This is done by delineating these areas and protecting them within a buffer system. This chapter provides detailed guidance on how to design and maintain effective buffer systems within a community. Three primary aquatic areas provide the foundation for the buffer system. They include the shoreline of a lake or estuary, a delineated wetland, or a stream channel. Some of the common delineation criteria for each aquatic area are shown in Table 21. Additional buffer width can be reserved around aquatic areas to provide further protection. These buffer areas may include sensitive habitats, steep slopes, floodplains and other important resource areas. considered for protection (see Table 19).

The remainder of this chapter explores thearchitecture of a buffer system, with a strongemphasis on how buffers can be applied toprotect urban streams. With some subtlerefinements, the same basic approach andconcepts can also be applied to shorelines andwetland areas.

Some Buffer Geometry and Terminology

To design an effective stream buffer system, it isimportant to understand spatial connectionsbetween the stream and its watershed. Anetwork of streams drain each watershed.Streams can be classified according to their orderin that network (Fig. 21). A stream that has notributaries or branches is defined as a first–orderstream. When two first–order streams combinetogether, a second–order stream is created, andso on. Headwater streams are defined as first–and second–order streams. Although they areshort in length and drain relatively small areas,these headwater streams comprise of roughly75% of the total stream and river mileage in theUnited States (see Table 22).

The next key concept is drainage density or thelength of stream channel per unit area. A regionwith steep topography, poor cover, and lesspermeable soils tends to have more streammileage than a region with less relief and morepermeable soils. Geomorphic research has shownthat drainage density is remarkably constantwithin the same physiographic region. Thus, formuch of the eastern US, a one–square–milewatershed often has a total stream channel length

of 1.4 miles (range 1.0–2.5).

Determining where a first–order stream actuallybegins in the landscape is not an easy matter. Thisis due to the complicated path that runoff followsto reach a stream channel. The total distancefrom the ridgetop (or watershed divide) to thestream channel is known as the overlandflowpath (Fig. 22). Typically, this distanceranges from 750 to 1,500 feet in many regions ofthe country. Runoff begins as “sheet flow”––theflow is very shallow and spread uniformly overthe land surface. Very quickly, however, thisuniform flow concentrates to form shallow andthen progressively deeper channels, usually within300 feet of the ridgetop (Ferguson and Debo1991). These channels only have running waterduring storm events and are known asintermittent channels.

At some point further downstream, groundwatersupplies running water to the channel on ayear–round basis––these streams are perennial.The transition from intermittent channel toperennial stream is not fixed. Indeed, it oftenmoves up or downstream from season to seasonand year to year, in response to changes in thelocal water table.

The cross–sectional area of a perennial streamchannel fixes that stream’s capacity to conveyrunoff. Typically, an undeveloped stream channelcan fully accommodate the peak discharge froma two–year storm event, but no more. When thepeak discharge rate exceeds the two–year stormevent, runoff volume exceeds the capacity of thechannel and must

spill over the banks into the adjacent floodplain oneither side of the channel (Fig. 23). By convention, thearea and height of the floodplain is defined using the100–year storm event. The runoff from this event isdetermined from the maximum rainfall that has aprobability of occurring once every 100 years. The widthof the floodplain tends to be narrower in headwaterstreams and much broader in higher order streams andrivers.

A developed watershed has a remarkably greater rateand volume of runoff for a given storm event than anundeveloped one (cf Chapter 2). As a consequence,both the cross–sectional area of the stream channel andthe elevation of the 100–year floodplain (area immersed

during the 100–year flood) are increased. In morepractical terms, the stream channel erodes, becomingwider and/or deeper. During extreme floods, a larger landarea is subject to flooding after development (see Fig. 23).The severity of the response is a direct function of theamount of impervious cover that is created in thewatershed.

The geometry of streams and their floodplains is formedby rainfall and runoff. After development, more rainfall istranslated into runoff, and the geometry of both the streamand the floodplain changes. A clear understanding of thedynamics of these variables is essential in designing aneffective stream buffer scheme.

Benefits of Forested Stream Buffers

A wide forest buffer is an essential component ofany local stream protection strategy. Its primaryvalue is to physically protect the stream channelfrom future disturbance or encroachment. Anetwork of buffers act as the right–of–way for astream and functions as an integral part of thestream ecosystem. But a stream buffer alsoprovides many other important benefits thatcontribute to the quality of the stream and theadjacent community. The many benefits of streambuffers are summarized in Table 23. In manyregions, these benefits are amplified when thestreamside zone is kept in a forested condition.Recent research indicates that forested streambuffers provide the following benefits:

1. Reduced watershed imperviousness

The use of stream buffers can indirectly reduce asite’s impervious cover in several ways. To beginwith, land within the stream buffer networkcannot be developed, and thus will not haveimpervious cover. How much land does thestream buffer network consume? This questioncan be answered at the landscape scale byexamining the drainage density relationship. In theEast Coast, for example, a watershed with adrainage area of one square mile will have a totalstream channel length of about 1.4 miles, onaverage.

8. Increased pollutant removal. Buffers can provide effective pollutant removal for development located within 150 feet of the buffer boundary, when designed properly.

9. Foundation for present or future greenways. Linear nature of the buffer provides for connected open space, allowing pedestrians and bikes to movemore efficiently through a community. (ƒ)

10. Provides food and habitat for wildlife. Leaf litter is the base food source for many stream ecosystems; forests also provides woody debris that createscover and habitat structure for aquatic insects and fish. (ƒ)

11. Mitigates stream warming. Shading by the forest canopy prevents further stream warming in urban watersheds. (ƒ)

12. Protection of associated wetlands . A wide stream buffer can include riverine and palustrine wetlands that are frequently found near streams.

13. Prevent disturbance to steep slopes. Removing construction activity from these sensitive areas are the best way to prevent severe rates of soil erosion (ƒ)

14. Preserves important terrestrial habitat. Riparian corridors are important transition zones, rich in species. A mile of stream buffer can provide 25-40acres of habitat areas(ƒ)

15. Corridors for conservation. Unbroken stream buffers provide “highways” for migrations of plant and animal populations.(ƒ)

16. Essential habitat for amphibians. Amphibians require both aquatic and terrestrial habitats and are dependent on riparian environments to complete theirlife cycle (ƒ)

17. Fewer barriers to fish migration. Chances for migrating fish are improved when stream crossings are prevented or carefully planned.

18. Discourages excessive storm drain enclosures/channel hardening. Prevents increases in runoff from impervious cover and subsequent eroding oroverflowing of headwater streams.

19. Provides space for stormwater ponds . When properly placed, structural BMPs within the buffer can be an ideal location to remove pollutants andcontrol flows from urban areas.

20. Allowance for future restoration. Even a modest buffer provides space and access for future stream restoration, bank stabilization, or reforestation.

