Purpose 1
The purpose of this Chapter is to nominate trees and other vegetation for the purpose of clause 5.9 of the Shoalhaven Local Environment Plan (SLEP) 2014, which states: ‘A person must not ring bark, cut down, top, lop, remove, injure or wilfully destroy any tree to which this development control plan applies without development consent or council permit except as otherwise stated in clause 5.9 Preservation of Trees or Vegetation of the SLEP 2014.’ This Chapter also provides guidance for the removal or pruning of trees on land in the Shoalhaven Local Government Area (LGA). This Chapter outlines where and when approval is required under the Environmental Planning and Assessment (EP&A) Act, but is also subject to other legislation listed in Part 6. It also outlines the application process for approval. Advisory Note: In addition to the provisions outlined in this
Chapter, you must refer to the supporting maps.

This Chapter applies to all land within the Shoalhaven LGA. You should also refer to the Supporting Maps for further information.
Context 3
Appropriate management of trees on public, rural and residential land is essential to preserve the attractiveness and natural character of the City. Trees are part of the wider habitat that supports our native wildlife and birds. Controls also need to allow for the removal of unsafe or unsuitable trees and plan for their replacement to ensure the tree canopy is maintained into the future. Council embraces a whole of life approach to tree management in order to prevent exposure to unnecessary risk. Note: There are penalties for the illegal removal of
vegetation. People who clear trees and other vegetation without approval can face significant fines. People who illegally clear in areas covered by the Native Vegetation (NV) Act 2003 can face penalties of up to $1,100,000. Under the National Parks and Wildlife (NP&W) Act 1974 it is an offence to harm or pick threatened species, populations or Endangered Ecological Communities (EECs). The criminal prosecution penalty for harming species, populations or EEC is up to $220,000 or two years in prison or both.
Penalties for clearing threatened species, populations or ecological communities listed under the Environment Protection and Biodiversity Conservation (EPBC) Act 1999 are up to $550,000 for an individual and $5.5 million for a body corporate, or a criminal penalty of seven years imprisonment and/or a penalty of $46,200.

Objectives 4
The objectives are to:
i. Provide a consistent framework to respond to applications for approval to remove trees outside the development approval process.
ii. Recognise trees as a highly valued asset to maintain the visual appeal and amenity of the local area.
iii. Enable land owners to remove trees from their property that are a risk to buildings. iv. Control inappropriate ring-barking, cutting down, lopping, topping, removing,
injuring, poisoning or wilful destruction trees. v. Minimise the risk caused by destabilisation of foreshore, riparian or agricultural land. vi. Ensure that high value trees or trees in environmentally sensitive locations are
preserved unless assessed as a risk to life or property. vii. Recognise the intrinsic value of trees to support native birds and wildlife. viii. Facilitate the removal of undesirable exotics, noxious weeds, dangerous trees and
any other inappropriate plantings, and to replace these with suitable local indigenous species which will positively contribute to visual and environmental amenity and ecological sustainability.
ix. Avoid inappropriate removal of vegetation in paper subdivisions or areas where a Tree Preservation Order has historically applied.
Controls 5
5.1 Prescribed Trees or Vegetation for the Purpose of Clause 5.9 of the SLEP 2014
The following defines prescribed trees or vegetation which a person must not ringbark, cut down, top, lop remove, injure or wilfully destroy without the authority conferred by either a development consent or a Tree Removal Permit granted by Council. All species of trees or vegetation which occur: 1. In an area mapped by Chapter G4 ‘Supporting Maps’ that are not listed as an
exemption in Section 5.2.3; or 2. On publically owned land or; 3. In an urban area (residential, business, industrial, commercial, special use and RU5
Village zoned land) that meets the following criteria: a) More than 5 metres tall; or b) More than 5 metres wide across the foliage crown; or c) Having a trunk circumference of more than 500 mm measured 1 metre above
ground level; or d) Where the tree in question is a Toona Australis (Red Cedar); or e) Where the tree contains a hollow; or

