INVITATION TO TENDER

CHANDLER PARK FIELD UPGRADES – PHASE 2 CONTRACT #2019-11B

July 30, 2019 FILE: 5330-20/2019-11B PURPOSE: The Town of Smithers is seeking an experienced landscaping firm to complete field upgrades to the north side of the Chandler Park playing fields. The location of work is between Third Avenue and the Hwy 16 Frontage Road, directly South of Alberta Street. The general scope of work includes removal of the existing running track, site grading, installation of growing medium, repair of irrigation system and sodding. BACKGROUND: In 2016, the Town of Smithers undertook field improvements that included work similar to the scope of work in this project on the entire east side and south-west corner of the park in order to upgrade Field 1 and completely redevelop Field 2. Phase 2 of the project is meant to be a continuation of the park's revitalization by improving the growing medium and turf for improved use of the Field 3 area and longevity of the entire park. SUBMISSIONS: Tenders will be accepted until 2:00 pm, August 13th, 2019, at: Smithers Municipal Office P.O. Box 879 1027 Aldous Street Smithers, B.C. V0J 2N0 Please submit your tender package in a sealed envelope with a completed Schedule D: Declaration provided in this Invitation to Tender attached to the outside of the envelope. Tender security in the amount of ten percent (10%) of the total tender price, payable to the Town of Smithers, must be included in the submission; see the Instructions to Tenderers. Tenders will be publicly opened immediately after bid closing in the Council Chambers at the Town’s municipal office. The Town of Smithers reserves the right to waive informalities in or reject any or all Tenders or to accept the tender deemed most favourable in the interest of the Town. The lowest or any tender will not necessarily be accepted; award of a contract is subject to the Town’s Purchasing Policy. SUBSTANTIAL PERFORMANCE DATE: The Substantial Performance date for this project is September 27th, 2019.

These Instructions to Bidders form an integral part of the tender, and by submitting a tender the bidder is bound to the conditions and provisions contained herein.

1. PREPARATION OF TENDER: 1.1 Tender Inquiries

1.2 Tender Documents Obtained Electronically

If tender documents are obtained electronically (BC Bid), the tenderer shall register with the Town’s Development Services Department using the above contact information. Registrants shall provide complete contact information, including business name, contact personnel, phone and fax numbers(s) as well as an email address. Registering ensures that any Addenda are distributed to all tenderers; however, it is the tenderers’ responsibility to check the source(s) of the electronic tender package for updates, addenda and related information. Failure to register may disqualify the tender submission.

1.3 Interpretation of Tender Documents

If a prospective tenderer is in doubt as to the true meaning of any part of the specifications or other documents or finds omissions or discrepancies therein, he shall submit a request for interpretation or correction thereof and if deemed necessary by the Director of Development Services, an Addendum will be issued to all persons receiving specifications or other documents.

The Contractor shall be responsible for obtaining all necessary licenses and permits, payment of all taxes due on goods, services or materials, and shall hold a valid Business License with the Town of Smithers.

1.5 Availability of Resources

Contractors shall obtain their own information as to the availability of electrical power and light, water, fuel and all other local materials required for the work, satisfying themselves as to the quality of the materials and the sufficiency of quantities obtainable, generally obtain their own information on all matters and things that may in any way influence them in making their Tender, and fixing the rates entered by them in Schedule ‘A’ (Breakdown of Total Tender Price). Contractors shall satisfy themselves in all respects as to the risks and obligations to be undertaken under the terms of the Contract.

1.6 Inspection of Site

The Tenderers submitting bids shall, at their own expense, visit the site of the Works and shall inspect and consider the site and its surroundings and obtain for themselves, on their own responsibility, all information that may be necessary for the completion of the Contract Documents. The Contractor, before submitting his bid, shall satisfy himself as to the nature of work and the materials necessary for the completion of the works.

  1.7 Onsite Tender Meeting (Attendance is Optional)

To assist Tenderers' with any concerns and / or questions, an optional site meet-ing will be held on Tuesday, August 6, 2019 @ 1:00 pm. A Town Representative and the project Landscape Architect will be in attendance. It will be beneficial to the Tenderer to familiarize himself with the Specifications and Contract Docu-ments and Drawings, before this meeting, to better understand the intent and project context.

All questions asked at this meeting, ( with their answers ), will be forwarded in writing to all Tenderers, regardless of their attendance at this meeting.

1.8 Tender or Tenderer’s Amendments

The Tender shall be based on the whole of the Specifications and Contract Documents, without reservation. Notwithstanding paragraph 2.1 hereof, a Tenderer may amend a Tender already submitted but not yet opened. Such amendment must be received by the Town before the appointed Tender closing time and must be in writing over the signature of the same person(s) who signed the original Tender. Amendments received by facsimile may be accepted if they do not reveal the total amount of the originally submitted Tender. This provision shall not be construed as permitting Tenders to be submitted contrary to the terms of Paragraph 2.1 hereof.

1.9 Supply of Materials

The Contractor shall be responsible for the supply of all temporary and permanent materials to complete the project.

Every item in Schedule A: Breakdown of Total Tender Price is to be included and a price provided. If the Contractor considers that items have been included in any other amounts in Schedule A, "NIL" is to be entered in the cost column. If the Contractor considers items have not been included in any of the tasks or supplies in Schedule A, the Total Tender Price is considered to include all items needed to complete the work.

1.11 Reasonable Prices

Each bid price in Schedule A shall be a reasonable price for such an item, and in no circumstance will a manifestly unbalanced Tender be considered.

1.12 Agreement of Figures

If in Schedule A the sum of the individual Unit Prices and the Total Price do not agree, the Individual Unit Prices will be considered as representing the Tenderer’s intentions.

1.13 Sufficiency of Tender

The Contractor shall be deemed to have satisfied himself before tendering as to the correctness and sufficiency of his tender for the Works.

1.14 Non-Collusion

Tenderers will not discuss or communicate with one another about the preparation of their tenders. Each Tenderer will ensure that its participation in the tender process is conducted without collusion or fraud.

1.15 Freedom of Information and Protection of Privacy Act

All documents and other records pertaining to the Project that is in the custody of, or under the control of, the Town are subject to the Freedom of Information and Protection of Privacy Act. Subject to the limitations of the Freedom of Infor-mation and Protection of Privacy Act, all documents and other records submitted in response to this invitation to tender may be considered confidential.

1.16 Important Dates

The following is a summary of important dates with respect to this call for tender:

Tenders available after 1:00 pm, Tuesday, July 30, 2019.

Optional Site Meeting 1:00 pm, Tuesday, August 6, 2019.

Tenders Submitted by 2:00 pm, Tuesday, August 13, 2019.

Proposed Project Start-up Monday, August 26, 2019.

Proposed Substantial Completion Friday, September 27, 2019.

Proposed Total Completion Friday, October 11, 2019.

2. TENDER SUBMISSION:

2.1 Tender Forms

a) The Tender must be submitted on the supplied Tender Forms, which shall be a signed original, completely filled out in ink or typewritten, and sealed in an opaque envelope.

b) In the case of an individual or partnership, the Tender form must be manually signed by the individual or the partners in the presence of a witness. In the case of a corporation, the Tender form must be signed by its duly authorized officers

c) Schedules included in the tender package shall be completed in full and accompany the Tender Form.

d) The supplied Declaration form shall be signed and attached to the outside of the sealed envelope prior to submission of Tender. The Tender shall be delivered to the Town of Smithers Municipal Hall addressed to the Director of Development Services (see section 1.1).

2.2 Tender Security

a) Every Tender must be accompanied by a Bid Security in the form of either a certified cheque from a chartered Canadian Bank, cash, irrevocable letter of credit, or a Bid Bond, using forms acceptable to the Owner. The Tender Security shall be in the amount of ten (10%) of the Total Tender Price (as entered by the Tenderer on the Tender Form) and shall be made payable to The Town of Smithers.

b) The successful Tenderer shall forfeit all or part of the Tender Security as liquidated damages should he refuse or neglect to sign the Contract Agreement and provide the specified Contract Security and Insurance Certificates within a period of fourteen (14) calendar days after receiving notice that his Tender has been accepted.

c) In addition, should the successful Tenderer refuse or neglect to sign the Contract Agreement and provide the specified Contract Security and Insurance Certificates within the time period stipulated herein, the Tenderer shall be liable to the Owner for the difference between his/her bid and the eventual Contract price.

d) The Tender Securities of the unsuccessful Tenderers will be returned to them immediately after the Contract is awarded, except that the Tender Security of the second lowest qualified bidder will be retained until the Contract Agreement is executed. The successful Tenderer will receive his/her Tender Security upon the execution of the Contract Agreement and delivery of the required bonds and insurance certificates unless otherwise arranged herein (see section 4.2).

2.3 Acceptability of Tenders

a) Tenders received later than the time stipulated in the Invitation to Tender will not be accepted and will be returned unopened.

b) Due to the precise nature of this work, the Contractor and his selected subcontractors are to give examples of previous work experience of similar nature to the work(s) to be performed under this contract, including a list of previous work experience with references and date of completion, (Schedule ‘C’). The Town reserves the right to request clarification of information submitted and to request additional information from any proponent.

c) Where only one Tender submission is received for a project, it shall not be opened without the written consent of the Contractor, on the understanding that if such Tender submission is in excess of the estimated budget for this project, it may be retendered for a better response without any changes being made to the Tender Documents. The Declaration Form that the Tenderer is required to sign and attach to the outside of the envelope shall be considered the Contractor’s written consent allowing the Town to open a submission package when it is the only one received.

d) Tenders that are unsigned, incomplete, conditional, illegible, or that contain additions not called for, erasures, alterations or irregularities of any kind, may be rejected. Tenders must be made on the forms provided. The Owner reserves the right to waive any irregularity or insufficiency and to accept the Tender deemed the most advantageous.

e) Alternate Tenders may be considered if the Tenderer submits a bid without any qualifying conditions on photocopies of the Tender Form or another acceptable form to the Owner.

2.4 Written Safety Policy

a) Contractors shall submit with their tender a copy of their written Safety Policy. A written policy is valid for the calendar year in which the works are scheduled to commence. If a Contractor has previously submitted their Safety Policy, the Contractor shall provide written notice indicating this with their tender submission. The Town shall review all submitted Safety Policies, using Appendices ‘A’ & ‘D’ in the Contractor Coordination Program (CCP) as the measures of compliance. Policies that are missing or non-compliant shall not disqualify the tender, but shall be submitted, or revised and resubmitted, as per the direction of the Town.

