3. Inspection Rules & Policy: All interested parties should reach at Tata BlueScope Steel Pvt. Ltd., A-11 to A-13 and A-16, 6th Phase, Adityapur Industrial Area, PO - Gamharia, Jamshedpur-832108,

by 10:00 AM (or as announced) on the date of inspection. Only registered customers/bidders/representatives of firms shall be allowed for inspection of material, subject to fulfilling their safety requirement of the steel works. Taking photographs of the material is strictly prohibited. Customers are advised to ensure that they inspect the materials on offer on the scheduled date as mentioned in the catalogue, before Participating in the auction. It is

retreated that all materials are offer / sold by Tata BlueScope Steel Pvt. Ltd. on “AS-IS-WHERE-IS” and “NO-COMPLAINTS” basis, and no complaint what so evershall be entertained regarding the quality of materials after the sale.

All are required to bring safety Goggles, Safety Helmet & Safety Shoes. Without the safety equipment’s no one will be allowed to inspect the material inside the works. “Tata BlueScope Steel Pvt. Ltd. would not accept any claim from any customer for non-inspection of materials.”

Interested bidders have to come with safety shoes, safety jackets, and safety goggles & safety helmets at the time of inspection. All interested parties have to arrange for their own safety shoes, safety jackets, safety helmets and safety goggles as per Tata BlueScope Steel Pvt. Ltd. standards. No person will be allowed to enter the works without these. Compliance to Tata BlueScope Steel Pvt. Ltd. safety norms is a must. No complaints during lifting, in what-so-ever manner, will be entertained if customers fail to inspect the materials during scheduled inspection dates. No ''people movement'' shall be allowed within the danger zone, at the time of loading/delivery of materials from the yards. Tata BlueScope Steel Pvt. Ltd. will not be responsible for any delays arising out of non-compliance to Tata BlueScope Steel Pvt. Ltd. norms.

4. Bidding modalities: 4.1 Price Bid Basis: In Indian rupees as per unit of measurement as given in Material List. Price to be quoted is basic, ex- location exclusive of taxes (In case of consignment agency

sale price to be quoted ex location inclusive of taxes), and any other statutory levies.4.2 Bid Increment : Rs.100/- ( Rupees Hundred only ) / (or as specified)4.3 Type of Auction: Yankee + English no ties

Minimum Qty : For Yankee Lots of TBSL-191201 initial bid of 60 MT and increment of 60 MT.4.4 Bid Validity: Bid shall be valid for 10 (Ten working days excluding Saturdays, Sundays and holidays) working days counted from the next day of auction process in case of

auction against a catalogue which is completed on the same day. And if it is continuing on any other day the counting of days for lot confirmation shall be from the next day of completion of entire auction process.

4.5 Bid duration: Lots open for bidding would be 20 minutes only. If, No bids received within these 20 minutes the lots are closed automatically.4.6 Auto Extension of the Auction Timings: In the event of bids in the last sixty (60) seconds of the scheduled bid time, the Bid Timings are automatically extended for One hundred

eighty (180) seconds from each such bid. Such Auto Extension shall continue until no bids are placed for sixty (60) seconds (Engine remains inactive for sixty (60) seconds. The Inactivity Time for Auto Extension purpose is normally “3” minutes. "Service Provider" however retains the right to change the “Inactivity Time” as well as “Extension Period”. The Inactivity Time applicable for the particular Online Bid shall be visible to the customers on the Bidding page.

5. Taxes & duties:5.1 GST : As applicable5.2 TCS : As applicable. In case of availing of concessional rate of TCS proper certificate issued by appropriate Income Tax authority are to be issued in

favour of the Principal Company along with payment. Self certification of Form no 27C is not acceptable. Form 27C will also have to be certified by appropriate Income tax authorities.

5.3 Any change in taxes applicable at the time of lifting shall be applicable.

6. Payment terms & conditions : 6.1 Payments:

6.2 Full Payment: Full value in advance for stock material within 5 days of sale intimation. This should include applicable tax and other charges as applicable. Successful tenderer(s) must release payment BY RTGS ONLY.Partial payment can be accepted only in case of materials on arising basis.

6.3 Delayed Payment Charges (DPC): Installment payments with DPC @ five (05) paise per Rs. 100 per day will be accepted up to 4 (Four) working days from due date of installment payment as mentioned in the confirmation letter. This is not applicable for EMD payment.

