VOTING IN ST. JOSEPH COUNTY
Registration
Eligibility
You must register in order to vote. If you are an Indiana resident and a United States citizen, age 18 by General Election Day, you may register to vote in St. Joseph County, providing you meet the following criteria:
• You have been a resident in your precinct for at least 30 days before the election, even if your residence is non-traditional, such as an RV or a shelter.
• You are not currently imprisoned after being convicted of a crime.
• You apply to register to vote during the registration period that continues through the 29th day before Election Day and your application is approved.
Notes
• In-person registration requires the identification number from a valid U.S. or State of Indiana government-issued ID or the last four digits of your Social Security Number; registration by mail requires that you enclose a photocopy of a current valid government-issued Photo ID (see requirements below).
• You must re-register if you have changed your name or residence. The regular registration application form is also used to make these changes.
• You do not declare a party affiliation when registering in Indiana.
• College students may register and vote either at their school or at home (usually by absentee ballot, either in person or by mail).
• If you will be 18 years old by the General Election, but not by the Primary Election, you may register and then vote in the Primary Election, but only to nominate the General Election candidates. You may not vote for candidates or issues in a Nonpartisan Election held during the Primary Election.
Photo ID Requirements
To vote in Indiana, you must present a valid Photo ID issued by the State of Indiana or U.S. government, such as an Indiana driver license or Photo ID, U.S. passport or military ID. The ID must be current or have expired after the last general election. Some IDs require no expiration date or may have an indefinite expiration date: These include: U.S. Dept. of Defense, a branch of the uniformed services, the Merchant Marine, the U.S. Dept. of Veterans Affairs (or Veterans Admin.), or the Indiana National Guard.
The name on the ID must reasonably conform to your voter registration information. Examples: B. A. Smith, Bill A. Smith, and William Smith. You can obtain a photo ID for voting purposes at the Bureau of Motor Vehicles free of charge.

There are exemptions for the indigent, for those with religious objections to being photographed, and for those living in a state-licensed facility that is their polling place.
If you don't have your photo ID when you go to vote, you may cast a provisional ballot. By noon of the 10th day after the election, you must provide the county Election Board the necessary documentation or affirm that one of the exemptions applies to you. The Election Board will then determine if your vote should be counted. To learn more, visit www.PhotoID.in.gov or call the BMV at (317) 233-6000 or 888-692-6841.
Ways to Register
Indiana offers citizens a number of ways to register to vote:
1. You may register online at www.IndianaVoters.com with a valid State of Indiana issued Photo ID.
2. You may register in person at many places, including:
• St. Joseph County Voter Registration Office, 4th Fl. County/City Building
• St. Joseph County Clerk Offices in South Bend, Courthouse Basement, 101 S. Main St., or Mishawaka, County Services Building, 219 Lincolnway West
• Bureau of Motor Vehicles branches
• Public Assistance offices 3. You may register by mail, with applications available at these places:

Follow the instructions on the application and return or mail it to the Voter Registration Office at the address provided on the application. Types of Elections
General Elections
General Election Day is the first Tuesday after the first Monday in November. All party candidates that qualify will be listed. Names of write-in candidates are not provided at the polling place or on the ballot. Referenda questions may also be on the ballot. You do not declare a party affiliation in order to vote.
Primary Elections
Primary Election Day is the first Tuesday after the first Monday in May. Primaries are party elections to select those candidates who will represent the party in the General