3. AWARD OF CONTRACT

1. Irrevocability of Tenders

All Tenders shall be valid and open for acceptance for a period of at least sixty (60) calendar days from the date of receipt of Tenders. During this time period Tenders will be irrevocable.

2. Qualifications of Contractors - Tender Evaluation

a) No award will be made to any Contractor who cannot give satisfactory assurance as to his ability to carry out the Works both from his financial rating and by reason of his previous experience as a Contractor on work of a similar nature to that contemplated in the Contract. The Contractor is required to

submit details of his previous experience (see Schedule C). Unfamiliarity with the type of work proposed may be sufficient cause for rejections of the bid.

b) Tenders will be evaluated taking the following factors into account: - Reputation and/or experience of the Contractor. - The monetary amount of the bid. - Ability to complete the work within time guidelines or constraints, or in

advance of the specified date of Substantial Performance. - The overall cost to the Owner.

3.3 Acceptance of Tender

a) The lowest or any Tender will not necessarily be accepted. Notwithstanding any industry custom or the tendering guidelines of any organization, the Owner may: i) In its discretion refuse all Tenders without giving reasons, or ii. Make an award to a Tenderer who does not submit the low monetary bid,

upon applying the criteria in Section 3.2 of these Instructions. b) Acceptance of any Tender is contingent upon the necessary funds being legally

available. c) Contract Award shall be by a Notice of Acceptance in writing, signed by the

Director of Development Services as the duly authorized representative of the Owner.

4. PERFORMANCE OF CONTRACT

1. Time of Completion

The Contractor shall commence work as specified in the signed Form of Agreement, or no later than fourteen (14) days after receiving instructions from the Director of Development Services to proceed with the Works. The whole of the Contract Works shall be completed by the date as specified in the executed Form of Agreement.

In the case the work is not completed within the time specified, the Town may extend the time of completion, upon acceptable advance written notice from the Contractor. If the time is extended, the Town shall have the right to charge to the Contractor and to deduct from the final payment for the work, the actual costs to the Town of engineering, inspection, superintendence, and other overhead expenses which are directly chargeable to the Contract and which accrue during the period of such extension. The cost of the final surveys and preparation of final measurement shall not be included in such charges.

4.2 Contract Security (Performance Bonding)

a) Before the Contract Agreement is executed, the Successful Tenderer shall be required to give the Owner, if acceptable to the Owner, a Performance Bond in the amount of one hundred percent (100%) of the Contract Price. A surety company authorized to do business in the Province of British Columbia shall provide this Bond.

b) Should the successful Tenderer prefer, the Performance Bond may be

waived, and in its place the Town will retain, until Substantial Performance of the Contract, the Tender Security in the amount of 10% of the Contract Price, but only if it is in the form of a certified cheque, cash or irrevocable letter of credit acceptable to the Town.

c) In the event that the Total Tender Price [as entered by the Tenderer on the Tender Form] and the Contract Price differ, as a result of post-tender negotiations, or approval of Provisional or Alternate Items of Work as identified in the Tender documents, the Contract Security shall be in the amount of ten percent (10%) of the Contract Price on the Form of Agreement. Revisions to the Contract Security shall be amended prior to issuing Contract documents.

3. No Increase in Rates

No claim for increases in prices in Schedule ‘A’, or other prices quoted in the Contract will be entertained, nor shall the Contractor be entitled to make any claim on the grounds of misrepresentation, nor on the grounds that he was given any promise or guarantee by the Owner or his agents or employees or any other person.

Contractor Coordination Program

PURPOSE To ensure that workers of the Town of Smithers and other employers who are working at Town of Smithers’ workplaces are not placed at risk because of a lack of knowledge of workplace hazards, or a lack of coordination of workplace safety.

POLICY The Town of Smithers will ensure that all employers and workers at Town of Smithers’ workplaces are aware of any pre-existing workplace hazards.

The Town of Smithers will ensure coordination of occupational health and safety activities on all multiple employer workplaces, or ensure that a Prime Contractor does so.

The Town of Smithers will ensure compliance with the Workers Compensation Amendment Act and the WorkSafeBC OHS Regulations at all workplaces within the Town of Smithers.

SCOPE This program applies to every situation where workers other than the Town of Smithers workers are performing their job duties at a Town of Smithers workplace.

Exception for Short Term Workplace Visits

The WorkSafeBC Prevention Manual offers the following guidance on workplace visits: "Virtually all workplaces will be visited by workers of other employers. For example, workers may deliver or pick up mail, goods, materials or enter to inspect premises. Short term visits of this type, even if regular, do not make the workplace a "multiple-employer workplace" for the purposes of section 118(1)"

DEFINITIONS (For purposes of this program)

Construction Project Any erection, alteration, repair, dismantling, demolition, structural or routine maintenance, painting, land clearing, earth moving, grading, excavating, trenching, digging, boring, drilling, blasting, concreting, the installation of any machinery or any other work deemed to be construction by WorkSafeBC. (WSBC OHS Regulation Section 20.1)

Contractor Includes a contractor, subcontractor, utility company, government agency or a service company providing/assigning workers and/or services/equipment within the workplace.

Contractor Safety Program

A contractor's Occupational Health and Safety program as required by WorkSafeBC OHS Regulation.

Multiple Employer Workplace

Multiple employer workplaces are created when workers of two or more employers are working at the same location.

In this type of workplace workers of one employer do not actually have to come into contact with the workers of the other employer. They do not even have to be in the same place at the same time. What is important is whether or not the workers' activities could affect the health and safety of another employer's workers. This is true even if the workers on the workplace are workers of the Town of Smithers and a contractor.

Short term visits by couriers, inspectors, suppliers etc. are not regarded as workers at the workplace.

Notice of Project The Notice of Construction Project given by the Prime Contractor, or Owner, to the WorkSafeBC as defined in and required by Section 20.2 (2) and (3) of the WorkSafeBC OHS Regulation.

Prime Contractor In relation to a multiple-employer municipal workplace, the contractor, employer or other person who enters into a written agreement with the Town of Smithers to be the Prime Contractor.

Qualified Coordinator Applies where a Prime Contractor has been designated. On a construction workplace, means the person appointed by a Prime Contractor to coordinate occupational health and safety activities within the workplace.

Qualified Person Applies to every contractor hired whether it is a single employer workplace or a multi-employer workplace. On a construction workplace, means a person designated by a contractor (other than the Prime Contractor) to be responsible for that employer's health and safety activities and responsibilities.

Single Employer Workplace

A defined area in which there are workers of only one employer

Workplace Safety Coordinator

Applies where a Prime Contractor has not been designated.

The person designated by the Town of Smithers to coordinate workplace safety on multiple employer workplaces if there is no Prime Contractor, and to receive/review a contractor's safety program, records, documentation and safety performance.

OVERVIEW OF REGULATION Responsibility of Owner

On October 1, 1999, the Workers Compensation Amendment Act (Bill 14) came into effect. Part 3 of the WC Amendment Act includes responsibilities for owners and contractors on multiple employer workplaces. Part 20 of the WorkSafeBC OHS Regulation also applies and includes responsibilities for construction workplaces.

The WC Amendment Act requires the Town of Smithers, as owner of the workplace, to:

▪ Maintain the workplace in a safe manner

▪ Give any other employers on the workplace all information about the workplace hazards

▪ Give other employers on the workplace the information they need to eliminate or control those hazards.

The WC Amendment Act also sets out the responsibilities when the Town of Smithers has more than one outside employer at its workplace. On multi-employer workplaces there is a responsibility to coordinate activities of the employers, workers, and other persons at the workplace. There is also a responsibility to establish and maintain a system or process to ensure that everyone at the workplace complies with the WorkSafeBC OHS Regulation.

Coordination - Overview

The Town of Smithers can decide to coordinate safety activities at a multiple employer workplace or to designate this responsibility, in writing, to a Prime Contractor to perform the duties of coordination.

Construction Workplaces

If there is no Prime Contractor, and there are more than 5 workers, in total, at the workplace, the Town of Smithers must designate a Workplace Safety Coordinator to coordinate workplace safety. (NOTE: It does not matter who employs the workers.)

The Workplace Safety Coordinator is responsible for submitting the Notice of Project to the Workers’ Compensation Board where a Notice of Project is required. (See WorkSafeBC OHS Regulation 20.2 for the general requirements of a Notice of Project.)________________________________________________________________________

On a multiple employer workplace:

The Workplace Safety Coordinator must also:

• Ensure that all of the workers at the workplace are aware of any pre-existing hazards on the workplace

• Identify any hazards on the workplace that are created by the work

• Have a workplace drawing that shows where all employers are working, where first aid is located, emergency transportation system for injured workers, and evacuation marshaling points

• Have written procedures outlining safe work procedures to be followed by all workers at the workplace

If the Town of Smithers designates a Prime Contractor for the construction workplace it must be in writing. The Town of Smithers must inform the Prime Contractor of pre-existing hazards.

The Prime Contractor must designate a Qualified Coordinator. The Prime Contractor’s Qualified Coordinator must:

• Ensure that all workers at the workplace are informed of pre-existing workplace hazards, and of any hazards in the workplace that are created by the work

• Ensure there are written procedures for safe work practices to be followed at the workplace

• Ensure that the hazards are addressed throughout the duration of the work activity

• Have a workplace drawing showing where all employers at the workplace are working, where first aid is located, emergency transportation system for injured workers, and evacuation marshalling points

Non-construction Workplaces The Town of Smithers must act as the Prime Contractor on a single employer workplace where workers of another employer are employed, and where a Prime Contractor has not been designated in writing.

In this situation the Town of Smithers must:

• Ensure that the names of the persons who will supervise workers at the workplace have been forwarded to the Town of Smithers.

If the Town of Smithers has designated a Prime Contractor in writing at non-construction workplaces there is a responsibility to:

• Give the Prime Contractor at the workplace any available information that is necessary to identify, eliminate or control hazards at the workplace.

RESPONSIBILITIES

The Town of Smithers is responsible to determine whether a workplace includes the workers of other employers and whether this is a multiple employer workplace or a single employer workplace. The Town of Smithers is also responsible for determining if the workplace is a construction workplace as outlined in the definition section.

