Public hearing and introductory ordinance amending the Zoning Ordinance (Map) of the City of Laredo by rezoning Lot 2, Block 1628, Eastern Division, located at 2711 Cleveland Street, from R-2 (Multi-Family Residential District) to R-1-MH (Single-Family Manufactured Housing District). Staff does not support the application and the Planning & Zoning Commission recommends denial of the zone. District II

VII. FINAL READING OF ORDINANCES

2.

2013-O-072 Amending the City of Laredo FY 2013 Airport Operations Budget by appropriating proceeds from the sale of land to Diocese of Laredo and the Laredo Housing Opportunities Corporation, in the total amount of $1,740,719.24. The amount of $444,445.00 will be transferred and appropriated in the Airport Construction Fund Budget to provide local match for FAA Grant No. 72 for the Noise Abatement Program and to acquire PV Investments leasehold interest and authorizing the City Manager to implement said budget amendment. 2013-O-073 Amending the City of Laredo FY 2013 Airport Construction Fund Budget by appropriating revenues from the Federal Aviation Administration Airport Improvement Program Grant Project No. 3-48-0136-72-2012 in the amount of $4,000,000.00 for noise mitigation under FAR PART 150 Noise Abatement Program at the Laredo International Airport and appropriating local match in the amount of $444,445.00 and authorizing the City Manager to implement said budget amendment. The City’s local match of ten percent (10%) in the amount of $444,445.00 is available in the Airport Construction Fund. 2013-O-074 Amending the City of Laredo Bridge System FY 2012-2013 annual budget by appropriating $490,266.00 from the Bridge System Construction Fund opening balance to be used for Bridge related projects such as toll lane signage, lane barrier gates and treadles and other related improvements. 2013-O-075 Amending the Zoning Ordinance (Map) of the City of Laredo by authorizing a Conditional Use Permit for a Manufactured Home on Lot 9, Block 2070, Eastern Division, located at 3305-B Santa Clara Street; providing for publication and effective date.

2013-O-076 Assuming that leasehold interest from LESSEE PV Investments, Inc., as approved by Ordinance No. 2011-O-121 dated September 6, 2011 on two (2) tracts of land being Lot No.1 consisting of approximately 15,463.8 square feet and Lot No. 3 consisting of approximately 4,769 square feet all located on Block No. 15 at the Laredo International Airport, including any sublease interests emanating there from, and compensating PV Investments in the amount of $106,000.00 for improvements made on the leasehold premises, and authorizing the City Manager to execute all relevant documents. Funding is available in the Airport Fund.

VIII. RESOLUTIONS

3. 2013-R-045 Accepting the conveyance of the following Utility Easement

and Temporary Construction Easement from: Roberto Rodriguez – a 60 foot Utility Easement with corresponding Temporary Construction Easement as follows: one (1) 0.9525 Acre Tract, a copy of which conveyance is attached as Exhibit 1; This 60 foot Easement is for an 8 inch water and 12 inch sanitary sewer line, for the service area of Shiloh Crossing, Stone Creek, Village Heights and Shenandoah Valley Subdivisions.

IX. MOTIONS

4. Authorizing the City Manager to grant a public fireworks display permit for

the Laredo Country Club 4th of July fireworks display to begin at approximately 9 p.m. on July 4th, 2013. The technicians for the display will be Atlas Enterprises, Inc.

5. Referring the City of Laredo Comprehensive Plan to the Planning and Zoning Commission and requiring that a report from the Planning and Zoning Commission with any recommendations be brought back before the City Council before the adoption of the budget; in accordance with Article IX, Section 9.03 of the Charter of the City of Laredo.

6. Authorizing the City Manager to continue using the Webb County Jail to

incarcerate prisoners that are arrested for Class C misdemeanor violations and to amend the current agreement with Webb County by setting a daily rate of $62.50 per day per prisoner. The daily rate is subject to change in accordance with the rate allowed by the United States Government for incarcerating federal prisoners in the Webb County Jail. Subject to continued appropriation, the agreement will continue annually unless written notice from either party to discontinue the services is submitted. Webb County Jail is the only source that provides this service within our geographic area.

