1 Terms and Conditions CIMB Preferred 10 Campaign (“Campaign”) 1. The CIMB Preferred 10 Campaign is organised by CIMB Bank Berhad (13491-P) 2. Terms and Conditions CIMB Preferred 10 Campaign (“Campaign”)

1. The CIMB Preferred 10 Campaign is organised by CIMB Bank Berhad (13491-P)

3. In carrying out this Campaign in conjunction with CIMB Islamic Bank, the Prizes under this

Campaign shall come from the same pool of Prizes intended for the campaign organised by

CIMB Bank.

The Campaign Period

4. The CIMB “Preferred 10” Campaign (“this Campaign”) shall run from 1st March 2016 to 31st December 2016, both dates inclusive (“Campaign Period”).

5. CIMB reserves the right upon giving prior notice of fourteen (14) calendar days to change the duration and/or the commencement and/or expiry dates of the Campaign Period.

Eligibility

6. This Campaign is open exclusively to:

a) all new CIMB Preferred customers; and b) all new and existing CIMB Preferred customers who are CIMB Preferred Visa Infinite

Credit Card (“Preferred Visa Infinite Credit Card”) principal cardholders (collectively referred to as “CIMB Preferred Visa Infinite Credit Cardholders”) issued by CIMB in Malaysia (hereinafter referred to as “CIMB Malaysia”) only; and

c) all new and existing CIMB Preferred Current Account (“Participating Account”) primary accountholders; and

d) all successful CIMB Preferred applicants of CIMB Bank ASB Financing and/or CIMB Islamic Bank Term Financing-i Secured by ASB Certificate; and

e) all new and existing CIMB Preferred customers who invest in the following CIMB’s investment products:

Structured Investment (excluding Dual Currency Investment , Gold Convertible Investment & Reinvestment of Structured Investments); and/or

Unit Trust (Participating Equity Unit Trust Funds only); and/or

Private Retirement Scheme; and/or

ASNB-Variable Funds (ASN2, ASN3, ASG); and/or

Multi Collateral Financing; and/or

Clicks Trader & Clicks Trader Plus (collectively referred to as “Investment Products”)

during the Campaign Period EXCEPT for the following persons/entities who shall NOT be eligible to participate in this Campaign:

(i) Permanent, contract and/or temporary staff or employees of CIMB (including its

subsidiaries and related companies) and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or

(ii) Representatives and/or agents (including advertising and campaign agents, 3rd party

vendors and service providers) of CIMB (including its subsidiaries and related companies) and their permanent and/or contract employees and their immediate family members (i.e. spouses, children, parents, brothers and sisters);and/or

(iii) Non-individuals including but not limited to Sole-proprietorships, Partnerships,

Charitable/Non-profit Organizations/Societies, Corporate and Commercial Customers, public listed companies, private limited companies, clubs, associations and co-operatives; and/or

(iv) Individual below the age of 18 years; (hereinafter collectively referred to as the “Eligible Participant”)

7. In relation to joint accounts/joint applicants of the Participating Accounts, only the first

named account holder/applicant i.e. the primary account holder/primary applicant shall be eligible to participate in this Campaign. Guarantors of ASB Financing/Term Financing-i Secured by ASB Certificate, MCF will not be eligible to participate in this Campaign.

8. In relation to Preferred Visa Infinite Credit Card, only the principal cardholder will be eligible

to participate in this Campaign. Supplementary cardholders/ membership assignees are not eligible.

9. CIMB reserves the right to approve or reject any credit card or financing applications, and/or to request for any further supporting documents as it deems fit. For the avoidance of doubt, CIMB has the sole and absolute discretion to determine whether the supporting documents are sufficiently clear for purpose of processing applications submitted to CIMB.

Prizes

10. The following prizes will be available to the selected winners of this Campaign:

(the prizes stated above are hereinafter collectively referred to as the “Prizes”). 11. The Prizes:

(a) are provided on an “As Is” basis; (b) are neither transferable nor exchangeable for cash or credit; and (c) do not include any accessories or items that are shown in any promotional and/or

advertising materials in relation to this Campaign.