Election in the fall. When voting in an Indiana primary election, you must select the ballot of one party and may vote only for candidates on the selected ballot. There are no write-in candidates allowed in a primary election.
Nonpartisan Elections
Nonpartisan Elections may take place at the Primary Election or the General Election. In St. Joseph County, voters elect members of most school boards on nonpartisan ballots at the General Election. Local questions may be placed on the ballot in either election. You must be 18 to vote in Nonpartisan Elections. You do not declare a party affiliation to vote in a Nonpartisan Election during the primaries.
Voting Procedures
Where to vote
Indiana polls are open from 6:00am to 6:00pm. District designations or boundaries vary for elective offices such as state senators or representatives, county commissioners or county councils, city councils, townships, and school boards. Local precinct polling places are printed in the newspaper near election time. You can also contact the Voter Registration office, 574-235-9521, or visit www.IndianaVoters.com to find your precinct polling place. You must vote at the correct precinct.
Indiana law requires that polling places and voting machines be accessible to the elderly and disabled. In the past, some polling places have not met this requirement. If you think your polling place does not comply with state accessibility requirements, contact the St. Joseph County Commissioners at 574-235-9534 so that the polling place may be made more accessible. To file a grievance about your precinct's accessibility, call the Hoosier Voter Hotline at 1-866-IN-1-VOTE (866-461-8683).
How to vote
The St. Joseph County Election Board determines which type of state-approved voting system will be used. The Indiana Voter Bill of Rights and posters instructing how to cast your ballot should be available at your polling place. If you make a mistake while filling in your ballot, do not attempt to correct it. Ask for a new ballot. This will prevent a possible invalid ballot. If you are denied a ballot, request a provisional ballot.
Assistance at the Polls
Precinct judges (one Republican and one Democrat) are available to explain voting procedures. They are required by law to provide such help. If you need assistance to vote, you may either ask them for assistance or designate someone to help you. That person may not be your employer or union official. The person who assists you must fill out an Affidavit of Voting Assistance before helping you at the voting booth. No one who assists you may disclose how you voted.

Absentee Voting
Requirements
Indiana voters, registered to vote in the precinct where they live, may vote absentee-in-person at the Election Board office in the County/City Building in South Bend or the County Services Annex in Mishawaka. You need not state a reason for voting absentee-in-person. Absentee voting begins 28 days before Election Day from 8:00am to 4:30pm and ends at noon the day before the election. At least two Saturdays will be open from 8:00am to 4:00pm.
To vote absentee-by-mail, one of the following conditions must apply: 1. You have a specific, reasonable expectation that you will be absent from the county on
Election Day during the entire 12 hours that the polls are open (6 am until 6 pm). 2. You have a disability. 3. You are at least 65 years of age. 4. You will have official election duties outside of your voting precinct. 5. You are scheduled to work at your regular place of employment during the entire 12
hours that the polls are open. 6. You will be confined due to illness or injury or you will be caring for an individual
confined due to illness or injury during the entire 12 hours that the polls are open. 7. You are prevented from voting because of a religious discipline or religious holiday
during the entire 12 hours that the polls are open. 8. You are a participant in the state's address confidentiality program. 9. You are a member of the military or a public safety officer. 10. You are a "serious sex offender" as defined in Indiana Code 35-42-4-14(a). 11. You are prevented from voting due to the unavailability of transportation to the polls.
12. You are a voter eligible to vote under the “fail-safe” procedures described in IC 3-10-11 or 3-10-12, which cover situations in which someone’s name does not appear on the poll list. See “Indiana’ Voter’s Bill of Rights at: www.2018 Voters' Bill of Rights.FINAL.pub - IN.gov
Procedures To vote absentee-by-mail, send a completed application to your county Election Board by midnight of the Monday a week prior to Election Day, by mail or fax. The board will process it and mail you an absentee ballot if it is approved. You may mail the completed ballot to the county Election Board. Or, you, a member of your immediate household, or your attorney-in-fact may hand-deliver your ballot. It is against the law to have any other person deliver a completed ballot.
You must qualify under point #2 or #6 above or be physically unable to complete the ballot and sign the affidavit on your own to vote absentee-by-traveling-board, and complete an application as outlined in the procedures above. A bipartisan absentee voting board will deliver your ballot and assist you with filling it out, if needed. They will forward it to the Election Board for you.

