The execution proceedings are for realizing the fruits of the decree obtained in the court of first instance. The practical aspects of the procedural law can be better understood when put forth by a practicing advocate

GUEST LECTURE ON ELECTRICITY LAW AND POLICY

18th – 20th January 2019

Background: In India energy law was prevalent in different forms for over a century and it deals with the management of energy resources. In the 1800s and early 1900s, there was a legislation to manage energy sectors such as coal and oil but even now energy law is considered to be a new area of law. Lawyers of Energy Law are often associated with major developmental programs and may work with companies and public utilities to handle taxation of energy, procurement of licenses and ownership rights for energy-rich land, adjudication regarding these energy rights etc. Energy Law in India is covered under Electricity Act, 2003. With the enactment of Electricity Act, India has taken its first step towards liberalization of energy sector. After the enactment of the legislation, there took place a paradigm shift in the energy sector and the energy market was thereupon open to the forces of competition through Open Access System, de licensing of generation, electricity trading, public private partnership etc.

In this context the Guest Lecture Series aims at giving a deeper understanding on Electricity laws and policy. It also helps the students to impart knowledge relating to the role, powers and functions of the regulators, courts, tribunals that have been and continue to be instrumental in developing and defining the energy sector (such as State Electricity Commissions, Appellate Tribunal for Electricity, Petroleum and Natural Gas Regulatory Board etc.). REPORT ON GUEST LECTURE ON PHILOSOPHY OF LAW AND ETHICS

28th -29th January 2019

Background: Law and morality are complementary to each other. Law is seasoned by morality as moral values are inherent for social transformation. As opposite to this notion there are theorists who believe law as consisting of minimum morality. According to Mark Tebbit “the issue that stands behind nearly every controversy in contemporary legal theory is the problem of how law is to be understood in relation to moral values.” The main reason behind introducing this course is to materialize traversing through various theories of law by putting morality at the focal point. At the same time the works of great philosophers of all times-from ancient, Christian and modern era from Socrates to Martha Nussbaum are examined in the light of their philosophy towards law and morality. The guest lecture discussed at length various legal theories and its relevance in a given social, political or moral set up. Indian legal thought is also given considerable relevance. In this context the guest lecture aims at giving the students a great learning experience on the relevance of philosophy towards law and legal theories.

P2P- 7th January

History of Constitutional Interpretation

The first P2P session of the semester by The Centre for Specialization In Business and

Innovation was conducted on 7th January, 2019 from 6 pm to 7 pm at the Assembly Hall. The

session was in the form of an informal talk and focused on the topic of “History Of

Constitutional Interpretation”. the speaker for the session was Sudharsan Satalkar of the

2016-21 batch. The talk revolved around the phases of Constitutional Interpretation and its

development. The session saw an attendance of about 20-30 students who actively participated in

the discussions which followed. They were served with coffee and biscuits. The speaker was

provided with Yummy’s Coupons and shall be presented with a digital certificate for the same.

The speaker was chosen on the basis of voluntary interest and a brief submitted by him regarding

the topics. The students were highly interested in the session as the topic of constitutional law

forms the basis of law school studies. The senior batches enthusiastically answered all the

interactive questions posed by the students. The juniors paid rapt attention to the discussions and

put forward their queries.

The speaker first began the session by questioning the audience about the working and

interpretation of an unwritten constitution. He pointed out a judgement by Mensfield, J. which

explained the prevalence of The Rule of Law and Principles of Natural Justice in deciding cases

unless required otherwise in the presence of Statutes for the same. He traced the development of

interpretation of the Constitution from the Literal Interpretation of the text to the Mischief Rule

of interpretation. He was met with a variety of questions, disagreements and speculations from

the audience, much of which only presented more points to explore. The purpose of the peer to

peer sessions have always been to encourage discussion, dissent, debate and opinion sharing.

