• The following terms and conditions (“T&C”) shall be applicable for all consumers purchasing JSW Colouron+ (hereinafter referred to as “Product”) from the Company (hereinafter referred to as “Customer”). The Company reserves the right to amend and/or supplement these T&C as it may deem appropriate. Any such changes shall be deemed effective with immediate effect and Customer shall be deemed to have consented thereto.

• This promotional event includes a prize and the winner shall be selected through a lucky draw (“Contest”) for eligible Customer purchasing the Product between the period of 25th September, 2020 to 10th November, 2020 (including the aforementioned dates) (hereinafter referred to “Contest Period”)

• During the Contest Period, the Customer shall be eligible for the lucky draw coupons on purchase of the Products worth INR 10,000 ( Ten thousand) or more including taxes and every additional purchase of INR 10,000 shall make the Customer proportionately eligible for additional coupons.

• The winners of the lucky draw contest shall be intimated by way of a phone call on the mobile/landline number shared by the Customer in their respective lucky draw entry form.

• All rights related to contest/promotion/lucky draw/participation are reserved by the Company and no claim of being a winner shall stand valid unless ratified by the Company.

• All details and particulars submitted in the lucky draw coupons must be accurate, true and complete. All and any shall be disqualified. Suspected or actual fraud by any Customer in relation to the Contest owing to incomplete, ineligible, inaccurate, duplicate, fraudulent or illegible entries to the lucky draw may result in disqualification of the Customer’s participation in the Contest, in addition to any other rights or remedies available with the Company in this regard under law and equity.6. The final lucky draw event of the contest shall be conducted at JSW HEAD OFFICE Mumbai or such other venue as may be ascertained and declared by the Company.

• The winner shall be announced within 60 days after the end of Contest Period.

• Each winner shall be entitled to win only one prize each, regardless of how many times their lucky draw coupons get picked during the lucky draw event.

• The prizes are non-transferable and non-exchangeable for cash or any other items.

• In the event of any conflict, inconsistencies or discrepancies between the T&C and the contents of any brochure, marketing and/or promotional materials relating to promotion of the Product or the Company, these T&C shall take precedence over any other such document and the decision of the Company in this regard shall be final and binding.

• The prize shall be delivered to the respective winner within 60 days of the winners being announced by the Company at the address provided by the winning Customer in their respective lucky draw entry form or may be collected from the nearest JSW’s office facility.

• Applicable taxes, if any, shall be paid by the winning Customer before collecting the prize.

• By participating in the Contest, the Customer is deemed to have accepted and agreed to be bound by these T&C and any other instructions, terms and conditions that the Company may issue from time to time.

• The Company reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify the terms, rules or provisions in respect of the Contest or any part thereof at its sole discretion at any time during the Contest Period, as shall be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and/or force majeure events and the same shall be binding on the Contestants.

• Disclaimer of Warranty: The Company expressly disclaims any liability or responsibility for any damages, loss, or injury arising out of the usage or non-usage of the prize item by the winning Customer. The Company makes no warranty in respect of the prize item and expressly disclaims any guarantees or warranties towards the same. If a winning Customer is dissatisfied with the prize item, the sole remedy available with such shall Customer would be to discontinue using the prize item. The winning Customer agrees and acknowledges that the use of the prize item shall be at the Customer’s sole risk.

• Force Majeure: The Company reserves the right to modify or cancel the Contest at its sole discretion in the event of any force majeure events including but not limited to natural disasters, terrorism related risks, civil war, government actions or any reasons, which in the opinion the Company may adversely affect the Contest or if continuity of the Contest is not be commercially viable to the Company or for any other circumstances beyond the reasonable control of the Company.

• Limitation of Liability: The Company shall not be liable for any damages whether special, incidental, consequential, directly or indirectly related to the usage or non-usage of the prize item and any cost arising therefrom.

• Governing Law: These T&C shall be governed by the laws of India and the appropriate courts in Mumbai shall have exclusive jurisdiction to adjudicate or entertain matters arising out of or in connection with these T&C.

• Survival: These T&C shall continue to prevail even after the expiry of the Contest Period.

• Severability: If any of the clause of these T&C or any other subsequent rules for the Contest declared by the Company are found to be unlawful, void or for any reason unenforceable, then that clause or rule shall be deemed severable from these T&C and shall not affect the validity and enforceability of any remaining provisions of the T&C, unless it is practically not possible to administer the program.
