UPDATE ON THE AGREEMENT FOR BIODIVERSITY-FRIENDLY CARBON

OFFSETS BETWEEN THE SECRETARIAT OF THE CONVENTION ON

BIOLOGICAL DIVERSITY AND THE

GOVERNMENT OF PARANA STATE, BRAZIL

1. At COP 11, the Secretariat circulated a report prepared by the State Government of

Parana, Brazil, on the results of a Memorandum of Agreement signed with the Secretariat on

offsetting carbon emissions resulting from the operations of the Secretariat.1 Thanks to this

agreement, since 2008 all carbon emissions related to the operations of the office of the

Secretariat of the Convention on Biological Diversity in Montreal, as well as those related to

travel of staff and sponsored delegates, are offset within Parana's signature BIOCLIMA

reforestation programme, itself linked to Brazil’s national biodiversity strategy and action

plan.

2. Through this agreement, landowners in buffer zones close to the Iguaçu Falls

protected areas complex sign contracts for at least 30 years to set aside specific areas to

restore its original Atlantic Rainforest cover. Carbon offsets are tracked with the full technical

supervision of local and international non-governmental organization. The Brazilian branch

of the Nature Conservancy is also involved on site. The programme has been allowing small

landowners and traditional farmers to adjust to mandatory land reserves,2 while the State’s

Environment Institute offers endemic forest species seedlings and technical assistance. The

contribution is offered to the Parties of the Convention, free of charge. Parana State is also a

member of the CBD Advisory Committee of Subnational Governments.

3. The present note has been submitted by the Environment Institute of the Parana State

Government, Brazil (IAP), as an update on this agreement, and as a commitment by the

Institute’s presidency to continue these offsets until COP 13. It has been translated “pro

forma” from Portuguese originals.

a) SUMMARY OF THE PARTNERSHIP

The partnership between the Government of the State of Paraná and the Secretariat of

Biological Diversity (SCDB) Convention aims to cooperate on the implementation of the

Convention on Biological Diversity, and provides for the offsetting of carbon emissions from

the SCDB office and related delegate travel sponsored by the SCBD. During COP 8, held in

March 2006 in Curitiba, Paraná State began the bilateral agreement, as part of a programme

which resulted in the planting of 8 million tree seedlings by Paraná. Subsequently, during

COP 9 in 2008, held in Bonn, Germany, a Memorandum of Understanding was formalized

between the State Government and the SCBD, to offset emissions from 2008 to 2010,

estimated at 10,100 equivalent tons of CO2, by planting 100 hectares of native trees, with a

period of calculation for carbon fixation of 30 years. The report of these activities until 2010

was presented by the State Government to the SCDB in 2011, when a team from the

Department of Environment of Paraná visited Montreal at the occasion of their invitation to

lead the first meeting of the Advisory Committee of Subnational Governments to the CBD, to

be held in Curitiba in 2012. Thus, in April 2012, at this event, which coincided with the

launch of the groundbreaking climate change and biodiversity BIOCLIMA Parana

programme, a new Memorandum of Understanding was signed with the aim of continuing the

partnership.

FIRST MEETING OF THE ADVISORY COMMITTEE ON SUB-NATIONAL GOVERNMENTS

Partial results include offsetting a total of 10,100 equivalent tons of CO2 through plantings of

native species in the State of Paraná from 2008 to 2010, as reported in 2010, and 12,625

equivalent tons of CO2, to meet the 2010-2012 period, as reported in 2012. For the next

period (2012-2014), plantations are being implemented for an estimated 13,000 tons of CO2

emissions, as forecast by the SCDB. As was the case for 2012, field surveys with appropriate

mapping will be carried out and sent to the Secretariat by the end of the year.

BACKGROUND AND RELEVANT FACTORS FOR THE RESTORATION PROCESS

AND PARTNERSHIP: PERIOD 2012-2014

Paraná was a pioneer in the implementation of the Forest Code Law 4771/65, in force until

2012. For the maintenance of the State’s legal reserve system, permanent preservation areas

and legal reserves were established in more than 120,000 rural properties, considering the

then prevailing rules.

