And for those who were stumped by the Earth Day Trivia Quiz in my April column, here are the answers: 1) The 5th Amendment to the US Constitution is frequently used for protection against self-incrimination. What else does it cover?Property Rights – The 5th Amendment has the Takings Clause, which states “No person shall … be deprived of life, liberty, or property without due process of law; nor shall private property be taken for public use, without just compensation. This is the basis of American proper-ty rights and was so fundamental to the founding fathers that it became the 5th Amendment of the US Constitution in 1791.

2) March 2004 headlines in US newspapers announced the intention of what country to sell land to private citizens and recognize a version of “property rights.” China – That country finally started selling/giving land to its residents. In countries where all land, trees, water, minerals, etc. are owned by the government, there is no private property and property rights do not exist.

3) Which CA Governor signed an Executive Order requiring formal consideration of state agency actions on private property rights?George Deukmejian – He recognized the importance of private prop-erty rights.

A re you aware that the Town of Truckee erosion prevention ordinance requires “year round” erosion prevention? It’s true. In fact, it’s

entitled the “Town of Truckee Minimum Standards for Year-Round Erosion Prevention on One and Two Family Dwelling Projects.”

So, even though it may not look like rain, erosion prevention devises must be in place before any excavation work is undertaken. Summer storms can form in the area in the middle of the night. Remember July 22, 2012 when thunderstorms erupted at one in the morning?

The bottom line is that all construction sites must be protected to keep contaminants from entering the waterways. Every day when work is complete, please assure that BMPs (best management practices, erosion prevention devises) are implemented and that your site is protected. Keep in mind that BMPs include more than just erosion protection for soil. Anything that can be mobilized by storm water needs to be covered or contained, such as paint, oil, or cement.

Truckee Council Member Dr. Mark Brown (Truckee Drug, Alcohol Testing & Chiropractic) will be moderating a panel of three speakers at the prestigious League of CA Cities annual conference in September. Moderators were sought who are “willing to run a tight ship and keep all the speakers to their time limits.”

Longtime CATT member J. Corda Construction announced the creation of “Jones Corda Construction,” formalizing a commitment between John Corda and his Controller Joan Jones. Joan joined Corda Construction 14 years ago and is also serving as Truckee’s Mayor on the Town Council. John’s announcement closes with “Jones Corda Construction is looking forward to continuing what we started for many, many years to come.”

Reno Iron Works received two awards from the Nevada Chapter of Associated General Contractors in addition to receiving the coveted “Golden Hard Hat” award at AGC’s 15th annual Safety Awards luncheon. RIW walked away with the “No Lost Time” and Specialty Contractor “Best Safety Record Under 50,000 hours” awards.

Tahoe Regional Planning Agency gave a “Best In The Basin” award to Ward-Young Architecture & Planning for designing a residence in Meeks Bay. The home was designed with a stepping form that made efficient use of a narrow, steeply sloped lakeside site. The detached garage linked to the stepping form of the house with a minimal foundation footprint. The home was built by Loverde Builders and the landscaping done by Green Envy.

Ward-Young Architecture & Planning was also named as a “Runner-Up” in the 9th annual Tahoe Quarterly magazine “Mountain Home Awards.” The

recognition was given for the architecture and interior design of the Highlands Fire Station in Northstar.

And new CATT member DiNallo Designs was recognized by Tahoe Quarterly magazine for interior remodel design on a Dollar Hill home. Although the entire home was undergoing a transformation, it was the kitchen remodel that got TQ’s attention and resulted in a “Merit Award.” Elisa DiNallo is quoted extensively in the article that described her work to update the kitchen.

Builders Magazine, another new CATT member, featured the Truckee Tahoe construction market and CATT in its July-August issue. A photo supplied by Incline Builders appeared on the front cover of the issue and lots of statistics filled the article. Builders Magazine comes out every other month and includes articles from a diverse group of CA and NV construction associations.

CATT member Truckee River Associates is holding a photo contest via Facebook. Using the “Flying A building” in downtown Truckee (aka Sports Tahoe) as background, TRA is soliciting photos to be posted on their Facebook page. 1st, 2nd, and 3rd place prizes will be awarded ($500 gas card, $250 gas card, and $150 gas card). While it may be okay here, it won’t be over there- what’s a contractor to do in navigating this bureaucratic maze? Regulations exist for almost every aspect of ‘doing business as’ a contractor…Q: Do I need a contractor’s license to remove graffiti from public and private property? Our process is to use chemical paint lifters and pressure washing. I have knowledge of the laws in AZ but not in NV or CA where I’m looking to get licensed.A: Thank you for contacting Capitol Services. In NV a license would NOT be required to REMOVE graffiti via chemicals and pressure washing; however, in CA a “C-61”/”D-38” (Limited Specialty) license would be necessary. However, a contractor’s license would be required in both states if you also APPLY any paint or sealant after you remove the graffiti. Now that you know you need a license in one or both states, call us back to discuss the application process. Q: We have a corporation “Smith Concrete Inc., dba Smith Home Remodeling” which has both a “C-8” concrete and “B” General Building license. Can we advertise and do business as “Smith Concrete Inc” in relation to our “C-8” work, and concurrently advertise/do business as “Smith Home Remodeling” on our General Building projects?A: Sorry you may not do business as two different names with only one license number. You can either do business under your entire name, “Smith Concrete Inc., dba Smith Home Remodeling” or use just your ‘doing business as’ (dba) “Smith Home Remodeling”. To simultaneously conduct business under two different names, you may want to apply for a second “C-8” license under Smith Concrete Inc.—with no fictitious business name (dba). Then you can use the new license number to advertise and conduct your concrete work, while using the existing

license for your general construction.Q: We are currently licensed as a corporation in CA, however this is a Limited Liability Company (LLC) in our home state. Now that the CSLB is issuing licenses to LLC’s, we want to get a license for that business entity as well. We would like to use an employee of our CA corporate entity as our Responsible Managing Employee (RME) since he has his own inactive Sole Owner license. Does he have to be an employee of the LLC or could he be a consultant?A: The new law allows them to serve as a Responsible Managing Member, Manager or Officer (RMM or RMO), or be designated as a RME. Contractor’s Board regulation #823 addresses the specific requirements related to RME’s including that this individual be a Bona-fide employee of the LLC (not a consultant).Q: I hold a ”B” contractors license and want to be able to take on projects for painting and tile work. I understand that with my “B”, I can’t do single trade projects without holding these classifications. Do I have this right? What would be required if I want to get these two licenses? Is there any way to get an exam waiver?A: You are correct; General Building contractors must either hold the specialty class (in this case the “C-33” painting and “C-54” tile) or sub-out the work to a properly licensed specialty contractor. To secure these classes (and self-perform this work), you’ll need to file two Applications For Additional Classification.

The CSLB will only allow you to file one application at a time. You can request an exam waiver by submitting significant proof (i.e. project lists) that you have handled these trades since your license was issued 5 years ago. Even with these detailed projects lists, the CSLB may still require you to sit for the trade test.
