CCCA Moving Forward Despite Cancellation Of Golf Tournament
In the absence of CCCA’s Edu-cation Chair, Ray Depa, who was un-able to attend our Luncheon meet-ing April 17th, due to a mandatory settlement conference in Modesto, I had the distinct pleasure of in-troducing our speaker, Bill Manning, with Van De Poel, Levy & Allen, LLP in Walnut Creek. Bill not only gave an excellent presentation on “Selected Concepts in Product Liability Law,” but surprised us all to learn not only was Bill born in Casablanca, and both he and his wife are the 2013 US National Ballroom Dancing Champions! Way to go, Bill!ANNOUNCEMENT:
It is with a heavy heart that I am announcing the “2014 Summer Fun: Bring It On” Golf Tournament has been CANCELED, by a unanimous decision of the CCCA Board of Directors. As you know, our annual Golf Tour-nament is our main fundraising event of the year for the following charities: “Wounded Warrior Project”, “Children’s Miracle Network”, “Angel Flight West” and “Toys for Tots”! “Hitting A Home Run - covering all the bases” is an apropos theme, both in honor of the Baseball “Summer Classic”, and in making the most of a mid-week conference experience, offering a chance to get out of the Sacramento Summer heat for a time.

Our Speaker for the April 17, 2014 Central Coast Claims Association Luncheon was attorney Bill Man-ning, of Van de Poel, Levy & Allen, LLP. We had the pleasure of his company at a great lunch served at Scott’s Seafood in downtown San Jose, and enjoyed his great sense of humor. He also spoke about his life in Aviation as a Commercial Pilot and flight Instructor. The bonus was he told us he and his wife ranked fourth in the coun-try in Ballroom Dancing Competitions at their level. His credentials as an attorney are extensive, as well.
Addressing the group, Mr. Manning gave several examples of Product Liability cases. He explained that these types of cases arise in situations where there is a stream of commerce. A manufacturer, distributor, or supplier to the retailer that were involved and could be held liable. Theories of Liability include: negligence in products; manufacturing defects, design defects, etc.
He outlined a bizarre case, Collins v. Navistar, Inc., 214 Cal. App. 4th 1486, in which a truck driver driving under an overpass was hit on the windshield by concrete blocks that had been thrown over the side of the overpass by vandals. The issue “was it foreseeable” by the manufacturer of the windshield was in question. Attorney’s needed to prove a design defect to get a Products Liability verdict. The case is set for trial.
Mr. Manning gave his two hour presentation in thirty minutes and we would have enjoyed the two hours if there had been time. He clearly had much more mate-rial to share. He also clearly has extensive knowledge on the subject.

Recreational Vehicle Claims the focus for May 15th CCCA
Join The CCCA In Welcoming Guest SpeakerJoin the Central Coast Claims Asso-ciation for our next informative luncheon meeting Thursday, May 15, 2014, as we welcome attorney Jonathan L. Lee, of Robinson & Wood, LLP, as our guest speaker.
Jonathan Lee has been a shareholder in Robinson & Wood for 25 years. He has tried a total of 55 jury trials to completion throughout California. Mr. Lee has dedi-cated himself to personal injury cases for almost his entire career. In more recent years, he has focused on representing parties in matters involving serious injury, catastrophic brain and spine injury and events involving wrongful death. Some cases have included aggravated liability related to alcohol or drug use. Some suits have involved punitive damages.
Recent cases stem from bicycle accidents, pedestrian accidents, boating events and other recreation-based events, as well as the more common automobile-related accidents. Jonathan has also acted as counsel for parties involved in tractor trailer rig collisions. Injuries have occurred in cases related to premises liability, while other cases have presented issues related to public entities or Uninsured Motorist and Underinsured Motorist matters.
As a former prosecutor, Jonathan is at home in the courtroom. He utilizes multi-media presentations where appropriate to com-municate significant issues and arguments to jurors. He is known for his creative arguments.
Born in Long Beach, California, on July 22, 1954, Mr. Lee at-tended Long Beach Poly High School, then Pepperdine University, where he obtained a B.S. in Business Administration in 1976 while on a music scholarship. He then attended Pepperdine School of Law, receiving a J.D. in 1979 and was admitted to the Bar that same year. He was immediately hired as a Deputy District Attorney for the County of Tulare, where he served through 1981. One of his trial victories during that time concerned the conviction of two people for hit and run driving the same car.
His precedent-setting Supreme Court case of Ford v. Gouin (1992) 3 Cal. 4th 339 has made him a sought after expert in the field of assumption of risk and recreational injuries. More recently, he has authored a series of published articles about the reasonable cost of medical treatment as proof in civil lawsuits. He is also an acknowledged expert on that subject, which became hotbed of

evolving court opinions over the past decade. Jonathan has been asked to speak multiple times on behalf of the Association of Defense Counsel of Northern California, as well as for the JAMS mediation organization, regarding changes in treatment of these types of damages. Jonathan’s article on deposition techniques was featured in the Ex-pert Advice Column of California Lawyer Magazine. The Santa Clara County Bar Association and other organizations have asked him to speak about final argument.
Aside from trial work, he has mediated and settled the vast major-ity of his cases with an eye toward early evaluation and resolution. He has been also been named a Super Lawyer in the field of personal in-jury litigation. Jonathan has retained and deposed hundreds of doctors, psychologists, psychiatrists, health care professionals during the course of his career and has employed ex-perts in a large number of fields. He has acted as a private mediator and early settlement conference neutral.

CEA policyholders file claims, receive payments for damage from La Habra earthquakeBut recent earthquakes show that Californians are uncertain about their insurance coverage
SACRAMENTO, Calif. — The California Earthquake Authority (CEA) has paid numerous claims for damage to homes that sustained rela-tively minor damage from the March 28 magni-tude-5.1 La Habra earthquake. To date, most CEA claim payments from the La Habra shake are to help cover costs for emergency repairs—a new feature in CEA homeowners policies that does not require meeting a deductible to receive payment.
"On the one month anniversary of the La Habra earthquake, we are again reminded that we live and work in earthquake country," said Insur-ance Commissioner Dave Jones. "California is intersected by a complex fault system. Residents should learn about the risk in their area and what steps they should take to mitigate and prepare for the inevitability of the next major quake."
Home insurance companies that offer CEA polices have responded to hundreds of calls from California residents who ask if they have cover-age for earthquake damage.
“Home insurance policies do not cover earthquake damage,” said CEA CEO Glenn Pomeroy. “Without a separate earthquake-insur-ance policy, California residents with earthquake damage will be responsible for costs to repair or
rebuild their homes, and to replace their personal property.”
Many claims filed after the La Habra quake have been denied because many of those resi-dents did not have separate earthquake-insurance policies. Other claims have been denied because their damage did not exceed their coverage de-ductibles.
CEA’s policies are designed to help home-owners and renters recover from damaging earthquakes. Deductibles of 10 or 15 percent are necessary to help reduce premiums. Though some believe earthquake-insurance premiums for older homes in high-risk areas are costly, CEA has low-ered rates over time by a total of 45 percent and offers earthquake coverage for all Californians who insure their home with a CEA participating insurer, regardless of where they live.
California has two-thirds of the nation’s earthquake risk, yet fewer than 11 percent of Cali-fornia residents have protected their household finances with earthquake insurance.
