: Means an ICAO cont ract ing mem ber stat e.

    State of Design. The Contr act ing St ate whi ch issued the originaltype cer t i f icate and any subsequent supplemental type cer t i f icatesfor an aircraft , or which approved the design of an aeronaut icalproduct or appl iance.

    State of Manufacture. The Cont ract ing St ate, under whose authori t yan aircraft was assembled, approved for compliance with the typecert i f icate and al l extant supplemental type cer t i f icates, test f lownand approved for operat ion. The st ate of manufacture may or may

    not also be t he st ate of design.

    State of Origin (Dangerous Goods). The St ate in whi ch dangerousgoods wer e f i rst loaded on an aircraf t .

    State of Registry. The Contracting State on whose register anaircraf t is entered.

    State of the Operator: Means the state in which the operator sprincipal place of business is located, or i f there is no such place ofbusiness, t he operator s perm anent resident.

    Takeoff decision point . The point used in determ ining t akeof fper formance f rom which, an engine fa i lure occurr ing at th is point ,e i t her a re ject ed takeof f m ay be made or a t akeof f safely cont i nued.

    Technical Instructions. The latest ef f ect ive edi t ion of t he TechnicalInst ruct ions for t he Safe Tr ansport of Dangerous Goods by Air (ICAODoc. 9284-AN/ 905), i ncluding t he supplem ent and any addendum,approved and publ ished by decision of t he Council of t he ICAO.

    Threat: Events or errors that occur beyond the inf luence of thef l ight crew, increase operat ional complexi ty and which must bemanaged t o maintain t he margin of safety.

    Threat Management: The process of det ect ing and responding t o t hethreats wi th countermeasures that reduce or e l iminate theconsequences of threats, and mit igate the probabil i ty of errors orundesired air craft st ates.

    Training programme. A programme that consists of courses, courseware, faci l i t ies, f l ight t raining equipment, and personnel necessary

    t o accomplish a specif ic t raining obj ect i ve. I t may include a corecurr iculum and a specialty curr iculum.

    Training specifications. A document issued t o a cert i f ied Aviat ionTraining Organisat ion by the Authority that prescribes thatorganisat ions training, checking, and test ing authorisat ions andlimitat ions, and specif ies training programme requirements.

    Training time. The t ime spent receiving from an authorisedinst r uctor f l ight t ra in ing, ground t ra in ing, or simulat ed f l ight t ra in ingin an approved f l ight simulat or or approved f l ight - t r a in ing device.

    Training to proficiency. The process of t he check pi l otadministering each prescribed manoeuvre and procedure to a pi lot asnecessary unt i l i t is perf ormed successful ly duri ng the t raining period

    UN number . The four -digit numb er assigned by the Unit ed Nati ons

    Committee of Experts on the Transport of Dangerous Goods toident if y a subst ance or a part icular group of subst ances.

    Unit load device. Any t ype of ai rcraf t container , ai rcraf t pal let wi t ha net , or a i rcraf t pal let wi t h a net over an igloo.

    Unqualified Person: In relat ion to Part 4 of these regulat ions meansany person who is disquali f ied from owing a company or sharestherein under S.20 companies and Allied Matters Act. Cap 20 LFN2004.

    Manoeuvering Area. That par t of an aerodrome to be used for t he take-of f , landing, and tax ing of a i rcraf t , excluding aprons.

    Marker. An object displayed above ground level in order to indicate anobst acle or del i neate a boundary.Marking. A symbol or group of symbols displayed on the surface of themovement area in order t o convey aeronaut ical inform at ion.

    Movement Area. That par t of an aerodrome to be used for t he take-of f ,landing, and taxing of aircraft , consist ing of the manoeuvering area and

    t he apron.

    Obstacle. Al l f ixed (whether temporary or permanent) and mobi leobjects, or par ts thereof , that are located on an area intended for thesurface movement of a i rcraf t or that extended above a def ined sur facein tended t o pro tec t a i rc raf t in f l igh t .

    Obstacle Free Zone (OFZ). The airspace above the inner approachsurface, inner transit ional surfaces and balked landing surface and thatport ion of the str ip bounded by these surfaces, which is not penetratedby any f ixed obstacle other than a low-mass and frangibly mounted one

    requir ed f or air navigat i on purposes.

    Obstacle limitation surfaces. Series of surfaces that def ine the volumeof airspace at and around an aerodrome to be kept free of obstacle inorder to permit the intended aircraf t operat ions to be conducted safelyand to prevent t he aerodrome f rom becoming unusable by t he growt h ofobst acles around t he aerodrome.

    Runway. A def ined rectangular area on a land aerodrome prepared fort he landing and take-of f of a i rcraf t .