If a 100–ft wide stream buffer is reserved oneach side of the channel, then the buffer wouldconsume about 34 ac or about 5% of the totalwatershed area. If the zoning density was fixed,this would reduce impervious cover by a likeamount. While this represents a modest reductionin total imperviousness at a site, it can becombined with other techniques to achieve asignificant watershed reduction.

The second way that stream buffers reduceimperviousness is by forcing a more clustered andcompact development pattern. The linear natureof the stream buffer, along with the limitations onroadway crossings, make it nearly impossible touse traditional roadway networks that createneedless imperviousness area. (see Chapter 6).Shorter and more economical branching orcul–de–sac road networks are often morefeasible residential street designs.

2. Distance from imperviousness to thestream

A stream buffer is also useful in that it increasesthe distance from impervious areas to the stream.This allows more room to locate effectivestormwater BMPs, or to utilize innovativestormwater conveyance systems, such asbiofilters. In rural areas, the separation distancehelps to improve the performance of on–siteseptic systems. The greater the distance thatsubsurface septic system effluent must travel, thegreater the chance that soils and plants willremove harmful bacteria and nutrients.

3. Reduce small drainage complaints

Probably the most frequent complaints fielded bylocal public works agencies concern smallresidential drainage problems––backyardflooding, streambank erosion, standing water,clogged culverts and the like. The common rootof these problems is that property is simplylocated too close to a stream. By reserving aforested buffer that creates more distancebetween the residents and the stream, the numberof complaints should drop, giving much neededrelief to local governments from thistime–consuming maintenance burden.

Forest buffers, particularly those with a deeplayer of organic matter, can have 10 times morerunoff storage capacity and infiltration capacitythan a grass or turf area (CBP 1993). This“spongy” quality helps the buffer forests absorbmore runoff and should also help reduce drainageproblems.

4. Space in which streams can move laterallyover time

In a very real sense, a buffer is the right–of–wayfor a stream, and allows for the physicalprotection of the stream channel.

Stream channel location is not constant over time.Over the course of decades, the actual positionof the channel may wander back and forth acrossthe floodplain (Leopold et al. 1964). Some lateralmovement of the stream can and should beexpected, even in undeveloped streams.

In urban streams, the lateral movement becomesmore rapid and unpredictable. To begin with,most urban stream channels have not yet adjustedto the increased frequency and rate ofstormwater runoff generated by upstreamdevelopment. It is therefore quite common for anurban stream to double or triple channel widthbefore reaching a new equilibrium. Fallen treesfrom undercut banks can further accelerate theprocess, resulting in localized widening as muchas five times the pre-development channel width.

Clearly, the existence of a wide buffer gives theurban stream the room to move laterally or widenover time, without threatening structures ordeveloped property. When a stream is givenroom to move, communities often spend fewerdollars for expensive channel protection andstabilization methods that are required to keep achannel in a fixed place.

5. Effective flood insurance

Small stream flooding is a common occurrence inurban areas, even during moderate storm events.Floodwaters can extend far from the channel anddamage property and structures. However, whenthe post-development 100–year floodplain iswholly contained within a stream buffer, the risksof flood damage are greatly reduced. Becausestructures are kept away from the floodplain, theydo not need to be “floodproofed” with expensiveprotective measures. Thus a stream buffer is aneffective form of flood insurance for a communityand conforms with federal flood insurancerequirements (FEMA).

In addition, the dedication of a buffer provides

for temporary storage of floodwaters inheadwater streams (for extreme floods greaterthan the two year event), thereby reducing theheight of the flood crest for downstream areas(Karr and Schlosser 1978).

6. Protection against streambank erosion

A deep network of tree roots consolidate thesoils of the floodplain, making them moreresistant to erosive forces of runoff. The shallowroots of grass, on the other hand, provide littleresistance to bank erosion (Karr and Schlosser1978). When deep tree roots are absent, the toeof the streambank is very susceptible to rapiderosion. The bank then begins to undercut, andblocks of turf at the top of the bank begin toslump into the channel (Sweeney 1993). Theseeroded sediments are deposited in the channel,where they can smother the existing streamsubstrate. Also, deposited sediments temporarilyreduce the cross–sectional area of the channel,thus leading to a new and more severe phase ofbank erosion.

7. Increased property values

Forested buffers create a more natural andattractive sense of community. A national surveyof 36 stream buffer program administratorsindicated that stream buffers were perceived tohave either a neutral or positive impact onadjacent property values (Heraty 1993). None ofthe respondents indicated that buffers had anegative impact on land value.

This finding is consistent with numerous otherstudies that have found that greenways and

buffers increase property values of adjacenthomes (Correl et al. 1978, Seattle Office ofPlanning (1987) and Mazour (1988).

8. Increased pollutant removal

Urban stream buffers have the potential toremove pollutants that move through them, ingroundwater or sheet flow. Soils and vegetationwithin the buffer act as a living filter. Pollutants instormwater settle out, adsorb to soil, or are takenup by vegetation. Performance monitoring studiessuggest that stream buffers can remove themajority of sediment and trace metals that aredelivered to them, as long as even and uniformsheet flow is maintained across the outer edge ofthe buffer. Removal of phosphorus and nitrogenappears to be modest, and more unreliable (seeTable 28).

It is important to note that stream buffers cannotbe relied on as the sole urban BMP at mostdevelopment sites. Most of the runoff producedin urban areas concentrates too quickly to beeffectively treated by a buffer, and other, morestructural, BMPs must still be installed (e.g.,stormwater ponds, wetland infiltration or filteringsystem).

9. A foundation for greenways

At the landscape scale, a buffer networkprovides a connected system of open space thatcan link a community together. A buffer serves asthe foundation of a greenway that can meet therecreational needs of adjacent urban residents.The greenway can contain foot trails, which allowfor easier pedestrian movement through the

community or to provide an opportunity fornature enjoyment. Surveys by Adams (1994)indicate that 58% of suburban residents activelyengage in wildlife watching and nature enjoymentnear their homes. Residents also exhibit a keendesire to live next to natural areas and are willingto pay a premium for homes located next to them(Adams et al. 1983)

Where the stream buffer is wide enough andpublicly owned, it can also serve as the site of abikeway that links the community together.Because bikepaths are impervious and requireclearing of vegetation, they should be carefullylocated in the outer zone of a buffer.

10. Provision of food, cover, and streamhabitat

Riparian forests are an integral part of the streamecosystem. Trees supply the stream with leaflitter, which constitutes the major source ofenergy in headwater streams in most parts of thecountry. Leaf litter and woody debris literallyform the base of the food chain. Bacteria andfungi colonize these packs of organic matter andare in turn consumed by aquatic insects, whichare eaten by other insects and fish. Thus theannual leaf fall supplied from a forested buffer isthe key energy source for every trophic level inthe stream.