7. Consideration to award a software maintenance contract to the sole source provider, HTE Sungard, in the amount of $304,641.57. This maintenance contract provides customer support and service for the HTE OSSI computer software system utilized by the Police and Fire Departments. The term of the contract is for twelve (12) months ending on December 31, 2013. Funding is available in the Police and Fire Department annual budgets.

8. Consideration to renew contract FY10-057 awarded to Delta House Electric

and Motor Rewind, Freer, Texas, for an amount up to $300,000.00 to provide electric motor repair service for the Utilities Department. Repairs are for motors with horsepower ratings from 1/8 HP to 400 HP that are used in water and wastewater operations. This is the last extension period for this contract. Funding is available in the Utilities Department Fund.

9. Consideration for acceptance, release of retainage, approval of change order no. 2, a credit in the amount of $241,837.02 for a total final contract amount of $642,027.48, and final payment in the amount $84,612.96 to QRO Mex Construction Inc., Granite Shoals, Texas for the Regency Park Waterline Replacement project. Funding is available in 2009 Bond Sewer Line Rehabilitation account 559-4283-538-0363.

10. Consideration for approval to negotiate competitive sealed proposal

construction contracts for the bids received for the South Laredo Library, and to award contracts for the trade packages which are within funding availability, namely: (1) site work & drainage package, (2) carpentry package, (3) HVAC package, (5) structural steel & roof framing package, (6) glass & glazing package, (7) doors & windows package, (8) elevator package, (9) millwork package, (10) metals package; reject the bids for (4) masonry & stucco package due to the bid being too high; and approval to advertise for bids for the masonry & stucco package rejected in this second advertisement and approval to award contracts for the first four (4) previous trade packages which are within funding availability, namely: concrete package to Mariano Zapata, roofing package to A-Lert Roof Systems, a division of Centurion Industries, Inc., electrical package to AC-DC, Inc., and the plumbing package to A-Plus Plumbing Contractor, Inc. Funding is available in the 2008 C.O., 2009 C.O., Capital Improvements Fund, and Community Development 34th Action Year.

11. Consideration for approval of award of construction contract to the lowest

bidder Martinez Paving Company, Inc., Laredo, Texas, in the amount of $1,366,711.75 for the Backwoods Drive Extension Project from South of Yukon Drive to Shiloh Drive approximately 1800 L.F., with a six (6) months construction contract time; and authorizing the City Manager to execute all related contract documents contingent upon receipt and approval of insurance and bond documents. Completion date for the project is scheduled for January 2014. Funding is available in the 2007 Certificate of

Obligation-Backwoods Drainage and 2010 Utilities Sewer System Revenue Bond.

12. Consideration to authorize purchase contracts utilizing the Houston-

Galveston Area Council of Governments (H-GAC) and BuyBoard Cooperative Purchasing Program pricing to:

1. Santex Truck Center, San Antonio, Texas, for the purchase of one

(1) International Cab & Chassis in the amount of $84,122.00 and;

2. Heil of Texas, Houston, Texas, for the purchase of one (1) grapple dump body in the amount of $77,463.00.

Funding is available from 2012A Contractual Obligation Bond proceeds.

X. GENERAL COUNCIL DISCUSSIONS AND PRESENTATIONS

1. Recognizing Mr. Miguel Timoshenkov for his 42 years of

outstanding journalistic career and retirement.

2. Discussion with possible action on creating a recognition program for new businesses opening in Laredo on a monthly basis.

1. Discussion with possible action directing the City Attorney to take legal action as necessary to obtain completion on the Maria Luisa Haynes Health and Wellness Center.

2. Recognizing the Laredo Bad Boyz Baseball Team for their 2013 season accomplishments.

C. Request by Council Member Jorge A. Vera

1. Discussion with possible action to establish a one or two Miracle Baseball Fields that will benefit children with special needs.

2. Discussion with possible action on the proposed ordinance on “spice”, “saliva”, “bath salts”, and K2”, etc., otherwise known as “synthetic cannabis”, among prohibited

XI. EXECUTIVE SESSION

The City Council hereby reserves the right to go into executive session at any time during this public meeting, if such is requested by the City Attorney or other legal counsel for the City, pursuant to his or her duty under Section 551.071(2) of the Government Code, to consult privately with his or her client on an item on the agenda, or on a matter arising out of such item.