12. The Prizes may carry their own terms and conditions which shall be applicable in addition to the terms and conditions contained herein.

13. The Grand Prize winner shall have to comply with the following additional terms: (a) obtain road tax and insurance at his/her own cost and expense for the Grand Prize; (b) must have full legal capacity to own the Grand Prize and must not be prohibited by

any law or regulation to own the Grand Prize; (c) shall be responsible, at his/her own cost and expense, for obtaining all the necessary

approvals (if applicable) from the relevant authorities to enable the transfer of the Grand Prize to his/her name. CIMB shall not be responsible if the Grand Prize is unable to be transferred to the Grand Prize Winner for any reason whatsoever;

(d) in the event the market value of the Grand Prize is for any reason lower than the purchase price/value stated in Clause 8 above, CIMB shall not be liable for the difference between the market value and the purchase price/value (if any) and the Grand Prize winner shall not make any claims in respect of such difference;

(e) the Grand Prize winner is not allowed to nominate another person/entity to receive the Grand Prize.

(f) If the Grand Prize winner fails to comply strictly with any of the terms and conditions stated herein, CIMB reserves the right to forfeit the Grand Prize from the said winner and select another Grand Prize winner. In such event, CIMB will not be liable for any costs, refund or losses incurred by the said winner.

14. To CIMB’s best knowledge, all information regarding the Prizes stated herein are correct at

the time of printing of the terms and conditions of the Campaign herein. The images of the Prizes shown in any marketing, promotional and advertisement materials are for visual and illustration purposes only and the actual Prize received may vary.

15. The winners of the Prizes will be notified by CIMB in the manner referred to and the winners

shall claim the Prizes within three (3) months from the date of notification failing which CIMB reserves the right to forfeit the Prizes.

16. To the fullest extent permitted by law, CIMB expressly excludes and disclaims any

representations, warranties or endorsement, implied or express, written or oral, of all prizes offered under this Campaign, including but not limited to any warranty of quality, merchantability, fitness for a particular purpose, health and safety. All risks, loss, damage and/or injury associated with the use of the Prizes shall be assumed by the winners.

Qualifying Criteria

17. Subject to the terms and conditions herein, the Eligible Participant shall stand a chance to win

the Prizes stated in Clause 10 above by earning an entry or entries (“Entry” or “Entries” as the case may be) during the Campaign Period in the following scenarios:- Register his/her participation in this Campaign via short messaging system (SMS) by sending an SMS as follows:- P10 space <last 6 digits of IC> to 62666 (Note: Standard telecommunication charges will apply for each SMS sent);

Upon successful registration, the Eligible Participant(s) shall be notified via SMS on their mobile number registered with Maxis, Celcom, U Mobile or Digi Communication service provider maintained in the Bank’s record;

A) Preferred Visa Infinite Credit Card

Every approved application of any principal CIMB Preferred Visa Infinite Card by CIMB Malaysia during the Campaign Period entitles the principal Eligible Participant to ten (10) Entries.

B) New to Preferred Customer

Every approved application of any Preferred Membership during the Campaign Period entitles the principal Eligible Participant to ten (10) Entries.

C) Preferred Current Account

(i) Every new sign up for a Preferred Current Account with the requisite minimum initial deposit entitles the Eligible Participant to ten (10) Entries;

(ii) Every Incremental Deposit in the multiple of RM10,000 in Preferred Current Account entitles the Eligible Participant to one (1) Entry.

“Incremental Deposit” is defined as Incremental Average Balance (“IAB”) of Eligible Participant’s Participating Account throughout the Campaign Period calculated based on monthly average balance (“MAB”) compared to “Baseline” as stated in Table I below: Table I

Deposits made for the purposes of computation of the IAB shall only apply to fresh funds that

are placed in the Participating Account during the Campaign Period. Fresh funds herein referred

to as funds that do not originate from an existing account(s) with CIMB Bank Berhad, CIMB

Islamic Bank Berhad and/or CIMB Investment Bank Berhad.

