ARTICLE 1 RECOGNITION1.4 The parties agree that all Head Coaches in classifications 2373, 2374 or 2375, who supervise two or more full-time faculty unit employees, shall be excluded from the bargaining unit.ARTICLE 2 DEFINITIONS2.13 Faculty Unit Employee – The term “faculty unit employee” or “employee” as used in this Agreement refers to a bargaining unit member who is a full-time faculty unit employee, part-time faculty unit employee, probationary facultyunit employee, tenured faculty unit employee, temporary faculty unit employee, coaching faculty unit employee,counselor faculty unit employee, faculty employee, or library faculty unit employee.2.13 f. Coaching Faculty Unit Employee – The term “coaching faculty unit Employee” or “coach” as used in thisAgreement refers to a bargaining unit employee in the following classifications: 2373, 2374, and 2375, except asmodified in provision 1.4; and 2376, 2377, 2378, 2379, 2380, 2381, 2382, 2383, 2384.ARTICLE 12 APPOINTMENT12.6 Full-time temporary employees, except Coaching Faculty Unit Employees, shall not be appointed on a conditionalbasis. Full-time Coaching Faculty Unit Employees may be appointed on a conditional basis, and those conditions mayinclude, but shall not be limited to, adherence to NCAA by-laws and other NCAA regulations.Three-Year Appointments12.12 Temporary faculty unit employees (excluding coaches) employed during the prior academic year and possessingsix or more years of prior consecutive service on that campus, shall be offered a three-year temporary appointment. Inaddition to other provisions of this Agreement, the following special conditions shall apply: …

12.13 Temporary faculty (excluding coaches) holding three-year appointments shall have the expectation ofappointment to subsequent three-year appointments except in instances of documented unsatisfactory performance orserious conduct problems. These temporary faculty will be re-appointed after a three-year appointment unless there isinsufficient work for which the faculty member is qualified. In the event there is insufficient work to support thereappointment at the previous time base, the time base of his/her successor three-year appointment may be reduced toreflect available work for which the temporary faculty member is qualified.12.19 Criteria for range elevation for temporary faculty (excluding coaches) shall be appropriate to lecturer workassignments.ARTICLE 15 EVALUATIONPeriodic Evaluation of Temporary Faculty Unit Employees15.23 Full-time temporary faculty unit employees appointed for two or more semesters or three or more quarters,regardless of a break in service, must be evaluated in accordance with the periodic evaluation procedure. Thisevaluation shall include student evaluations of teaching performance for those with teaching duties, peer review by acommittee of the department or equivalent unit as defined in provision 15.2, and evaluations by appropriateadministrators. Evaluation of full-time temporary Coaching Faculty Unit Employees shall include an opportunity for peerinput and evaluation by appropriate administrators.15.24 Part-time temporary faculty unit employees appointed for two (2) or more semesters or three (3) or morequarters, regardless of a break in service, shall be evaluated in accordance with the periodic evaluation procedure.Such evaluations shall include student evaluations of teaching performance for those with teaching duties, evaluationsby appropriate administrators and/or department chair, and an opportunity for peer input as defined in provision 15.2from the department or equivalent unit. Evaluation of part-time temporary Coaching Faculty Unit Employees shallinclude an opportunity for peer input and evaluation by appropriate administrators.ARTICLE 20 WORKLOADCoaching Employees: Assignment of Responsibility20.25 The assignments of a coaching employee may include, but shall not be limited to, coaching and related duties,service on appropriate systemwide and campus committees and task forces, public services, teaching responsibilitiesand student advising.20.26 By virtue of the nature of coaching service, the assignments, location of assignments, and schedules ofassignments may vary. Such assignments shall be made by the appropriate administrator. A coaching employee shallbe reimbursed for approved expenses incurred by assignments at off-campus locations.