XII. RECESS AS THE LAREDO CITY COUNCIL AND CONVENE AS THE

LAREDO MASS TRANSIT BOARD 14. Motion to approve free bus rides on all Metro Routes on Thursday, June 20,

2013, in conjunction with the Eighth Annual American Public Transportation Association’s National Dump the Pump Day.

Comprehensive Plan: The Future Land Use Map recognizes this area as Medium DensityResidential.

Transportation Plan: The Long Range Thoroughfare Plan does not identify Cleveland Street.

IMPACT ANALYSIS

R-IMH (Single Family Manufactured Housing District): The purpose of the R-IMH District is topermit subdivisions designed to meet the dimensional and configuration requirements formanufactured and modular housing neighborhoods.

Is this change contrary to the established land use pattern?No, there are multiple manufactured homes in the immediate vicinity.

Would this change create an isolated zoning district unrelated to surrounding districts?Yes, the predominant zoning in the area is R-2 with a couple ofR-3's in the near vicinity.

Will change adversely influence living conditions in the neighborhood?Yes, it will not be compatible with uses allowable in the adjacent zoning districts.

Are there substantial reasons why the property cannot be used in accord with existing zoning?No, the existing zoning allows for residential uses.

AMENDING THE ZONING ORDINANCE (MAP) OF THE CITY OFLAREDO BY REZONING LOT 2, BLOCK 1628, EASTERN DIVISION,LOCATED AT 2711 CLEVELAND STREET, FROM R-2 (MULTI­FAMILY RESIDENTIAL DISTRICT) TO R-I-MH (SINGLE-FAMILYMANUFACTURED HOUSING DISTRICT); PROVIDING FORPUBLICATION AND EFFECTIVE DATE.

WHEREAS, a zone change has been requested by the owners of Lot 2, Block 1628,Eastern Division, located at 2711 Cleveland Street, from R-2 (Multi-Family Residential Dis­trict) to R-I-MH (Single-Family Manufactured Housing District); and,

WHEREAS, the required written notices were sent to surrounding property owners atleast ten (l0) days before the public hearing held before the Planning and Zoning Commissionon March 19,2013, and,

WHEREAS, the Planning and Zoning Commission, after a public hearing, has rec­ommended denial of the proposed zone change; and,

WHEREAS, notice of the zone change request was advertised in the newspaper atleast fifteen (15) days prior to the public hearing held before the City of Laredo City Councilon this matter; and,

WHEREAS, the City Council has held a public hearing on June 3, 2013, on the re­quest and finds the zone change appropriate and consistent with the General Plan of the Cityof Laredo; and,

WHEREAS, the City Council does not consider the impact, if any, of private cove­nants and deed restrictions on the subject property with the adoption of this ordinance.

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF LAREDO THAT:

Section 1: The Zoning Map of the City of Laredo be and is hereby amended by rezon­ing Lot 2, Block 1628, Eastern Division, located at 2711 Cleveland Street, from R-2 (Multi­Family Residential District) to R-I-MH (Single-Family Manufactured Housing District).

Section 2: This ordinance shall be published in a manner provided by Section 2.09(D) of the Charter of the City of Laredo.

BACKGROUND: Congressman the Honorable Henry Cuellar has announced the issuance of a grant by theFederal Aviation Administration in the amount of $4,000,000.00 for airport noise mitigation at theLaredo International Airport.

Since inception when the City first started to the voluntary airport noise abatement program federalfunding totals in excess of $30.0 million.

The City's program is voluntary to the property owner and the owner gets to chose:

a. Whether to sell in fee simple to City, or

b. Have the City soundproof the residence, if feasible to soundproof, and in exchange the property ownerconveying a perpetual avigation 1noise easement to City, or

c. Sell a perpetual avigation 1noise easement to City.

AMENDING THE ZONING ORDINANCE (MAP) OF THE CITY OF LAREDO BYAUTHORIZING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR AMANUFACTURED HOME ON LOT 9, BLOCK 2070, EASTERN DIVISION,LOCATED AT 3305-B SANTA CLARA STREET; PROVIDING FORPUBLICATION AND EFFECTIVE DATE.