D) ASB Financing/Term Financing-i Secured by ASB Certificate

(i) Every CIMB Bank ASB Financing or CIMB Islamic Bank Term Financing-i Secured by ASB Certificate with minimum amount of RM10,000 applied and approved during the Campaign Period entitles the principal Eligible Participant to ten (10) Entries; and

(ii) Every additional RM10,000 CIMB Bank ASB Financing or CIMB Islamic Bank Term Financing-i Secured by ASB Certificate approved during the Campaign Period entitles the principal Eligible Participant to one (1) Entry;

subject to the following conditions:

The ASB Financing or Term Financing-i Secured by ASB Certificate must be disbursed by 15 November 2016 otherwise Eligible Participant will not be entitled to the Entry(ies) under this Clause.

E) Investment Products

(i) Every new investment in Investment Products during the Campaign Period for the Minimum Investment Amount referred to in Table A below by the Eligible Participant who does not have any Investment Products with CIMB (“New Investor”) entitles the principal Eligible Participant to ten (10) Entries;

(ii) Every additional RM10,000 investment amount in any Investment Product by new or existing investors during the Campaign Period entitles the principal Eligible Participant to one (1) Entry. The RM10,000 Investment amount refers to fresh funds only.

(iii) “New Investment” refers to new sign up of the investment product. (iv) “New Investor” refers to first time investor into the Investment product with CIMB.

(v) For investment in foreign currency, Entries will be given based on the investment amount in

local currency equivalent. (vi) In the event Eligible Participant exercises his/her cooling-off right or the investment is

rejected or cancelled by any parties for whatsoever reason within the Campaign Period, the Eligible Participant shall not be entitled for the Entry under the Campaign. The “cooling-off” is a period of six (6) business days from the date of receipt of the Unit Trust application by CIMB;

(vii) The Eligible Participant is required to sign all relevant standard documents and comply with all terms and conditions in respect of his/her investment in the relevant products under the Campaign, which are separate from the terms and conditions herein;

(viii) Investments in the Unit Trust Funds are not obligation of, deposits in, guaranteed or insured by CIMB and are subject to investment risks, including the possible loss of the principal

amount invested. Eligible Participants are advised to read the Prospectus of the relevant Fund(s) before investing. Eligible Participants should also consider all fees and charges involved before investing. Past performance of the relevant Fund(s) is not an indication of future performance and income distributions are not guaranteed. Eligible Participants should rely on their own evaluation to assess the merits and risks of any investment. Eligible Participants who are in doubt as to the action to be taken should consult their professional advisers immediately;

(ix) The Eligible Participant is not covered by the compensation fund under section 152 of the Capital Markets and Services Act 2007 (CMSA). The compensation fund does not extend to the Eligible Participant who has suffered monetary loss as a result of a defalcation or fraudulent misuse of moneys or other property, by a director, officer, employee or representative of CIMB. Where the Eligible Participant suffers monetary loss in the above circumstances related to the acts of CIMB’s employees, the Eligible Participant may lodge a complaint with CIMB’s Customer Resolution Unit (“CRU”) as set out in clause 20.11. The Eligible Participant who is not satisfied with CRU's decision may refer the case to the Financial Mediation Bureau or the Securities Industry Dispute Resolution Centre within six (6) months of receiving a final decision from CRU. The Eligible Participant should note that his/her complaint will only be dealt with by either one of the above channel that the Eligible Participant chooses to refer his/her case to;

(x) The list of participating Equity Unit Trust Funds is available upon request and is subject to change from time to time by CIMB at its absolute discretion upon giving adequate notice;

(xi) The master prospectus of the unit trust funds of ASNB dated 30 June 2014 have been registered with the Securities Commission Malaysia and are available at any office of ASNB and its agents. Units will be issued upon receipt of the registration form as enclosed in the prospectuses. Before investing, please read and understand the content of the prospectuses. Total return on the investments may go down as well as up. Investments in the funds are exposed to fund management risk, inflation risk and purchasing power risk. Past performances of the unit trust funds of ASNB are not guarantees of future performances. Before investing, kindly consider the fees and charges involved; and

(xii) The Eligible Participants who wish to know the key features of a specific unit trust fund of ASNB may request the Product Highlights Sheet issued by ASNB at any office of ASNB and its agents.