6.4 Saturdays& Sundays are excluded for counting purpose for payment schedule.6.5 In the event of Non-Receipt of Payment within the stipulated period of Payment, the Sale Offer for the approved Lot shall stand withdrawn automatically.6.6 Buyers have to send the payment deposit slip (UTR No /Scan Copy of NEFT/RTGS Transaction Slip) against Lot No. immediately after the payment to AHB at email id:

7. Lifting terms & conditions:7.1 DOs will be handed over to authorized representatives of bidders on receipt of payment. Lifting date is calculated from the next day of DO Release date. 7.2 Loading Charges: As per material list. Loading charges to be deposited with the TBSL account along with the payment of material7.3 Loading shall be given strictly as per the statutory norms & safety norms of Tata BlueScope Steel Pvt. Ltd.7.4 PICK & CHOOSE NOT ALLOWED FOR ANY OF THE LOTS.

7.5 LOT TRANSFER WILL NOT BE ALLOWED & NO STOCK TRANSFER WILL BE DONE.

7.6 USE OF HYDRA CRANES BY CUSTOMERS IN ANY PREMISES/LOCATION /STOCKYARDS OF TATA BLUESCOPE STEEL PVT. LTD. AND ITS VENDORS/CONSIGNMENT AGENTS' PREMISES IS BANNED.

7.7 The Customers by whom the winning bid is submitted (“winning Customer”) will be allowed to start lifting the Material only after making the complete payment against each lot (including taxes & duties). The lifting will be under the supervision and direction of concerned official of Tata BlueScope Steel Pvt. Ltd in charge of such warehouse where the materials are stored. The materials will be delivered ex-warehouse. It will be the responsibility of the winning customer to arrange for lifting,

payment of freight and transit insurance. The winning Customer shall be liable to bear the transit insurance and Tata BlueScope Steel Pvt. Ltd. shall not be liable for the same in any manner. Entire lot shall be lifted within 10 working days from the Issuing date of Delivery Order. Failing which customer needs to pay Rs 1000 per day per lot extra as Ground Rent Charges.

8. Penalties:8.1 The following penalties shall be applicable in the eventuality of a buyer defaulting in making the payment of EMD (wherever applicable) or any installment/s, as per the

stipulated schedule for each lot, in a financial year: In the first instance, a penalty of Rs. 50,000/- (Rupees Fifty Thousand only) shall be recovered from the customer. In the second instance, a penalty of Rs.100,000/- (Rupees One Lakh only) shall be recovered from the customer. In the third, and any subsequent instance, a penalty of Rs.150,000/-(Rupees One Lakh Fifty thousand only) shall be recovered and the customer shall be debarred

from participating in any auction for a period of three months from the date of debarment.In the event of any default, the customer’s user id will be disabled and the customer will be blocked from participating in any auction of TBSL with immediate effect.

The defaulting customer shall be allowed 06 (six) working days to deposit the penalty as mentioned above. In case the penalty is not received within the stipulated period, the customer’s security deposit shall be forfeited, and the defaulting customer shall be debarred from participating in any auction of TBSL.

8.2 If after making payment of EMD (wherever applicable), the installment payment/s are not made by the customer as per the stipulated schedule for each lot, the entire EMD amount against such lot shall be forfeited.

8.3 Penalty for dishonour of cheques: In case of dishonor of a payment instrument deposited by a customer for any reason whatsoever, the following shall be recovered from the customer:-

Rs.1000/- (tax inclusive) in form of Demand Draft towards bankers charges per instrument.

Delayed payment charges @ 5 paise per Rs.100/- per day for the period of delay beyond the due date.

Penalty @ 1% ( Inclusive of tax) of the dishonoured amount, subject to a maximum of Rs.25000/- ( Rupees Twenty Five Thousand Only) per dishonoured instrument.

DEFAULTS WOULD BE COUNTED AGAINST TATA BLUESCOPE STEEL PVT. LTD. AND NOT AGAINST A PARTICULAR AUCTIONEER

9. Lot Closure Norms :For Lot Closure, the tolerance would be ± 10% of the original quantity.

10. Complaints :Complaints, if any, with regard to any transaction shall have to be lodged by the buyer within three calendar months from the date of last invoice. No complaint shall be entertained thereafter, under any circumstances.

11. Jurisdiction :Any dispute arising out of any contract shall be decided in Jamshedpur by the courts in Jamshedpur and by no other courts. The courts in Jamshedpur shall have exclusive jurisdiction to adjudicate upon any such dispute.