WHEREAS, a request has been received for the issuance of a Conditional Use Permit for amanufactured home on Lot 9, Block 2070, Eastern Division, located at 3305-B Santa Clara Street; and,

WHEREAS, the required written notices were sent to surrounding property owners at least ten(10) days before the public hearing held before the Planning and Zoning Commission on May 7,2013;and,

WHEREAS, the Planning and Zoning Commission, after a public hearing, has recommendedapproval of the Conditional Use Permit; and,

WHEREAS, notice of the zone change request was advertised in the newspaper at least fifteen(15) days prior to the public hearing held before the City of Laredo City Council on this matter; and,

WHEREAS, the City Council has held a public hearing on May 20,2013, on the request andfinds the Conditional Use Permit amendment appropriate and consistent with the General Plan of theCity of Laredo; and,

WHEREAS, all conditions imposed by the Conditional Use Permit, and all pertinentrequirements the Laredo Land Development Code shall be met before the activity sanctioned by theConditional Use Permit may commence; and,

WHEREAS, the City Council does not consider the impact, if any, ofprivate covenants and deedrestrictions on the subject property with the adoption of this ordinance; and,

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OFLAREDO THAT:

Section 1: The Zoning Map of the City of Laredo be and is hereby amended by authorizing theissuance of a Conditional Use Permit for a manufactured home on Lot 9, Block 2070, Eastern Division,located at 3305-B Santa Clara Street.

Section 2: The Conditional Use Permit is further restricted to the following provision herewithadopted by the City Council:

1. The C.U.P. shall be issued to Bernardo Morin, and is non-transferable.2. Permittee must own both the lot and any manufactured home placed on the lot.3. The C.U.P. is restricted to the site plan, Exhibit "B", which is made part hereof for all purposes.4. The C.U.P. is restricted to the activities described in letter, Exhibit "A", which is made part hereof

for all purposes.5. The manufactured home must comply with all conditions of the Building Code and comply with

HUD Code.

Section 3: This ordinance shall be published in a manner provided by Section 2.09 (D) of theCharter of the City of Laredo.

Section 4: This ordinance shall become effective as and from the date of publication specified inSection 3.

Section 5: The Conditional Use Permit authorized by this ordinance shall be revoked pursuant tothe Laredo Land Development Code, section 24.94.10, entitled "Revocation," according to the criteriaand procedures described therein and below:

1. Criteria

Any Conditional Use Permit, authorized by City Council, shall be considered in noncompliance andshall be revoked and removed from the City of Laredo Zoning Map, in the event a court of law finds theuse in violation of any of the following conditions:

A. The use established on site does not conform, at any time, with any or all permit condition(s)approved by the City Council and or any local, state, or federal law.

B. The activity authorized by the Conditional Use Permit commences prior to the institution ofall conditions imposed by the Conditional Use Permit.

C. Discontinuance of the Council approved conditional use for a period of six (6) consecutivemonths.

D. The use of which the Conditional Use Permit was authorized does not commence within sixmonths of City Council's final approval date.

2. Procedures

Should City of Laredo Enforcement Official inspection reveal noncompliance with Laredo LandDevelopment Code, Subsection 24.94.10, Conditional Use Permit revocation procedures shallcommence as below stipulated:

A. A Zoning Officer shall, upon discovery of conditional use permit noncompliance as perSubsection 24.94.10, issue a written warning, granting a grace period of a minimum of ten(10) working days, within which time the use may be brought into compliance with thecurrent City Council approved Conditional Use Permit for that location.

B. If noncompliance persists after the conclusion of the warning grace period, a ZoningEnforcement Official shall issue a written citation.

C. Should the citation result in a guilty verdict, the City of Laredo shall consider the ConditionalUse Permit revoked and proceed with its removal from the City of Laredo Zoning Map.

D. The Planning Director shall then issue the permit holder written notification of theConditional Use Permit's official revocation and removal from the City of Laredo ZoningMap.

E. In the event of discontinuance or failure to commence as stipulated in Subsection 24.94.10.1D and E of this Ordinance, Zoning Enforcement Staff will issue written notification of same.Ten days after issuance of Zoning Enforcement notification of discontinuance or failure to

This Non Exclusive UtilityEasement is hereinafter referred to as the "Easement".

This Grant, however, is made and accepted subject to any and all validly existingencumbrances, easements, mineral leases, conditions and restrictions, relating to the hereinabovedescribed property as now reflected by the Official Public Records of Webb County, Texas.