Winners Selection Criteria of this Campaign

18. Subject to the terms and conditions herein, the winners for the prizes under Clause 10 above

shall be selected in the following manner: A) Grand Prize winner:

(i) At the end of the Campaign Period, Eligible Participants will be randomly short-listed by an automated selection system from the pool of total Entries earned in accordance with Clause 17 (A) to (E) above to be selected as the Grand Prize Winner (“Shortlisted Grand Prize Winner”).

(ii) The Shortlisted Grand Prize Winner will be contacted by telephone by representatives of

CIMB based on his/her mobile number maintained in CIMB’s records and shall be required to answer two (2) questions correctly before being declared a winner (“Grand Prize Winner”).

(iii) The Shortlisted Grand Prize Winner who fails to answer the questions correctly will not

receive the Prize and the next Shortlisted Grand Prize Winner will be called. All question and answer sessions will be judged and decided by a panel of judges selected by CIMB and the decision of the panel of judges selected by CIMB shall be final and binding.

(iv) CIMB has the sole discretion to fix the appointed date and time (Monday to Friday) from

(9am to 6pm) to contact the Shortlisted Grand Prize Winner. If the Shortlisted Grand Prize Winner is not contactable by telephone on the first attempt for reasons including, but not limited to the following circumstances:- No reply, Not interested to participate, Ended the call during conversation, Number not in use, No connection, Voice mailbox reached, another two (2) attempts shall be made to contact the Shortlisted Grand Prize Winner. Where the third (3rd) attempt is also unsuccessful due to the circumstances set out above, CIMB reserves the right to disqualify the Shortlisted Grand Prize Winner and proceed to contact the next Shortlisted Grand Prize Winner and this process will be repeated until the Grand Prize Winner is confirmed.

(v) Further and for the avoidance of any doubt, all telecommunication charges shall be borne solely by the Shortlisted Grand Prize Winner (including roaming charges incurred by the Shortlisted Grand Prize Winner outside Malaysia) as a result of CIMB contacting the Shortlisted Participants.

B) Consolation Prize winners:

(i) At the end of the Campaign Period and after the Grand Prize Winner has been selected, Eligible Participants will be randomly short-listed by an automated selection system from the pool of total Entries earned in accordance with Clause 17 (A) to (E) above to be selected as the Consolation Prize winners (“Consolation Prize Winners”).

(ii) All Consolation Prize Winners will be notified in writing to his/her address maintained in CIMB’s records (“CIMB’s notification letter”).

(iii) The Consolation Prize Winners will receive CIMB’s notification letter within 12 weeks after the end of the Campaign Period.

C) Monthly Prize Winners:

(i) At the end of each Participating month, Eligible Participants will be randomly short-

listed by an automated selection system from the pool of total Entries earned during each Participating month in accordance with Clause 17 (A) to (E) above to win the monthly prizes (“Monthly Prize Winners”).

(ii) The Monthly Prize Winners will receive CIMB’s notification letter within four (4) weeks after the end of each Participating month.

18.1 The Grand Prize Winner, the Consolation Prize Winners and the Monthly Prize Winners shall

collectively be referred to as the “Campaign Winners”. 18.2 It shall be the Eligible Participants’ responsibility to ensure their phone numbers and mailing

address provided are current and updated with CIMB in the event of any changes being made to the same by them. The notification and delivery of prizes by CIMB will be based on the Eligible Participants’ phone numbers and mailing address maintained in CIMB’s records. CIMB shall not be responsible to the Eligible Participant(s) for any loss (including loss of opportunity and consequential loss flowing there from) suffered in the event the Eligible Participant’s telephone number or mailing address in CIMB’s record is not current or correct.

18.3 For the purposes of this Campaign, an Eligible Participant shall only be entitled to win a

maximum of one (1) Grand Prize OR one (1) Consolation Prize. 18.4 The Campaign Winners agree and authorise CIMB to disclose their details (including but not

limited to name, NRIC number, telephone number and address) to CIMB’s distributor/agent who would then contact the Campaign winners regarding the delivery or redemption of the Prizes. The Campaign Winners are responsible to make the necessary arrangements with CIMB and/or its distributor/agent to collect or redeem their Prize(s). CIMB will not bear any accommodation and/or transportation charges and/or other cost that the Campaign Winners may incur or have to incur in the course of redeeming or using the Prizes.

