NOTIFICATION

New Delhi, the 10th July. 2015

G.S.R. SSO(E).-In exercise of the powers conferred by sub-section( I) read with clause (d) ofsub-section (2) of section 87 of the Railways Act, 1989(No. 24 of 1989), the Central Government hereby makesthe following rules further to amend the Railways (Punitive charges for overloading of wagon) Rules, 2012.namely:-

I. (I) These rules may be called the Railways (Punitive charges for overloading of wagon)(Amendment) Rules. 2015.

(2) They shall come into force on the date of their publication in the Official Gazette. .2, In the Railways(Purritive charges for' overloading of wagon) Rules. 20) 2, in the SCHEDULE,-

(i) in Situation A, for part-ll, the following part shall be substituted, namely:-

"Part-II

(i) For BCNHL wagons

·Punitive charges leviable on the entire weigbt orcommodity loaded in excess of permissiblecarrying capacity and loading tolerance or halftoone

Extent of overloading

\i If the weight of the commodit~ exceeds thepermissible carrying capacity of wagon;

<a>upto half tonne Nil

(b) by more than half tonne but not more than Two .times of the freight rate. applicable to thatthree and half tonnes commodity.

(c) by more than three and halftonnes Three times of the freight rate applicable to thehighest class.

*Explanation.- It is hereby clarified that on the weight exceeding the permissible carrying capacity upto halftonne, the normal freight at the rate applicable to the commodity shall be recoverable and punitive chargesshall be recovered for the entire weight of the commodity in excess of permissible earrying capacity andloading tolerance of hatftonne:

(ii) For BCCW walons

Extent of overloading *Punltive charges leviable on the entire weilht ofcommodity' loaded In excess of permissiblecuryinl Capacity

If the weight of the commodity exceeds thepermissible carrying capacity of wagon;

(a> upto three tonnes Two times of the freight rate applicable to thatcommodity.

(b) By more than three tonnes Three times of the freight rate applicable to thehighest class.

*Explanation.- Punitive charges shall be recovered for the eirtire weight of the commodity in excess ofpermissible carrying capacity.";

(ii) in Situation-B. for part-ll, the following part shall be substituted. namely:-"Part-II

(i) For BCNHL walons •

Extent of overloading ·Punltive cbarges leviable on tbe entire welabt ofcom'modlty loaded in excess of permissiblecarrying capacity •

If the weight of the commodity exceeds thepermissible carrying capacity of wagon;

(a> upto half tonne Nil

(b) by more than half tonne but not more than Three times of the freight rate applicable to thethree and halftonnes highest class.

(c) by more than three and halftonnes Five times of the freight rate applicable to thehighest class.

·Explanation.- It is hereby clarified that on the weight exceeding the permissible carrying capacity upto halftonne. the normal freight at the rate applicable to the commodity shall be recoverable. However. incase ofweight exceeds the permissible carrying capacity by more than half tonne. punitive charges shall be recoveredfor the entire weight of the commodity in.excess of permissible carrying capacity.