The adjacent forests also supply large woodydebris to the stream channel. These logs,branches and twigs create more structuralcomplexity within the channel and thus morehabitat area for aquatic insects. The woodymaterial often forms natural debris dams that help

a headwater stream retain more of its nutrientsand organic matter. For example, Sweeney(1993) noted that forested streams had 17 timesas much wetted benthic habitat area asunforested streams. In addition, forested streamshad eight times as much woody debris and 38times as much leaf litter as unforested streams.The presence of a forest buffer also appears todirectly influence the quality and the diversity ofthe stream community. Both Steedman (1988)and Sweeney (1993) have extensivelydocumented that a stream insect communitydeclines in total area and diversity when the forestcover is lost.

11. Stream warming is mitigated

Mature forests provide shade that keeps streamtemperatures from rising during the summermonths. When the forest cover is removed, anurban stream will invariably heat up by as muchas 5–10 degrees F (Greene 1950, Pluhowski1970, Sweeney 1993, and Galli 1991). Atemperature increase of this magnitude canseriously threaten the survival of trout and othersalmonid fish species, as well, as well as somesensitive aquatic insects, such as stoneflies.

12. Wetland protection

Wetlands often are the surface expression of

the underlying water table. Some type of wetlandis almost always found where the water table is ator near the surface. Likewise, perennial streamsare also an expression of the water table whereit meets the lowest point in the local landscape.As such, streams are almost always associated

with certain types of riverine and palustrinewetlands. Located near the stream channel or inthe adjacent floodplain, these wetlands are oftenforested and of high functional quality. Clearly, byreserving a wide stream buffer, it is possible tomore systematically protect these importantwetlands from disturbance. In addition, extendingthe buffer network beyond the limits of a wetlandprovides a more effective transition zone betweenthe wetland and upland urban areas. 13. Prevention of soil erosion from steepslopes

Steep slopes and streams are often located neareach other, as the stream has historically been theerosional agent that creates sharp relief. Steepslopes pose the greatest risk of sediment deliveryduring construction. The combination ofsteepness and proximity to the stream make theseslopes the most susceptible areas for erosion atany development site. Sediment loads from theseareas can be exceptionally high, even when thebest erosion and sediment control techniques areapplied. Where stream buffers are expanded tofully include all adjacent steep slopes and therebyprevent their clearing and disturbance, they canbe a very effective component of an erosion andsediment control plan.

14. Preservation of wildlife habitat

A continuous one–mile stream buffer that extends100 ft outward on either side of the channelpreserves about 25 ac of contiguous stream orriverine habitat. A stream buffer acts as a habitat“island,” a transition zone between aquatic andterrestrial environments. Most ecologists have

concluded that the total number of species ofbirds, mammals, reptiles, and amphibians, isstrongly related to the area of a habitat island––asit gets larger, more species are recorded.

Studies of wildlife diversity in urban habitatislands suggest that a surprising number of bird,mammal and reptile species can be found incontiguous habitat island that are 25 ac or greaterin area (Table 24).

15. Creation of wildlife corridors In addition to their intrinsic value as wildlifehabitat, stream buffers also create potentialcorridors for wildlife travel between larger habitatislands in the urban landscape (e.g., urban forestpreserves, natural wetland complexes,stormwater wetlands and community parks).Not only do stream buffers increase theeffective size of the total habitat island, but theyprovide source populations of organisms forfuture recolonization. To be most effective, awildlife corridor should be 300–600 ft wide(Desbonnet et al. 1994).

16. Critical amphibian habitat

Amphibians have a terrestrial and aquatic lifecycle and require both habitats in close

proximity. Thus amphibian species are commonlyfound in greatest abundance within the streambuffer zone. Tree frogs, salamanders, springpeepers, and other species create the diversemusical chorus heard in thespring and summer riverine woods. Amphibiansappear to be undergoing a world–wide decline inabundance, particularly in urban and suburbanareas (Minton 1968, Cochran 1989). A numberof researchers have noted the importance ofstream buffers to support amphibian populationsin urban areas.

17. Barriers to fish migration are discouraged

Stream buffer programs regulate the manner inwhich the stream channel is crossed by highways,utilities, and other linear development. Whenutilized properly, a stream buffer regulation canprevent the creation of unintentional barriers toupstream fish migration, such as roadwayculverts, grade control structures, hardened utilitycrossings and the like.

18. Excessive storm drain enclosures/channelhardening avoided

Headwater streams are exceptionally vulnerableto physical elimination in urban watersheds. Onceimpervious cover in the watershed exceeds 30 to60%, stormwater flow becomes so great thatmany natural channels cannot withstand themwithout severely eroding or overflowing (cfChapter 2). As a consequence, many openchannels and headwater streams are enclosed instorm drains to more quickly route stormwaterrunoff off the site and prevent temporary floodingof streets and parking lots.

The loss of headwater streams can be striking. Insome highly developed urban areas, the majorityof headwater streams have been enclosed bystorm drains or hardened channels. While astream buffer may not fully protect an urbanstream channel from erosion (upstream BMPsare still needed), it may reduce the need forcostly bank and channel protection techniques.

19. Good sites provided for stormwater ponds

A buffer system provides an excellent frameworkwithin which stormwater BMPs can beintegrated. It is the most effective and economicalplace in the landscape to provide stormwaterquantity and quality control. When carefullylocated and designed, these ponds can maintainthe quality of the stream and the buffer network.

20. Allowance for future restoration

Stream buffers are a prerequisite for futurewatershed restoration. Most urban watershedrestorationists have discovered that the bestlocations and opportunities for restorationprojects are along the stream buffer. Thisrelatively narrow strip of land provides numeroussites for riparian reforestation, access for streamrestoration projects, and many candidatelocations for stormwater retrofit projects. At itsmost fundamental level, the reservation of astream buffer enables a community to fix in thefuture some of the mistakes it may have made inthe past. Without a pre–existing stream buffer,such restoration is seldom possible.

Local Experience with Buffer Programs

Communities have learned that they must gobeyond merely drawing a line on a map duringthe development review process. They must alsoactively manage and protect a stream both duringthe construction process and over time in thechanging landscape.

Our most detailed knowledge about the quality oflocal buffer programs comes from a detailednational survey of 36 local and state programs byHeraty (1993) The responses from planners andengineers suggest that most local buffer programscould stand significant improvement in how theyare administered. Indeed, respondents in nearly25% of all programs surveyed have alreadyrecognized this need and have revisited theirbuffer programs to improve their effectiveness.The survey results are supplied in Appendix B,and some of the key findings are provided below:

1. Buffer boundaries are largely invisible tolocal governments, contractors and residents.

Stream buffer boundaries may be drawn ondevelopment plans, but they often becomeinvisible after the plans are approved. The surveyindicated that over two–thirds of all communitiesthat required buffers did not record theirpresence on their official maps. Without buffermaps, local governments cannot systematicallyinspect or manage their network of buffers. Inaddition, less than half of all communities requiredthat the buffer boundaries be shown onconstruction plans, such as clearing and gradingplans or erosion and sediment control plans. Theabsence of buffer limits on construction stage

plans increase the risk that contractors willencroach upon or disturb the buffer during theconstruction phase.