f) Subject to a development consent condition or Section 88B restriction-as-to-user that prohibits tree clearing or removal of the tree in question; or
g) Part of an EEC; or h) Is not listed as an exemption in this Chapter.
5.2 When is Approval Required?
5.2.1 Heritage Items and Heritage Conservation areas None of the exemptions listed in this Chapter apply to Heritage listed trees. Approval is always required by a Development Application (DA) except where specifically exempt by clause 5.10(3) of the SLEP 2014.
5.2.2 Urban Areas and Trees and Vegetation within the Curtilage of a Dwelling in a Non-urban Area
Note: An urban area for the purpose of this Chapter is any Residential, Business, Commercial, Industrial, Special Use and RU5 Village Zones.
In Urban areas, if more than ten (10) trees require removal, a development approval must be lodged with Council. For less than 10 trees a Tree Removal Permit must be submitted where the owner seeks to remove a prescribed tree, unless one of the following exemptions applies. Urban Area Exemptions The following tree removal/lopping activities do not require a Tree Removal Permit from Council: a) Where a tree is closer than its own height from a building it can be removed, or pruned
to Australian Standard Pruning of amenity trees (AS 4373-2007) without consent. This means where any part of a tree is above a line 45 degrees from the vertical extension of the wall of any building measured from its base (as shown in Figure 1).

b) Severe weather event or windstorm (e.g. wind speeds of above 80km per hour) – any work to prune or remove a tree posing an immediate risk to persons or property during or immediately following a storm event (within 3 days) where the land owner has given verbal notification to Council, or provided the details of the tree works within 14 days in the form of a plan showing the property and location of the tree; or
c) Removal or pruning of any species declared under the Noxious Weeds Act 1993 or any of the non-native/ invasive tree species listed in Table 1, regardless of size (unless the land or tree is listed as a heritage item).

5.2.3 Non-urban Areas Note: A non-urban area for the purpose of this
Chapter is any mapped area with a Rural (excluding RU5), Environmental and/or Recreational Zone.
In non-urban areas (excluding RU5 and trees and vegetation within the curtilage of a dwelling) a DA must be submitted for the removal or lopping of prescribed trees and vegetation where the: a) Tree in question is a Toona Australis (Red Cedar); or b) Tree contains a hollow or hollows; or c) Land is subject to a development consent condition or Section 88B restriction-as-to-
user that prohibits tree clearing or removal of the tree in question: or d) Land was originally part of the ‘paper subdivision’ deposited plans listed in Schedule
2(i) of the Shoalhaven Tree Preservation Order that was in force prior to commencement of SLEP 2014; or
e) Vegetation is less than 20 metres from the bank of a creek or water body deemed Category 1 (large creek/river) as defined by the SLEP 2014; or
f) Vegetation is verified as supporting an EEC; or g) Vegetation is mapped as supporting rainforest vegetation species; or h) Vegetation is mapped on the scenic preservation overlay of SLEP 2014; or i) Vegetation is within 30 metres from a rural road boundary Note: Items (d)-(i) are depicted on the supporting
maps for this Chapter.
Non-urban Area Exemptions The following tree removal/lopping activities do not require a DA from Council: a) Where a tree is closer than its own height from a building it can be removed, or
pruned to Australian Standard Pruning of amenity trees (AS 4373-2007) without consent. This means where any part of a tree is above a line 45 degrees from the

vertical extension of the wall of any building measured from its base (as shown in Figure 1).
b) The clearing of native vegetation that is authorised by a development consent or property vegetation plan under the NV Act 2003; or
c) Severe weather event or windstorm (e.g. wind speeds in excess of 80 km per hour) – any work to prune or remove a tree posing an immediate risk to persons or property during or immediately following a storm event (within 3 days) where the land owner has given verbal notification to Council or provided the details of the tree works within 14 days; or
d) Crown maintenance pruning in accordance with Australian Standard Pruning of amenity trees (AS 4373-2007) by up to 10 percent in any one year; or
e) Removal or pruning of any species declared under the Noxious Weeds Act 1993 or any of the non-native/ invasive tree species listed in Table 1 regardless of size.
f) Removal or pruning of any of the tree species listed in Table 2 if less than 10m tall.
5.3 Council Owned and Managed Lands
Approval is always required for any vegetation removal on land owned and managed by Council including road reserves to which Council is the Roads Authority and crown reserves to which Council is the Trust Manager. Tree removal on public land generally needs to go through a Review of Environmental Factors (under Part 5 of the EP&A Act) prior to any works being undertaken. There is a cost associated with this process. Public Land Exemptions The following tree removal/lopping activities do not require a permit or DA from Council: a) Works carried out by Council or its agents provided that assessment of the work has
been carried out in accordance with the ‘Tree Management Policy – Council Managed Lands’.
5.4 Application procedures
When do you need to Apply for a Tree Permit or a Development Consent? If the tree(s) are on land to which this Chapter applies and the proposed removal/pruning/lopping is not exempt, an application must be submitted to Council in the form of either a: 1. Tree Removal Permit (for urban and RU5 zones for less than 10 trees); or 2. A DA (for non-urban zones excluding RU5 and urban areas where seeking approval
to remove more than 10 trees.)