In order to fit the new rules of restoration and conservation provided for by Law 12,651 /

2012 and its complementary State Decree 8680/2013, Parana joined the System of National

Rural Environmental Registry (SICAR), coordinated by the Brazilian Ministry of

Environment. With the new rules in effect, there was a sharp decrease in demand for

seedlings for restoration, compared to previous years, mainly due to factors such as:

a) Insecurity of farmers in planting new areas of restoration due to waiting to perform

the rural areas registration (CAR), which has just started its operation on May 6,

2014;

b) Concerns about the actual requisites of the State restoration program and on its

Rural Property Environmental Regularization, after their records were analyzed by

State environmental agencies.

In this context, the production of forest species by IAP was reduced, as the State’s production

capacity (10 million seedlings per year) would not be used in the field. Even so, from January

2012 to October 2014, about six million native tree seedlings were delivered free of charge. It

is worth noting that by order of the Institute since 2013, distribution of any amount of native

seedlings to farmers in the state of Paraná is free.

Another factor to be considered in Paraná is the decrease in the previously defined deficit area

(i.e. areas expected to be restored as per the previous forest code), as the new code reduces

the requirements of permanent preservation areas and due to the new code’s waiver for

restoration of Legal Reserves for properties with estate taxes lower than 4 modules. On the

other hand, with the new law we expect a higher probability that rural properties effectively

carry out the enforcement of environmental legislation. In Paraná, rural estates with taxes

above 4 modules represent only 8% of the properties in number but hold more than 58% of

the total area. These properties, therefore, will now have to reestablish their legal reserve and

other obligations. Bill PRA 360/2014 is currently before the State Legislative Assembly to

further implement the federal law’s prescriptions.

IAP has invested great effort in conducting training courses aimed at technicians that can

assist farmers in completing the rural property registration. More than 50 training events have

taken place, and until the end of October 2014 we expect to graduate over 1,500 technical

multipliers. Several partnerships for monitoring and maintaining the rural registration

database were established, giving us better conditions for analysis and establishment of

reserves. The biggest uncertainty for the restoration process is due to the understanding of

Article 12 of the Federal Decree 8235/2014, which provides that written agreements signed

prior to Law 12,651 / 2012 must be reviewed and adjusted to the current legislation.

Numerous lawsuits are being deposited requesting reduced areas for restoration, and formal

legal guidance to our institution on how to treat such requests is not yet available. Meanwhile,

the Institute is preparing terms of reference and guidance on the restoration process outlining

the various modalities provided for by law, aiming to provide land users with a menu of

feasible options.

Training events through the State’s partnerships.

Between 2012 and 2014, IAP provided 6.273.627 native forest seedlings, benefiting 12,683

farmers. We believe and hope that with the implementation of the new registration process

(CAR), and with the start of operation of an analysis module, scheduled for November 2014

by the Ministry of Environment, we can once again notify landowners with legal deficits to

restore and resume the full-scale distribution of seedlings, now with an improved and efficient

monitoring system, integrated with the Federal government system.

The State of Parana, through its Environmental Institute (IAP), would like to submit the

attached report to your attention, and express its interest in continuing the partnership

established with your Secretariat to offset carbon emissions from your office’s operations

through planting native trees and recovering natural forests. Thus, we’d like to renew the

Memorandum of Understanding signed in April 2012 by Governor Beto Richa with the

SCBD.

We’d like to reiterate that IAP, through its Department of Restoration and Monitoring of

Biodiversity, manages the production of saplings of over 80 native forest species of the

Atlantic Rainforest biome in 20 incubators in various regions of Parana State. We’d like to

reiterate our intention to continue this important partnership for the 2015-2016 period, given

our pride in continuing to restore natural areas to compensate carbon emissions from the

activities of the Secretariat.

Our team, under the leadership of Ms. Mariese C. Muchailh, Director of Restoration and

Monitoring of Biodiversity, will continue to be at your disposal for the necessary follow up

RESUMO SOBRE A PARCERIA

A parceria entre o Governo do Estado do Paraná e o Secretariado da Convenção da

Diversidade Biológica (SCDB) tem como um de seus objetivos principais o apoio mútuo para

ações que visem a implementação da Convenção da Diversidade Biológica prevendo a

compensação das emissões de carbono do escritório da SCDB e funcionários que ali atuam.

