P R O C L A M A T I O N

WHEREAS, on September 17, 1968, the 90th Congress authorized President Lyndon B. Johnson to issue annually a proclamation designating the week including September 15 and 16 as National Hispanic Heritage Week to honor the contributions of Americans who trace their roots to Spain, Mexico, the countries of Central and South America and the Caribbean; and

WHEREAS, on August 17, 1988, Congress amended the former resolution, authorizing the President to extend this recognition into an annual month-long celebration, from September 15 through October 15 as Hispanic Heritage Month; and

WHEREAS, Hispanic Heritage Month celebrates the achievements of Hispanic Americans in the Arts, Education, Entertainment, Government, History, Law, Literature, Medicine, the Military, Music, Politics, Science, Sports, and other endeavors; and

WHEREAS, the City of Manassas recognizes the contributions that local residents make in our community to promote Latino culture and heritage including Lourdes Kite, Cesar Brioso and Angie Carrera who worked tirelessly to help create and promote the special exhibition Bridging Cultures: The Latino Community in Manassas now on display at the Manassas Museum; and

WHEREAS, the City of Manassas Museum, in partnership with the Prince William County Chamber of Commerce and local Hispanic business leaders and residents opened the Bridging Cultures exhibition in April, 2019 and continue to provide associated programming around this special show ; and

WHEREAS, the Manassas Museum partnered with Osbourn High School Calas Club students to produce a video about the tradition of the Quinceañera and worked with students to capture stories of their idea of the American dream especially for use in the Bridging Cultures exhibition;

NOW, THEREFORE, I, Harry J. Parrish II, Mayor of the City of Manassas, Virginia and on behalf of the Manassas City Council, hereby proclaim September 15 through October 15 as

Hispanic Heritage Monthin the City of Manassas and take great pride and pleasure in drawing special public attention to the contributions of Hispanic citizens that improve the quality of life in our community and in communities across the nation.

            PROCLAMATION

WHEREAS, Car Free Day is celebrated in 2,000 cities and in 46 countries, with a common goal of reducing the number of cars on streets, reducing traffic congestion, and improving parking demands and overall mobility; and    WHEREAS,  Car Free Day benefits the National Capital Region, including the City of Manassas, by improving traffic‐related air pollution, by reducing noise, and by encouraging energy conservation; and    

WHEREAS, Car Free Day provides health benefits not only by improving environmental conditions, but also by promoting active transportation such as walking and biking; and    WHEREAS, Car Free Day benefits the National Capital Region, including the City of Manassas, by enhancing the quality of life for its residents and by creating healthy and vibrant communities; and    WHEREAS, Car Free Day supports the City of Manassas mobility vision, which seeks to provide and promote a multi‐modal transportation system throughout the City; and    WHEREAS, Car Free Day supports the City of Manassas strategic plan by increasing pedestrian, bike, and traffic safety awareness; and    WHEREAS, the National Capital Region Transportation Planning Board proclaimed September 21 through September 23, 2019 as Car Free Days throughout the Washington Metropolitan Region; and    WHEREAS,  the  City  of  Manassas  and  partners  will  celebrate  Car  Free  Day  on  Saturday, September  21  at  the  Farmers Market with  information  from  the  City  and  partners  on  the  topic  of transportation, a walking tour, a community bike ride, and a pop‐up park.        NOW, THEREFORE, I, Harry J. Parrish II, Mayor of the City of Manassas, Virginia and on behalf of the Manassas City Council, hereby proclaim September 21 through 23, 2019 as

P R O C L A M A T I O N

WHEREAS, National Preparedness Month is a nationwide effort first sponsored by the U.S. Department of Homeland Security in 2004; and

WHEREAS, National Preparedness Month creates an important opportunity for Manassas citizens to prepare their homes, businesses, and communities for any type of emergency from natural disasters to attacks of terrorism; and

WHEREAS, emergency preparedness is everyone’s responsibility; and

WHEREAS, Manassas residents have suffered through many natural disasters over the years including blizzards, hurricanes, tornadoes, and in 2011 an earthquake; and

WHEREAS, the Manassas City Council joins the City of Manassas Fire and Rescue Department’s Emergency Management Division in recognizing the value of emergency preparedness for citizens of Manassas and City Government; and

WHEREAS, the number of declared major disasters has nearly doubled since the 1980s; and