    Runway Strip. A def ined area including the runway and stopway, i fprovided, i ntended:

    Runway Visual Range (RVR). The range over which the pi lot of anaircraft on the centre l ine of a runway can see the runway surfacemarkings or the l ights delineat ing the runway or ident ifying i ts centrel ine.

    Shoulder. An area adj acent t o t he edge of a pavement so prepared as t oprovide a t ransi t ion betw een the pavement and t he adjacent sur face.

    Safety Management System. A system for the management of safety ataerodromes including the organizat ion structure, responsibi l i t ies,procedures, processes and provisions for the implementat ion ofaerodrome safety policies by an aerodrome operator, which provides fort he cont rol of safety at , and the safe use of t he aerodrome.

    Safety Area. A def ined area made up of e i t her a runway or t ax iway andthe surrounding surfaces that are prepared or suitable for reducing therisk of damage to aircraft in the event of an undershoot, overshoot, orexcursion f rom a runway or the unintent ional departure f rom a t ax iway.

    Taxiway strip. An area inc luding a tax iway intended to protect anaircraf t operat ing on a tax iway and to reduce the r isk of damage to an

    aircraf t accidental ly running of f t he tax iway.

    Unserviceable Area. A part of the movement area that is unf i t andunavailabl e for use by aircr aft .

    Work Area. A part of an aerodrome in which maintenance orconstruction works are in progress.

    Wildlife hazard. A potent ia l for a damaging aircraf t col l is ion wi th birdsor animals on or near an aerodrome.

    5. PROCEDURESFOR MAKING AND AMENDINGREGULATIONS

    (1) There shall be est ablished by the Direct or General of t he Aut horit y, aRegulat ions Commit t ee (hereinaf t er referred t o as t he commit t ee ) .

    (2) The Commit t ee shal l be a st anding Commit t ee wi t h in t he Author i t y .

    (3) The Comm it t ee shall be responsibl e for :-

    (a) Monit or ing amendment s t o t he St andards and RecommendedPract ices contained i n t he Annexes t o t he Convent ion onInternat ional Civi l Aviat ion;

    (b) Incorporat ing t he amendment s int o these Regulat ions;

    (c) Considerat ion of proposals for amendm ent t o these Regulat ionsmade by st akeholders and other mem bers of t he Public;

    (d) Proposing on it s mot ion, amendment s t o t he Regulat ions;

    (e) Not if icat i on of and f i l i ng wi t h ICAO of dif f erences and compli ancew it h t he SARP s.

    6. DISPLAY AND INSPECTION OF LICENCES AND CERTIFICATES

    (1) Pi lot l icence:

    (a) To act as a pi lot of a civi l aircraft of Nigerian regist ry, apilot shall have in his or her physical possession orreadily accessible in the aircraft , a val id pi lot l icence orspecial purpose authorisat ion or val idat ion issued underthese regulat ions or an appropriate l icence issued by anICAO contract ing state and rendered val id by theAuthor i ty .

    (b) To act as a pi lot of a c ivi l a i rcraf t of foreign regist rywit h in Niger ia, a pi lot shal l be t he holder of a val id p i l otl icence issued by the state of registry of the aircraft , ora l icence from an ICAO contract ing state rendered val idby that st ate of regist ry , and have the pi lot l icence in hisor her physical possession or readily accessible in thea i rc ra f t .

    (2) Fl ight inst ruct or: A person who holds a f l ight inst ruct or rat ing

    in his or her pi lot l icence shall have that l icence, or otherdocumentat ion acceptable to the Author i ty , in that personsphysical possession or readily accessible in the aircraft whenexercising the privi l eges of t hat rat ing.

    (3) Ot her personnel l icence: A person requir ed by any part ofthese Regulations to have a licence shall have it in his or herphysical possession or readily accessible in the aircraft or att he work sit e when exercising the privi l eges of t hat l icence.

    (4) Medical cert i f icat e: A person requir ed by any part of t hese

    Regulat ions to have a current medical cert i f icate shall have itin his or her physical possession or readily accessible in theaircraft or at the work site when exercising the privi leges ofthat cer t i f i ca te .

    (5) Aviat i on Training Organisat i on (ATO) cert i f icat e: Each holder ofa cer t i f icate or a provisional cer t i f icat e for t he conduct ofpi lot t ra in ing course or cer t i f icate for a i rcraf t maintenancetraining courses shall display that cert i f icate in a place in theschool that is normally accessible to the public and that is notobscure.

    (6) Cert i f icat e of Airwort hiness: Each owner or operat or of anaircraf t shal l d isplay the cer t i f icate of a i rworthiness of thataircraf t in the cabin of the aircraf t or at the entrance to theaircraf t f l ight deck.

    (7) Approved Maint enance Organisati on (AMO) Cert if icat e: Eachholder of an AMO cert i f icate shall prominent ly display thatcer t i f icate in a place accessible to the publ ic in the pr inc ipalbusiness of f i ce of t he AMO.