The survey also revealed that 60% of propertyowners were largely unaware of the boundary orpurpose of the stream buffer in their community.This ignorance could generally be traced to thelack of active notification by local governmentsabout the boundaries of buffers to new propertyowners.

2. Buffers are subject to extensiveencroachment in urban areas.

When boundaries are not well defined, buffersbecome an urban “commons” area, subject toencroachment pressures from adjacent propertyowners and other users. The pressures beginduring the construction stage, where a buffer maybe subject to illegal clearing and grading,compaction of soils, tree damage from heavyequipment, and sediment impacts due to poorerosion controls elsewhere on the site. Corish(1995) notes that over 50% of communitiessurveyed reported that site clearing and gradingoperations frequently do not protect preservevegetated areas, and that 25% of all buffers arematerially damaged during construction. Corish’sfinding is comparable to Heraty's, indicating that26% of jurisdiction report frequent bufferencroachment during construction. Encroachment pressures continue well after thesite has been developed. Some indication of theextent of these pressures can be gleaned fromCooke's 1991 study of 21 urban wetland buffersin the State of Washington (Table 25).

The buffers ranged in age from two to eight years.Ninety–five percent of the buffers showed visiblesigns of encroachment or disturbance, includingmowing, dumping of yard wastes, tree removal,trails, and erosion. Those buffers located next toresidential areas were often cleared of nativevegetation and replaced with lawns (often withhigh fertilizer input).

3. Few jurisdictions have effective buffereducation programs

The lack of awareness about stream buffers is notsurprising since only 15% of all programs markedor posted buffer boundaries. Usually the onlynotification given about the existence of bufferswas a one–time legal disclosure, such asrecordation on the property deed, language in ahomeowner association charter, or a writtendisclosure upon resale. Surprisingly, 47% of allbuffer programs had no specific notificationprogram for individual property owners at all.

Increasingly, communities are experimenting withnew and innovative techniques to educate theirresidents about buffers, including pamphlets,boundary markers, buffer walks, regularhomeowner's association meetings, and individualmaintenance agreements. One promisingapproach involves enlisting residents to plantnative trees and shrubs in their backyards toattract wildlife and save water. This“bufferscaping” effort not only increases the widthof the buffer, but actively involves interestedresidents in the stewardship of the buffer and thestream environment.

4. Allowable and unallowable uses areseldom defined

In addition to the inexorable pressure fromadjacent land owners, a buffer planner mustreconcile what uses are to be allowed or deniedwithin the buffer zone. Potential uses are biketrails, footpaths, BMPs, utility crossings,campgrounds, athletic fields, playgrounds,gazebos, decks, streambank stabilization

Many communities have revisited their streambuffer ordinance to make better decisions on theuse of the buffer. In general, uses that createimpervious surfaces, require extensive clearing,generate pollutants, or that can be locatedelsewhere are not allowed (MWCOG 1995).Uses that create minimal or temporary changes to

the buffer, such as foot paths or stormwaterBMPs, or that cannot be located away from thestream (utility crossings, water–dependentaccess) are generally allowed.

5. Few jurisdictions specified mature forestas a vegetative target

Few jurisdictions clearly specify a vegetative goalof mature forest for their stream buffer program.Heraty (1993) found that over two–thirds of allprograms simply required that pre-developmentvegetative cover be maintained, regardless ofwhether it was trees, weeds, or turf. Indeed,20% of all buffer programs failed to specify anyvegetative goal at all. Given the importance ofriparian forests in the ecology of headwaterstreams, the adoption of a specific vegetativetarget for the stream buffer would be wise.

6. Accuracy of buffer delineation seldomconfirmed in the field

Local programs encounter a number of difficultiesin accurately delineating buffer boundaries atindividual development sites. For example,Heraty (1993) reported that nearly 50% of thebuffer programs find that buffer widths are notmeasured from an appropriate baseline, or thatconsultants do not properly expand the bufferwidth to pick up floodplains, wetlands or criticalhabitats specified in their ordinance. One–third ofthe governments indicate that consultants fail todraw buffer boundaries on site plans orconstruction drawings, even when this has beenmandated. Some 30% of all respondentsindicated that they did not have the time orresources to check the validity of the developer's

buffer delineation on the plans at all. It isspeculated that an even greater number failed toconfirm stream and buffer boundaries in the field.

Twenty percent of jurisdictions had no mechanismto inform the contractor about buffer boundariesduring construction. On the positive side, Corish(1995) reported that 75% of respondents didinspect the condition of the buffer at least onceafter construction had begun. In general, localgovernments consistently noted problems duringthe construction stage. For example, respondentsreported that erosion control structures were notproperly maintained (67%), cleared areas werepoorly revegetated (56%), cleared slopes werenot adequately stabilized (44%), cleared land wasexposed for longer than the prescribed maximumtime period (44%) and that soils were heavilycompacted (28%). Indeed, only a mere 18% of alljurisdictions surveys concluded that “few problemswere encountered in implementation” (Corish1995).

7. Most buffers remain in private ownership

The vast majority of buffers (90%) remain inprivate ownership after development (Heraty1993). Access and use is solely restricted to theproperty owner. In some subdivisions, the bufferis considered semi–private open space and isdedicated to a homeowner association, whichmanages the buffer and can control or restrictaccess. Only 10% of all communities require thatthe buffer be public open space, and dedicated tothe local parks authority. In privately ownedbuffers, use restrictions are primarily spelled out inthe property deed of record. A formalconservation easement is utilized in only about

11% of cases.

Residents appear to broadly support privatelyowned stream buffer programs in theircommunity. Over 80% of local governmentsagreed with the statement “that a majority of ourcitizens think that the community is better offhaving stream buffers,” and that the streambuffers had a neutral (54%) or positive (40%)influence on adjacent land values.

This is not to imply that buffers are popular withall residents. A sampling of the most frequentlycited complaints about buffers from residentsinclude:

G the buffer system gives strangers accessto my backyard

G the buffer is a breach of my property rights

G access along the stream buffer is deniedG vagrants and teenagers use the buffer

for illegal purposesG trees obstruct water or scenic viewsG I am taxed on land that I cannot developG buffers are a source of varmints, weeds,

ticks, feral dogs, etc.G the process for adding decks, sheds,

gazebos is too restrictive G the buffer is in an unsightly condition

during early stages of forest growth G unfair to those who owned land prior

to the buffer law

By and large, resident complaints about streambuffers are uncommon and can be directlyaddressed through a concerted educationprogram to inform residents of the many benefits

buffers provide, as well as clear enforcement oftrespassing laws. Interestingly, many communitiesoften receive an equal number of complaints fromresidents that demand better stewardship of thebuffer system.