WHEREAS, experience has shown that communities are not truly prepared for a disaster until every individual, family, and household takes responsibility for preparedness; and

WHEREAS, since we cannot always know when and where a disaster will occur, as citizens of the City of Manassas, we can prepare ourselves by creating a family emergency plan, by choosing an out-of-town emergency contact, by assembling an emergency supply kit, and by getting involved in community preparedness and becoming informed about the types of emergencies and related emergency actions that can occur in our community;

NOW, THEREFORE, I, Harry J. Parrish II, Mayor of the City of Manassas, Virginia and on behalf of the Manassas City Council, hereby proclaim the month of September 2019 as

National Preparedness Monthin the City of Manassas and encourage all citizens and civic organizations to recognize the importance of preparedness by evaluating and updating their plans for the aftermath of a large-scale emergency.

3. AUTHORIZATION OF A CLOSED MEETING

3.1 Authorize a Closed Meeting

COUNCIL MEMBER WOLFE MOVED that the City Council convene in a closed meeting to discuss the terms and conditions of a proposed interjurisdictional agreement for shared services, where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the City, as authorized by Virginia Code §2.2-3711 (A) (29). Seconded by Council Member Sebesky. Roll call vote: AYES – Davis-Younger, Ellis, Sebesky, Smith, and Wolfe. ABSENT FROM MEETING– Lovejoy. MOTION CARRIED.

4. AUTHORIZATION OF A CLOSED MEETING

4.1 Certify a Closed Meeting

COUNCIL MEMBER WOLFE MOVED that Council certify that, in the closed meeting justconcluded, nothing was discussed except the matter (1) specifically identified in the motion toconvene in a closed meeting and (2) lawfully permitted to be discussed under the provisions ofthe Virginia Freedom of Information act cited in that motion. A Regular Meeting of the Council of the City of Manassas, Virginia was held in Council Chambers, City Hall, on the above date with the following present on roll call: Mayor Harry J. Parrish II, Council Members Michelle Davis-Younger, Theresa Coates Ellis, Ian T. Lovejoy, Pamela J. Sebesky, Ralph J. Smith; City Manager W. Patrick Pate, Deputy City Manager Bryan Foster, Deputy City Clerk Cheryl Santos, City Attorney Craig Brown, Police Chief Doug Keen, Airport Director Juan Rivera, Communications Manager Patty Prince, IMCA Fellow Kimberlee Short. Absent from Meeting: Council Member Mark D. Wolfe.

Mayor Parrish called the meeting to order at 5:33 p.m., delivered the invocation, and led those present in the Pledge of Allegiance.

COUNCIL TIME

Council Member Lovejoy had no comments.

Council Member Sebesky welcomed all the students back to school. She also reminded citizens to continue to keep looking at the Boards, Committees, and Commissions they are interested in and fill out an application.

Council Member Davis-Younger stated that the council has been on recess but yet, while on recess still continued to attend various events which consisted of a ride along with Officer Crossey. She reported attending several ribbon cuttings and both National Night Outs at the Lawn and at Georgetown South. She reported spendingtime with Monica Boehringer and shadowing her while she performed her duties. Shealso reported attending the Big Shred and talking with Patrick Small to talk about Economic Development. She reminded everyone on August 29 at 7 pm, there will be a Grant Avenue Streetscape Meeting. She also noted that Georgetown South is looking for tutors to help with students starting September 10 for students from Grades 1-6. She reported that the Jennie Dean Foundation has been able to raise $100,000. She further reported that the City Leadership Academy will be starting soon and urged citizens to sign up if they want to know more about the City and noted that the next Council Meeting will be September 9.

Council Member Ellis welcomed all students back to school. She reported that she is the Council Liaison for the Economic Development Authority (EDA), which just wrapped up their Strategic plan and should be getting information out soon. She stated that visitation numbers have gone up this year.

Council Member Smith wished all the students a successful school year. He stated he accepted the School Board’s invitation to attend the School Board’s meetingand was interviewed as the newly appointed elected council member by a gentleman who was trying to obtain his merit badge.

MAYOR TIME

Mayor Parrish provided an update on the closing of Peebles Department Store.

He stated he has been asked by several council members to add to the agenda the decision of nominating a Vice-Mayor, which will be done after the Consent Agenda.

Mayor Parrish asked Council to consider ending the meeting early due to the light agenda.