Coach Provisions (continued)Coaching Employees Assignments and Schedules20.27 At the request of the coaching employee, the appropriate administrator shall discuss assignment and futureassignments with the coaching employee. Assignments pursuant to this Article shall be made by the appropriateadministrator.20.28 The coaching employee may request a particular schedule within the confines of program requirements. Allschedules shall be subject to approval of the appropriate administrator.Coaching Employees Work Hours20.29 The work hours of a full-time coaching employee shall be an average of forty (40) hours in a seven (7) dayperiod. This provision shall apply pro rata to a less than full-time coaching employee.ARTICLE 26 FEE WAIVER26.1 The appropriate administrator shall approve requests from all tenured and probationary faculty unit employees andtemporary faculty unit employees (excluding coaches) with three (3) year appointments pursuant to Article 12 of thisAgreement for enrollment in the CSU fee waiver program subject to the provisions of this Article. Coaches must have atleast six (6) years of fulltime equivalent service in the department for enrollment in the CSU fee waiver program subjectto the provisions of this Article.26.9 Provided that the operational and program needs of the participating employee’s department or equivalent unit aremet in an orderly and normal manner, the library or coaching faculty unit employee shall be provided reasonablerelease time for one (1) on-campus course per semester/quarter taken pursuant to provisions 26.5-26.7. Reasonablerelease time for a participating employee at the Chancellor’s Office shall be time equal to class time.ARTICLE 31 SALARY31.15 The Post Promotion Increase Program:a. Eligibility: The Post Promotion Increase (PPI) Program is a program for those senior faculty members (Fullprofessors and Lecturer D faculty and equivalent librarian, counselor and coaching faculty ranks) who have exhaustedall their SSI eligibility. Having established the pool of eligible recipients, one half of the pool will be nominated for PPIincreases in fiscal year 2008/2009, and the second half of the pool in fiscal year 2009/2010. Selection of the two groupswill be conducted by reference to their dates of hire. The half of the pool with the earliest dates of hire will beconsidered for PPI increases in fiscal year 2008/2009, with the remainder being considered in fiscal year 2009/2010. …Equity Increases31.17 a. 5. The parties agree that the first year focus is on Assistant Professors and equivalent librarian, coaching, andcounselor ranks. The second year focus is on Associate and Full Professors and equivalent librarian, coaching, andcounselor ranks.

ARTICLE 32 BENEFITS32.2 Eligible Lecturers and Coaches in academic year classifications who are appointed for at least six (6) weightedteaching units (i.e., 0.4 time base) for at least one semester or two or more consecutive quarters shall be eligible toreceive health benefits offered through the CalPERS system for the life of this Agreement. This unique enrollmentcriteria for health benefits is pursuant to Government Code 22772(4) and the negotiated Agreement between CSU andCFA and is subject to CalPERS rules and regulations. The CSU shall contribute the amount required for such paymentsby Government Code Section 22871. This provision shall be applicable to eligible employees in the following academicyear classifications:Class Code Class Title0357 CMA Lecturer – Cruise AY 0360 Maritime Vocational Lecturer IV – Cruise AY0361 Maritime Vocational Lecturer IV – Noncruise AY 0364 Maritime Vocational Lecturer – Cruise AY0365 Maritime Vocational Lecturer – Noncruise AY 0557 CMA Lecturer – 2nd Cruise AY0560 Maritime Vocational Lecturer IV – 2nd Cruise AY 0564 Maritime Vocational Lecturer – 2nd Cruise AY2308 Lecturer, Statewide Nursing Program AY 2358 Lecturer AY2375 Head Coach AY 2378 Coach AY2381 Coaching Specialist AY 2384 Coaching Assistant AYCSU Benefit Plans and Eligibility32.4 The term “eligible employee(s)” as used to define eligibility for the CSU dental, vision, life insurance, accidentaldeath and dismemberment and longterm disability plans shall mean an employee or employees who are appointed half-time or more for more than six (6) months. Those excluded from CSU benefit plans also include intermittent employeesor any employee paid wholly from funds not controlled by the CSU or from revolving or similar funds from which aregular State share payment of the insurance premium cannot be made. The term “eligible employee(s)” as used todefine eligibility for the CSU dental, vision, life insurance, accidental death and dismemberment and longterm disabilityplans includes eligible Lecturers and Coaches in academic year classifications who are appointed for at least six (6)weighted teaching units (i.e., 0.4 time base) for at least one semester or two or more consecutive quarters. Eligibleacademic classifications are listed in 32.2.ARTICLE 38 LAYOFF38.9 For coaches, the unit of layoff shall be by classification title and coaching specialty, regardless of work year.

32.13 All employees eligible for either health or dental insurance pursuant to this Agreement, shall be entitled to waive health and/or dental insurance in exchange for the following monthly payments:

a. Waive medical & dental $140 per month

b. Waive medical only $128 per month

c. Waive dental only $12 per month

In order to participate, each employee will be required to request participation and certify that s/he has alternate non-CSU insurance for the CSU insurance being waived.

Fee Waiver

Lecturers with three-year appointments orcoaches with six years of full-time equivalent service are eligible to waive certain fees each term at a CSU campus for a maximum of two courses or 6 units. Afaculty member may transfer the fee waiver benefit to a spouse, domestic partner, or child. See Article 26.