To have and to hold, the same perpetually to Grantee, together with the right andprivilege, at any and all times to enter said Easement or any part thereof, for the purpose ofconstructing, reconstructing, repairing, and maintaining said utility easement, including allnecessary laterals and appurtenant facilities, subject to and upon the following terms andconditions:

1. Non Exclusive. Grantor excepts from this Easement and reserves unto themselves, theirsuccessors and assigns, the right to build streets and roads, as long as such use does notunreasonably interfere with the Grantee's use.

2. Reversion. This grant and all rights associated therewith shall terminate and revert toGrantor should Grantee: fail to substantially complete the construction of the initial water andsewer lines on or within twelve (12) months of the date of commencement of construction.

3. Access. Grantee will only access the Easement exclusively off of Shiloh Drive in theCity of Laredo.

4. No Surface Facilities. No facility or equipment installed or constructed hereunder iconnection with the Easement shall extend above the surface of the ground, except that Grante 11=shall be permitted to place or extend to the ground level, sewer manholes, manhole collars an 00manhole covers, however not to exceed twelve (12") inches, or to a level sufficient to reasonabl ~ '~\

avoid inundation from flooding or as dictated by best engineering practices. Grantee shall not (a)fence or otherwise enclose this right-of-way or any part thereof; (b) install any telephone lines,telegraph lines, electric lines or any other surface or overhead lines on, over or across this Easement;or (c) disturb any streets or roads constructed by Grantor, without the prior written consent ofGrantor, except to fulfill the purpose of the easement as set out in the Habendum clause, also orupon the dedication of any street or road constructed on the easement to the City of Laredo, thisprovision (c) shall become null and void.

5. Construction, remediation and removal. Grantee shall install initial water and sewer lines inaccordance to the terms of the Letter Agreement dated April 18, 2013 executed by Grantor andGrantee and attached hereto as Exhibit "B"

TEMPORARY CONSTRUCTION EASEMENT

That the undersigned, Roberto Rodriguez, hereinafter referred to as "Grantor", for and

in consideration of the sum of TEN DOLLARS ($10.00) cash, and other good and valuable

consideration in hand paid by the Grantee herein named, the receipt of which is hereby fully

acknowledged and confessed, has GRANTED, and by these presents does hereby GRANT, unto

the CITY OF LAREDO, a municipal corporation and political subdivision of the State of

Texas, hereinafter referred to as "Grantee", a temporary construction easement for the purpose of

enabling the Grantee, its employees, agent and representatives to have working space to

construct a water and sewer lines and in the construction of a drainage channel on the and for

such purpose this temporary construction easement give Grantee the right to enter upon and

across the following tract ofland in Webb County, Texas:

An approximately fifty foot (50') wide strip of land, adjacent to and abutting, theeast boundary line of a sixty foot (60') City of Laredo "Non Exclusive UtilityEasement", as depicted on a survey attached hereto as Exhibit "A",

This temporary construction easement, however, is made and accepted subject to any and

all validly existing encumbrances, easements, mineral leases, conditions and restriction, relating

to the herein above described property as now reflected by the Official Property Records, of

Webb County, Texas.

This temporary construction easement is granted on condition that the Grantee return

possession of the said tract of land in the same or better condition than when the temporary

easement was granted, and it is granted on the further condition that it shall terminate not later

than twelve (12) months after the date of comencement of construction.

The conveyance of this temporary construction easement is made upon the express

condition that the easement be used for the construction of the improvements to the Utility

Easement and the Drainage Easement.

The City of Laredo, Grantee, in consideration for the temporary use of the Property,

expressly and contractually agrees to hold harmless Robert Rodriguez, Grantor, from any injury,

loss, and damages to persons and property resulting from the Grantee's activities on the Property

and further agrees to provide either a separate liability coverage policy with Grantee's present

insurance carrier or to add Grantor's Property and Grantor to its present insurance policies

protecting Grantor in addition to the City for injuries, loss and damages resulting to persons and

property resulting from Grantee's activities on the Property.

Provided however, there is reserved to the Grantor, its officers, employees, agents and

representatives, the right to use the temporary construction easement areas described herein, for

access to, from and along the Grantor's abutting real property, including the right of passage on,

through and along the easement, and the right to cross over, on or under that easement, for access

to and from the Grantor's abutting property.

