2021 UPSET TAX SALE INFORMATION

It is recommended that first time buyers read the Upset Tax Sale – Questions & Answers sheet. You must also read and be familiar with the 2021 Upset Tax Sale Conditions of Sale, Affidavit of Bidder and the Bidder Registration forms. To ensure you are a qualified bidder, make sure to read all forms in their entirety. It is strongly suggested that you consult with a lawyer before you participate in this sale. All documents and forms associated with the 2021 Upset Tax Sale may be found on the county website at www.carboncounty.com. There is no guarantee of the condition of the parcels listed, and they are sold “AS IS”. Pursuant to the Real Estate Tax Sale Law, all sales are subject to the rule of caveat emptor (“buyer beware”), such that in each and every case the properties are offered for sale by the Tax Claim Bureau without guarantee or warranty whatsoever, including existence, ownership, size, boundaries, location, structures or lack of structures upon the land, condition, liens, title or any other matter or thing whatsoever. It is assumed that anyone who bids on a property has done an independent due diligence investigation of these matters on their own. Bidder Registration instructions and information: As per Section 501-A(a) of the Real Estate Tax Sale Law: A person that intends to bid at a scheduled sale must appear and register at the bureau not less than 10 days before the scheduled sale. 2021 UPSET TAX SALE – CONDITIONS OF SALE

The following conditions shall govern the sale of properties by the Carbon County Tax Claim Bureau at a Public Upset Tax Sale scheduled for Tuesday, September 24, 2021, at 10:00 A.M., located at 410 Center Avenue, Jim Thorpe, PA: 1. The Tax Claim Bureau will issue a deed to the Purchaser(s) as listed on the registration form,

after the court has confirmed the sale. Assignment of Bids will not be accepted on any properties sold by the Tax Claim Bureau. The Minimum Bid will include all Delinquent Taxes, Penalties, Interest, Costs, Year 2021 Taxes and Municipal Liens, as long as the amounts have been provided to the bureau, in addition to the Realty Transfer Tax, Recording Fee and Deed Preparation. The Transfer Tax collected is equal to the Assessed Value x the Common Level Ratio Factor; it has nothing to do with the Purchase Price. The Bid Price must be paid by CASH, CASHIER'S CHECK, CERTIFIED CHECK OR MONEY ORDER. Upon director approval local attorney checks may be accepted.

2. All properties are sold under and by the virtue of the Act of 1947, P.L. 1368, as amended,

known as the "Real Estate Tax Sale Law", and all titles transferred by the Tax Claim Bureau are under and subject to the said Act. All sales are final and no refunds will be made after each property is struck down.

3. The Tax Claim Bureau is selling the taxable interest and the property is offered for sale by

the Tax Claim Bureau without any guarantee or warranty whatsoever, either to the structures or lack of structures upon the land, liens, title or any other matter. It is strongly urged that prospective Purchasers have an examination made of the title to any property in which they may be interested.

4. The Purchaser(s) take subject to any Real Estate Taxes, Municipal Liens, Mortgages, Federal

Tax Liens, and other liens which are not divested by this sale. 5. In the event of a dispute by the Bidders or failure of the Purchaser(s) to pay the Purchase

Price immediately, the property will again be put up for sale. If the successful bidder does not complete the purchase by tendering payment in full to the Carbon County Tax Claim Bureau, the sale will be declared void and that bidder may be barred from purchasing any properties from the Upset Tax Sale and/or from any subsequent Carbon County Tax Claim Bureau sales.

6. The Tax Claim Bureau will sell subject to existing occupancy, if any. 7. The distribution of monies, after deduction of all costs received from the sale, will be made

in accordance with the said Act.

8. Risk of loss shall pass to the Purchaser(s) immediately upon conclusion of the sale.

9. The Bureau will sell the property as described on the dockets in the Carbon County Tax Claim Bureau and makes no representations or warranties as to the description or title, or even the existence of the property, nor will it make any survey on a property sold.

10. As per Act 33 of 2021, the bureau shall provide a list of bidder applications received to all

municipalities within the county at least five (5) days prior to the Upset Sale. If a municipality objects to any bidder, it is the responsibility of the bidder to contact the municipality for resolution prior to bidding at the Upset Sale.

2. I hereby certify that within any municipal jurisdiction, I am not delinquent in paying real estate taxes to any taxing district in the Commonwealth of Pennsylvania and I am not delinquent in paying municipal utility bills owed to any municipalities within the Commonwealth of Pennsylvania.

3. Section 601(d) of the Real Estate Tax Sale Law has been amended to include that no individual whose landlord license has been revoked in a municipality, pursuant to its ordinance, may purchase property in the county in which the local municipality is located at a tax sale (P.L. 609, No. 82). Therefore, I hereby certify that I am not bidding for, or acting as an agent for, a person who is a barred landlord. 4. I hereby certify that I have not, within the three years preceding the filing of this affidavit, engaged in a course of conduct or permitted an uncorrected housing code violation, to continue unabated after being convicted of an uncorrected housing code violation, and have not either failed to maintain property owned in a reasonable manner such that the property posed a threat to health, safety or property; or permitted the use of property in an unsafe, illegal or unsanitary manner such that the property posed a threat to health, safety or property; as defined in Section 619(e) of the Real Estate Tax Sale Law. 5.