18.5 The Campaign Winners shall at their own costs and expenses, be required to attend the prize presentation ceremony and/or other publicity programs in relation to this Campaign as and when required by CIMB. If the Campaign Winners fail to attend such ceremony and/or other publicity programs as required by CIMB, CIMB reserves the right to forfeit the Prize(s) of the Campaign Winners and select another winner.

Additional Rewards

19. Subject to the terms and conditions herein, Eligible Participants shall also be entitled to earn

the following rewards (“Rewards”) provided in Table 2 below during the Campaign Period upon satisfying the terms and conditions governing each of the Rewards.

(A) RM200 rebate for Sun Maxi-Med-i

(i) The Eligible Participant must during the Campaign Period, purchase from CIMB’s licensed sales staff located in CIMB branches a Sunlink or Sunlink Istimar Policy (hereinafter collectively referred to as “the Participating Bancassurance Product(s)”) which is underwritten and managed by Sun Life Malaysia Assurance Berhad and Sun Life Malaysia Takaful Berhad (jointly known as “Sun Life Malaysia”).

(ii) The Eligible Participant(s) who purchased the Participating Bancassurance Products will

be entitled to a RM200 Cash Rebate for one Sun Maxi Med-i policy (“Cash Rebate”) provided that the Eligible Participant signs up for the Sun Maxi Med-i policy and pays the premium in full.

(iii) To be eligible for the Cash Rebate, the Eligible Participant(s) must make payment of the

premium / contribution for the Participating Bancassurance Products as well as the Sun Maxi Med-i Policy via any mode of payment (cash, cheque, auto debit or credit card).

(iv) The Eligible Participant(s) must provide details of a valid CIMB Bank savings account

which is held in the sole name of the Eligible Participant (“the Eligible Account”) at the point of application for any of the Participating Bancassurance Product(s) by indicating the details in Section A - e-Payment column in the proposal form/application form. For avoidance of doubt, joint savings account(s) that are maintained by the Eligible Participant (s) will not be accepted.

(v) The Cash Rebate will be credited into the Eligible Account within sixty (60) days after the

end of the Free-Look Period for the respective Participating Bancassurance Products. The “Free-Look Period” is defined as a period where the policy or certificate owner is given a Free-Look Period of 15 days from the policy or certificate delivery date to review the suitability of the newly purchased/participated plan. If the policy or certificate is surrendered within this period, the full premium or contribution less the medical

examination expenses incurred, if any, will be refunded to the policy or certificate owner. Eligible Participant (s) who surrenders the Participating Bancassurance Products policy/certificate after the Free-Look Period and/or during the Campaign Period will not be entitled to the Cash Rebate.

(vi) The Eligible Participant must be the Policy Owner and also the Life Assured

(Conventional) / Certificate Owner and also the Person Covered (Takaful) in the Participating Bancassurance Product’s policy and the Sun Mexi Med-i Policy or certificate purchased/participated to be eligible for the Cash Rebate.

(vii) The Cash Rebate is only applicable for premiums / contributions paid on the

Participating Bancassurance Products and the Sun Mexi Med-i Policy in respect of Protection Benefits and Riders (if any). The Cash Rebate is not applicable in relation to any premiums / contribution on any additional / top-up premium / contribution for the investment portion.

(viii) The application for the Participating Bancassurance Product and the Sun Mexi Med-i

Policy must be accepted and the policy document must be issued by Sun Life Malaysia by 1st December 2016.