Note: For ease of reading, the rest of the responsibilities will be separated into the following three categories:

1. Single Employer Workplace 2. Multiple Employer Workplace with a Prime Contractor 3. Multiple Employer Workplace without a Prime Contractor

Responsibilities: Single Employer Workplace

The Town of Smithers:

The Town of Smithers is responsible to ensure that the contractor at the workplace is aware of all pre-existing workplace hazards and has the information on how to eliminate or control the hazards.

On a construction workplace, if the work requires a Notice of Project. The Town of Smithers must submit the Notice of Project to the WorkSafeBC or ensure that the Prime Contractor does so.

Workplace Safety Coordinator:

The Town of Smithers Project Manager is responsible to:

• Determine the boundaries of the workplace, and to ensure that only workers of one employer perform duties within those boundaries

• Ensure all relevant information on workplace hazards is provided to the employer

• Decide whether the contractor should be designated, in writing, as a Prime Contractor and to designate the Prime Contractor

Contractor

Note: Applies to a contractor to the Town of Smithers and to service providers such as BC Hydro or gas distribution companies.

• Obtaining information on workplace hazards from the Town of Smithers and informing its workers at the workplace

• Ensuring compliance with the Workers Compensation Amendment Act and the WorkSafeBC OHS Regulation.

If designated as the Prime Contractor, the contractor is responsible to:

• Ensure that all workers at the workplace, as well as its own workers, are aware of the pre-existing workplace hazards

• Ensure that all work is performed without unnecessary risk and in compliance with the Workers Compensation Amendment Act and the WorkSafeBC OHS Regulation

Town of Smithers Supervisors

Supervisors must:

• Ensure that all workers know that a single employer workplace has been designated

• Ensure they do not assign duties, which take the Town of Smithers workers into the single employer workplace

• Contact the Town of Smithers Project Manager if any worker reports that they must enter the single employer workplace to do their job to determine if the work should go ahead

Town of Smithers Workers All workers are responsible to ensure that their duties do not take them into the single employer workplace. If they must enter the workplace, they must inform their supervisor.

Town of Smithers

The Town of Smithers is responsible to:

• Designate the Project Manager to be responsible for coordinating workplace safety

• Ensure that all health and safety activities are coordinated

• Ensure that all employers comply with the Workers Compensation Amendment Act and the WorkSafeBC OHS Regulation

Workplace Safety Coordinator

The Town of Smithers Project Manager must ensure that:

• All employers on the workplace are aware of pre-existing workplace hazards

• Workplace safety meetings are held and documented

• All occupational health and safety activities are co-ordinated

If the workplace is a construction workplace and a Notice of Project is required the Town of Smithers Project Manager is responsible to ensure that the Notice of Project is submitted to the Workers' Compensation Board.

On construction workplaces, the Town of Smithers Project Manager must:

• Have the written procedures to protect the health and safety of all workers on the workplace

• Maintain a workplace map that shows where all employers are working, occupational first aid is located, emergency transportation system, and evacuation marshalling points are located

Contractors

Contractors are responsible to:

• Comply with their contracted safety requirements and the directives of the Town of Smithers Project Manager regarding coordination of activities

• Give the Town of Smithers Project Manager the name of a Qualified Person who is responsible for their health and safety activities

Supervisors

All supervisors are responsible to check with the Town of Smithers Project Manager to ensure that the duties that they are assigning do not cause hazards for the workers of other employers on the workplace.

Workers

All workers are responsible to follow safe work procedures and to alert their supervisor if the duties that they are performing may create a hazard to other workers.

Responsibilities: Multiple Employer Workplace with a Prime Contractor

The Town of Smithers

The Town of Smithers is responsible to identify workplace hazards for the Prime Contractor and to give the Prime Contractor information on how to eliminate or control the workplace hazards.

Workplace Safety Coordinator

The Town of Smithers Project Manager is responsible for designating a Prime Contractor, based on the complexity and risk of the work being performed.

If a Prime Contractor is designated, the Town of Smithers Project Manager is responsible to inform all other employers of the designation of Prime Contractor.

Prime Contractor

The Prime Contractor must ensure that:

• All occupational health and safety activities are coordinated

• All employers on the workplace comply with the Workers Compensation Amendment Act, and the WorkSafeBC OHS Regulation, and

• Ensure that workplace safety meetings are held and documented

Other contractors are responsible to deliver to the Prime Contractor’s Qualified Coordinator the name of the person who supervises their workers.

On a construction workplace, the contractors must designate a Qualified Person to be responsible for that contractor's health and safety activities. That contractor must give the name of this Qualified Person to the Prime Contractor.

PROGRAM DETAILS

This program is designed to help ensure that when contractors are working at a Town of Smithers workplace, the work is performed safely and there is no unnecessary increase in liability for the Town of Smithers as a result of their actions.

Situation Identification

There are two types of situations where workers of another employer are performing duties at a Town of Smithers workplace.

The first of these, and most difficult for the organization to control, are workers who are not performing contract work for the Town of Smithers. They may include the workers of a utility company, a government agency or Service Company. The typical example might be workers of a gas utility company who have set up traffic control to do repair work on the gas distribution system. They are at a workplace, and the Town of Smithers workers may be working on the same workplace.

It is the responsibility of the Town of Smithers to ensure that the workplace is safe and that all workers, including contractors and their employees, are aware of the workplace hazards of which the organization has knowledge as owners of the workplace. As long as there are no interactions, or overlap between workplaces that would create hazards for the workers of the contractor or for the workers of the Town of Smithers there is no further action required.

The second situation is one that the organization is most familiar with. This is a situation where a contractor has come onto a workplace to perform work for the Town of Smithers. In this situation, there is still the responsibility to ensure that the workplace is safe, and that the contractor is aware of pre-existing hazards. The organization must determine if this is a single employer workplace or a multiple employer workplace, and to decide whether or not there should be a Prime Contractor.

Pre-contract Hazard Assessment Contractors must be made aware of all of the pre-existing workplace hazards that may affect their workers. Often this seems like common sense, but lack of documentation of the process of identifying workplace hazards can create problems.

A workplace hazard identification must be completed prior to putting a project out to tender. This will be performed by the Town of Smithers Project Manager.

Hazard identification should include, but not be limited to:

• workplace access difficulties • confined spaces • chemical exposures • excavations • work at heights • lockout • electrical hazards • asbestos • temperature extremes • noise • workplace hazardous materials • traffic

Any other workplace hazards must also be identified.

Providing methods to eliminate or control workplace hazards will include providing the contractor with the Town of Smithers safety program and procedures. If the contractor is going to do work that is not covered by the safety program, it is important that once the hazards are identified, the contractor provides the written procedures for the work.

Day Labour On occasion, a contractor will come onto a workplace and will perform work without subcontractors, in co-operation with workers of the Town of Smithers. In the past there have even been some situations where workers of the Town of Smithers supervised the contract workers. In other cases a supervisor has been hired on contract to oversee the activities of the contractor. In both these situations, the Town of Smithers accepts a significant amount of liability.

As a result of amendments to the WorkSafeBC OHS Regulation, it is very important to determine whether or not these contractors should be designated as Prime Contractors. If they are not designated as Prime Contractors, the Town of Smithers may be liable for violations of the WorkSafeBC OHS Regulation by the contractors. Even if they are designated as Prime Contractors, supervision of the contract workers by a Town of Smithers supervisor can make the Town of Smithers liable for any violation of the WorkSafeBC OHS Regulation.

It is the policy of the Town of Smithers that all day labour contracts will be reviewed by the Town of Smithers Project Manager to determine how they will be supervised.

Multiple Employer Workplaces Multiple employer workplaces are created when the workers of two or more employers are working at the same location. They do not have to both be working all of the time.

If they are both at the workplace and the activities of either employer can affect the health and safety of workers of the other employer, then the workplace becomes a multiple employer workplace. This is true even if the workers on the workplace are workers of the contractor and the Town of Smithers.

When the Town of Smithers has contractors on a multiple employer workplace, there is a requirement for coordination of activities.

This coordination role can be fulfilled by the Town of Smithers Project Manager, or it can be delegated to a contractor, who is designated as Prime Contractor in writing.

Contractors must give the Town of Smithers Project Manager or the Prime Contractor the names of the individuals who will be supervising their workers.

On a construction workplace, contractors must also give the name of the Qualified Person who will be responsible for their health and safety program.

Prime Contractor Designation In the past contracted work was much simpler than it is today. A project was developed and put out to bid. The successful bidder hired other contractors. These contractors were subcontractors to the successful bidder. In these cases the successful bidder was usually referred to as the “Principal” or “Prime Contractor”.

As a result of amendments to the Workers Compensation Amendment Act and the WorkSafeBC OHS Regulation, it is now very important that the Town of Smithers carefully decides whether to designate a contractor in writing as the Prime Contractor. The decision on whether to designate a Prime Contractor rests with the Town of Smithers Project Manager, who will maintain a corporate policy on the issue.

The responsibility for coordination of activities at the workplace, and for ensuring compliance with the Workers Compensation Amendment Act and the WorkSafeBC OHS Regulation will rest with the Prime Contractor. Typical contract language to designate a Prime Contractor is in Appendix “C”.

It is also very important that these contractors are made aware of all of the pre-

existing workplace hazards that might put their workers at risk. They must also be given the information that they need on how to eliminate or control those hazards.

The Town of Smithers may decide, at any time, to appoint a Prime Contractor on a single employer workplace. The Town of Smithers can also appoint one contractor to be the Prime Contractor on a multiple employer workplace.

If the Town of Smithers appoints a Prime Contractor the affected contractor(s) will be given written notice.

Workplace Safety Requirements of the Prime Contractor

The Prime Contractor has the responsibility to:

• Ensure work is done in a safe manner that complies with all regulatory requirements

• Direct and coordinate the work activities related to the health and safety of all contractors and any other workers on the workplace

• Have a supervisor readily available at the workplace. This supervisor will have the necessary skills, qualifications and experience to coordinate the health and safety activities of the workers

• Obtain from the organization written information on hazards and conditions and the methods to address the hazards and conditions and will circulate this information

• Ensure first aid facilities are provided and maintained on the workplace in accordance with Part 33 of the WorkSafeBC OHS Regulation

• Take all reasonable steps to ensure that the occupational health and safety activities of all Contractors and their workers comply with the WorkSafeBC OHS Regulation

• Immediately give the Town of Smithers Project Manager the name of any contractor who does not co-operate, assist or do what the qualified coordinator requires regarding coordination of health and safety activities within the workplace

At non-construction workplaces, the Contractor will:

• Ensure there is a supervisor at the workplace who has the necessary skills and experience to run the Contractor's Safety Program

• At the start of work, the Contractor will provide the Town of Smithers Project Manager, in writing, the names of all supervisors

• The Town of Smithers Project Manager or Prime Contractor, must be immediately informed of any changes

At construction workplaces, the Contractor will

• Ensure there is a Qualified Person present who has the necessary skills and experience to run the Contractor's Safety Program

• At the start of work, the Contractor will provide the Town of Smithers Project Manager or the Prime Contractor, in writing the name of the Qualified Person

• The Town of Smithers Project Manager or Prime Contractor, must be immediately informed of any changes

The Contractor must:

• Ensure that a Joint Health and Safety (JHS) Committee is formed for the workplace if required by the Workers Compensation Amendment Act, and that the activities of the JHS Committee meet the requirements of the Workers Compensation Act.