    (8) Inspect ion of l icence: Each person who holds a crew mem beror other personnel l icence, medical cer t i f icate, val idat ion orauthorisat ion required by these Regulat ions shall present i tfor i nspect ion upon a request fr om ;

    (a) The Author i t y ; or

    (b) Any Federal or St ate law enforcement of f i cer or anyot her per sons duly aut horised t o make such a request .

    7. CHANGE OF NAME

    (1) A holder of a l icence, cer t i f icate, val idat ion or author isat ionissued under these Regulations may apply to change the nameon a l icence, cer t i f icate, val idat i on or Author isat ion. The

    holder shall i nclude w it h any such request

    (a) The current l icence or cer t i f icate; and

    (b) A copy of the marriage l icences, court order, or ot herdocument verif ying the change of name.

    (2) The Author i t y wi l l return to the l icencee t he document sspecif i ed i n paragraph (a) of t his subsect i on.

    8. CHANGE OF ADDRESS

    The holder of a l icence, ATO or provisional ATO cert i f icate issuedunder Part 2 or Part 3 of these Regulations who has made a changein permanent mail ing address may not, af ter 30 days from thatdate, exercise the privi leges of the l icence or cert i f icate unless theholder has not i f ied the Author i ty in wr i t ing of the new permanentmail ing address, or current resident ial address i f the permanentmail ing address includes a post off ice box num ber.

    (b) Any f raudulent or intent ional ly fa lse entry in anylogbook, record, or report that these Regulat ionsrequire, or used to show compliance with anyrequir ement of t hese Regulat ions;

    (c) Any reproduct ion for f r audulent purpose; or

    (d) Any al terat ion.

    (2) Any person who comm it s any act prohibit ed under paragraph(a) may have his or her airman l icence, rat ing, cert i f icate,val idat ion or authorisat ion revoked or suspended and may beprosecuted in accordance wi t h Nigerian Laws.

    11. REFUSAL, SUSPENSION ANDCANCELLATION OF LICENCESANDRATINGS

    The Author i t y may in the interest of safety, publ ic interest or i f i tappears reasonable t o i t t o do so, r efuse to grant , vary, suspend,cancel or revoke a Licence, Cert i f i cate, Permi t s, Aut horisat i ons,Rat ings or Valid at ions.

    12. SURRENDER, SUSPENSION, OR REVOCATION OF LICENCE, CERTIFICATE, DOCUMENTS, AUTHORISATION OR VALIDATION

    (1) Any l icence, aut horisat i on, document s, val idat ion orcertif icate issued under these Regulations ceases to be

    eff ect i ve i f i t is surrender ed, suspended, or revoked.

    (2) The holder of any l icence, authori sat i on, val idat ion orcert i f icate issued under these Regulat ions that has beensuspended or revoked shall return that l icence, cert i f icate,authorisat ion or val idat ion when requested to do so by theAuthor i ty .

    13. APPEAL AGAINST REFUSAL TO GRANT A LICENCE, CERTIFICATE, RATING, AUTHORISATION, APPROVAL OR VALIDATION

    (1) An applicant who is ref used a l icence, cert i f icate, rat ing,approval, authorisat ion or val idat ion under these regulat ionsmay wit h in 30 days af t er t he date of ref usal , appeal in wr i t ingand in dupl icate t o the Author i t y for reconsiderat ion of t herefusal.

    (2) I f an applicant does not appeal wit hin t he period prescribed insubsect ion 1, t he Aut horit y wil l consider t hat he or sheis sat i sf i ed wi t h the decision given for t he ref usal.

    14. REAPPLICATION AFTER SUSPENSION

    Unless otherwise authorised by the Authority, a person whoselicence has been suspended may not apply for any l icence, rat ing,val idat ion or aut horisat i on during t he period of suspension.

    15. REAPPLICATION AFTER REVOCATION

    Unless otherwise authorised by the Authority, a person whosel icence, cer t i f icate, rat ing or author izat ion has been revoked maynot apply for any l icence, cer t i f icate, rat ing or author izat ion forone (1) year af t er t he date of revocat ion.

    16. VOLUNTARY SURRENDER OR EXCHANGE OF LICENCE

    (1) The holder of a l icence, cer t i f icate, val idat ion orauthorisat ion issued under these Regulat ions may voluntari lysurrender i t for :

    (a) Cancellat ion;(b) Issuance of a low er grade l icence; or(c) Anot her l icence wi t h specif ic rat ings delet ed.

    (2) An applicant request ing volunt ary surrender of a l icence shallinc lude the fo l low ing signed stat ement or i t s equivalent :

    This request i s made for m y own reasons, w it h ful lknowledge that my ( insert name of l icence or rat ing, asappropriate) may not be reissued to me unless I again pass thetests prescribed for its issuance.