(viv) The Cash Rebate shall only be applicable for Participating Bancassurance Products and

the Sun Mexi Med-i Policy signed up during the Campaign Period. Existing policy(ies)/certificate(s) and the replacement of policy (ROP) / certificate (ROC) will not be entitled for the Campaign Reward.

vvi) In respect of the Participating Bancassurance Products and the Sun Maxi Med-i Policy, CIMB is merely a distributor of the same which is underwritten and managed by Sun Life Malaysia. CIMB will not be responsible for or be held liable in any way in respect of any matter or claims arising under the Participating Bancassurance Products and/or the Sun Maxi Med-i Policy. The Terms and Conditions herein shall prevail over any provisions or representations contained in any other promotional materials relating to the Campaign. Sun Life Malaysia being the licensed insurer & takaful operator and underwriter & manager of the Participating Bancassurance Products and the Sun Maxi Med-i Policy respectively shall undertake the obligations as the insurer & takaful operator. The Participating Products and the Sun Maxi Med-i Policy are not CIMB’s products and therefore there are no obligations nor guarantee by CIMB.

(B) Free Dengue Cover

(i) The first 1,000 Eligible Participants for this Campaign will be given a Free Dengue Cover

worth RM20 per annum underwritten by Sun Life Malaysia.

(ii) The free dengue cover is subject to Sun Life Malaysia’s Terms and Conditions governing dengue cover.

(C) Bonus Points redemption

(i) Eligible Participants are entitled to redeem bonus points during the campaign period to

Gold and/or Priority Pass and/or other gifts which CIMB may in its sole discretion offer during this Campaign period.

(ii) The redemption of bonus points under this clause is subject to CIMB’s existing Terms and Conditions governing Bonus Points Redemption.

(D) Free One Month BUY Brokerage

Enjoy Unlimited Free One Month BUY Brokerage (“Offer”) when you open a share trading account and trade in Bursa Malaysia with i*Trade@CIMB.

(i) The Offer is valid from 1 March 2016 to 31 December 2016, both dates inclusive.

(ii) The Offer is open to all new and existing CIMB Preferred members who open a Clicks Trader Plus account (“CTP Account”) with CIMB during the Offer Period (“Eligible Clients”).

(iii) The following shall not be eligible to enjoy the Offer: (a) CIMB Preferred members who already have an existing CTP Account and/or other

share trading account with CIMB prior to the Offer Period; and

(b) Others as may be determined by CIMB.

(iv) The Offer will take effect upon the 1st online purchase of Bursa Malaysia shares (“Online

Bursa BUY Trade”) is transacted via Eligible Client’s CTP Account.

(v) The Offer will allow Eligible Clients to enjoy zero brokerage for Online Bursa BUY Trade

for 30 calendar days starting from the date when the 1st Online Bursa BUY Trade is

transacted (“Zero Brokerage Period”).

(vi) Brokerage rate for Day Trade Facility which involves trading of a particular share where

during the Zero Brokerage Period.

(vii) The following transaction costs (including goods and services tax, where applicable) will

still be chargeable to the Eligible Clients during the Zero Brokerage Period for trades

transacted on Bursa Malaysia:-

(a) Brokerage fee (at a rate offered by CIMB) for selling of shares;

(b) Clearing fee (at a rate of 0.03% of the transaction value); and

(c) Stamp duty (RM1 for every RM1,000 of the transaction value).

(viii) The applicable BUY brokerage rate shall be chargeable to Eligible Clients for trades

transacted after the expiry of Zero Brokerage Period.

(E) 6 months Easy Payment Plan with motor insurance underwritten by Allianz General

Insurance Company (Malaysia) Bhd

(i) Eligible Participants who sign up for any Motor Insurance underwritten by Allianz

General Insurance Company (Malaysia) Bhd at any CIMB Auto Finance Centres and CIMB Bank Branches is eligible for the 0% Easy Payment Plan subject to the following:-

(a) payment on the motor insurance shall be made via any CIMB Credit Card of the

Eligible Participant for a minimum premium of RM300

(ii) The 6 months Easy Payment Plan under this clause is subject to the CIMB’s existing terms and conditions governing Easy Payment Plan.

20. GENERAL TERMS & CONDITIONS

20.1 By participating in this Campaign, the Eligible Participant is deemed to have read, understood and agreed to be bound by the Terms and Conditions stated herein and agree that any and all decisions made by CIMB in relation to every aspect of the Campaign including but not limited to the eligibility of the Eligible Participant to participate in the Campaign and the entitlement to the Prizes shall be final, binding and conclusive.