Further, Mayor Parrish asked Council whether they still wanted to send a representative to the School Board to work on their budget, and if so, who should participate.

Mayor Parrish noted that future work sessions will deal with important issues such as the update on the fire station, location of city offices as relates to the potential use of the DMV building, and the performance evaluation of City Manager, Pat Pate.

STAFF REPORTS

City Manager, Pat Pate, reported Peebles Department Store has been serving this community for 61 years and will be closing at the end of this year, but will reopen as Gordmans in 2020. He welcomed Humbrecht Law Office to the City of Manassas. He reported that visitors to the City are on the rise and reminded folks to be mindful of our visitors. Further, he reported that school is off to a successful start and ABC News attended opening day. He asked that drivers please be aware and stop when the school buses have their arms out. He alerted drivers that the school buses are outfitted with cameras, so even if you do not see a police officer, you may still get a ticket. Mr. Pate reported that until October 15, Columbia Gas will be working on their gas lines at the intersection of Godwin Drive and Nokesville Road at the very edge of the City. He also reported that on August 29 at 7 pm, at Georgetown South Community Center, there will be a meeting on the Grant Avenue Streetscape Project Plan. He stated that onSeptember 6, during First Friday, new ABC law will allow people to carry alcohol purchased at local restaurants within marked boundaries.

SUBSTITUTE MOTION TO REMOVE FROM THE AGENDA CONSIDERATION OF VICE-MAYOR

COUNCIL MEMBER ELLIS MOVED a substitute motion to remove consideration of appointing a Vice-Mayor until the September 9 meeting when there is a full Council. Seconded by Council Member Lovejoy. Roll call vote: AYES – Ellis, Lovejoy. NAYS – Davis-Younger Sebesky, and Smith. ABSENT FROM MEETING –Wolfe. MOTION FAILED.

Introduction

The City of Manassas Planning Commission fulfills the appointed duty of advising the City Council on new development, land use, zoning issues, Capital Improvement Program (CIP) recommendations, and planning issues in the City. This report details the land use actions reviewed by the Planning Commission in FY19 reporting period (July 1, 2018 to June 30, 2019) and outlines actions identified for FY20.

Responsibilities

The Planning Commission serves in an important advisory capacity to the City Council as required by Sec. 15.2-2210 of the Code of Virginia. The Planning Commission exists “to promote the orderly development of such political subdivision and its environs.” The duties and responsibilities of the Commission as set forth in the State Code include:

Making recommendations and an annual report concerning the operation of the Commission and status of planning within the City.

Preparing, publishing, and distributing reports, ordinances, and other material relating to its activities.

Preparing a Comprehensive Plan for the physical development of the territory within its jurisdiction.

Reviewing and approving new public facilities.

Reviewing and making recommendations on special use permit and rezoning applications.

Activities

The Planning Commission met in seven regular meetings and one worksession to act on land use cases. The Planning Commission acted on five (5) special use permit cases, three (3) rezonings, and two (2) zoning text amendments, recommending approval for:

A height modification to the telecommunications tower at Stonewall Park

A new telecommunication tower on Dean Drive

A height modification for Micron Technology, Inc.

A motor vehicle repair (minor) use in the Wellington Station shopping center

A medical care facility for sedation dentistry

A comprehensive sign package at All Saints Catholic Church

Jefferson Square, a 105-unit townhouse and single-family detached development

Proffer amendments to remove restrictions on two heavy industrial properties on Redoubt Road.

A zoning text amendment to allow height modifications by special use permit in the I-1 zoning district

A zoning text amendment to make technical corrections and ensure compliance with state and federal laws and regulations

Comprehensive Plan Annual Implementation Report

The Planning Commission is charged with preparing the

City’s Comprehensive Plan and monitoring the progress of

implementation of the Plan’s recommendations. The annual

implementation report

The Manassas 2040 Comprehensive Plan update was the Planning Commission’s major focus in 2019. In preparation for the plan, staff worked with Planning Commission and other Boards, Commissions, and Committees to engage the community in forward-thinking dialogue about the future and vision for Manassas.

Throughout the summer of FY19, the City held six topic specific discussions, seven neighborhood

meetings with HOAs, pop-up booths at four local events, and a town hall forum on transportation, land

use, and housing. With more than 250 meeting attendees, 200 pop-up responses, and 500 visits to

letstalkmanassas.org, the 2018 Community Conversations demonstrated the passion and commitment

that Manassas residents have for their City and its future.

