Child support obligations aren’t alwaysclear, especially if there are unusualcircumstances. Te BC Court of Appealrecently dealt with such a case.

Te court considered the child supportobligations for Peter (all names changedhere), a pleasant 24-year-old man with amental disability. Peter couldn’t make basicdecisions for himself and likely would

never be able to live independently. His lifeexpectancy was normal, and he would needsupport for the rest of his life.

Peter’s parents, Mark and Linda, haddivorced in 1995. Tey initially shared jointcustody and guardianship of Peter, ve yearsold at the time, but in late 1996, they agreedthat Mark would have sole custody. SinceMark’s business took him to the UnitedStates a great deal, he also agreed to payLinda (who earned only a modest income

at the time) $300 a month in child support.Tis was essentially to enable her to travel tothe US for visits with Peter, which she didfrequently over the years.

By the time of the court hearing over childsupport, however, both Linda and Markwere very well-off nancially.

Linda had married a venture capitalistin 1998 and enjoyed an affluent lifestyle.She didn’t work, and details of her current

income were sketchy (she got some moneyfrom a company her husband was involvedwith). Before her rst marriage to Mark,she had earned roughly $20,000 a year as acharter airline employee, and in the initialcourt documents in this case, she said sheearned $20,000 annually, though later saidit was less.

Mark, 68 and retired, owned a mostly USreal estate portfolio worth $11 million (inaddition to a substantial inheritance)andearned some $168,000 a year.

Teir son Peter had some signicant assetshimself, partly from an inheritance from hisgrandmother and partly from a trust fund,though that fund could only be accessedif the Public rustee agreed. Peter also got

some monthly government assistance.Due to the substantial change in Linda’s

nancial circumstances and her no longerhaving any nancial difficulties in exercisingaccess, the lower court decided Mark didn’thave to pay Linda any arrears dating from2008 or make any further child supportpayments to her.

But Mark also wanted his ex-wife to helppay for the ongoing support of their son.

Te Court of Appeal emphasized that, eventhough Mark could well afford to supportPeter alone, Linda was also responsible forPeter’s support – it’s fundamental that bothparents have an obligation to support achild like Peter, who was likely to outlive hisparents.

It was Linda’s voluntary choice not towork, observed the appeal court. So it saidLinda should be treated as earning $20,000annually. Using this income gure and the

child support guidelines, the appeal courtordered Linda to pay Mark $174 a monthtoward Peter’s child support.