• Advise the Town of Smithers Project Manager or the Prime Contractor, of any accidents or incidents at the workplace that must be reported to the Workers' Compensation Board.

• Inform all persons working on the workplace of the health and safety requirements at the workplace.

At all times the contractor will ensure that its workers and subcontractors, and all other workers coming onto the workplace will:

• Provide occupational health and safety records and documentation to the Town of Smithers Project Manager or Prime Contractor

• Follow the directions of the Town of Smithers Project Manager or the Prime Contractor on all matters relating to occupational health and safety

• Inform the Town of Smithers Project Manager or the Prime Contractor of any information that they require to coordinate each employer's work activities within the workplace

Additional Requirements for Construction Workplaces (Required by WorkSafeBC OHS Regulation Part 20)

At construction workplaces the Prime Contractor will:

• Notify the Workers' Compensation Board by a Notice of Project that it is the Prime Contractor

• Have a qualified coordinator readily available at the workplace. This qualified coordinator will have the necessary skills, qualifications and experience to coordinate the occupational health and safety activities of every employer

Before the work begins, the Prime Contractor will provide the Town of Smithers Project Manager with the following information:

• A copy of the Notice of Project (for construction projects)

• Written confirmation that the Prime Contractor's safety program is in place

• The name of the qualified coordinator

• Any changes of appointment

For construction projects, the Prime Contractor will post a copy of the Notice of Project in prominent locations within the workplace to ensure that all employers know that, as Prime Contractor, it has responsibility for coordinating the work activities related to occupational health and safety matters of all contractors. ________________________________________________________________________

Prime Contractor's Health and Safety Records The Prime Contractor must:

• Maintain all occupational health and safety documentation at one location at or near the workplace and make these documents available to the Town of Smithers Project Manager. (A listing of the required documents is given at Appendix B)

• Ensure that its Qualified Coordinator collects records of all JHS Committee proceedings at the workplace and distributes them to other qualified persons working within the workplace and to the WorkSafeBC.

• In the event of an accident that requires notification to the Workers' Compensation Board, at the same time, notify the Town of Smithers Project Manager about the accident

• If requested, provide information on the progress of the investigation and coordinate all responses to requests for information with the Town of Smithers

Workplace Safety Coordinator The Town of Smithers Project Manager:

If a Prime Contractor is appointed, the Town of Smithers Project Manager will be the Town of Smithers workplace representative and have duties and responsibilities that include but are not limited to the following:

• To ensure all contractors are informed of appointment of the Prime Contractor

• To inform the Prime Contractor that they must be copied in all communications

• To monitor the Prime Contractor's compliance with the safety requirements of the contract

• To ensure that the Town of Smithers workers do not direct or supervise any contractor's workers on the workplace

• To receive and/or distribute all necessary documentation

• To ensure that all pre-existing hazards of the workplace and procedures for addressing the hazards are conveyed to the Prime Contractor

If there is no designated Prime Contractor on a multiple employer workplace the responsibility to coordinate the activities of all employers at the workplace lies with the Town of Smithers Project Manager.

The Town of Smithers Project Manager will also watch for situations where the work of one contractor or a worker of the Town of Smithers could cause a hazard to the workers of another contractor. It is the Town of Smithers Project Manager's responsibility to ensure that these situations are controlled.

At construction workplaces, this includes maintaining the location of first aid and evacuation marshalling points. It also includes maintaining the written procedures that will be used to ensure the safety of workers on the workplace.

The Town of Smithers Project Manager will ensure that contractors coming onto the workplace bring with them their written procedures. If the contractors do not bring written procedures, the Town of Smithers Project Manager must develop those procedures.

Appendix A - Overview of Occupational Health and Safety Program Content

WorkSafeBC OHS Regulation 3.3 defines the contents of an Occupational Health and Safety Program. The program must include the following:

• Policy • Inspection of Premises and Work Practices • Written Instructions to Supplement the WorkSafeBC OHS Regulation • Management meetings • Investigation of Accidents • Maintenance of records and statistics • Joint Occupational Health and Safety Committee • Instruction and Supervision of Workers • Occupational First Aid Services and Equipment • Workplace Hazardous Materials Information System

Policy The policy must define the employer's aims and clearly state the responsibilities of the employer, managers, supervisors and workers.

Inspection of Premises and Work Practices Direction must be given for the provision regular inspection of the premises, equipment, work methods and work practices, including specific instruction that states the intent of inspections, who is to inspect, what is to be inspected, inspection frequency and who conducts the inspection.

Written Instructions There must be appropriate written instructions to supplement the WorkSafeBC’s Occupational Health and Safety Regulation and copies of the instructions must be made available for reference by all employees.

Maintenance of Records and Statistics Instruction must be given to maintain records and statistics that include reports of inspections and accident investigations. Provision must be made for making this information available to the JHS Committee, an officer of the WorkSafeBC, the union representing the workers or where there is no union, workers at the place of employment.

Joint Occupational Health & Safety Committee Provisions must be made for the establishment and maintenance of a committee. The instructions must state committee membership, function and detailed duties.

Instruction and Supervision of Workers Provision must be made for instruction and supervision of workers in the safe performance of their work. Of particular importance is new worker orientation, regular safety talks, addressing specific job/task hazards at all levels and ensuring supervisors are knowledgeable of their health and safety duties and responsibilities.

Occupational First Aid Services and Equipment Written instruction must be provided that direct the occupational first aid services and equipment to be provided, requires a treatment record book to be maintained, and that states how to summon a first aid attendant and how to report injuries.

Workplace Hazardous Materials Information System There must be written instructions that assign responsibility for the program, provide direction on maintaining material safety data sheets and labels, and detail the education and training to be provided.

Appendix C - Contract Language for Hiring Municipal Contractors

The following checklist should be used when designing contract language that outlines the responsibilities of Prime Contractors and other contractors on the organization’s workplaces:

1. The contractor should be required to perform the services to a standard acceptable to the Municipality.

2. If a notice of project is required, the contractor should be required to send it to the Workers Compensation Board.

3. The contractor should be required to ensure compliance with the WorkSafeBC OHS Regulation and WC Amendment Act.

4. The contract should note that any failure to meet the safety requirements of the contract would result in cancellation of the contract.

5. The contractor must be required to have in place a written safety program and written safe work procedures specific to the work being performed.

6. There should be a requirement that the safety program and all written safe work procedures are available at the workplace prior to the commencement of the work.

7. The contractor must be a registered firm with the WorkSafeBC.

8. The contract should require that the contractor provide occupational first aid services.

9. If a contractor is designated Prime Contractor, the workplace safety requirements for the Prime Contractor from this program should be part of the contract.

10. If a contractor is designated Prime Contractor, the requirements for the designated qualified safety coordinator, from this program, should be part of the contract.

11. There should be a requirement that the contractor have toolbox safety meetings at least weekly and formal safety meetings monthly, with minutes forwarded to the Corporation.

GENERAL CONDITIONS CHANDLER PARK FIELD UPGRADES

PHASE 2 CONTRACT #2019-11B

1. Definitions For the purpose of this Contract, the following definitions shall apply: 1.1 The Owner is the Town of Smithers (the “Town”). 1.2 The Consultant is the Town of Smithers Director of Development Services, or

designate. 1.3 Project Coordinator is the Town’s representative administering the Contract. 1.4 Changes in the Work are additions, deletions or other revisions to the work within the

general scope of the Contract – see section 10.

2. Scope of Work 2.1 The contractor shall provide all the necessary materials, equipment, labour,

supervision, and all items necessary to complete the scope of work included in this tender.

The work described in this Contract is to be substantially completed by September 21, 2019, and all work(s) to be totally completed by October 11, 2019. The work shall be performed according to the Specifications and Drawings in a safe, professional manner.

2.2 Specifications listed on the Contract Drawings shall supersede the Town of Smithers specification.

2.3 The successful contractor, all the contractor’s employees and sub-contractors working on this project will be required to take part in Tailgate safety meetings with the Project Coordinator. The Contractor will be responsible to record the minutes of each meeting held and have them available for inspection at any time workers are on site for this contract.

2.4 It is the Contractor’s responsibility to coordinate work at all locations with the respective Town of Smithers Project Coordinator, and make all efforts to minimize disruptions to day-to-day operations. This may include the Contractor working during evenings, nights, or weekends as directed by the Project Coordinator at no additional cost to the Owner.

3.1 The Contractor shall have in force a General Liability Insurance policy for at least $2,000,000.00, which includes the Town of Smithers as Additional

Insured. No Contract shall be awarded until the contractor has furnished proof of such insurance, and this must be done within 14 calendar days of the Notice of Acceptance, or the Owner may award the Contract to another Contractor or undertake the work with his own forces and use the Tender Security to offset any extra costs incurred as a result.

3.2 Each insurance policy shall also contain a clause obliging the insurance company to give the Town thirty (30) days written notice before the policy may be cancelled.

3.3 The Contractor shall supply and maintain General Liability Insurance, continuously from the commencement of work until 12 months following the date of Substantial Performance of the Work.

4. Indemnification

The Contractor shall indemnify and hold harmless the Owner, his agents and employees from and against all claims, demands, losses, costs, damages, actions, suits or proceedings by third parties that arise out of or are attributable to the Contractor's performance of the Contract.

5. WorksafeBC

The attention of the Contractor is drawn to the Regulations issued by WorksafeBC, which must be adhered to. Refer to the Town of Smithers’ Contractor Coordination Program included in the contract documents.

6. Legislation

The Contractor shall carry out his work in accordance with all relevant legislation including, but not limited to, Town bylaws. All works in this contract must be done in strict accordance with BC Building Code, Provincial government Health and Safety Regulations, Worksafe BC.