As part of the Comprehensive Plan update, work continued on the City-wide Transportation Master Plan and Comprehensive Housing Plan. These plans provide valuable information and recommendations for Planning Commission’s consideration as it reviews the Comprehensive Plan.

Using the results of the Community Conversations initiative and above-mentioned supplemental plans,

the Manassas Planning Commission Comprehensive Plan Committee met 14 times to draft goals,

objectives, and strategies for the 2040 Comprehensive Plan. The draft 2040 Comprehensive Plan builds

and expands upon the strengths of the existing plan and addresses key issues identified through public

outreach. A public report out meeting was held on June 26, 2019, and included a video overview of the

progress and changes to date. A summary of the update process and upcoming meetings is available at

www.manassascity.org/planmanassas.

A Look Ahead

In FY20, the Planning Commission will continue its work on the Manassas 2040 Comprehensive Plan. The draft plan is anticipated for formal review in Fall 2019.

Commissioner Biographies

HARRY J. CLARK

Mr. Clark has been a resident of Manassas for over 27 years. During that time, he has been active in

promoting and supporting recreation and sports in Manassas. He graduated from Georgetown

University in 1972 with a degree in Economics and entered active duty in the Army, retiring in 1994. He

has been active with the Stonewall Park Summer Recreational Swim Team, holding a position on the

Board for over 20 years. He has been an active supporter of the Osbourn High School Swim Team. He

served as a member and Chairman of the Manassas City Recreation and Parks Committee before being

appointed to the Planning Commission and currently serves as a member of the Freedom Aquatic and

Fitness Center Advisory Board. The Manassas City Council appointed Mr. Clark to serve on the Manassas

Regional Airport Commission. Mr. Clark also serves on the Manassas City Board of Equalization. He

holds a Master of Science Degrees in Business Administration from Boston University and Information

Systems Management from Strayer University. Mr. Clark is a graduate of the Virginia Certified Planning

Commissioner’s Program.

RUSSELL HARRISON

Mr. Harrison and his family have been residents of Manassas since 2002. In addition to the Planning

Commission, he served as Chair of the Manassas Electoral Board from 2014 until May 2017, and was a

member of the Board, which oversees elections in Manassas, for six years. He also volunteers as a CCD

teacher for All Saints Church. Professionally, Mr. Harrison is the Director of Government Relations for

the IEEE, the world's largest technical professional society and leading technology standards association.

He holds a Bachelors Degree in Political Science from Allegheny College, a Masters in Public Policy from

the University of Maryland and is a Certified Association Executive through the ASAE. Mr. Harrison is a

certified Virginia Planning Commissioner.

KEN JOHNSON

Mr. Johnson and his family have lived in Manassas for over 40 years. He has served the community in a

variety of ways--as a scout leader, soccer coach, president of the Osbourn High School 2B Band Boosters

Club, member and Chair of the City's Recreation and Parks Committee, and as Vice Chairman of the

Manassas Traffic Safety Commission. He also served on the Citizen’s Advisory Committee for the

Downtown Sector Plan, led the Bike Trail Committee, and is Chairman of the Zoning Ordinance Review

Committee. Mr. Johnson retired from the Federal government after 32 years of service and is now a

contractor consultant. He holds Masters Degrees in Economics and Information Resource Management

and is a graduate of the Virginia Certified Planning Commissioner's Program.

ROBERT SCHILPP

Mr. Schilpp has been a resident of Manassas for over 32 years. He has served in a variety of capacities

during that time, including as a member of the Bethel Lutheran Church Council for 14 years, and

president of the congregation for six of those years; coaching youth soccer for 20 years; and

participating on several Manassas City School committees. In addition to the Planning Commission,

Mr. Schilpp has been a member of the Board of Zoning Appeals since 2003 and has chaired the board for

the past ten years. He retired from the Department of Defense in 2002, following 34 years of service,

and then worked as a defense contractor for a number of years before becoming an adjunct professor of

history at Northern Virginia Community College. He graduated from Susquehanna University in

Pennsylvania with a degree in history in 1968, and received a Masters Degree, also in history, from

George Mason University in 1997. Mr. Schilpp is a certified Virginia Planning Commissioner.