8. The stream buffer program needs to beresponsive to the interests of the developmentcommunity

Although the stream buffer system is not likely toconsume more than 5% of the land area of awatershed (much of which cannot be developedanyway because it is also a floodplain, wetland, orsteep slope), it can consume a much largerproportion of an individual development site.Clearly, the potential exists to generate complaintsabout excessive regulation and property rightissues. While only one community reporteddeveloper complaints that stream buffers actuallystifled development activity (Heraty 1993), thedevelopment community does express strongconcerns in several areas:

G inflexible buffer delineationG inconsistent application of buffer guidelinesG lengthy approval processG lost lots that could have been developedG extra costs for development submittal G buffer use are too restrictive (e.g., stormwater BMPS are not allowed)While the philosophical issue of property rightsinfringement can never be satisfactorily resolvedfor all developers, local governments areencouraged to craft their programs to beresponsive to the economic needs of thedevelopment community. After all, the primary

purpose of the stream buffer program is to placesome distance between development and thestream—and not to discourage developmentfrom taking place.

Pollutant Removal Capability of StreamBuffers

While an urban stream buffer provides manyimpressive benefits, it must be emphasized thatthey often have a limited capability to removepollutants borne in urban stormwater runoff. Thisis a surprising conclusion for a number ofreasons. First, many communities have citedpollutant removal as the key justification forestablishing buffer programs (Heraty 1993).Second, high removal rates have been frequentlyreported for forested buffers in rural areas(Desbonnet et al. 1994). Why, then, do streambuffers have limited value to remove pollutants instormwater runoff?

The primary reason relates to how flow reachesthe stream buffer in urban watersheds. Buffersrequire the presence of sheet flow to be effective.Once flow concentrates to form a channel, iteffectively short–circuits the buffer and notreatment occurs. Unfortunately, flow usuallyconcentrates within a short distance in urbanareas. It is doubtful, for example, whethersheetflow conditions can be maintained over adistance of:

G 150 ft for pervious areas G 75 ft for impervious areas

This constraint sharply reduces the percentage ofa watershed that can be effectively treated by a

Due to the rapid concentration of flow, most runoff enters the buffer in an open channel or stormdrain pipe. On awatershed scale, a buffer only receives 10% of the sheetflow.

stream buffer. This can be illustrated using thedrainage density example that was used earlier. Ifwe assume that (a) 1.4 miles of stream exist in aone square mile watershed, (b) a 100–ft bufferexists on each side of the channel and (c) that eachside of the buffer serves the maximum limit of 150ft of contributing pervious area, we would be ableto directly treat about 50 ac total of pervious area.This acreage represents only 8% of the

total drainage area to the stream (or 13% if weinclude the area in the stream buffer) This impliesthat the runoff from the remaining 87% of thetotal drainage area will be delivered to the streamin one of three ways:

G in an open channelG within an enclosed stormdrain pipe, orG a stabilized outfall channel from a BMP

In each case, the channel or pipe will cross thestream buffer before it discharges into the steam(Fig. 24) In addition, some kind of structuralBMP will still be needed to provide water qualitycontrol for the runoff before it reaches the stream.

The four basic options for providing stormwaterquality control include:

Each practice must be fully integrated within thestream buffer system in order to maximizetreatment efficiency and ensure that the largestpossible contributing drainage area is captured.

Urban Vegetative Treatment Systems

Under some circumstances, an urban streambuffer can be employed as a vegetative filter totreat the quality of stormwater runoff. Indeed, awide variety of vegetative filters have been usedfor this purpose. While each of these filters relieson the use of vegetation to slow runoff velocityand filter out pollutants, not all of them arecomparable. Consequently, their design andpollutant removal performance are often quitedifferent. The differences are often amplified bythe diverse and conflicting terminology used todescribe urban vegetative filter systems (Table27).

For example, as many as 15 different names havebeen given to these practices, and these are oftenused interchangeably. In reality, however, mostvegetative filters can be grouped in one of threegeneral categories:

Open Channels: designed to filter out pollutantsin stormwater as they are conveyed through anopen, grassy channel. Sometimes known asswales, the channel conveys stormwater runoffacross the stream buffer and discharges directlyinto the stream. From a pollutant removalstandpoint, there are four basic design options forthe open channel, which are described in detail inChapter 6 (Page 157).

Filter strips: designed as a grass filter thataccepts sheetflow from impervious or perviousareas to pretreat it before it is delivered to astream buffer or downstream BMP. As notedbefore, urban filter strips can treat runoff over arelatively short distance (usually 75 to 150 feet).Some design guidance for urban filter strips canbe found on page 116.

Forested buffers: primarily designed to protectstreams; forest areas may provide sometreatment of stormwater runoff from nearbypervious or impervious areas but this is only asecondary benefit. In most cases, stormwaterrunoff from upland areas crosses the forestedstream buffer in the form of an open channel oran enclosed storm drain. The pollutant removalbenefit of stream buffers can be more significantin low-relief coastal areas, where groundwaterinteraction is strong.

Performance of urban vegetative practices:Our current knowledge about the pollutantremoval capability of each of the three categoriesof urban vegetative practices is summarized inTable 28, and is described below:

Open Channels: the performance of grassedopen channels has been reasonably well studiedin a wide number of environments around thecountry. The studies indicate that grassedchannels have a high capability to reducesediment, hydrocarbon and metals in mostsituations (>50%). However, their ability toremove phosphorus and nitrogen is much morelimited and unreliable, with removal ratesaveraging only 10 to 50%. Grassed channelshave shown little capability to reduce bacteria,chlorides or nitrate, with zero or negative removalrates frequently reported.

Filter strips: only one study has assessed thecapability of a grass filter strip to treat urbanstormwater runoff. Yu et al. (1992) reportedmoderate to high removal rates for a 150–ft stripthat treated runoff from a large parking lot, butmediocre performance in a shorter, 75–ft strip.

Stream buffers: at the present time, there is noperformance data on the effectiveness of foreststream buffers to treat urban stormwater runoff.Some indication of their potential effectivenesscan be inferred from the performance of forestand grass buffers from agricultural areas.

While grass channels generally are reported to have a high capability to remove sediment, their ability to removenutrients varies substantially, often due to soil, slope and other factors.

The moderate to high pollutant removal observedin rural and agricultural buffersappears to be due to the relatively slow transportof pollutants across the buffer in sheet flow orshallow groundwater flow. In either case, therelatively slow movement of

water gives soil, roots and microbes more time totrap or remove pollutants. Desbonnet et al.(1994) recently reviewed over 35 monitoringstudies that investigated the pollutant removalperformance of rural and agricultural buffers (Fig.25).

Although considerable variation was observedamong the studies, several performance trendsemerged:

G Buffers were generally capable of removing75% of the suspended sediment delivered tothem in surface runoff, even when the grassbuffer was as narrow as 25 ft.

G Removal of nitrogen and phosphorus insurface runoff seldom exceeded 50 or 60%,even in widest buffers monitored. Furtherincreases in nutrient removal required thatbuffers extend 300 to 600 ft long, a ratherimpractical length.