7. Protection of Work and Property

The Contractor shall be responsible for protecting all of his work until Substantial Completion is achieved. The Contractor shall protect the Work and the Owner’s property adjacent to the Place of Work from damage and shall be responsible for damage which may arise as a result of his operations under the Contract.

8. Taxes, Licences, and Permits

The Contractor shall pay all taxes due and obtain all licences and permits required to carry out the work unless specifically stated to the contrary in these documents. A Town of Smithers Business Licence is required for all contractors and subcontractors; the fee is $160/yr.

Contractor shall provide written notice of commencement to the Owner at least 48 hours (not including Saturdays, Sundays or Statutory Holidays) prior to starting work. No work shall be undertaken until a preconstruction meeting has been held.

9.2 The Work shall be organized to minimize disruption to the public. 9.3 If the Work has not started within 14 calendar days of the date of the written notice to

proceed and without valid reasons, the Owner may award the contract to the second choice Tenderer. The Contract Security may be used towards the extra cost if any, of the second choice Tender over the first choice tender.

10. Changes in the Work

10.1 Changes in the work shall not commence until the Contractor has received a written Change Order signed by the Consultant and the Contractor.

10.2 The value of the work performed in the change, if applicable, must be written on the Change Order and mutually agreed to.

10.3 Refer to ‘Section 01 00 07 – 1.28 Change Order For Extra Work’ for change order procedure and requirements for pricing of changes.

11. Cleanup

The Contractor shall maintain the Work in a safe and tidy condition, free from the accumulation of waste products and debris during the course of these works. At the completion of these works, the Contractor shall clean the site. All garbage must be removed from the sites at the contractor’s expense. It is the contractor’s sole responsibility to store, move, recycle or dispose of any waste generated from the work in this contract.

12. Completion

See ‘Section 01 00 07 – General Requirements’ for instructions at the completion of the work(s).

13. Payment

See ‘Section 01 00 07 – General Requirements’ for payment instructions.

14. Warranty

The Contractor shall be responsible for the proper performance of the Work. The Contractor shall correct, promptly, at his/her expense, defects or deficiencies in the work, which appear prior to and during the period of one year from the approval of Substantial Completion and the required inspection(s). After that period the normal statutory limits shall apply.

1. General Requirements

1.1 Scope of Work

.1 Supply all labour, materials and equipment necessary for the preparation and completion of all work, as specified herein, and marked below, and shown on the Landscape Drawings:

- Site preparation and rough grading - Growing Medium and finish grading - Irrigation System repairs, as necessary

- Sodding 1.2 Contractor’s Responsibilities

In addition to the services defined in Scope of Work the Contractor, shall be responsible for:

a) Attendance at any necessary meetings with Owner’s staff, the Consultant and/or other agencies.

b) Maintaining effective liaison with Owner’s representatives through regular contact and scheduled meetings.

c) Maintaining the project on the agreed schedule

d) Maintaining a close working relationship with the Owner’s appointed Representative.

e) Ensuring that the project is constructed in accordance with all current municipal and provincial standards.

f) Ensuring that the project is constructed in accordance with the prevailing Worker’s Compensation board requirements, and ensuring that all labour and subcontract labour has the necessary Worker’s Compensation board coverage.

1.3 Owner’s Responsibility

.1 The Owner shall be responsible for:

a) Providing all background information including: - Site plans including underground services; - Notification to user groups of Contractor’s work schedule.

b) Review the work as it proceeds

c) Approval, or otherwise, of all scope changes, cost changes to the original budget and schedule changes which impact the overall project schedule.

.1 All work described herein shall be carried out by experienced personnel under the direction of a skilled supervisor.

1.5 Substitutions

.1 Substitutions will only be permitted where the Contractor shall prove to the Owner and/or the Consultant; the substitute is equivalent (or better) than the specified product.

.2 Substitutions will be permitted if proof is submitted that any product specified is not obtainable, where a proposal will be considered for the use of the nearest equivalent product with an equitable adjustment of contract price.

1.6 Inspection

.1 Give one (1) day prior notice to the Owner`s Representative for each required inspection.

.2 Inspections are to be undertaken at the stages outlined in each section. In

addition, the Owner’s representative and / or the project landscape architect shall be undertaking frequent / daily site visits to review work progress and quality.

1.7 Guarantee

.1 All work and materials shall be guaranteed for one year, beginning on the date of Substantial Completion, and ending on the date of the Final Acceptance Certificate.

1.8 Replacements

.1 All Turf found dead, or not in healthy, satisfactory growing condition or

which, in any other way, do not meet the requirements of the specifications, shall be replaced by the Contractor at his own expense, where maintenance during the guarantee period, (under the responsibility of the Owner), is verified to follow all recommended standards for proper plant maintenance.

.2 The cost of replacement resulting from theft, vandalism, carelessness or neglect on the part of others, or any causes due to circumstances beyond the control of the Contractor, (after certification for Substantial Completion has been authorized), shall be borne by the Owner. Prior to this time, see Section 1.14-Protection of Work.

1.9 Delays

.1 The Contractor will not be compensated for any additional costs resulting from delays in the performance of the Work by weather, labour disputes, strikes, lock-outs, fire, or delay by common carriers.

.2 If the Contractor is delayed in the performance of the work due to actions by the Owner, he shall be compensated for any additional costs thereby incurred, and the completion date shall be changed accordingly. The amount of the compensation and the extent of change in completion date shall be determined by the Owner.

.3 If the Contractor is delayed in the performance of the Work by a Stop Work Order issued by a court or other public authority, as a result of any act or fault of the Contractor, or of anyone employed by it directly or indirectly, then the Contractor shall not be entitled to claim compensation for additional costs thereby incurred, and the completion date shall not be changed.

1.10 Disputes .1 The Consultant is in the first instance, the interpreter of the contract and

the judge of its performance and shall decide on questions arising from the Contract Documents whether as to the performance of the Work or the interpretation of the Specifications and Drawings, or as to the measurement of quantity or valuation of any work executed or to be executed under the Contract.

.2 In all case of misunderstanding and disputes, oral arrangements will not be considered and the Contractor must produce written authority in support of his contention, and shall advance no claim in the absence of such written authority or use any conversation with any person in presenting any claim against the Owner.

.3 In the event of the Contractor failing to agree with the Consultant’s decision, the Contractor may ask for the Owner’s interpretation. If the Contractor does not agree with the Owner’s decision it shall be decided by arbitration in the manner hereinafter provided.

.4 Any matter which, in the Contract, is left to be mutually agreed upon by the parties, and upon which they cannot agree, shall be settled by arbitration pursuant to the “Arbitration Act” and amendments thereto of the Province wherein the Work is situated and amendments thereto.

.5 No action at law shall be commenced by either the Contractor or the Owner until the arbitration proceedings have been dispensed with. The Contractor shall not cause a delay of the Work while the arbitration proceedings are pending or in progress.

1.11 Protection of Work

.1 The Contractor is responsible to provide adequate protection of job site during construction. The Contractor will be responsible to replace any work, at his cost, due to vandalism up to the issuance of the Certificate of Substantial Completion.

.2 The Contractor is responsible to supply and install temporary security fence when necessary as outlined in Section 31 22 13 2.1.

1.12 Work Schedule

.1 Interim review of work progress based on work schedule will be conducted as decided by the Owner and schedule updated by Contractor in conjunction with and approval of consultant.

.1 Contractor shall have complete use of work areas for execution of work. He shall cooperate and co-ordinate his work with the Owner and the park users to permit as much use of the park as possible.

.2 There may be times when the Municipality and its user groups want access and use of the existing, irrigated playing field, within the running track. Wherever possible, the Contractor is to co-ordinate his work to ensure this field is open for use.

1.14 Testing and Certification .1 All products and materials used in the work shall be subject to testing

by a certified laboratory to ensure that they meet the specified standard. This includes, but is not limited to growing medium, granular base, and compaction tests.

.2 Testing shall be carried out by an independent testing laboratory, using commonly accepted testing methods, or methods set out in this Standard. Payment for the testing shall be made by the Contractor. If the test identifies the material is unacceptable, the Contractor shall also pay for all subsequent testing.

.3 The testing laboratory shall make the test result available to the Contractor, the Consultant and the Owner and shall include either (a) certification that the tested samples meet the requirement of this Standard, or (b) recommendations for the modifying the material or product to meet the Standard.

.4 The Contractor shall carry out the recommended modifications and shall submit new samples for testing if required by the Owner.

.5 The Contractor shall only be required to modify the products or materials as necessary to meet this Standard, except if his contract with the Owner requires a different product or material of equal or better quality.

1.15 Inspection Acceptance

.1 The Owner`s Representative shall have access to the work at all reasonable times for ensuring compliance with the Standard.

.2 The Owner shall not interfere with the Contractor’s control and management of the work and his forces, except to examine for or to prevent non-compliance with this Standard.

.3 Inspections and reports shall be timed to avoid undue delays in the execution of the work. The Contractor shall give reasonable notice when the work will be ready for inspections in order to avoid delays. The Contractor shall notify the Owner`s Representative for inspections at the time periods identified in each of the following sections.

.4 The Owner’s Representative will be undertaking approximately one site visit per day (Monday – Friday). Times are to be coordinated with the Contractor and the Owner’s representative.

.5 Conditions for Acceptance of work are shown in the ‘General’ part of each section.

1.16 Safety

.1 The Contractor shall comply with all applicable laws, bylaws, rules, regulations and lawful orders of any public authority having jurisdiction for the safety of persons or property or to protect them from damage or injury.

.2 The Contractor shall erect and maintain, as required by existing conditions and progress of the work, all reasonable safeguards for safety and protection, as required by the Worker’s Compensation Board.

.3 The Contractor shall provide barricades, safety guards, and/or warning devices for purposes of controlling traffic whenever necessary for the protection of persons and property.

1.17 Site Protection

.1 All site services and features shall be protected against damage during the work. Damage shall be reported and completely repaired to the satisfaction of the Authority.

1.18 Reporting Damage

.1 Notification of danger or damage to property, site features or the environment shall be given at once, (verbally, and where necessary in writing, to the Authority and to the appropriate public agencies or authorities responsible for the safety and repair of such property as public utilities or for protection of the environment).

1.19 Supervision

.1 The Contractor shall ensure competent supervision for the duration of the work on site.

.2 The Contractor’s person designated responsible for supervision shall ensure that the required standards of work, materials and safety are

achieved. This includes, but is not limited to, confirmation of safety codes and utility lay out, records of changes, and on-site coordination, scheduling and management.