20.2 At the time of selecting the Campaign Winners, the Campaign Winners’ CIMB Preferred Visa Infinite Card, CIMB Preferred Current account/Current account-i, ASB Financing/Term Financing-i Secured by ASB Certificate MUST be in good standing and MUST NOT be in breach of any of the terms and conditions governing the said card and account and MUST NOT be delinquent, and/or be invalid or cancelled within CIMB’s definition, otherwise they will be disqualified from participating or being declared the Campaign Winner in this Campaign.

20.3 CIMB shall not be liable to any Eligible Participant or any party for any loss or damage of whatsoever nature suffered by the Eligible Participant or any party (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the participation or non-participation in the Campaign. 20.4 CIMB reserves the right to cancel, terminate or suspend the Campaign upon giving notice of not less than fourteen (14) calendar days. For avoidance of doubt, any cancellation, termination or suspension by CIMB of the Campaign shall not entitle the Eligible Participant or any other persons whatsoever to any claim or compensation against CIMB for any losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension. 20.5 CIMB reserves the right upon giving notice of not less than 21 calendar days to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) (“the Amendment”) any of the Terms and Conditions herein. Notification to the Eligible Participant in respect of the Amendment shall be effected at CIMB’s absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Eligible Participant’s last known address or by posting a notice regarding the Amendment at each of CIMB’s branches or by effecting an advertisement regarding the Amendment in one newspaper of CIMB’s choice, or via CIMB’s website or by any other means of notice which CIMB may select and the Amendment shall be deemed as binding on the Eligible Participant as from the date of notification of the Amendment or from such other date as may be specified by CIMB in the notification.

20.6 The Terms and Conditions herein, as the same may be amended from time to time pursuant to Clause 19.5, shall prevail over any provisions or representations

contained in any other promotional and/or advertising material in relation to the Campaign.

20.7 The terms and conditions governing the respective Preferred Membership, Preferred Infinite Credit Card, the Participating Accounts, the Investment Accounts, CIMB Bank ASB Financing and/or CIMB Islamic Bank Term Financing-i Secured by ASB Certificate are separate from the Terms and Conditions herein. The Eligible Participant is required to comply with all terms and conditions governing the said Preferred Membership, Preferred Infinite Credit Card, the Participating Accounts, the Investment Accounts and CIMB Bank ASB Financing and/or CIMB Islamic Bank Term Financing-i Secured by ASB Certificate in addition to the terms and conditions herein.

20.8 CIMB will not assume any responsibility for the prizes, products and/or services offered under this Campaign. The prizes, products and/or services are offered and/or provided solely by the relevant vendors, distributors and/or providers, under such terms and conditions as determined by such vendors, distributors and/or providers, and CIMB accept no liability (including without limitation, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third party) howsoever arising whether in contract, tort, negligence or otherwise in connection with the prizes, products and/or services offered under Campaign.

20.9 CIMB accepts no responsibility for any tax implications, goods and services tax, incidental cost and/or any other charges and/or damages caused by any of the prizes and/or non-fulfilment by any of its agents/distributors. Any tax filing obligation or any tax payment due to any authority or any incidental cost and/or any other charges that may arise as a result of receipt of the prizes remain the sole responsibility of the Eligible Participant. It is the responsibility of each Eligible Participant to seek independent advice on the possible implications this may have on his/her own financial situation.

20.10 If there is any inconsistency, conflict, ambiguity or discrepancy between the Bahasa Malaysia and English version or other language version of the Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request had been made by the Eligible Participant(s) and noted and acknowledged by the Bank in its records that the Bahasa Malaysia version of the Terms and Conditions shall govern the operation of the Campaign, then the Bahasa Malaysia version of the Terms and Conditions herein shall prevail. 20.11 In the event of any complaints related to the Campaign, the Eligible Participant may contact CIMB’s Customer Resolution Department (CRU) bearing the following address, telephone, facsimile numbers and e-mail address (or bearing such other address, telephone, facsimile numbers and e-mail address which CIMB may change by notification to the Eligible Participant):