G Removal of nutrients in subsurface orgroundwater flow was very inconsistent.Under ideal site conditions—poorly drainedand organic rich soils, deep root systems andgroundwater flow within two to six feet of thesurface—buffers exhibited exceptionalremoval of nitrate– nitrogen—often 90% ormore. When such conditions exist, bufferscan be very useful in reducing the nitrogeneffluent from rural septic systems.

In general, most researchers consider agriculturalbuffers to be a useful BMP, but only when theyare combined with other practices (Magette et al.1989). It is also widely recognized that manyagricultural buffers fail to perform as designedafter they are installed in the field (Dillaha et al.1989). Field surveys indicate that manyagricultural buffers lack good vegetative cover,are subject to excessive sediment deposition, orare short–circuited by channels formed byconcentrated flow.

Summary: Potential Pollutant RemovalCapability of Urban Stream Buffers.

On the basis of performance data from relatedvegetative systems, it is possible to estimate thepollutant removal capability of an urban streambuffer (i.e., explicitly designed to treat stormwaterusing the design procedure outlined in BufferCriteria 7). The hybrid of the grass strip in theouter zone and the forested buffer in the middleand streamside zone has the potential to achievethe following removal rates:

The ability of a particular buffer to actuallyachieve these rates depends on manysite–specific factors that are outlined in Jordan(1995). The design procedure outlined in Criteria7 is intended to restrict the use of the streambuffers for stormwater treatment only to thoseconditions where site–specific factors assurereliable pollutant removal (Table 29). Criteria 1. Minimum total buffer width.

Most local buffer criteria consist of a singlerequirement–that the buffer be a fixed anduniform width from the stream channel. Urbanstream buffers range from 20 to 200 ft in widthon each side of the stream according to a nationalsurvey of 36 local buffer programs, with a medianof 100 ft (Heraty 1993). Most jurisdictionsarrived at their buffer width requirement byborrowing other state and local criteria, local

Three lateral zones comprise the foundation of an effective urban stream buffer zone. The width, function, managementand vegetative target vary by zone.

experience, and, finally, through politicalcompromise during the buffer adoption process.Most communities require that buffers to fullyincorporate all lands within the 100–yr floodplain,and others may extend the buffer to pick upadjacent wetlands, steep slopes or critical habitatareas.

In general, a minimum base width of at least 100feet is recommended to provide adequate streamprotection. In most regions of the country, thisrequirement translates to a buffer that is perhapsthree to five mature trees wide on each side ofthe channel.

Criteria 2. Three–zone buffer system. Effectiveurban stream buffers divides the total buffer widthinto three lateral zones–– streamside–middle zoneand outer zone. Each zone performs a differentfunction, and has a different width, vegetativetarget and management scheme, as shown inFigure 26 and described below:

The streamside zone protects the physical andecological integrity of the stream ecosystem. Thevegetative target is mature riparian forest that canprovide shade, leaf litter, woody debris anderosion protection for the stream. The minimumwidth is 25 ft from each stream bank—about thedistance of one or two mature trees from thestreambank.

Land use is highly restricted—limited tostormwater channels, footpaths, and a few utilityor roadway crossings.

The middle zone extends from the outwardboundary of the streamside zone, and varies inwidth, depending on stream order, the extent ofthe 100–yr floodplain, adjacent steep slopes andprotected wetland areas. Its key functions are toprotect key components of the stream andprovide further distance between uplanddevelopment and the stream. The vegetativetarget for this zone is also mature forest, but someclearing may be allowed for stormwatermanagement, access, and recreational uses. Awider range of activities and uses are allowedwithin this zone, e.g., recreation, bike paths, andstormwater BMPs. The minimum width of themiddle zone is about 50 ft, but it may beexpanded based on stream order, slope or thepresence of critical habitats.

The outer zone is the buffer's buffer, anadditional 25 ft setback from the outward edge ofthe middle zone to the nearest permanentstructure. In most instances, it is a residentialbackyard. The vegetative target for the outerzone is usually turf or lawn, although the propertyowner is encouraged to plant trees and shrubs,and thus increase the total width of the buffer.Very few uses are restricted in this zone. Indeed,gardening, compost piles, yard wastes, and othercommon residential activities are promoted withinthe zone. The only major restrictions are noseptic systems cover, permanent structures, orimpervious cover.

Criteria 3. Pre–development vegetativetarget. The ultimate vegetative target for the streamsideand middle zone of most urban stream buffersshould be specified as the pre–developmentriparian plant community— usually mature forest.Notable exceptions include prairie streams of themidwest, or arroyos of the arid West, that mayhave a grass or shrub cover in the riparian zone.In general, the vegetative target should be basedon the natural vegetative community present inthe floodplain, as determined from referenceriparian zones. Turfgrass is allowed for the outercore of the buffer and is mandatory if the buffer isused as a stormwater treatment system (seeCriteria 7).

A vegetative target has several managementimplications. First, if the streamside zone does notcurrently meet its vegetative target, it should bemanaged to ultimately achieve it. For example, agrassy area should be allowed to grow into aforest over time. In some cases, activereforestation may be necessary to speed up thesuccessional process. Second, a vegetative targetimplies that the buffer will contain mostly nativespecies adapted to the floodplain. Thus,non–native or invasive tree, shrub and vinespecies should be avoided when revegetating thebuffer. Removal of exotic shrubs and vines (e.g.,multiflora rose or honey suckle) that are soprevalent along the buffer edge should beencouraged.

Criteria 4. Buffer expansion and contraction.Many communities require that the minimumwidth of the buffer be expanded under certainconditions. Thus, while the streamside and outer

The base width of the urban stream buffer may increase to pick up steep slopes, wetlands, and floodplains adjacentto the buffer. In addition, the base width often increases for larger streams and rivers.

zones of the buffer are fixed, the width of themiddle zone may vary. Specifically, the averagewidth of the middle zone can expanded toinclude:

Q the full extent of the 100–yr floodplainQ all undevelopable steep slopes (greater

than 25%)Q four additional ft of buffer for each one

percent increment of slope above 5% Q any adjacent delineated wetlands or

critical habitats

The middle zone also expands to protect streamsof higher order or quality in a downstreamdirection (Fig. 27). For example, the width of themiddle zone may increase from 50 ft (for first–a n d s e c o n d – o r d e r

streams) to 75 ft (for third– and fourth–orderstreams) and as much as 100 ft for fifth– orhigher order streams/rivers. The width of thebuffer can also be contracted in somecircumstances to accommodate unusual orhistorical development patterns, shallow lots,stream crossings, or stormwater ponds (seeCriteria 10).

Criteria 5. Buffer delineation. Three keydecisions must be made when delineating theboundaries of a buffer. At what mapping scalewill streams be defined? Where does the streambegin and the buffer end? And from what pointshould the inner edge of the buffer be measured?