1.20 Material and Equipment

.1 Use new material unless otherwise specified.

.2 Provide material and plants of specified design and quality, performing to published ratings. Unless other specified, comply with manufacturer’s latest printed instructions for materials and installation methods. Notify the Owner`s Representative in writing of any conflict between these specifications and manufacturers instructions. The Owner`s Representative will designate which document is to be followed.

.3 Substitution

a) Proposals for substitution may be submitted only after award of Contract. Such requests must include statement of respective costs of items originally specified and proposed substitutions.

b) Proposals will be considered by the Owner`s Representative if:

i) Products selected by tenderer from those specified, are not available or,

ii) Delivery date of products selected from those specified would unduly delay completion of Contract.

iii) Alternative products to those specified, which are brought to the attention of, and considered by the Owner`s Representative as equivalent to those specified and will result in credit to Contract amount.

c) Should proposed substitution be accepted either in part or in whole, assume full responsibility and costs when substitution affects other work on the project. Pay for design or drawing changes required as result of substitution.

d) Amounts of all credits arising from approval of substitutions will be determined by the Owner`s Representative and Contract price will be reduced accordingly. No substitutions will be permitted without prior written approval of the Owner`s Representative.

1.21 Site Security and Maintenance

.1 The site shall be maintained in an orderly manner.

.2 Protect the Work from all damage from the elements and all other causes in such a manner as the consultant may direct. The Contractor is not relieved of the responsibility for any injury or damage through failing to protect the Work, even though the Owner`s Representative did not specifically request such protection to be provided.

.3 During the construction period the Contractor must maintain the site on continual basis. Site maintenance shall include; dust control; property access; clean-up; surface restoration; traffic control; and barricading.

1.22 Clean-up

.1 Clean-up shall be a continuing process during the entire period until final acceptance and shall encompass materials, debris and equipment.

.2 The construction areas shall be maintained free of accumulations of excess or waste material and debris.

1.23 Change Order for Extra Work

.1 When there is an increase or decrease in the Work not covered by Contract Unit Prices, it shall be covered through a Change Order. The value of such Work may be determined either by:

a) Agreement between the Owner and the Contractor; or

b) On the basis of actual costs to the Contractor of the materials and labour including additional payroll costs covering Worker’s Compensation, Employment Insurance, Holiday Pay, Statutory Holidays and such other payroll costs as may be mandatory according to the laws of the province in which the Work is being carried out, plus twenty per cent (20%) to cover the use of tools, office expense, overhead and Contractor’s profit. The services of superintendents, timekeepers and the like shall be deemed to be included in overhead.

Labour costs shall be actual hours worked at payroll rates plus the additional payroll burden not exceeding twenty per cent (20%) of direct wages. Equipment rental shall be at rates quoted on the current provincial government Ministry of Highways and Transportation approved rates. For equipment which has to be brought in for the specified purpose, transportation costs will be paid. A piece of equipment shall mean a unit complete including operator, fuel, grease and maintenance and such costs as are normal to an operating unit. Rental shall be paid for actual hours of work only.

.2 When a Change Order involves work by a Subcontractor, the payment for materials and services shall be similar to that for the Contractor. The Contractor shall be entitled to a fee of ten per cent (10%) for general supervision.

.3 When work is being done on a cost basis, the Contractor shall submit to the Owner`s Representative an account in triplicate for work done. The account shall include the man hours, equipment hours, and materials used. The Owner`s Representative shall check account and if it is numerically

correct, he shall sign three copies and return one signed to the Contractor. Only those items which are eligible in accordance with these specifications shall be certified for payment by a Change Order.

If the Contractor fails to submit an account of work done on a cost basis, the Owner`s Representative shall prepare the account, and this shall be used as the basis for payment for that portion of the Work, and no payment will be made for any account subsequently submitted by the Contractor for that portion of the Work.

.4 Upon completion of all project related work items, the Contractor shall notify the Owner`s Representative in writing that the project is one hundred per cent (100%) complete and request a Construction Completion Certificate for the project. Upon a satisfactory inspection of the Works, the Owner`s Representative shall prepare and forward a Construction

Completion to the Owner and to the local approving agencies, for their acceptance of the project and signature on the noted Certificate.

.5 The project Guarantee Period will begin on the date of Issuance of the Substantial Completion Certificate.

1.24 Application for Payment

.1 Application for payment on account may be made monthly as the work progresses.

.2 Application for payment shall be dated the last day of the agreed monthly payment period and the amount claimed shall be for the value, proportionate to the amount of the contract, of work performed at that date.

.3 The Owner`s Representative will, upon receipt of an application for payment from the Contractor, issue a certificate for payment in the amount applied for or in such other amount as he determines to be properly due. If the Owner`s Representative amends the application, he / she will promptly notify the Contractor in writing giving his reason for the amendment.

.4 The Owner shall make payment to the Contractor on account no later than thirty (30) days after receipt of a certificate for payment.

1.25 Holdback Release

Ten per cent (10%) holdback payment shall be made after the following Conditions have been met:

.1 A Substantial Completion Certificate has been issued.

.2 A Statutory Declaration has been filed with the Owner`s Representative by the Contractor certifying that all materials, labour, subcontractor and material supplier claims incurred, directly or indirectly in account of the

Works have been fully paid by the Contractor and that no lien exists against the premises or materials mentioned herein, for work done or materials furnished in respect of anything done under or by virtue of the Agreement. The declaration shall be filed forty-five (45) days after the date issuance of a Substantial Completion certificate.

.3 A statement has been filed with the Owner`s Representative from the Worker’s Compensation board certifying that all assessments due by the Contractor have been paid.

.4 The Contractor has filed with the Owner`s Representative, a statement that all claims and demands for extra work or otherwise have been submitted, thus establishing the amount of the Final Payment.

.1 Upon receipt of written notice from the Contractor stating that the Work is substantially completed and ready for inspection (accompanied by a list of the known deficiencies) the Owner`s Representative shall promptly make the required inspection, and when they find the Work to be at least ninety seven per cent (97%) completed and available for the use that it was intended for, shall issue a Substantial Completion Certificate to the Contractor. This Certificate shall state that the Work provided for under the Contract has been substantially completed, and that the Work may be used for the purpose for which it was intended. Should the Work not be deemed substantially completed, a written notice will be given to the Contractor stating the deficiency corrections required for substantial completion.

.2 Once the project has been deemed substantially completed by the

Owner`s Representative, the Builder’s Lien period will start.

.3 A deficiency holdback amount equal to twice the estimated value of the works remaining after substantial completion has been given, will be retained until the Construction Completion Certificate has been issued.

.4 Upon completion of all project related work items, the Contractor shall notify the Owner`s Representative in writing that the project is one hundred per cent (100%) completed and request a Construction Completion Certificate for the project. Upon a satisfactory inspection of the Works, the Owner`s Representative shall prepare and forward a Construction Completion certificate to the Owner and to the local approving agencies, for their acceptance of the project and signature on the noted Certificate.

.5 The project Guarantee Period will begin on the date of issuance of the Substantial Completion Certificate.

1.27 Final Payment

.1 The final payment shall be made after the issuance of the Construction Completion Certificate and the Contractor has provided to the Owner`s

Representative all required invoices, project diaries, required reports and manuals.

.2 The Owner`s Representative`s inspection upon completion of the Work and issuance of the Construction Completion Certificate or Final Payment is not acceptance of the Work, nor shall these acts by the Consultant prejudice any requirements for the Contract nor operate to relieve the Contractor of any of his responsibilities thereunder.

1.28 Final Acceptance Certificate

.1 Upon the expiration of the one (1) year Guarantee Period and the successful conclusion of tests and satisfactory performance under operating conditions meeting the performance warranty or the requirements of maintenance, as the case may be, the Owner, or the Consultant on his behalf, shall accept the Works whereupon the Final Acceptance Certificate shall be issued.

.2 No certificate other than the Final Acceptance Certificate shall be deemed to constitute acceptance of any work or other matter in respect of which it is issued.

1.4 Protection

.1 Buried utilities and structures

a. Confirm the size, depth, and location of existing utilities, irrigation lines and structures (fibre optic cables, waterlines, manholes and catch basins), prior to commencing work. The Contractor is recommended to contact "BC One Call" @ 1-800-474-6886 to confirm location of underground utilities.

b. Maintain and protect from damage, existing turf grass to be retained, adjacent street curbs, power poles and site features designated to be retained. Obtain approval from Owner's representative before moving or otherwise disturbing utilities or structures.

c. Do not drive heavy equipment on existing turf as this will compact soil and / or leave ruts.

2. Products

2.1 Protective Fencing

.1 Physical protection barriers shall be erected at strategic locations along the edge of the Site Work Zone before excavation and grading occurs on the site. Confirm locations with Owner's Representative.

.2 Physical protection barriers shall meet all applicable municipal bylaws and regulatory requirements (i.e. 6'-0" ht. orange plastic fencing, polyurethane web securely mounted on wood or steel posts, or approved equivalent).

.3 Fence posts facing fields in use shall have added protection to ensure players are protected in case they crash into them.

.4 Protective fencing shall be removed only when all construction is fully completed.

2.2 Geotextile ( Optional - at Owner's discretion)

3. Execution

3.1 Site Preparation

.1 When at all possible, limit the work area to designated areas. Mark and protect these areas to ensure working areas are not accessible to the public. Minimize disturbance to surrounding areas. If necessary, repair damaged areas to the satisfaction of the Owner’s representative.

.2 Onsite features and structures marked to be retained that suffer damage due to the Contractor’s work are to be restored and / or replaced. The Contractor shall pay for all costs associated with this work.

.3 Locate all irrigation lines and sprinklers within the work area. Mark lines and sprinklers, and undertaken the associated work as outlined in Specifications Section 32 84 00 – Irrigation Repairs. ( Note: Only irrigation lines with less than 250 mm soil cover need to be temporarily removed.)

.4 A section of the existing chain link fence at the SW corner of the site, adjacent to Alberta St., shall be temporarily removed to provide access to the construction site. This shall include the temporary removal of approximately three fence posts, ( which are set within a sleeve), and roll the chain link back to the first standing post. Take adequate precautions to ensure there is no damage to the existing post / concrete footings being retained for re-erection of the fence upon completion of the said work.

3.2 Scarify/ Rototilling of Existing turf

.1 Clearly mark out and stake area to be excavated, as illustrated on drawing L 1.1. Obtain approval of Owner’s representative prior to commencing excavation .