The session saw an in-depth discussion about landmark caselaws which have helped in the

interpretation of the Constitution as we understand it today. The aim of the session was to seed

an interest in the students about the creation of our Constitution and the value it holds. the

session also saw the discussion of the KeshavanandBharti case on Article 21. The session ended

Page 41: CENSURE DES MEDIAS Censure Des Medias · hours about the issues in the movie “Udta Punjab” and the winner for the best counsel for Production house and CBFC were decided. With

with a brief discussion on which mode of interpretation was the best. The inputs for the same

were provided by the students.

The students who participated provided the Centre with valuable and constructive feedback. The most notable aspect was the appreciation of the provision of coffee, and the informal atmosphere that was created. Upon taking into consideration the feedback provided last time, the Centre also decided to provide Yummy’s coupons as incentive to those that were most active during the debate. All in all, the event was pleasant, informative and achieved the entire objective of peer to peer learning.

BRIEF INTRODUCTION:

Cherlapalli Central Prison is the largest Prison in Telangana and erstwhile united Andhra

Pradesh confining more than 2000 Prisoners at any given point of time. There are many

human oriented industries in this Prison. It employs prisoners in creamery agricultural,

industrial sectors etc. The jail also houses a 15-20 acre vegetable farm, dairy farm and a 20

acres mango orchard in a semi-open prison attached. The produce from these facilities not

just serves the requirements of the prison, but also is used for other prisons in the city. Steel

and wooden furniture made in this Prisons manufacturing wing is known for durability and

economy. Educational facilities are provided to the Prisoners through distance education

system.

PURPOSE OF THE VISIT:

The purpose of the visit was to expand the knowledge of the students in practical aspects of

prison related issues that would have been otherwise completely neglected. We hoped to give

an insight to the prisoners on their rights. The aim was to provide them with any kind of legal

aid that was needed and could be provided.

OUTCOME:

This helped the students learn about the working of the prison and lives of the prisoners.

There are a lot of cases where the prisoners were unjustly held in prisons due to the neglect of

their advocates and not taking right action at the right time. As the English jurist William

Blackstone has said “it is better that ten guilty persons escape than letting an innocent suffer.”

It has taught the students not to go with the stereotype that all the prisoners are brutal and evil

but to believe in the saying hate the sin not the sinner.

DAILY ROUTINE OF PRISONERS:

A prisoner's day starts at 6:00am. They have to perform their daily routine within an hour.

Breakfast is served at 7:00am. After breakfast they get busy with their usual work. Lunch is

served from 11:00 to 11:30am. After their lunch they can relax for a while, wash their clothes

and then get back to their work again until dinner is served. All the barracks and block gates

are closed at 6:00 P.M. Only in case of emergency, i.e., if any prisoner is in a critical stage,

the gates are opened. Else they remain closed till 6:00am.

Page 45: CENSURE DES MEDIAS Censure Des Medias · hours about the issues in the movie “Udta Punjab” and the winner for the best counsel for Production house and CBFC were decided. With

A canteen is also available for the prisoners where they can buy any item by giving coupons

worth Rs.5, Rs.10, Rs.15, Rs.20 (Coupons worth Rs.1500 are provided to them every month).

All prisoners have bank accounts. Half of their earnings are deposited in the bank and handed

over to them only after they are released from the prison.

ABOUT THE PRISON:

The Prison has various divisions and it is split into Open-air and the inner circle. We were

given details about the outer circle and informed about the importance of such a division. The

prisoners have difference in payment in denominations of Rs.10, Rs.30 and Rs.50

respectively for the Under-Trial Prisoners, Prisoners and the Open-air prisoners.

The students were able to interact with the inmates of the jail from the outer circle as well as

the Open-air Jail and many Under Trial Prisoners – which was the purpose of the visit. The

prison’s has got –

1. Watch towers – 7

2. 50 beds Hospital

3. DLSA Legal Clinic

4. Office Quarters

5. Capacity to hold 4,000 prisoners

6. Calling Facility and Meeting Areas for Families

All of these were shown to the members and the faculty so as to be able to understand the

purpose of the same as well as the maintenance of the jail. The jailor as well as the advocates

from the DLSA helped in the understanding of the psyche of the prisoners and that the

prisoners are not looked at differently based on crime but are on the basis of their actions

once they are in the jail. Through the visit the students learned in depth about the working of

the jail and the treatment of the inmates with reference to the remuneration and the work that

they are to do to keep themselves engaged.

