2. (A) Part I Techno-Commercial bid will be opened electronically on specified date and time as given in the NIT. Bidder(s) can witness electronic opening of bid. (B) Part II Price bid will be opened electronically of only those bidder(s) whose Part I Techno-Commercial Bid is found to be Techno-Commercially acceptable by CCI. (a). Bidder(s) need to submit necessary EMD and Tender fees (If ANY) to be eligible to bid online in the e-tender. Tender fees and Transaction fees are non refundable. No interest will be paid on EMD. EMD of the unsuccessful bidder(s) will be refunded by CCI.

(b). The process involves Electronic Bidding for submission of Techno Commercial Bid as well as Price Bid is explained in Help Manual.

a. In all cases, bidder should use their own ID and Password along with Digital Signature at the time of submission of their bid.

b. During the entire e-tender process, the bidders will remain completely anonymous to one another and also to everybody else.

(c). The e-tender floor shall remain open from the pre-announced date & time and for as much duration as mentioned above.

(d). All electronic bids submitted during the e-tender process shall be legally binding on the bidder. Any bid will be considered as the valid bid offered by that bidder and acceptance




of the same by the Buyer will form a binding contract between Buyer and the Bidder for execution of supply. Such successful tenderer shall be called hereafter SUPPLIER.

(e). It is mandatory that all the bids are submitted with digital signature certificate otherwise the same will not be accepted by the system.

(f). Buyer reserves the right to cancel or reject or accept or withdraw or extend the tender in full or part as the case may be without assigning any reason thereof.

(g). No deviation of the terms and conditions of the tender document is acceptable. Submission of bid in the e-tender floor by any bidder confirms his acceptance of terms & conditions for the tender.

(h). Unit of Measure (UOM) is indicated in the e-tender Floor. Rate to be quoted should be in Indian Rupee as per UOM indicated in the e-tender floor/tender document.

10. No deviation to the technical and commercial terms & conditions are allowed. 11. After submitting online bid, the bidder cannot access the tender, once it has been submitted

with digital signature. 12. CCI has the right to cancel this e-tender or extend the due date of receipt of bid(s) without

assigning any reason thereof. 13. The online tender should be submitted strictly as per the terms and conditions and procedures

PART-III : SPECIAL TERMS AND CONDITIONS

Re-Babbitt of 2 nos. Jaw Crusher Bearings with Grade 60 White metal as per specification

The tender contains general terms, special terms and conditions and price bid. All these

documents are to be submitted duly signed and stamped by the tenderers. In addition to the General Terms and Conditions of the contract under Part- I & II, the following

Special Terms and Conditions will also apply to the contract for Re-Babbitt of 2 nos. Jaw

Crusher Bearings with Grade 60 White metal as per specification in drg no.

1224.01.24A/22:00:13 . These Special Terms and Conditions, if contradictory to any conditions

given in Part- II & I shall prevail upon the conditions given therein.

2.0 SCOPE OF WORK AND RELATED CONDITION :

1.1 Cleaning of bearing halves. The traces of old babbit (metal) are to be removed. The water

jackets are also to be cleaned and precautions are to be taken for non ingress of debris inside

the waterlines.

1.2 Casting of the white metal liners on to the two halves of the 2 bearing castings.

1.3 The grade of the white metal should be Grade 60.

A Material Test Certificate/Report is mandatory along with the completed job. The certificate

must contain detailed percentages of the compositions of the white metal used for Babbitt. The

certificate must be from a government laboratory or from a government certified laboratory.

The test report must be within the acceptable range as shown above and the impurities must be

below or equal to 0.22%.

1.4 The Babbitt bearing should be subjected to ultrasonic test or X-ray diffraction test to

determine the following and shall have to be documented:

a) Bond test from the outer surface of a bearing or Bond testing from the inner surface of a

bearing.

b) Babbitt thickness measurement

c) Test for casting imperfections likes blow holes, cold shuts, etc.

1.5 The party shall ensure that the water jackets are not blocked due to ingression during

casting/machining and shall practically perform the test of water flow after the machining job.

Any blockage shall be cleared before handing over the job to the client. This has to be certified

by the party and documented ( 3rd

party certification not required).

1.6 The party shall give minimum 1 years guarantee and certify the performance of the bearing in

writing. The guarantee shall be applicable as per the clauses mentioned under Penalty clause

7.0 of Part III

1.7 The job must be completed within 3 months. The date of the arrival of the bearing cast at the

transporter’s storage yard (at party’s place) shall be considered the beginning of the 3 months

period. The completion date of the job shall be considered as per the dispatch date of

inspection call. Any rework after the inspection shall be cumulatively added.

1.8 The party shall do adequate professional packaging for the return journey of the bearings.

The package should be strong to withstand the affliction of shipment. The bearing liners

should not be damaged during transportation. Any damaged bearing liner due to poor

packaging shall be rejected at site. The Party shall be required to deliver the packed bearings at

the CCI authorized transporter’s yard.

2.0 EQUIPMENT REQUIREMENT :

2.1 The party should furnish the list of equipments available at his workshop/establishment.

3.0 PARTY TO BE FULLY RESPONSIBLE IN CASE OF ACCIDENTS

The entire responsibility on account of any accident or damage or personal injury which

may occur to any of the party’s equipments or his employees or any outside party shall be

exclusively that of the party and no claim whatsoever will be entertained by the

Corporation on this account.

4.0 PARTY NOT TO SELL/MISSPLACE MATERIAL

The party shall not sell or otherwise dispose off or remove clandestinely any materials

received from Bokajan Cement Factory. The bearing cast on its arrival at the party’s


workshop shall be the responsibility of the party. Any theft , damage to the property of CCI

shall have to be compensated. The party shall have to pay Rs. 10.00 lakhs (rupees ten lakhs

only) for the loss of the bearings (2 halves) from their custody.