12. General terms & conditions:12.1 Any dispute on condition of material shall not be entertained at any point after confirmation of lot.

12.2 All materials are offered/sold on “As is Where is Basis” and “No Complaint Basis”.

12.3 Payment and invoicing has to done in the name of the H1 bidder, subject to the prices being approved.

12.4 Dispatch is subjected to FORCE MAJEURE conditions

12.5 The seller reserves the right to terminate any offer at any point of time without assigning any reasons

12.6 In the event of termination of the offer, seller shall refund the balance amount after due reconciliation

12.7 No claims whatsoever would be entertained after cancellation of the bid

12.8 Material purchased should be the only material being lifted from the designated location. Tata BlueScope Steel Pvt. Ltd. has the right to check any vehicle at any moment of

time. If material lifted differs from the material that is purchased by the buyer, and then the buyer/authorized representative will be permanently debarred and penal

action against the buyer/ authorized representative as deemed fit shall be taken by Tata BlueScope Steel Pvt. Ltd.

12.9 If the safety compliance is not followed then Tata BlueScope Steel Pvt. Ltd. can penalize the buyer/authorized representative as deemed fit.

12.10 These terms and conditions as stated above supersede the relevant terms & conditions that are given in Tata BlueScope Steel Pvt. Ltd. Secondary General Terms and

Conditions.

The terms & conditions not covered above will be as per Tata BlueScope Steel Pvt. Ltd.’s Secondary General Terms and Conditions.

13. Lot Photograph: Photographs of lots are at best indicative only and do not necessarily reflect the actual condition of lots. All bidders are advised to physically inspect the offered lots before participating in the auctions. Tata BlueScope Steel Pvt. Ltd. or AHB shall not be responsible or liable for any error of judgment or bids put by bidders acting on the basis of these photographs.

14. Documents for verification regarding entry of vehicles inside Tata BlueScope Steel Pvt. Ltd. works :

a. 15.06.2014, Eye Test certificate production is mandatory for all Truck Drivers. If the age of the driver is less than 45 years frequency of production of such certificate is once a year and if the age of the driver is more than 45 years the frequency of production of such certificate will be at an interval of every 6 months.

15. Compliance to safety norms15.1 Authorized persons (of the customer) involved in lifting of the materials will be allowed only with Personal Protective Equipments (PPE) i.e., Safety Shoes, Safety Helmet,

Safety Goggles, Fluorescent Jacket and Hand Gloves. No "people movement" shall be allowed at the time of loading/delivery of materials from the yards" Tata BlueScope Steel Pvt. Ltd. will not be responsible for any delays arising out of Non- Compliance to the Safety Norms.

15.2 Documents for verification regarding entry of vehicles inside Tata BlueScope Steel Pvt. Ltd. works :

All customers to note that presentation of following set of documents to TATA BLUESCOPE STEEL PVT. LTD. authorities is COMPULSORY at the time of reporting of vehicles at TBSL designated Gate for entry of Customer trucks/vehicles.a. Driving License of driver,b. Registration Card,c. Commercial Certificate,d. Fitness Certificate of Vehicle,

15.3 The drivers of the vehicle must have the eye test certificate. The frequency of the testing would be as below:

2. If the age of the person is 45 years or more, the testing is required to be done once in every 6 months

Explanation for the Allocation of Quantity 1. Bidder B is the highest bidder @ Rs.15000/MT, hence the system allocates his bided quantity i.e., 200 mt = 1 Unit2. There are 4 bidders @ Rs.14800/Mt.

(i) Since bidder F’s bid was for 400 MT ( 2 Unit ) (Highest at Rs.14800/MT) the system allocates his bid quantity in full. of 13


(ii) Since bidder A placed his bid earlier than bidder D & bidder E i.e. 9.32 Hrs hence the software gives first preference to Bid der A (iii) and allocates bidder A the available quantity ( i.e. 200 MT = 1 Unit) first.

2. Since, all the quantity is exhausted at higher bid price than Rs.14750/MT, therefore no quantity is allocated to Bidder C. If Bidder C wants to win any quantity then he has to place bid in terms of higher price and/or greater quantity.

Quantity offered is based on eye estimation. Delivery will be made for the estimated quantity or actual ground stock. Estimation error may arise. After inspection, no complaint of whatsoever nature on estimated /offered quantity shall be entertained under any circumstances. Bidders are advised to make their own judgment on offered quantity before biddingNote: Tata BlueScope Steel Pvt.