All applications must be accompanied by a Tree Plan which is drawn to scale and illustrates:
Property boundary, existing structures and access roads; Location of all trees on the lot and identification of those trees or vegetation proposed
for removal with approximate heights and widths; A description of the trees (species name if known) proposed for removal; Distance of those trees or vegetation proposed for removal from the nearest
boundary and/or structure; If relevant, placement of drainage and sewer mains, and overhead power lines; A north arrow.
The application must be signed by the owner(s) of the property on which the trees are growing. Note that fees apply. Upon submission of the Tree Removal Permit Form, Tree Plan and relevant fee, Council staff will ensure that the form is correctly filled out and contains all necessary information required to allow lodgement.
5.4.1 Arborist Report An arborist is determined as a person with training, minimum Australian Qualification Framework (AQF) Level 3 in Arboriculture or equivalent recognized and relevant experience that enables the person to perform tasks required by Aust. Standard 4373-2007. (Ref: AS 4373-2007) Council will require the submission of an Arborist Report prepared by a suitably qualified and practising Arborist to assess the health and condition of the tree to support the removal application in the following circumstances:
1. On slopes greater than 20 degrees 2. Within an EEC 3. Within riparian vegetation 4. Within a Paper Subdivision 5. Where the tree is a heritage item or part of a heritage conservation area 6. Where the tree is a Red Cedar
Unless Council is satisfied the tree is a risk to human life or property.
5.4.2 Heritage Trees In the case of Heritage trees, Council will require the submission of a Heritage Assessment Report and an Arborist Report prepared by a suitably qualified and practising Arborist to assess the health and condition of the tree to support the application, in accordance with clause 5.10.5 of the SLEP 2014.

5.4.3 Assessment of Significance (7 part test) EP&A Act 1979 If the tree contains hollows, is a threatened species or is a component of an EEC, Council will require the applicant to provide an Assessment of Significance (7 part test) prepared by a suitably qualified person in accordance with the EP&A Act 1979 to determine impact on threatened species, populations or ecological communities or their habitats, unless Council is satisfied it is a risk to human life or property. All trees proposed to be removed or pruned to Australian Standard Pruning of amenity trees (AS 4373-2007) need to be clearly marked on site for inspection purposes. Where hollow bearing trees are approved to be felled, a condition of consent will require an animal handler to be on site to rescue any animals living in the hollows.
5.5 Assessment Criteria for Tree Removal and Pruning
5.5.1 Risks Caused by the Destabilisation of Foreshore, Water Courses and Agricultural Land are Minimised.
The intent of this Section is to:
i. To encourage the retention of vegetation along water courses, foreshores and steep land to provide for erosion control and maintain amenity.
Performance Criteria Acceptable Solutions

A1.1 Clearing of trees and vegetation only occurs within 20 meters of a bank of a large (category 1) water course when it is dangerous to life or property and erosion control measures have been considered; and;
A1.2 A program of replanting of endemic species is proposed to maintain bank stability, water quality and terrestrial habitat; and
A1.3 The application is supported by an Arborist Report prepared by a suitably qualified and practicing Arborist to assess the health and condition of the tree/s.
P2 Rural land with steep slopes is maintained in a stable condition.
A2.1 Clearing of trees on mapped land with a slope in excess of 20% only occurs where the trees are dangerous to life or property and erosion control measures have been considered; and
A2.2 A program of replanting of endemic species is proposed to maintain slope stability. Note: An Arborist Report prepared by a suitably qualified and practicing Arborist to assess the health and condition of the tree/s is provided where necessary.