5.0 INSPECTION

The Party shall provide the authorized representative of the corporation every facilities for

examining the job at all hours for the purpose of inspection and shall provide all assistance

which may required for the purpose of aforesaid. On completion of the job, the party shall

send the inspection call to MM department via mail.

6.0 CLAIMS FOR COMPENSATION

Under no circumstances, whatsoever, shall the party be entitled to any compensation from

the Corporation on any account nor will the Corporation entertain any claim for

compensation except for the work done under this contract.

7.0 PENALTY

7.1 Penalty is to be levied on the Party for poor workmanship only, which shall be applicable

in 2 ways.

a) If the bearing fails within the guaranteed period of 1 year for installations within 6

months from the date of supply, the party shall have to re-Babbitt and machine the bearing

within 7 days from the date of receipt at his workshop. The corporation shall bear the

transportation cost only for the whole episode.

b) If the bearing is not used within 6 months from delivery , but fails within the guarantee

period due to poor workmanship, the party may be blacklisted by the corporation.

7.2 No penalty will be imposed if the reasons for failure are beyond the control of the party or

attributable to poor maintenance practices. The decision of the corporation in this regard

shall be final and will be a binding on the party. However the party has to submit the

documentary evidence of this effect.

8.0 SUBMISSION & PAYMENT OF BILLS

The Party shall submit the proper bill indicating the GST no. of CCI and his company to

HOD(Mining) . The Mining deptt. will check the bill and shall enter in MB record and

shall forward to Finance Deptt. with note and which shall be paid within 15 days on

receipt of Bill. Payment will be made either through RTGS/NEFT/ A/c payee cheques

only & the paying authority is HOD (Finance), CCI Bokajan. The settlement of bills

shall be subjected to deductions as may be applicable under the rules and laws in vogue.

However, GST shall be paid after confirmation/Submission of Challans,etc.

9.0 DURATION OF CONTRACT

The contract for delivery of the finished re-Babbitt bearing shall be for a period of three

(3) months from the date of issue of letter of intent/work order. However, for the

completion period of the job a grace time till the arrival of the bearings at the party’s home

town(at the storage yard of the CCI authorized transporter).


10.0 RATE/PRICE

10.1 The rate quoted shall remain firm for the entire period from the date of award of work No

escalation shall be admissible in any case whatsoever.

10.2 The rate quoted shall be for 2 nos. of bearing halves inclusive of delivery and pickup from

the storage yard of Corporation approved transporter. The rates shall also be inclusive of

charges/levies/taxes and duties imposed by the Government. The rates should be strictly

quoted as per the enclosed price bid proforma.

10.3 The party may not add GST liability in their quoted rates. GST if applicable will be borne

by the Corporation.

11.0 COMPLETION OF WORK AND LIQUIDATED DAMAGES IN ADDITION TO

CLAUSE 9.0

11.1 Time is the essence of the contract. The entire work stipulated will have to complete

within the stipulated period mentioned in the tender/workorder.

11.2 The work shall be completed by the Party within the time stipulated in the tender notice to

the satisfaction of the Corporation failing which party shall pay damage to the Corporation

amounting. 10% the value of the work order for every delay of 10 days.

12.0 TERMINATION OF THE CONTRACT

12.1 The Corporation may terminate the contract at any time within their discretion, without

assigning any reason thereof by giving 15 (Fifteen) days notice and without any liability to

pay any compensation.

13.0 GST :

The Goods Service Tax as imposed by Central Government shall be applicable @ 18%

and shall be paid by CCI to the Party and the Party will deposit the same to the

Government through his own account/GST Registration No. Any modification made in

this regard by the Government shall be applicable accordingly. The tenderer, therefore, is

advised to register with GST if not already registered and quote the GST Registration No.

in the tender. The rate may be quoted accordingly without GST. The successful tenderer

should ensure that the GST amount paid to him by CCI against his GST bill, are being

paid to the Government in time every month, so that CCI can avail the input credit.

In case GST is payable on the finished goods which are to be supplied, the supplier shall

record the following certificate on their bills.

“It is certified that the GST on the goods on which it has been charged has actually been

paid by us and is not more than that is payable under the provision of the relevant Act or

the Rules made there under. GST gate pass should be enclosed along with the supplies and

photo copy of GST gate pass should be enclosed along with the copy of invoice”. Relevant documents are to be furnished by the supplier to CCI on time for availing credit

benefits whenever applicable. In case all the required documents for claiming credit are

not submitted in time equivalent

NOTE: THE ABOVE CLAUSE NO. 13.0 CAN BE MODIFIED AS PER ANY MODIFICATION IN THE

CONCERNED GST RULES MADE BY THE GOVERNMENT.


14.0 NOTICE:

a) All notices, communications, references and complaint of the party addressed to the

General Manager of the Unit of the Corporation or to any official of the Corporation

concerning the work, shall be in writing only.

b) Any notice hereunder may be served on the party by Registered Post/Mail at his last

known address. Proof of issue of any such notice should be conclusive to the party having

been duly informed.

1.7 The job must be completed within 3 months. The date of the arrival of the bearing cast at the

transporter’s storage yard (at party’s place) shall be considered the beginning of the 3 months

period. The completion date of the job shall be considered as per the dispatch date of

inspection call. Any rework after the inspection shall be cumulatively added.

1.8 The party shall do adequate professional packaging for the return journey of the bearings.

The package should be strong to withstand the affliction of shipment. The bearing liners

should not be damaged during transportation. Any damaged bearing liner due to poor

packaging shall be rejected at site. The Party shall be required to deliver the packed bearings at

the CCI authorized transporter’s yard.