Bluelines found on the U.S. Geological Survey’s 7.5 minute quad maps provide the initial basis for delineatingstreams; but final delineation often requires field confirmation.

The mapping unit: the traditional mapping scaleused to define the stream network are thebluelines present on USGS 7.5 minutequadrangle maps (1 inch=2,000 feet (Fig. 28)).It should be kept in mind that bluelines are only afirst approximation for delineating streams, as thisscale does not always reveal all first orderperennial streams or intermittent channels in thelandscape, or precisely mark the transitionbetween the two (MOPS 1993 and Leopold etal. 1964). Consequently, the actual location ofthe stream channel can only be confirmed in thefield. The origin of a first order stream is always amatter of contention. As a practical rule, theorigin of the stream can be defined as the pointwhere an intermittent stream forms a

distinct channel, as indicated by the presence ofan unvegetated streambed and high water marks.Other regions define the origin of a stream as theupper limit of running water during the wettestseason of the year.

Problems have frequently been reported insituations where the stream network has beenextensively modified by prior agricultural drainagepractices, such as ditching.

The inner edge of the buffer can be definedfrom the centerline of small first– orsecond–order streams. The accuracy of thismethod is questionable in higher order streamswith wider channels. Thus, the inner edge of thebuffer is measured from the top of eachstreambank for third and higher order streams.

Criteria 6. Buffer crossings. Two major goalsof a stream buffer network are to maintain anunbroken corridor of riparian forest and maintainthe upstream and downstream passage of fish inthe stream channel. From a practical standpoint,it is not always possible to try to meet both goalseverywhere along the stream buffer network.Some provision must be made for linear forms ofdevelopment that must cross the stream or thebuffer (Fig. 29), such as roads, bridges, fairways,underground utilities, enclosed storm drains oroutfall channels. It is still possible to minimize the impact to thecontinuity of the buffer network and fish passage.Performance criteria should specifically describethe conditions under which the stream or itsbuffers can be crossed. Some performancecriteria could include:

Crossing width: minimum width right of way toallow for maintenance access.

Crossing angle: direct right angles are preferredover oblique crossing angles, since they requireless clearing of the buffer.

Crossing frequency: only one road crossing isallowed within each subdivision, and no morethan one fairway crossing is allowed for every1,000 ft of buffer. Crossing elevation: all direct outfall channelsshould discharge at the invert elevation of thestream. Underground utility and pipe crossingsshould be located at least three feet below thestream invert, so that future channel erosion doesnot expose them, creating unintentional fish

barriers. All roadway crossings and culvertsshould be capable of passing the ultimate 100–yrflood event. Bridges should be used in lieu ofculverts when crossings require a 72 inch orgreater diameter pipe. The use of corrugatedmetal pipe for small stream crossings should beavoided, as these often tend to create fishbarriers. The use of slab, arch or box culverts aremuch better alternatives. Where possible, theculvert should be “bottomless” to ensure passageof water during dry weather periods (i.e., thenatural channel bottom should not be hardened orotherwise encased).

Criteria 7. Stormwater runoff. Buffers can bean important component of the stormwatertreatment system at a development site. Theycannot, however, treat all the stormwater runoffgenerated within a watershed (generally, a buffersystem can only treat runoff from less than 10%of the contributing watershed to the stream).Therefore, some kind of structural BMP must beinstalled to treat the quantity and quality andstormwater runoff from the remaining 90% of thewatershed. More often than not, the mostdesirable location for stormwater practices iswithin or adjacent to the stream buffer. Thefollowing guidance is recommended forintegrating stormwater BMPs into the buffer:

a. The use of buffers for stormwater treatment.The outer and middle zone of the stream buffermay be used as a combination grass/forest filterstrip under very limited circumstances (Fig. 30).For example:

Under some conditions, the stream buffer can be used to treat the quality of stormwater runoff from adjacent perviousand impervious areas.

overland flow from impervious areas and 150 ftof pervious areas (backyards or rooftop runoffdischarged to the backyard). The designer shouldcompute the maximum runoff velocity for both thesix–month and two–year storm designs from eachcontributing overland flow path, based on theslope, soil, and vegetative cover present. If thecomputation indicates that velocities will beerosive under either condition (greater than 3 fpsfor 6–mo storm, 5 fps for 2–yr storm), theallowable length of contributing flow should bereduced.

When the buffer receives flow directly from animpervious area, the designer should include curb

cuts or spacers so that runoff can be spreadevenly over the filter strip. The filter strip shouldbe located 3 to 6 inches below the pavementsurface to prevent sediment deposits fromblocking inflow to the filter strip. A narrow stonelayer at the pavement’s edge often works well toprotect the strip from eroding.

The stream buffer can only be accepted as astormwater filtering system if basic maintenancecan be assured, such as routine mowing of thegrass filter, and annual scraping and removal ofsediments that build up at the edge of theimpervious area and the grass filter. Theexistence of an enforceable maintenance

agreement that allows for public maintenanceinspection is also helpful.

b. Locating stormwater ponds and wetlands inthe buffer. A particularly difficult managementissue involves where stormwater ponds andwetlands be located in relation to the buffer?Should they be located inside or outside of thebuffer? If they are allowed within the buffer,where exactly should they be put? Some of thepossible options are outlined in Table 30 andFigure 31.

A number of good arguments can be made forlocating ponds and wetlands within the buffer oron the stream itself. Constructing ponds on or near the stream, for example, affords treatmentof the greatest possible drainage area treated ata topographic point that makes constructioneasier and cheaper. Second, ponds and wetlandsrequire the dry weather flow of a stream tomaintain water levels and prevent nuisanceconditions. Lastly, ponds and wetlands add agreater diversity of habitat types and structure,and can add to the total buffer width in somecases.

On the other hand, locating a pond or wetland inthe buffer can create environmental problems,including the localized clearing of trees, thesacrifice of stream channels above the BMP, thecreation of a barrier to fish migration,modification of existing wetlands, and streamwarming. Locating ponds and wetlands in bufferswill always be a balancing act. Given theeffectiveness of stormwater ponds and wetlandsin removing pollutants, it is generally notadvisable to completely prohibit their use withinthe buffer. It does make sense, however, tochoose pond and wetland sites carefully. In thisrespect, it is useful to consider possibleperformance criteria that restrict the use of pondsor wetlands to: G a maximum contributing area (e.g., 100

acres), orG the first 500 feet of perennial stream channel,

orG clearing of the streamside buffer zone only for

the outflow channel (if the pond is dischargingfrom the middle zone into the stream)

Ponds or wetlands canbe located only on (a) intermittent streams, (b) in the upper 300 feet of perennial streams, (c) off–line, (d) regionalponds or (e) laterally within the buffer. Alternatively, other BMPs can be located outside of the buffer; although theiroutfalls may still require a buffer crossing.

G off–line locations within the middle or outerzone of the buffer, or

G use ponds only to manage stormwater quantitywithin the buffer.

