The meeting was called to order by Mayor John Joyce at 7:30 pm. Present (via roll call): Ralph Carlson, Dan Elliott, Matt Hildebrand, Mayor Joyce, Sandy Szeliga Present: City Manager Sarah Dvoracek, Assistant City Manager Mark Wilson, Finance Director Pepper Lockhart, Chief of Police John Beam, City Attorney James White, DDA Director Eric Kehoe, City Clerk Kathy Fiebig, and Communications Director/Meeting Host Melissa Rohen. Guests: Cathie Crew, Victoria Martin, John and Angela Hunter, Matt Biolette (Republic Services), Chris Emerick, Laurie Chase, Roger Elkins, Unit Assistant, Randy Berger and Travis (by phone). Citizens’ Comments: none Approval of Agenda Ms. Dvoracek added “trash cart deployment” to Items for Discussion, and Mr. Hildebrand suggested moving Items for Discussion in front of new business since council expects to go into closed session at that time. Both items involve discussions with guests, and this will prevent them having to wait during the closed session. Motion made by Mayor Joyce to approve the agenda with these changes. Unfinished Business F. Evart Industrial Properties, LLC - expansion project Mrs. Dvoracek reminded council that the Zoning Board of Review will meet on Friday, September 11 at 7:30 pm at Riverside East to consider the proposed variance for the Evart Industrial Properties LLC regarding their new site plan. G. Proposed policy changes for the Evart Police Department – no action taken. Items for Discussion
• Introduction of Eric Kehoe – Downtown Development Authority Director and Michigan Main Street Director
• Trash Cart Deployment Mrs. Dvoracek has received a few negative comments regarding this change in service, primarily from senior citizens who are worried about their ability to maneuver the cart to the street. She has been speaking with Matt Biolette of Republic Services and he has