P3 Vegetation associated with State Environmental Planning Policy No 14 – Coastal Wetlands (SEPP 14) wetland areas is retained to maintain the viability of the wetlands.
A3.1 Tree vegetation removal only occurs:
a) In an artificial wetland; and b) 100 metres or more away from any natural
wetland, unless
A3.2 The trees are dangerous to life or property and erosion control measures have been considered;
A3.3 A program of replanting of endemic species is proposed to maintain wetland environment. Note: An Arborist Report prepared by a suitably qualified and practicing Arborist to assess the health and condition of the tree/s may be required.
5.5.2 Maintain the Character and Scenic Amenity of Rural Roads The intent of this Section is to:
i. To encourage the retention of vegetation along rural road corridors to ensure character and biodiversity value is maintained and enhanced.
Performance Criteria Acceptable Solutions
P4 Vegetation along rural road boundaries is retained for its aesthetic, habitat and water quality value.
A4.1 Tree removal only occurs within 30 meters of a rural road boundary where they are hazardous to life or property; and
A4.2 A program of replanting endemic or suitable plant species is proposed to maintain aesthetic, habitat and water quality values.
5.5.3 Amenity Considerations The intent of this Section is to:
i. To ensure that the unique character and environmental integrity of towns and villages in the Shoalhaven LGA is retained through the appropriate management of tree removal.
Performance Criteria Acceptable Solutions
P5 Character of towns and villages is maintained and improved by the retention of mature trees.
A5.1 Trees are only removed under the exemptions where they are hazardous to life or property. Where trees have been removed they are replaced with trees endemic to the region in an appropriate location;

A6.1 Trees removed to facilitate solar access for the tree owner or their neighbours are kept to the minimum necessary to ensure solar efficiency.

A7.1 Removal of a tree that is a poor specimen and is in a state of decline that is prolonged and irreversible as supported by an Arborist Report prepared by a suitably qualified and practicing Arborist in relation to the health and condition of the tree/s.
P8 Protect public and private assets from unnecessary damage.
A8.1 Removal of trees that have caused or are likely to cause significant structural damage and is supported by relevant evidence; and
A8.2 The application is supported by written expert advice and other reasonable alternatives are not available.
P9 Reduce bushfire hazard A9.1 Trees removed are consistent with the minimum requirements for asset protection zones in Rural Fire Service Planning for Bushfire Protection 2006 and the land is bushfire prone.
5.5.4 Heritage Considerations The intent of this Section is to:
i. To ensure that the heritage values and unique character of towns and villages in the Shoalhaven LGA are retained through the appropriate management of tree removal.
Performance Criteria Acceptable Solutions
P10 Heritage values and character of towns and villages is maintained and improved by the retention of heritage trees or trees within the curtilage of a heritage item.
A10.1 Trees to be removed will not adversely affect the heritage significance of the heritage item or heritage conservation area; and
A10.2 A heritage management document prepared by a suitably qualified heritage consultant; and an Arborist Report prepared by a suitably qualified and practicing Arborist to assess the health and condition of the tree/s is provided; or
A10.3 The tree and/or vegetation removal is carried out in accordance with clause 5.10(3) of SLEP 2014.

5.5.5 Other Important Vegetation The intent of this Section is to:
i. To ensure that sensitive areas of the Shoalhaven are protected.
Performance Criteria Acceptable Solutions
P11 Verified EECs are protected A11.1 The trees to be removed are not part of a listed EEC (Mapped in this DCP) in accordance with an assessment by a suitably qualified person.
A11.2 Tree removal in mapped EECs where the tree is hazardous to life or property as demonstrated by an arborist’s report that recommends removal for the protection of life or property.
P12 Removal of trees in deemed paper subdivisions is avoided or minimised
A12.1 Removal of any trees in Jerberra Estate is in accordance with Chapter N20 Jerberra Estate
A12.2 Removal of any trees in other paper subdivisions within Shoalhaven where they are ancillary to an approved development or use and meet other criteria in this plan.
P13 Toona Australis are protected. A13.1 A report from a suitably qualified arborist is provided and determines that the Toona Australis is an unacceptable risk to an existing structure; or
A13.2 Upon inspection the subject tree is obviously damaged, decayed or causing structural damage.
P14 Areas recognised for their scenic value are preserved.
A14.1 Removal of trees on land covered by the Scenic Preservation Overlay of SLEP 2014 where it is demonstrated that it is a hazard or there is another compelling reason for removal and a program of replanting of endemic species is proposed.
P15 Land mapped by the Illawarra Regional Environmental Plan (REP) No. 1 (Deemed SEPP) identified as supporting rainforest vegetation species is conserved.
A15.1 The trees to be removed are not part of a rainforest community (Mapped in this DCP) as demonstrated by an assessment by a suitably qualified person.
P16 Development is maintained in accordance with existing conditions of development consent.
A16.1 Removal of trees on land covered by conditions of development consent or Section 88B restriction to user instruments where an application is submitted which demonstrates a hazard or other compelling reason for removal. Note: Applicants may choose to apply for a Section 96 amendment to their existing 88B Restriction.