Durante a COP 8, realizada em março de 2006 em Curitiba – Paraná iniciou-se o acordo

bilateral, que resultou com o plantio de 8 milhões de mudas de árvores pelo Paraná naquele

ano. Em decorrência da dimensão e amplitude que tomaram as ações do efetuadas pelo

Governo, durante a COP 9 em 2008, realizada Bonn na Alemanha, foi formalizado um

Memorando de Entendimento entre o Governo do Paraná e a ONU/SCBD, com as metas de

compensará emissões da SCBD de 2008 até 2010, estimadas em 10.100 toneladas de CO2,

através do plantio de aproximadamente 100 hectares de árvores nativas, cujo período de

cálculo da fixação de carbono foi de 30 anos. O relatório destas atividades foi apresentado

pelo Governo do Paraná a SCDB em 2010. Em 2011 uma equipe da Secretaria de Meio

Ambiente do Paraná esteve no escritório da SCDB em Montreal quando o Governo do Paraná

foi convidado a liderar a primeira reunião do Comitê Consultivo de Governos Subnacionais

para CDB, a ser realizado em Curitiba em 2012. Desta forma, em Abril de 2012 durante este

evento e o lançamento do PROGRAMA BIOCLIMA PARANÁ, novamente foi firmado novo

Memorando de Entendimento com objetivo de dar continuidade à parceria.

Resultados parciais: Os períodos de compesanção a partir de 2010, foi um total de

12.625 toneladas de CO2, através de plantios de espécies nativas no território do

Estado do Paraná, para atender o período de 2010-2012, conforme relatório 2012,

através do PROGRAMA BIOCLIMA PARANÁ. Para o próximo período de 2012 a 2014,

estão sendo ealizados plantios, com uma estimativa de 13.000 toneladas de CO2,

conforme previsão de emissões da SCDB.

CONTEXTO E FATORES RELEVANTES PARA O PROCESSO DE RESTAURAÇÃO E PARCERIA:

PERÍODO 2012 A 2014

Alguns fatores são de extrema relevância no contexto da restauração da Biodiversidade no

Estado do Paraná e que merecem aqui serem relatados.

O Paraná foi um dos pioneiros na implementação do Código Florestal Lei 4771/65 que esteve

em vigência até 2012. Pelo sistema de Sistema de manutenção da reserva legal – SISLEG

foram averbadas reservas legais e áreas de preservação permanente de mais de 120.000

imóveis rurais, considerando as regras então vigentes.

No intuito de se adequar as novas regras de restauração e conservação previstas pela, Lei

12.651/2012 e demais normas complementares (quadro) o Paraná, por meio do Decreto

Estadual 8680/2013, aderiu ao SICAR – Sistema de Cadastro Ambiental Rural Nacional,

coordenado pelo Ministério do Meio Ambiente – MMA.

Com as novas regras em vigência, houve um acentuado decréscimo na demanda por mudas

para restauração, em comparação com anos anteriores, principalmente devido a fatores como:

a) Insegurança do produtor rural em implantar novas áreas de restauração:

Em função de esperarem para realizar o CAR, que só iniciou sua operação em

06 de maio de 2014;

Prevendo aguardar para verificar a real necessidade de restauração previstos

no Programa de Regularização Ambiental da propriedade rural – PRA, após

terem seus cadastros analisados pelos órgãos ambientais estaduais;

Neste contexto, a produção de espécies florestais pelo IAP foi reduzida, pois a capacidade de

10 milhões de mudas por ano não alcançaria êxito na execução a campo. Mesmo assim, no

período de janeiro de 2012 a outubro de 2014, foram entregues cerca de seis milhões de

mudas florestais nativas, gratuitamente. Cabe destacar, que por Portaria do IAP foi definido

desde 2013 a gratuidade na distribuição de qualquer quantidade de mudas nativas a

produtores rurais no estado do Paraná.

Outro fator a ser considerado no Paraná é a diminuição do déficit de área a ser restaurada

em comparação ao código florestal anterior:

Mas um ponto positivo é que, após as inúmeras benesses da nova lei, é que esperamos uma

maior a probabilidade de que os imóveis venha a ser regularizados ambientalmente e realizem

efetivamente o cumprimento da legislação ambiental. No Paraná, oi imóveis com mais de 4

módulos Fiscais representam em números apenas 8% dos imóveis do Paraná mas detêm mais

de 58 % do território. Estes imóveis, portanto, terão que restabelecer suas reserva legais e

demais obrigações previstas.