There are different blocks where prisoners are divided into various blocks as per their

behavior and various other parameter, they are named as follows: -

MANASA BLOCK

GANGA BLOCK

BRAHMAPUTRA BLOCK

Page 46: CENSURE DES MEDIAS Censure Des Medias · hours about the issues in the movie “Udta Punjab” and the winner for the best counsel for Production house and CBFC were decided. With

KRISHNA BLOCK

GAUTHAMI BLOCK

SWARNAMUKHI BLOCK

EXPERIENECE:

Through this visit the members were able to understand that the jail and the members inside

are not as brutal as one would think of and some of them truly do need help in terms of legal

aid, as many of them come from poor backgrounds where sometimes their families do not

support them and in other cases they are not financially sound enough to have a lawyer for

themselves. The work done by the DLSA in this regard stood out, as the lawyers who

accompanied the students were able to give them true insight into what it is like to work with

such people and what it takes to be, as lawyers, surrounded by people who may or may not

have committed a crime but need help in any shape or form. The visit was truly one of a kind

that opened the students’ minds to various things which are otherwise not given as much

importance.

REPORT ON THE WORKSHOP “FACE THE BOOK WITHIN”

One day workshop titled “FACE THE BOOK WITHIN” on 5th January 2019 from 10 am to 5 pm was conducted by inviting the experts and trainers from the Teenage Foundation. The foundation help youngsters discover their inner potential, equip youngsters with tools and techniques required to maneuver through the tough adolescent years and afterward.

The workshop was a daylong workshop which adopted activity/games based approach to drive home the learning: the workshop focused on important youth issues like peer pressure, academic issues, cell phone use, and abuse and social networking- a double-edged sword which discussed in a group discussion session. We also conducted team building and value education games. The workshop also emphasized on Yoga for health, goal setting, how to wisely use technology and avoid the pitfalls in our lives and so on.

Only a total of 20 students were selected for the workshop.

CONTENT OF THE WORKSHOP

Introduction and communication skills – make the first lasting impression and be a winner

We started with an exercise in personality development. In life we are bound to meet numerous people and it is important to make a great first impression on them. We spent the first one hour of our workshop teaching youngsters how to introduce themselves to others, introducing two people to each other and the art of small talk. They were also given topics on which they need to speak impromptu for one minute thus underlining importance of good expression and speaking skills. Yoga for New age Teens - for health and well being

Keeping in mind the new age computer generation and their lifestyle we designed a fitness program which includes warm up stretches, eye, neck and back exercises followed by spine strengthening Suryanamaskaras and then a cool down called the chair exercises. We suggested youngsters start off on Yoga which is in fact the secret of eternal youth. Practicing yoga can bring about immense benefits in both mental and physical health and be an insurance against mental and physical challenges for a life time. We introduced them to Suryanamaskaras (Sun salutations) a set of 12 exercises which have amazing benefits. These alternating backward and forward bending postures flex and stretch the spinal column through their maximum range giving a profound stretch to the whole body. In the long run these exercises strengthen the spine which ensures a strong and straight posture. This was considered a complete body workout. Experts say that doing 12 sets of Surya Namaskars translates into

Page 53: CENSURE DES MEDIAS Censure Des Medias · hours about the issues in the movie “Udta Punjab” and the winner for the best counsel for Production house and CBFC were decided. With

doing 144 powerful yoga poses in a span of 12 to 15 minutes. This set of exercise is so versatile that it can be used to achieve any goal from weight loss to body strengthening, to a long youthful healthy life. Each posture must be held with an appropriate breath in/out, which leads to detoxifying the organs through copious oxygenation and has a deeper relaxing effect. Ideally this must be done at dawn (daybreak). Games and Processes - activities and tasks to inculcate values, team building and life planning