Provisional Ballots
The Help America Vote Act of 2002 provides that you may request a provisional ballot and vote if your qualification to vote is challenged for one of the following reasons: 1. Voter is unable or declines to present a photo ID meeting state requirements. 2. Voter's name isn't on the poll list, unless the voter qualifies to use one of the fail-
safe procedures. 3. Voter doesn't currently reside in the precinct, but is listed on the poll list, unless
the voter qualifies to use one of the fail-safe procedures. See Note below. 4. Poll list indicates a first time voter is required to provide additional residency
verification, but the voter is unable to do so. 5. Voter is not a U.S. Citizen. 6. Voter is not 18 years old at the general or municipal election. 7. Voter's signature does not match that on the registration record. 8. Voter is not affiliated with the party he is claiming at a primary election.
Exception: If the voter's party affiliation is challenged, and he fills out the challenged voter's affidavit (Form PRE-4), he will use a regular ballot to vote. His ballot will not be kept separate from the undisputed ballots. He will NOT use a provisional ballot.
Your provisional ballot will be kept separate from the other ballots cast in that precinct and delivered to the Election Board when the polls close. You have until noon 10 days after the election to provide the Election Board any needed documentation, including a valid photo ID, supporting your claim to the right to vote. The county Election Board will determine whether you were eligible to vote and whether your vote should be counted. Exception: If the challenge is for point #4 above, you must provide documentation by the time polls close on Election Day.
Note: Other fail-safe procedures may allow you to vote in certain situations. When your name isn't on the poll list, you may need to ask the poll worker to call for a Certificate of Error from the county, file a written or oral statement of affirmation or provide a voter registration receipt, depending on the circumstances. When your name does not match what is on the poll list, you may vote if you sign the poll book with your new name. When your address does not match the poll book, you may vote after signing the poll book and completing the required paperwork (Form VRG 4/12).

Violations of Election Law
It is unlawful under Indiana law to engage in these activities:
• intimidate a voter
• pay a voter to cast a vote for or against any candidate
• tamper with any voted ballot
• disclose how another person voted
• vote at a polling place that you know is not your legal polling place

Circuit Courts are courts of general jurisdiction and are established by the Indiana Constitution. St. Joseph County is designated as the 60th Judicial Circuit. By local rule, the Circuit Court has jurisdiction over civil matters and select criminal cases, and conducts all Grand Jury proceedings. The Court consists of one elected Judge, who serves a six-year term, and three magistrates appointed by the Judge.

St. Joseph Superior Court
Superior Courts are authorized by the Indiana General Assembly. The St. Joseph Superior Court consists of eight judges, four in the Civil Division and four in the Criminal Division. The Governor appoints judges upon recommendation by the St. Joseph County Judicial Nominating Committee, based on merit. Judges serve a first term of two years, followed by subsequent terms of six years, with appointments renewed at the end of each term by a retention vote at the General Election. The Superior Court Chief Judge appoints four magistrates to oversee the Traffic and Misdemeanor Court and Small Claims Court.

Probate Court
St. Joseph County is the only county in Indiana with a Probate Court, a court of limited or special jurisdiction. This court has authority over estates, wills, trusts, guardianships, adoptions, paternity, and a family court dealing with domestic matters such as divorce, child support, and visitation. The Probate Court also has exclusive jurisdiction over all juvenile matters, including the administration of the Thomas N. Frederick Juvenile Justice Center. The Judge of the Probate Court is elected for a six-year term and appoints a Senior Judge and three magistrates.

Redevelopment Commission
The Redevelopment Commission was established to address conditions associated with blight and the underutilization of land and/or barriers to development. The Commission operates within the city limits of South Bend and identifies problem areas and develops a strategic plan for eliminating blight and bringing about new development within those areas. A primary focus is on the expansion of tax base and the creation of new jobs within South Bend.
There are five voting members of the South Bend Redevelopment Commission. Three are appointed by the Mayor; two are appointed by the South Bend Common Council. In addition, one member of the South Bend Community School Corporation Board of School Trustees is appointed by the Mayor as a non-voting adviser to the Commission.

Redevelopment Authority The South Bend Redevelopment Authority is an instrument used to finance local public improvements for lease to the South Bend Redevelopment Commission. Three members of the Authority are appointed by the Mayor.