offered a couple of possible alternatives for these situations. Council requested that Mrs. Dvoracek and Mr. Biolette continue to look for solutions to be presented at the next meeting.
New Business Items for Action: H. Sewer Credit for 220 S. River Street Due to abnormally high usage, Patrick Muczynski of the Water Department checked the home and discovered a leak in the laundry room spigot. He verified that the excess water had not gone into the sewer system. Motion by Mr. Hildebrand to approve a sewer credit of $881.08 for 220 S River Street. Support by Ms. Szeliga. Motion was proved with a roll call vote; all were in favor. I. Request to renew snowplow contract Mayor Joyce appreciated the savings offered with the three-year term and wondered if Mr. Berger would consider extending the contract to five years at these terms. Mr. Berger is willing to do so if the gas recovery cost clause remains in effect for the additional years. Mr. Hildebrand acknowledged the convenience and stability of long-term contracts with service vendors but would like to see a policy put in place that would allow for a review either annually or bi-annually. The contract will be extended to five years and a review clause inserted. No action taken. Motion by Mayor Joyce: “I move that the City Council go into closed session pursuant to MCL 15.268(f) to review and consider the contents of appointment to a public office which is exempt pursuant to MCL 15.268(f).” He requested the attendance of the following: himself, all Council Members, City Attorney White, City Manager Dvoracek, Finance Director Pepper Lockhart and City Clerk Fiebig. Support by Mr. Carlson. Council moved to closed session at 8:06 pm. Motion by Mr. Hildebrand to end the closed session. Support by Ms. Szeliga. Motion carried with a roll call vote; all were in favor. Closed session ended at 8:28 pm. Motion by Mayor Joyce to reconvene the public meeting. Support by Ms. Szeliga. Motion carried with a roll call vote; all were in favor. Public meeting reopened at 8:30 pm. K. Pepper Lockhart’s proposed Finance Director/Treasurer contract Mayor Joyce offered Resolution 2020-16 to approve the employee contract for Finance Director Lockhart and set the salary pursuant to that contract. Support by Mr. Hildebrand. Motion carried with a roll call vote; all were in favor. L. Sarah Dvoracek’s proposed City manager contract Mayor Joyce offered Resolution 2020-17 to approve the renegotiated employee contract for City Manager Dvoracek and set the salary pursuant to that contract. Ms. Dvoracek advised council that the Splash Pad has been closed for the season. She reminded them that the City had received a grant earlier this year for 300 native trees. The first 30 trees are arriving tomorrow. Mr. Wilson has scheduled planting for Friday, September 11 at 8 am at Riverside Park West. She reminded Council of the Special Council Meeting to discuss the Strategic Plan on September 11 following the Zoning Board of Appeals Meeting. She will be sending out a number of documents prior to this meeting. There being no further business, the meeting was adjourned at 8:37 pm with a motion by Mayor Joyce and support by Mr. Carlson. September 11, 2020 @ 8:00 pm Riverside East Pavilion
The meeting was called to order by Mayor John Joyce at 8:00 pm. Present (by roll call): Ralph Carlson, Dan Elliott, Mayor Joyce, Sandy Szeliga Absent: Matt Hildebrand Present: City Manager Sarah Dvoracek, Assistant City Manager Mark Wilson, City Clerk Kathy Fiebig Guests: Chris Emerick, Cathie Crew, Karen Higgins Citizens’ Comments: none Mayor Joyce stated that the sole purpose of this special meeting was to address the contract with Snowmen Plow Services. Ms. Dvoracek reminded council that they had requested several changes to the Snowmen Plow Services Contract during the regular council meeting on September 8, 2020. Per that discussion, language regarding insurance was added to Item 7, and Items 8, 9 and 10 were added. These insert a hold harmless clause, provide for regular performance evaluation reviews, and added termination language. The City has spoken with Mr. Berger and he is comfortable with these changes and did not feel it was necessary to attend this meeting. City Attorney James White has reviewed and approved all changes. Motion by Mayor Joyce to approve the revised contract as presented. Support by Mr. Elliott. Motion passed on a roll call vote; all were in favor. Citizens’ Comments: none Motion by Mayor Joyce to adjourn. Support by Mr. Carlson. Motion passed with a voice vote; all were in favor. AGENDA REPORT To: Honorable Mayor Joyce & Council Members From: John Beam, Chief of Police Date: September 17, 2020 Re: Proposed Policy Changes for Evart Police Department For the Agenda of September 21, 2020 _________________________________________________________ Background. The Evart Police Department’s Policy and Procedure Manual was last updated on November 1, 2007. With our city’s ordinance, Chapter 240 Police Department, 240.03 Duties of the Chief of Police, states (2) “He shall recommend and publish when approved by the City Council, such rules and regulations for the Department as may deem advisable and shall enforce obedience to such rules. The Chief of Police may discharge any member of the Department with the consent of the City Council.” Recent events have required our department to examine our current policies and procedures manual. After a thorough review of the department’s policy and procedure manual, I am recommending the following changes, (see attachments):
1. Duty to Intervene a. This is a new stand-alone policy for the Evart Police Department. Currently the
Use of Force policy incorporates a duty to intervene, but after recent event in our nation we were provided this model policy by MMRMA and asked to adopt it in our department’s policies and procedure manual.
b. This was reviewed prior to the August 17, 2020 council meeting and I did not receive any suggestions or discussion on changing anything.
2. Response to Resistance a. This policy and procedure will replace the Evart Police Department’s Use of
Force policy and procedure. This policy and procedure was provided by MMRMA as a model policy and procedure, it was just customized to reflect the Evart Police Department and local resources.
b. This was reviewed prior to the August 17, 2020 council meeting and I did not receive any suggestions or discussion on changing anything.
3. Intermediate Weapons a. This policy and procedure will replace the Evart Police Department’s Use of
Department Weapons policy and procedure. This policy and procedure was provided by MMRMA as a model policy and procedure, it was just customized to reflect the Evart Police Department and local resources.
b. At the August 17, 2020 council meeting I received questions regarding less lethal munitions and some of the language presented in the less lethal munitions section. I have since omitted the less lethal munitions section since the Evart Police Department does not possess any less lethal munitions.
c. I incorporated expandable batons and prohibited weapons in this section. The language used in these sections came from the Bay City Department of Public Safety’s policy and procedure and the Michigan State Police’s policy and procedure.
4. Mutual Aid a. This policy and procedure is a revision of our current Mutual Aid Agreement
policy and procedure. Changes were made off of suggestions I received while discussing the policy and procedure with multiple parties.
Issues & Questions Specified. I spoke to both Police Committee Members, Mayor Pro Tem Szeliga and Councilmember Carlson, regarding the proposed changes I provided to them. They both are in support of my recommendation to adopt the policies and procedures. These policies and procedures were provided to the Evart Police Department by MMRMA as model policies except for the mutual aid policy and procedure. The Evart Police Department just had to customize the model policies to reflect the Evart Police Department and local resources. The Mutual Aid policy and procedure was sent to a MMRMA consultant who advised there should not be a mutual aid agreement with any other department. Therefore, the word “Agreement” was removed from the policy and procedure in addition to the revisions made prior to MMRMA’s review. I sent the Intermediate Weapons policy and procedure to MMRMA as well since I added sections on expandable batons and prohibited weapons. The mutual aid, response to resistance and duty to intervein policies and procedures were provided to City Attorney White for review on 09/14/2020, and the Intermediate Weapons policy and procedure on 09/15/2020. Alternatives.
1. Nothing
Financial Impact. The policies and procedures proposals could require more funds allocated to our training budget however many training expenses would be reimbursed by our liability insurance company through a grant. Recommendation. My recommendation is to adopt the policies and procedures as presented. Attachments.

CITY OF EVART ZONING BOARD OF APPEALS
PUBLIC HEARING September 11, 2020

The meeting was called to order at 7:30 pm by Chairman John Joyce.

Guests: Eric Kehoe, Cathie Crew, Thilo Savage, Kevin Keuthe, Jim Filipiak, Roger Elkins,
Karen Higgins, Ken and Kathy Wirth, Chris Emerick
Mr. Wilson advised the Zoning Board of Appeals that due to the irregularities of the lot in
question, the proposed addition will encroach upon the setback to the south. The Planning
Commission has approved the plans with the stipulation that the zoning variance must be
approved.
The applicant made no comments, and there were no questions from Zoning Board of Appeals.
There were no public comments.
Motion by Chairman Joyce to approve the variance as presented. Support by Mr. Elliott. The motion passed on a roll call vote; all were in favor. The meeting adjourned at 7:34 pm. ____________________________ Kathy Fiebig City Clerk