    17. LANGUAGE OF MANUALS, CERTIFICATES, RATINGS ANDLICENCES

    (1) Manuals, cert i f icat es or l icences being submi t t ed t o t heAut horit y must be in t he English language.

    (2) I f the original manual is in a language, ot her than English, acert i f ied English translat ion must be submitted.

    (3) When a cert i f icat e or l icence is issued in a language ot her thanEnglish, i t shall i nclude a cert i f ied English t ranslat ion.

    18. POWER TO PREVENT AIRCRAFT FROM FLYING

    (1) Where i t appears t o t he Aut horit y or an authori sed personnel

    of t he Author i t y that any aircraf t -

    (a) is in a condi t ion unf i t for f l ight ; or(b) is l ikely to be f lown in such circumstances that the f l ight

    would be in contravent ion of any provisions of these

    Regulations and be a cause of danger to any person orproperty whether or not in the aircraf t , the Author i ty orauthor ised person may direct t he operator or t he captain ofthe aircraf t that he or she is not to permit the aircraf t tomake that par t icular f l ight or any other f l ight of suchdescr ipt ion as may be speci f ied in the direct ion, unt i l thedirect ion has been revoked by the Author i ty or theauthorised person. The Authority or that authorised personmay t ake such st eps as are necessary t o det ain t he aircraf t .

    (2) For t he purpose of subsect ion (1), t he Authorit y or anyauthori sed personnel may enter on and inspect any aircr aft .

    19. AVIATION SAFETY INSPECTOR S ACCESS TO AIRCRAFT AND FACILITIES, AND OBSTRUCTIONOF AUTHORISED PERSONS

    (1) Whenever, in perf ormi ng t he dut ies of conduct i ng aninspect ion, an Inspect or pr esent s his or her cr edent ialsto : -

    (a) t he pi lot - in-command of an aircraf t , t he Inspector must begiven free and uninterrupted access to the aircraft ,includ ing the p i lo t s compar tment o f t hat a i rcra f t ;

    (b) the pi lot - in-command of an aircraf t operated by an airoperator cer t i f icate holder, the Inspector must be givenfree and uninterrupted access to the pi lot s compartmentof that a i rc raf t ;

    (2) Each hold er of a cert if icat e issued under t hese Regulat ions shall

    a l low t he Author i t y at any t ime and place, t o make inspect ions,inc luding on-the- job inspect ions, to determine compl iance wi thapplicable r egulat ions.

    (3) Each holder of an air navigat i on, aerodrome or met eorologicalservice provider approval, under these Regulat ions shall al lowthe Author i ty at any t ime and place to make inspect ions,inc luding on-the- job inspect ions, to determine compl iance wi thapplicable regulat i ons and their approval cert i f icat es.

    (4) I t shal l be an of fence to wi l l f u l ly obst ruct or im pede any

    authori sed personnel act i ng in t he exercise of his power or t heperf ormance of his dut ies under t hese Regulat ions.

    20. EXEMPTIONSANDEQUIVALENT SAFETY CASE

    (1) No person may int roduce procedures contr ary t o t hose prescribedin t hese Regulat ions unless needed and an equival ent safet y casehas f i rst been approved by the Authori t y.

    (2) The Aut horit y may issue exempt ion t o t he Regulat ions or rul eswhen the Author i ty has determined that i t is in the interest of thepublic and aviat i on safet y is not adversely aff ected .

    21. PETITION FOR EXEMPTIONS

    (1) Any interest ed person may pet i t ion t he Author i t y for a t emporaryor permanent exempt ion f rom any rules by the Author i t y .

    (2) Each pet i t ion f i l ed under t h is exempt ion must :

    (a) Be submi t t ed at least 60 days befor e t he proposed effect ivedate of the exemption, unless good cause is shown in thatpet i t ion .

    (b) Be submit t ed in dupl icate to the Author i t y .

    (c) Set f or th t he text or subst ance of the rule or st atut e f romwhi ch the exem pt ion is sought .

    (d) Explain t he int erest of the pet i t ioner in the act ion request edincluding, the nature and extent of the rel ief sought and adescript ion of each aircraft or person to be covered by theexempt ion.

    (e) Contain any inf ormat ion, views, or arguments availabl e t o t hepet i t ioner t o support t he act ion sought

    (f) Explain the reasons why the grant of the request w ould be inthe publ ic interest and, the reason why the exempt ion would

    not adversely aff ect safet y.

    (g) Indicate the act ion to be t aken by t he pet i t ioner t o provide alevel of safety equal to that provided by the rule f rom whicht he exempt ion is sought .

    22. ACTION ON PETITION FOR EXEMPTION

    (1) No publ ic hear ing, argument , or other form al proceedingshall be held on a pet it ion before i ts disposit ion exceptas may be provided for by t he Aut horit y.