Criteria 8. Buffers during plan review andconstruction. The limits and uses of streambuffer systems should be well defined during eachstage of the development process—from initialplan review through construction. The followingsteps are helpful during the planning stage:

G require that the buffer be delineated onpreliminary and final concept plans

G verify the stream delineation in the fieldG check that buffer expansions are computed

and mapped properlyG check suitability of buffer for stormwater

treatmentG ensure that the other BMPs are properly

integrated in the buffer G examine any buffer crossings for problems

Stream buffers are vulnerable to disturbanceduring construction. Steps to preventencroachment during this stage include:

G mark buffer limits on all plans used duringconstruction (i.e., clearing and gradingplans, and erosion and sediment controlplans)

G conduct a preconstruction stakeout ofbuffers to define limit of disturbance

G mark the limit of disturbance with silt orsnow fence barriers, and signs to preventthe entry of construction equipment andstockpiling

G familiarize contractors with the limit of

disturbance during a preconstructionwalk–through.

Criteria 9. Buffer education and enforcement.The future integrity of a buffer system requires astrong education and enforcement program. Twoprimary goals of a buffer are to make the buffer“visible” to the community, and to encouragegreater buffer awareness and stewardship amongadjacent residents. Several simple steps that canaccomplish these goals include:

G mark the buffer boundaries with permanentsigns that describe allowable uses

G educate buffer owners about the benefits anduses of the buffer with pamphlets,streamwalks and meetings with homeownersassociations

G ensure that new owners are fully informedabout buffer limits/uses when property issold or transferred.

G engage residents in a buffer stewardshipprogram that includes reforestation andbackyard “bufferscaping” programs

G conduct annual bufferwalks to check onencroachment

The underlying theme of education is that mostencroachment problems reflect ignorance ratherthan contempt for the buffer system. Theawareness and education measures are intendedto increase the recognition of the buffer within thecommunity. Not all residents, however, willrespond to this effort, and some kind of limitedenforcement program may be necessary(Schueler 1994). This usually involves a series ofcorrection notices and site visits, with civil finesused as a last resort if compliance is notforthcoming. Some buffer ordinances have a

further enforcement option, whereby the full costof buffer restoration is charged as a property lien(Schueler 1994). A fair and full appeals processshould accompany any such enforcement action.

Criteria 10. Buffer flexibility. In most regionsof the country, a hundred foot buffer will takeabout 5% of the total land area in any givenwatershed out of production. While thisconstitutes a relatively modest land reserve at thewatershed scale, it can be a significant hardshipfor a landowner whose property is adjacent to astream. Many communities are legitimatelyconcerned that stream buffer requirements couldrepresent an uncompensated taking of privateproperty. These concerns can be eliminated if acommunity incorporates several simple measuresto ensure fairness and flexibility whenadministering its buffer program. As a generalrule, the intent of the buffer program is to modifythe location of development in relation to thestream but not its overall intensity. Some flexiblemeasures in the buffer ordinance include:

Maintaining buffers in private ownership.Buffer ordinances that retain property in privateownership generally are considered by the courtsto avoid the takings issue, as buffers providecompelling public safety, welfare and theenvironmental benefits to the community thatjustify partial restrictions on land use. Most bufferprograms meet the “rough proportionality” testrecently advanced by the Supreme Court forlocal land use regulation (Hornbach 1993).Indeed stream buffers are generally perceived tohave a neutral or positive impact on adjacentproperty value. The key point is that thereservation of the buffer cannot take away all

economically beneficial use for the property. Fourtechniques–buffer averaging, densitycompensation, variances and conservationeasements––can ensure that property owners arefully inoculated from this rare occurrence.

Buffer averaging. In this scheme, a communityprovides some flexibility in the width of the buffer.The basic concept is to permit the buffer tobecome narrower at some points along thestream (e.g., to allow for an existing structure orto recover a lost lot), as long as the averagewidth of the buffer meets the minimumrequirement (Fig. 32). In general, buffernarrowing is limited, such that the streamsidezone is not disturbed, and no new structures areallowed within the 100–yr floodplain (if this is agreater distance).

Density compensation. This scheme grants adeveloper a credit for additional densityelsewhere on the site, in compensation fordevelopable land that has been lost due to thebuffer requirement. Developable land is definedas the portion of buffer area remaining after the100–yr floodplain, wetland, and steep slopeareas have been subtracted. Credits are grantedwhen more than 5% of developable land isconsumed, using the formula shown in Table 31.The density credit is accommodated at thedevelopment site by allowing greater flexibility insetbacks, frontage distances or

This density compensation formula, loosely adaptedfrom Burns (1992), is based on the premise that thepurpose of a buffer is to maintain distance from thestream, and not to reduce allowable density.

minimum lot sizes to squeeze in “lost lots.”Cluster development also allows the developer torecover lots that are taken out of production dueto buffers and other requirements (cf Chapter 4). Variances. The buffer ordinance should haveprovisions that enable a existing property ownerto be granted a variance or waiver, if the ownercan demonstrate severe economic hardship orunique circumstances make it impossible to meetsome or all of the buffer requirements. The ownershould also have access to an administrativeappeals process should a request for a variancebe denied.

Conservation Easements. Landowners shouldbe afforded the option of protecting their portionof the buffer in a perpetual conservationeasement. The easement conditions the use of thebuffer, and can be donated to a land trust as acharitable contribution that can reduce anowner’s income tax burden. Alternatively, aneasement can be donated to a local government,in exchange for a reduction or elimination ofproperty tax on the parcel.

Resources Needed for Implementation

To implement a stream buffer program, acommunity will need to adopt an ordinance,develop technical criteria, and invest in additionalstaff resources and training.

The buffer ordinance should contain the tenperformance criteria described previously. Asuggested checklist for the ordinance can be

found in Table 32.

The real costs of instituting a buffer program forlocal government involve the extra staff andtraining time to conduct plan reviews, providetechnical assistance, field delineation,construction and ongoing buffer educationprograms. Seventy percent of the governmentssurveyed by Heraty (1993) indicated that theirstaff expended no more than 10% more time toreview buffers. In most cases, these economieswere achieved by combining plan review andinspection functions with existing environmentaldesign requirements. However, it should be notedthat many of these programs did not contain all ofthe performance criteria recommended in thischapter, so that the stated costs are probably onthe low side (i.e., many respondents did notdevote staff resources to delineate streamboundaries in the field).

The adoption of a buffer program also requiresan investment in training for the plan reviewer andthe consultant alike. Manuals, workshops,seminars and direct technical assistance areneeded to explain the new requirements to all theplayers in the land development business.

Lastly, very few local communities yet recognizethe critical importance of buffer maintenance tothe long–term success of their program. Arelatively small staff commitment (often just oneindividual) to systematically inspect the buffernetwork before and after construction, and towork with their residents to increase and maintainawareness about buffers, can be an excellentinvestment in local stream protection.