.2 Cut a clean line / edge to separate the existing grass to be retained from the area to be excavated.

.3 Excavate sub-grade to lines, depth, elevations and dimensions as indicated on the landscape plans and associated details. Contractor is to remove the excavated sod to an offsite location of his choice. Excavate and remove existing sod to a depth of approximately 25 mm, ensuring all existing grass roots are removed.

3.3 Excavation and Removal of Material within the Existing Running Track

.1 Excavate and remove all existing material to a depth of 300 mm (12").

.2 Contractor is to take adequate measures to minimize disturbance of adjacent grass surfaces that are to be retained.

.3 All equipment entering and leaving the site to undertake this excavation work shall travel only on areas designated to be scarified / rototilled, (i.e. enter and exit the

site via the fence opening adjacent to Alberta St.), and not on existing turf areas to be retained.

.3 Before commencing excavation, the Contractor is responsible to mark the location of all underground utilities and irrigation lines. Damage to utilities caused by the Contractor and his sub-contractors shall be the Contractor's responsibility to repair all damage at his expense. All damaged work shall be completed to the satisfaction of the Owner.

.4 Running Track - Excavate and remove existing granular material to 300 mm depth. Transport excavated material to the municipal Works Yard, a distance of 1.5 km from Chandler Park. Deposit excavated material at a location specified by the municipal Works Superintendent. Compact and level the sub-base with a roller to 90% (min.) standard proctor density. Obtain approval of excavated area from the Owner’s representative prior to commencing ‘fill operations’.

The Owner's representative will assess the coarseness of the track's sub-base upon completion of excavation. If the material is still quite coarse, the Owner may ask the Contractor to supply and install a filter fabric liner in specific areas, between the coarse subgrade and proposed fill. The Contractor is to supply an 'Optional unit price', on the Form of Tender, to undertake this said work.

3.4 Redistribution of Existing Soil

.1 With a bulldozer, grader or similar equipment relocate the entire top 75 mm depth, ( less the 25 mm depth of excavated sod) from the site area , to the excavated running track. Install relocated material in 150 mm lifts (maximum.) Compact each lift at 95% Standard Proctor Density. This material shall form a 225 mm depth base, ( measured upon completion of compaction.). Compact to 95% standard proctor density. Grade to form desired slopes and grades as illustrated on drawing L1.

.6 Contractor is responsible to survey the graded sub-base. ( Elevation tolerance shall be +/- 15 mm.) Sub-base elevations shall be 75 mm below proposed final grade. Upon completion, receive approval from the Owner’s representative prior to proceeding.

.7 Contractor is responsible to install stakes at marked sprinkler heads to confirm proposed elevations and contours are obtained.

.6 Upon approval of rough grade, the Contractor shall proceed with the installation of 75 mm depth of approved growing medium uniformly over the entire project area, as outlined in Section 32 22 19 – Growing Medium and Finish Grading.

1. Critical Protection Zones represent the area surrounding a tree or group of trees preserved and protected to ensure the safety or survival of the tree(s). These shall be continually assessed and documented during the construction work.

2. Since most trees develop root structures beyond the canopy radius, the drip line radius of a tree is used only as a guideline for critical root definition.

3.3 Reporting changes or damage

1. Any damage to trees designated for preservation shall be documented and reported to the Owner's representative.

3.4 Protective Fencing

1. As a minimum, protective fencing should be erected outside the drip-line, in the location illustrated on drawing L1.

2. Signage should be provided at regular intervals along protective fencing indicating the function of the fencing, i.e. ‘Tree/Plant Protection Area- Do Not Enter.’

3.5 Protection of the landscape surrounding the protection areas

a. There should be no passage of machinery, stockpiling of materials and / or soil through or within vegetation protection areas at any time, including the site preparation phases.

1.4 Source quality control

.1 Inspection and testing of growing mediums shall be carried out by an accredited commercial soil-testing laboratory. The Contractor shall pay for all costs associated with this testing.

.2 Inform the Owner's Representative of proposed source(s) of growing medium to be supplied, and provide access for sampling. Acceptance of growing medium is subject to inspection and soil analysis test results. Do not commence growing medium installation until growing medium tests and review of growing medium source have been accepted by the Landscape Architect and / or the Owner's Representative.

.3 If the test identifies the material is unacceptable, the Contractor shall take necessary steps to produce an acceptable growing medium and undertake additional testing, at his cost, to verify that the material is acceptable.

1.5 Scheduling of work

.1 Schedule placement of growing medium after the areas have been accepted for rough grade preparation.

2. Products

2.1 Organic matter/ compost

.1 Organic matter shall be decomposed compost, peat, manure or fibrous stems and leaves of sphagnum mosses with a texture varying from porous to spongy fibrous, fairly elastic and substantially homogeneous with pH value not less than 4.5 and not greater than 7.0, medium to coarse shredded, suitable for horticultural purposes, free of decomposed colloidal residue, and wood.

.2 Use of local topsoil is encouraged when it meets this Standard for imported soil or can be modified to meet the requirements as set out for growing medium.

.3 Soil amendments shall be virtually free from subsoil, lumps, stones and invasive or noxious plants and their reproductive parts, non composted wood, wood waste, insect pests, plant pathogenic organisms, chemical pollutants or substances at levels toxic to plants, and other extraneous materials that detract from the desirable physical and chemical properties required for landscaping purposes.

.4 Drainage of growing medium shall be measured only after it is installed in place. Percolation shall be such that no standing water is visible 60 minutes after at least 10 minutes of moderate to heavy rain or irrigation.

.5 Previous soil tests have indicated that the 'loam' soil from Art Buchanan is high in silt and clay content and thus it is expected that sand will be needed, as an additive, to increase the percentage of sand and reduce the percentage of silt and clay. Preliminary tests have indicated that 3 parts sand mixed with 2 parts loam soil will obtain the desired texture and organic matter content for the turf areas. Soil analysis test(s) shall be conducted upon completion of mixing of ingredients to confirm preliminary tests.

3. Execution

3.1 Placing growing medium for turf areas .1 All unsuitable material and waste shall be removed from the site.

.2 Obtain approval of sub-grade prior to placement of the growing medium.

.3 In areas designated for installation of the growing medium ensure sub-grade is prepared to the depth, slope and elevations shown on the grading plan. As outlined in Section 31 22 13 – Site Preparation and Rough Grading, the subgrade shall be excavated to a depth such that a minimum of 75 mm (3”) depth of growing medium will be evenly spread over the prepared base.

.4 Obtain approval of sub-grade from the Owner’s Representative prior to placement of the growing medium.

.5 Growing Medium mix of sand and loam, (for the turf areas), shall be thoroughly mixed offsite. (It cannot be over stated the importance of developing a homogenous mix of growing medium.) The Contractor is to advise the Owner’s representative when the mixing is complete. The Owner’s representative will review and must approve the mixture prior to the Contractor transporting and installing onsite.

.6 The specified, ‘added’ growing medium shall be installed at approximately 75 mm (3”) depth, ( plus approximately 12 % extra to allow for compaction), over the prepared base. Growing medium shall be moist, but not wet when placed, and shall not be handled if it is frozen or wet because its structure will be altered.

.7 The total volume of required ‘additional’ growing medium is illustrated on drawing L2. If and when additional growing medium is required, the Contractor shall supply a unit cost to supply, install and grade this material. ( This unit cost shall be identified on the Form of Tender.)

.8 In placing growing medium, take care not to over distribute into turf areas designated to be retained.

.9 Upon completion of installing and even spreading of the ‘added’ growing medium, the Contractor shall rototill the entire area to a depth of 150 mm (6”), ( i.e. 75 mm of the added growing medium rototilled into the top 75 mm depth of existing growing medium base.) Regrade and compact to 90% Standard Proctor Density.

.10 Contractor is to install grade stakes at the sprinkler heads to develop the proposed elevations and contours illustrated on drawing L1.

.11 During the transport of the growing medium onto the project area, the Contractor shall ensure areas that are excessively compacted by dump trucks and other equipment are disced / rototilled to an acceptable density, ( i.e. 85 – 90% Standard Proctor density), prior to installation of the growing medium. The Owner’s Representative shall have the final say as to whether excessively compacted areas are to be loosened / rototilled to the specified compaction rate. (Note: areas with more than one pass of a dump truck should be loosened / rototilled.)

3.2 Fine grading

.1 Upon completion of irrigation renovations, fine grade all areas by raking out spoiled material and remove debris such as pebbles, soil clumps and weeds.

.2 Grade to the elevations shown on the plans, less depth of sod thickness, ( i.e. approx. 15 mm depth) Rough spots and low areas shall be eliminated to ensure positive surface drainage and firm enough to resist deep foot printing. It is envisioned a bulldozer or similar equipment with tracks plus a level bar, will be utilized for this work to ensure material is evenly spread and areas are not excessively compacted when preparing the final grade.

.3 Fine grade all areas such that the elevation of the finish surface, ( less the thickness of the proposed sod), will be flush with the top of existing adjacent turf surfaces. Final elevation shall have a tolerance of +/- 15 mm from the specified elevations illustrated on drawing L1.)

.4 Contractor is responsible to survey and confirm proposed elevations have been obtained.

.5 Obtain approval of fine grading from the project landscape architect / Owner's representative prior to proceeding with sodding operations.

1.3 Submittals

.1 Closeout:

a. Record Drawings

i. As renovation occurs, prepare accurate as-built drawing to be submitted before final inspection, including:

- Detail and dimension changes made during construction. - Significant details and dimensions not shown in original

Contract Documents. - Field dimensioned locations of valve boxes, manual

drains, quick-coupler valves, control wire runs not in mainline ditch, and both ends of sleeves.

- Take dimensions from permanent constructed surfaces or edges located at or above finish grade.

- Take and record dimensions at time of installation, on the working drawing. Submit to the Owner's Representative for preparation of digital computerized drawing.

1.4 Quality Assurance

.1 Regulatory Requirements:

a. Work and materials shall be in accordance with latest rules and regulations, and other applicable state or local laws. Nothing in the Contract Documents is to be construed to permit work not conforming to these codes.

.1 During delivery, installation, and storage, protect materials from damage and prolonged exposure to sunlight.

1.6 Warranty

.1 Standard written and signed one year guarantee shall include:

a. Filling and repairing depressions and replacing lawn due to settlement of irrigation trenches.

b. Adjusting system to supply proper coverage of areas to receive water.

c. Ensuring system can be adequately drained.

d. All malfunctioning equipment within this one year period, shall be replaced free of charge.