Dear Mr. Rodriguez,

This letter reflects the terms of the agreement reached between Roberto Rodriguez,Landowner, and the City of Laredo Utility Department represented by you, wherein Landowneragreed to grant the City of Laredo a Non Exclusive Utility Easement consisting of 41,493 sq. ft. setdescribed more particular on the attached exhibits to this letter, in exchange for the following:

The CITY shall within three (3) months from the date of the Non Exclusive UtilityEasement commence the construction and installation of a water line and sewer linealong the eastern most side of a street the City proposes to be run from existingShiloh Dr. to the C P & L Easement along the east side of the Rodriguez channeldescribed in the Exhibit "A" to the Non Exclusive Utility Easement, sometimereferred to a Backwoods Road, in a size capable of providing services of four (4)water taps and four (4) sewer taps in accordance with City specifications to becoordinated with the City's Utilities Department and Rodriguez's engineer designingand platting, all of the Rodriguez then owned property in the subsequent phases ofthe Shenandoah Valley Subdivision as per the Shenandoah Valley master planapproved October 2, 2003 or as may be amended. The completion and installationof the water and sewer line shall be completed within 12 months of the beginning ofconstruction of the improvements.

Authorizing the City Manager to continue using the Webb County Jail toincarcerate prisoners that are arrested for Class C misdemeanor violations andto amend the current agreement with Webb County by setting a daily rate of$62.50 per day per prisoner. The daily rate is subject to change in accordancewith the rate allowed by the United States Government for incarceratingfederal prisoners in the Webb County Jail. Subject to continued appropriation,the agreement will continue annually unless written notice from either party todiscontinue the services is submitted. Webb County Jail is the only sourcethat provides this service within our geographic area.

May 15, 2006 and November 15, 2004

In the past, the City of Laredo has been utilizing the Webb County Jail to incarcerate anyone who hasviolated Federal, State, and Local Laws. Furthermore, the City of Laredo has been paying Webb Countyfor incarcerating Class C Misdemeanor offenders. These offenders are arrested for violating CityOrdinance and/or for non-payment of fines owed to Municipal Court. Presently, Webb county has settheir rate at $62.50 per day for each prisoner incarcerated for Class C Misdemeanor offenses. Theprevious rate was at $56.84 was established in May 15, 2006 in accordance with the United StatesGovernment. Prior to that rate the rate was at $49.43 established in November 15, 2004 in accordancewith the United States Government. The daily rate is subject to change in accordance with the rateallowed by the United States Government for incarcerating federal prisoners in the Webb County Jail.The Webb County jail is the sole source within our geographical area that provides this service.

FINANCIAL:

Expenses are to be paid by the City of Laredo's General Fund. Funds are budgeted in the PoliceDepartment's operational budget account number 101-2366-523-5586 inmate processing.

BACKGROUND:The project consists of the construction of 1800 linear feet of Backwoods Drive from just south of Yukon Driveto Shiloh Drive. The work includes, but is not limited to site clearing, rough grading, excavation, embankment,preparation of subgrade, installation of base material and asphalt, installation of concrete, sidewalks,installation of waterlines and storm drainage system, including all appurtenances and incidentals as shown inthe construction plans and specifications. Plans and specifications were prepared by Sherfey EngineeringCompany, L.L.c., Laredo, Texas.

Four (4) bids were received at the City Secretary's Office at 4:00 P.M. on Monday, May 13,2013, and publiclyopened, read, and taken under advisement on Tuesday, May 14,2013, at 10:00 A.M.

There were mathematical errors in the bids of Vision Construction and Qromex Construction with no change inthe low bid. The corrected bids are as follows:

Public transportation has the abilityto save people money, conserve gasoline, and reduce the harmful greenhousegases emitted into our environment. By participating in DUMP THE PUMP DAY,the City of Laredo will help build support for public transportation. EI Metro plansto promote the event through several planned activities at the Transit Center inaddition to the free fares. Mayor Salinas will issue a proclamation declaring June20, 2013 as DUMP THE PUMP DAY in Laredo.

FINANCIAL IMPACT:The average passenger revenue that would be lost due to free fares for a Thursday isapproximately $11,000.