During the workshop we divided the youngsters into groups and made them play an interesting and innovative team game which simulates a real scenario, where a team has a common goal, a specified time limit to achieve it and competition from other groups. They have to cooperate, coordinate, put their heads together, strategize and do it. They learnt a lot in the process. They played goal setting games which illustrates the point that it is important to have a goal in life. Group Discussions improves expression and builds confidence

We conducted group discussions amongst youngsters on important topics such as cyber bully, social networking addiction, cell phone use and abuse, peer pressure, academic pressure, sibling rivalry, teens and environment etc. etc. This helps them to articulate their thoughts as well as release pressure (they just speak out their mind and woes) most importantly it helps them open and builds confidence. Dr Lalita Anand - FACE THE BOOK WITHIN...connecting the dots

The power point presentation which has some interesting videos and real life anecdotes connects the dots. Demystifies the intuition behind the games played, and discusses the following What are the Youth challenges? How to face it? Self-confidence, self- esteem and self-belief Appreciation and positive stroking Personality building based on values and courage Think out of the box

Dance breaking out of shyness and celebrating life (for therapeutic effects)

We concluded with a contemporary and popular dance session (Zumba /Shiamak Davar). The message behind this session is, “celebrate life, because we live only once” and also pick up any one creative art as a hobby for personality development (Music, art, designing, dance, any musical instrument etc.). This is also an exercise in conquering shyness, opening the person and building confidence.

“Report On Yoga Convention”

Date: 02/02/2019

A week programme on the yoga has been taken place in Symbiosis Law School, Hyderabad in the form of “Yoga Convention”. The said programme is motivated with the slogan of health, peace and spirit. Around 98 participants have been officially registered for the “Yoga Convention”. Many of them have been participated enthusiastically without registration. The programme was purely peace oriented. The major objective of the programme was to keep students mentally healthy and feet. Initially, the programme was introduced for the 2018 -2013 and 2017-2022 batches. Later on it has been opened for other batches too.

The Convention started from 28/1/2019 to 2/2/2019. Mr. Prashant Pandey a Yoga Teacher, therapist and astrologer have been called from the Symbiosis School of Sport Science, Symbiosis University, Hyderabad. He holds 3 sessions within a day throughout the week. Mr. Prashant Pandey holds total 18 different sessions during this august week. Almost 163 participants have been participated on different account (session wise) in yoga convention within this healthy week of SLSH. On his special request, the session was also opened for faculty members and non- teaching staff. Few faculty members have been actively participated in yoga sessions. The experience of Yoga Convention was realistic. The yoga sessions have been tremendously appreciated by the participants. However, the number of participation was comparatively less than the expectation. The three sessions from morning to evening have been arranged in such a way where students and teachers including non-teaching staff can participate in to session. The Suryanamaskar, Yogasans and Yognidra proved to be landmarks for yoga practice.

Page 55: CENSURE DES MEDIAS Censure Des Medias · hours about the issues in the movie “Udta Punjab” and the winner for the best counsel for Production house and CBFC were decided. With

On the last day of the session Mr. Pankaj Umbarkar offered vote of thanks. He appreciated the efforts of Symbiosis School of Sport Sciences. He agreed that, without the Officiating Director, SLSH and Head and Faculty of SSSS, Pune it was not possible. Hence he said special thanks to Dr. Sukhvinder Singh Dari and Dr. Nayana Nimkar for the permission of the said programme. He said thanks to Mr. Prashant Pandey for his seniority and patience to make the programme successful. He also said thanks to participants who actively participated in the programme actively without bothering to say thanks to those non-participants dejure but not defacto. The yoga sessions proved more optimistic with due reason that, those who were interested, they have been identified in its first attempt. At the end he said thanks to administrator, teaching and non-teaching staff of Symbiosis Law School, Hyderabad. It has been agreed by all members of the convention that, the success of programme is not depend on the numbers of participants, but the number of attempts of the participants to carry the practice for long term. However, programme has been ended with the hope of more co-operations and more co-ordination in its next attempt.