1.7 Owner's Instructions

.1 After system is installed and approved, instruct Owner’s designated personnel in complete operation and maintenance procedures.

1.8 Maintenance

.1 The Contractor will not be responsible for any post construction maintenance, such as winterizing this section of the irrigation system.

2. Products

2.1 Materials

.1 Rock-Free Soil:

a. Backfill soil or sand around PVC pipe.

b. Soil having rocks no larger than 6mm in any dimension (i.e. sand or sandy loam).

.2 Pea Gravel:

a. For use around base of drains and valves.

b. (3/8”) 10mm maximum round, washed rock.

.3 Sand/Topsoil:

a. Specified growing medium as outlined in Section 31 22 19. .4 Native Material:

a. Native soil free of wood and other deleterious materials used as trench backfill material.

.1 Pipe, Pipe Fittings, and Connections

a. Pipe shall be continuously and permanently marked with Manufacturer's name, size, schedule, type, and working pressure.

b. Pipe sizes shown on Drawings are minimum. Larger sizes may be substituted without additional cost to others.

c. Pipe:

i. Pressure Lines - Schedule 40 PVC. ii. Lateral Lines - Schedule 40 PVC. iii. Quick Coupler Piping - Schedule 40 PVC

d. Fittings - Same material as pipe, except where detailed otherwise

e. Sleeves / Conduits for low voltage wires:

i. Class 200 PVC Pipe. ii. Sleeve diameter shall be large enough to easily feed the

specified number of low voltage wires through it. (i.e. number of wires will vary.)

.2 Sprinkler Heads

a. Re-use existing sprinkler heads, unless otherwise damaged during construction. Type of head shall be products of Rainbird manufacturer to match the existing sprinkler heads.

b. Contractor is responsible to replace damaged sprinkler heads at his cost.

c. The Owner's Representative shall have final authority as to the acceptance and reuse of existing sprinkler heads.

.3 Sprinkler Risers

a. Pop-up rotor and impact sprinklers shall have adjustable riser assembly, three ell swing joint assembly, unless detailed otherwise on Drawings. These swing joint fittings shall be of schedule 40 PVC plastic and nipples schedule 80 gray PVC unless otherwise designated on Drawings. Horizontal nipple parallel to side of lateral line shall be 8 inches long minimum. All other nipples on swing joint riser shall be of length required for proper installation of sprinkler heads.

.4 Other Components

a. Recommended by Manufacturer and subject to Owner's Representative review and acceptance before installation.

b. Provide components necessary to complete system and make operational.

3. Execution

3.1 Preparation

.1 Protection - Repair or replace work of this Section damaged during course of the Work at no additional cost to others.

3.2 Irrigation Heads

.1 Location of existing heads and piping shown on Drawings is approximate only. Actual location may vary slightly.

.2 During construction, consult with the Owner's Representative to verify proper placement and make recommendations, where revisions are advisable.

.3 Contractor is to temporarily raise existing sprinkler heads above grade. Stake and ribbon to provide additional insurance that the sprinkler heads will not be damaged during the scheduled work. Alternatively, temporarily remove all sprinkler heads within the ‘Limit of Work’. Cap ends of swing joints to prevent soil from entering the pipe. Lower swing joints a minimum of 250mm (10”) below ground. Stake / mark for future recovery and prevention of damage to the swing joints.

.4 Upon completion of fine grading, reset sprinkler heads to the specified elevations or alternatively re-install sprinkler heads and compact growing medium firmly on all sides.

.5 Top of growing medium shall be slightly below top of sprinkler head, to provide for sod thickness and end result of top of sod being flush with top of sprinkler head.

3.3 Irrigation Lateral Lines / Pipes

.1 Approximate location of existing irrigation lateral lines is illustrated on drawing L1. Contractor is to confirm location and depth of all lateral lines prior to excavation.

.2 Contractor is to take all necessary precautions to ensure irrigation PVC pipe is not damaged during construction. If pipe is broken or cracked, the contractor shall replace at his cost.

.3 ( As a “rule of thumb” only), a minimum of 250 mm (10”) of growing medium depth is required for safety of pipes from heavy vehicles.

.4 If excavation exceeds this depth,( i.e. less than 250 mm soil cover exists over the irrigation pipes), the Contractor shall temporarily remove the affected section(s) of pipe, until final grading is completed. Alternatively, new PVC (of the same size and wall thickness) can be installed to replace the removed pipe.

.5 Installation of New Pipe (if Required)

a. Install pipe in a manner to provide for expansion and contraction as recommended by Manufacturer.

b. Unless otherwise indicated on Drawings, install lateral lines with minimum of 300 mm of cover based on finish grade.

c. Cut plastic pipe square. Remove burrs at cut ends before installation so unobstructed flow will result.

d. Make solvent weld joints as follows:

- Do not make solvent weld joints if ambient temperature is below 5ºC.

- Clean mating pipe and fitting with clean, dry cloth and apply one coat of P-70 primer to each.

- Apply uniform coat of 711 solvent to outside of pipe. - Apply solvent to fitting in similar manner. - Re-apply light coat of solvent to pipe and quickly insert into

fitting. - Give pipe or fitting a quarter turn to insure even distribution of

solvent and make sure pipe is inserted to full depth of fitting socket.

- Hold in position for 15 seconds minimum or long enough to secure joint.

- Wipe off solvent appearing at outer shoulder of fitting. - Do not use excessive amount of solvent thereby causing

obstruction to form on inside of pipe. - Allow joints to set at least 24 hours before applying pressure to

PVC pipe.

e. Tape threaded connections with teflon tape.

f. Supply and install PVC swing joints to match those being replaced.

3.4 Sprinkler Heads

.1 Before re-installation of sprinkler heads, open control valves and use full head of water to flush out system.

.2 Set sprinkler heads perpendicular to finish grade, as shown on the irrigation drawing Details.

.3 Do not install sprinklers using side inlets. Install using base inlets only, unless approved otherwise in writing by the Owner's Representative.

.4 Set sprinkler heads at a consistent spacing (as shown on the plan).

.5 Owner’s Representative will review irrigation system operation before Substantial Completion.

3.5 Adjusting

.1 Adjust heads to proper grade when turf is sufficiently established to allow walking on it without appreciable harm. Such lowering or raising of heads shall be part of original contract with no additional cost to others.(This shall be conducted approximately one growing month after turf sodding.)

1. General

1.1 Work in this section includes:

.1 Supply and install sod in designated lawn areas.

.2 Maintenance of sod up to Total Completion.

2. Related work in other sections:

.1 Finish Grading of proposed lawn areas. Section 31 22 19

.2 Subgrade preparation. Section 31 22 13

.3 Irrigation Renovations, Section 31 22 13.

2. Materials

1. Fertilizer

Slow release, granular form of 13-16-10 inorganic materials ( or alternative fertilizer mix as recommended by soil scientist), c/w with various micronutrients, or as directed by soil consultant after soil tests.

2. Sod

.1 Sod shall be # 1 Nursery quality relatively free of weeds, containing no clover and no more than two broadleaf weeds or ten annual weeds per 59 sq. m.

Obtain approval of sod source prior to onsite delivery. Provide a sample to the Owner’s Representative, if requested. The Owner’s representative will inspect the Contractor’s selected sod at its source for approval prior to shipping onsite. Contractor shall obtain this approval prior to purchasing the said sod.

.2 The grass mixture in the sod shall be as regionally available and contain the following grass species.

.3 Obtain approval of sod species prior to delivery to site. Possible source of sod:

Reid Lake Valley Turf, Prince George, BC (Tel.) 250 - 967 - 4512.

.4 Color of sod is to match color of existing sod as close as possible. Owner and / or Owner’s Representative has the discretion to refuse the sod, if color difference is too great. Sod thickness shall be approximately .6 - .75” ( i.e. 15 -19 mm min.).

.5 Sod shall be grown in a sandy loam growing medium. Sod that is grown in too silty or clayey loam can be rejected.

- Kentucky Bluegrass (minimum 3 approved varieties)

90% to 100%

- Perennial Ryegrass variety - Creeping Red Fescue 0 to 10% combined

3. Execution

3.1 Fertilizing

.1 Contractor shall evenly spread fertilizer with a broadcast spreader over all areas to be sodded at the rate of 10 lbs/1000 ft2.

.2 Fertilizer shall be applied to the growing medium, prior to sodding.

.3 Lightly rake fertilizer into the growing medium to a depth of ¼ “ (6mm).

3.2 Sodding

.1 Obtain approval of finish grade prior to sodding. Graded area shall have proper compaction levels, neither too compact nor too loose.

.2 Sod shall be laid as soon as possible after delivery to prevent deterioration

and not later than 48 hours after delivery.

.3 Sod shall be laid staggered, and in such a manner that no open joints are visible and no pieces overlap. Match ends of new sod with existing grass as

best possible. Height of new sod shall match height of adjoining, existing turf.

.4 The sodded areas shall be rolled and tamped providing sufficient pressure to ensure a good bond between the sod and growing medium.

.5 The Contractor will be responsible to replace any unhealthy sod pieces.

3.3 Maintenance

.1 The Contractor shall be responsible to maintain the sodded areas until it has been approved by the Owner's Representative at the Date of Total Completion.

.2 Apply enough water to ensure penetration to 50 mm (2’) depth. Control sprinkling to prevent wash-out, particularly on the sloped banks. ( Hand water, if necessary.)

.3 The Contractor is responsible for the first mowing of the newly sodded field with hand equipment, ( to ensure no ruts from heavy equipment are developed.) Rake and remove excess clippings from the site.

.4 Provide barricades or protection devices, until Final Completion to minimize damage from pedestrian and vehicular traffic.

.5 Repair and re-sod where necessary, to ensure uniform, dense growth of lawn and grade is kept uniform without foot prints.

3.4 Acceptance

.1 Areas will be accepted when the following conditions are met:

a) Roots of the sod have firmly established themselves into the growing medium.

b) Sodded areas shall be free of pests, weeds and diseases. Hand weed, where necessary.

.2 To fulfill the above requirements, it is anticipated the Contractor will maintain the new sod for approximately two weeks upon completion of sodding operations. This could include additional hand watering of newly sodded areas, ( weather dependant.)

.3 Pedestrian traffic through this area will not be permitted until the above

conditions have been met. Until that time, the Contractor is to barricade the area from use.