O IAP tem centrado grande esforço em realizar cursos de capacitações visando formar técnicos

que possam auxiliar o produtor rural no preenchimento do CAR. Foram mais de 50 eventos de

capacitação e espera-se formar até o final de outubro mais de 1500 técnicos multiplicadores.

Foram estabelecidas diversas parcerias visando este propósito de alimentar a base de dados

do CAR com qualidade, nos proporcionando um melhor resultado para analise e

estabelecimento do PRA.

Neste momento ainda tramita na Assembleia Legislativa do Estado, o Projeto de Lei 360/2014

que propõe o PRA do Estado do Paraná. Há ainda que ser mencionado que a maior

insegurança para o processo de restauração deve-se ao entendimento do artigo 12 do Decreto

Federal 8235/2014 que estabelece que os Termos de Compromisso firmados anteriormente a

Lei 12.651/2012 DEVERÃO ser revistos e readequados a legislação atual. Já estão sendo

protocolados inúmeros processos solicitando a revisão com redução de área a ser restaurada.

Ainda não há uma conclusão jurídica formal da nossa instituição de como serão tratadas tal

solicitações.

Estamos trabalhando fortemente num termo de referência que será o documento norteador

do processo de restauração para as diversas modalidades previstas em lei (APP, RL, área

consolidada em App, etc) visando fornecer um cardápio de opções viáveis para que o

produtor rural seja incentivado a restaurar além do que está previsto pela legislação.

O Instituto Ambiental do Paraná, tendo como principal motivação a preservação das espécies nativas e a restauração de áreas degradadas, criou uma estrutura com 2 laboratórios, 20 viveiros próprios e mais de 180 viveiros de Entidades Parceiras e Prefeituras que apoiam o produtor rural na restauração de florestas contidas em suas propriedades. Para aprimorar e padronizar o funcionamento desta estrutura sentiu-se a necessidade de informatização. O sistema SGA_ RESTAURAÇÃO, que entrou em funcionamento em 2014, visa estabelecer os processos desde a coleta, beneficiamento, armazenamento e distribuição das sementes, até a produção das mudas e destinação e monitoramento da restauração das Áreas de Preservação Permanente, Reserva Legal, Unidades de Conservação e demais Áreas Degradadas do Estado, visando à recuperação da Biodiversidade. O Usuário Ambiental é um grande beneficiado neste projeto, pois pode a partir de sua casa iniciar o processo de requisição das mudas, quando ele vai até o IAP ou Parceiro, o processo já está adiantado, inclusive com as mudas preparadas, bastando apenas apresentar a documentação do imóvel para o técnico liberar as mudas para retirada. Para garantir que as áreas restauradas sejam monitoradas e tenham uma evolução significativa da sua recuperação é exigido a delimitação geográfica, assim será possível fazer um monitoramento através de imagens. Futuramente as mudas plantadas hoje poderão ser localizadas e servir de novas matrizes que possam estar em extinção. Além disso, o projeto também deve proporcionar uma evolução em pesquisas bioclimáticas, pois os dados gerados pelo sistema serão disponibilizados para o meio científico. Este sistema SGA estará interligado ao CAR assim que este for disponibilizado pelo MMA.

Como resultados parciais foram entregues pelo IAP 2014 6.273.627 mudas florestais nativas,

no período de 2012 a 2014, beneficiando 12.683 produtores rurais. Os levantamentos de

campo com o devido mapeamento estarão sendo realizados e enviados ao final do período.

Acreditamos e esperamos que, com a implementação dos Cadastros ( CAR), com o início de

funcionamento do Módulo análise do CAR, previsto para novembro pelo MMA, poderemos

estar novamente notificando imóveis com déficit a restaurar e retomarmos os trabalhos de

distribui cão das mudas e agora com um sistema de monitoramento adequado e eficiente,

integrado ao sistema do governo federal ( SGA – IAP + SICAR / MMA) .
