I had indicated in my letter to you of May 15, 1989, that the PRP's would be willing to delete any recommendation from the Executive Summary and the text of the FS if the Agency agrees that the PRP's recommendation would be contained in a separate volume of the RI/FS. I had also asked that the separate volume become part of the Administrative Record and would be included in the package that was put out by the EPA and the DEP for public comment. I had also requested that the Agencies not put s disclaimer on the RI/FS. After our discussion on t1ay 19, 1989, we agreed as follows: 1. PRP's will put any recommendation with regard to remedy in a volume separate from the text of the RI/FS; 2. The recommendation will be made a part of the Administrative Record; 3. The PRP's recommendation will be contained in that package of materials which the EPA and the DEP make available for public comment as part of the Administrative Record; and 4. The EPA and the DEP will not disclaim the RI/FS except to the extent that the document may indicate that the RI / FS was produced by Central Haine Power Company under an Admi n i s trative Order with EPA/DEP oversight .

Dear Elie:

You have agreed to keep me informed with regard to the schedule to be followed by the EPA and DEP in putting the RI/FS out to public comment. Prior to that time, the EPA and DEP will be making a determination as to what will be .. con~ained in the Administrative Record which will be put forward for public comment. You have told me that it will be necessary that the PRP's summit to the EPA and DEP their recommended remedy in sufficient time for it to be included in the Administrative Record which will go to nu~1T-.c.•ment. You have agreed to tell me when the cutoff date for submission for the recommendation will be.

f the outline I have set forth above concurs with your understanding of our conversation, I would appreciate it if you would confirm such in writing so that I will have the confirmation for my files. Thank you for your assistance.
