TRANSPORTATION AND INFRASTRUCTURE

Cebu is the economic hub and gateway of Central and Southern

Philippines. There are several daily flights between Cebu and most

cities in the country.

Air freight to and from Cebu is reliable and efficient with major

international and local couriers such as DHL, TNT, UPS, FEDEX, LBC

and 2GO operating here.

1. I am a foreigner and would like to invest in the Philippines. what is the first thing I should do?

For Single Proprietorship:

An applicant has to submit to the Department of Trade and Industry (DTI) a completed DTI Form No. 17 (Application to Do Business in the Philippines) and DTI Form No. 16 (Application for Business Name Registration), together with the following requirements:

• Copy of passport and Alien Certificate of Registration, if any• A notarized appointment of Filipino

• The government except for public use or in the interest of national welfare and defense shall not demand properties represented by the investments or of the enterprise.

3. Can I, a foreigner, own land in the Philippines? what options do I have?

No. As mandated by the Constitution, only Philippine nationals or 60% Filipino-40% foreign-owned companies may acquire land in the country.

Foreigners, however, can lease land for a period of 50 years with the option of extension for another 25 years.

Also, foreigners may own buildings.

the proposed terms and conditions of registration within twenty (20) calendar days from receipt of the notice of approval of the application.• Payment of registration fee PhP6,000.00

5. How can I get Board of Investments (BOI) incentives?

Applying for BOI Incentives:

New and expanding projects can avail of incentives from the BOI.  These incentives include the following:Income Tax Holiday (ITH)

— Six (6) years for projects with pioneer status and for projects located in Less Developed Areas (LDA)

— Four (4) years for new projects with non-pioneer status

• Three (3) years for expansion/modernization projects• Duty exemption on imported

capital equipment/spare parts and accessories• Exemption from wharfage dues and

any export tax, duty, impost and fees• Tax exemption on breeding stocks

and genetic materials• Tax credits on imported

raw materials• Tax & duty-free importation

To avail of these incentives, the project should be listed in the Investment Priorities Plan (IPP) for the year. A copy of the IPP can be secured from the BOI upon request.

The application must be filed with the BOI on the prescribed Form 501 in three (3) copies, together with the following documents:

7. How will I import capital equipment? Are there restrictions in importation?

A company qualified for tax exemptions on the importation of its equipment must secure prior approval from its governing agency before actual importation can be made.

Regular importation is made through Authorized Agent Banks (AAB). 8. How will I import raw materials/supplies? Are there restrictions in importation?

The importation of raw materials has already been liberalized. Therefore the importer simply has to proceed to an AAB to open the necessary letter of credit or other modes through which payment will be made. There are, however, regulated items that require clearance from the concerned agency prior to importation, and items whose importation is prohibited.

9. Application for Barangay Clearance/Permit?

A barangay where the business is located issues a barangay permit. A fee of PhP50.00 is collected and the processing time is, at most, two (2) days. 10. How does one go about applying for a Mayor’s Permit/Municipal License to operate?

To get this permit/license to operate, present the following documents at the Licensing Section of the Mayor’s Office where your business is located:
