Cayman’s Tobacco Law and Regulations What You Need to Know In accordance with the Tobacco Law 2008 and the Tobacco Regulations 2010, public places are smoke free. This comprehensive legislation governs the sale, promotion, and use of tobacco in the Cayman Islands. The Law will: • Give us smoke-free public places, including all workplaces, bars, restaurants and parks. • Promote a society where no-smoking becomes the norm. What the law does. • Promotes a climate where non-smoking and the absence of tobacco promotion becomes the norm • Prohibits smoking in or within ten feet of a public place • Prohibits the sale of tobacco products to minors • Requires retailers to verify age for over-the-counter sales if there is any doubt • Prohibits tobacco advertising and promotion • Requires all tobacco dealers to register with the Medical Officer of Health • Requires tobacco dealers to display health warnings at the point-of-sale of tobacco products • Prohibits tobacco products from being displayed within reach of customers • Requires a display of health warnings covering at least 30% of the principal display area of the tobacco packages • Prohibits vending machine sale of tobacco products Smoke-free public places. Most bars, restaurants, office buildings, businesses and other enclosed areas are already smoke-free by choice. However, from 31 December 2009 the following public places are smoke-free inside as well as up to 10 ft from any entry, exit or other opening: • All offices, office buildings, warehouses and places of work • Common areas in apartment buildings, condominiums and retirements homes • Health care facilities and their grounds • Educational facilities and their grounds • Gyms, parks (including marine parks) and sport stadiums • Beauty parlors, barber shops and laundromats • Enclosed bars, restaurants and pool halls • Any means of transport (including boats) used for commercial, public or professional purposes and used by more than one person • All government owned facilities • Public toilets and public transportation terminals (e.g. the cruise terminals) • All shops and shopping centres • Concert and convention halls What is a public place? A public place means any place, including a workplace or public conveyance, to which members of the public have access whether or not a fee is charged for entry. What is an enclosed place? The Law describes an “enclosed place” as a place which has a full or partial roof with at least 50% of its sides covered with walls, windows, blinds or curtains. Is it an offence to smoke in a public place? Yes. Anyone who smokes in a public place is liable on summary conviction to a fine of $2000 for the first offence and to $10,000 for the second offence. What You Need to Know

In accordance with the Tobacco Law 2008 and the Tobacco Regulations 2010, public places are smoke free. Promoting smoke-free public places.All areas where smoking is not allowed must be marked with no-smoking signs as prescribed by the Law. Signs must be posted at all entries and exits.

Sample signs for use in public places

Retailing tobacco products.• No-one can sell any tobacco products to children under 18 years of age.• The Law requires vendors to display health warnings at the point of sale of tobacco products,.• Tobacco products cannot be displayed within reach of customers.

No-smoking in taxis, buses, boats and other forms of public transport.Drivers and owners of vehicles used for public transport must make sure they have the international no-smoking symbol prominently displayed inside the vehicle.

Designated smoking areas in outdoor bars and restaurants.Outdoor bars and restaurants may have designated smoking areas. Smoking permitted and no smoking areas must be clearly marked.