BILL THOMPSON

Mr. Thompson has been a resident of Manassas for over 25 years. During that time, he has been an

advocate for strong citizen input on development issues affecting the quality of life in Manassas

neighborhoods. He graduated from Western Kentucky University with a degree in Mass

Communications and served as a rotary wing aviator in the Army, National Guard and Reserves for 20

years. Mr. Thompson retired from his positions as Senior Director of Business Operations for the

National Education Association in Washington D.C., Director of NEA Properties, Inc. and Trustee of the

Indiana Education Association in 2015. During his working career, Mr. Thompson managed the

construction and operations of buildings that won awards from the Building Owners and Managers

Association (BOMA) for design and achieved Leadership in Energy and Environmental Design (LEED) Gold

Certification for energy efficient maintenance and operations. Mr. Thompson is a graduate of the

Virginia Certified Planning Commissioner’s Program.

ELAINE TRAUTWEIN

Ms. Trautwein has lived in Manassas for over 22 years. She established her own law practice shortly

after moving to the City with her two children. She has been active in her community and profession

and has previously served as a director of the Prince William County Bar Association. Ms. Trautwein is

certified by the Virginia Supreme Court as a guardian ad litem for children and has represented their

best interests before local courts for many years. Prior to her appointment to the Planning Commission,

she was involved as a citizen participant in the preparation of the Manassas Next 2032 Comprehensive

Plan. She holds a Bachelor’s Degree in Urban Affairs from Virginia Tech and graduated with honors from

George Washington University Law School. Ms. Trautwein is a certified Virginia Planning Commissioner.

Introduction

The Code of Virginia § 15.2-2308(c) and Section 130-525 of the City of Manassas Code of Ordinances

requires that the Board of Zoning Appeals submit an annual report of their actions. In accordance with

these requirements, the following report has been prepared for your benefit.

Authority

The Board of Zoning Appeals of the City of Manassas is a quasi-judicial body established and mandated

by Title 15.2 of the Code of Virginia. The Board Members are appointed by the Chief Judge of the 31st

Judicial Circuit Court upon recommendation of City Council and serve a five-year term at the pleasure of

the Court.

Mission

The Board of Zoning Appeals is charged with a specific limited mission as defined under § 15.2-2308 of

the Code of Virginia. The Board may hear and decide appeals from any order, requirement, decision, or

determination made by an administrative officer in the administration or enforcement of those items

covered under the City of Manassas Zoning Ordinance.

In addition to this review authority, the Board may grant certain variances from requirements of the City

of Manassas Zoning Ordinance, provided strict application of the zoning ordinance would unreasonably

restrict the utilization of the property or that the granting of the variance would alleviate a hardship, as

narrowly defined under § 15.2-2309 of the Code of Virginia.

The Board endeavors to discharge all matters before it in a manner consistent with this mission and

authority.

Activities

In the period of this report (July 1, 2018 to June 30, 2019), no new applications came before the BZA.

Coordination and Staff Support

There continues to be outstanding cooperation among the Board Members and the Zoning

Administrator. Cooperation of this nature results in timely exchange of necessary information and well-

prepared and well-executed staff reports, memoranda, and orders. The Board is appreciative of the

Clerk to the Board of Zoning Appeals and expressly wants to commend her for her thorough and well-

prepared minutes and service to the Board.

Member Profiles

ROBERT W. SCHILPP, CHAIRMAN TERM EXPIRES: APRIL 22, 2019

Mr. Schilpp has been a resident of Manassas for over 30 years and has served his community as a

member of the Bethel Lutheran Church Council and as president of the congregation; as a long-time

youth soccer coach; and as a member of several Manassas City School committees. Mr. Schilpp, who

also serves on the Planning Commission, has been a member of the Board of Zoning Appeals since 2003

and has chaired the board for the past nine years. He retired from the Department of Defense following

34 years of service, and worked as a Defense contractor for a number of years before becoming an

adjunct professor of history at Northern Virginia Community College. He holds a bachelor’s degree in

history from Susquehanna University and a master’s degree in history from George Mason University.

He completed the Virginia Certified Boards of Zoning Appeals Program in the fall of 2002.

JAMES T. NEJFELT, VICE-CHAIRMAN TERM EXPIRES: APRIL 4, 2023

Mr. Nejfelt was first appointed to the BZA in 2005 as an alternate member and became a full member

later that year. He has resided in the City of Manassas since 1983 in the Point of Woods neighborhood,

and is active in his church. Mr. Nejfelt formerly practiced law and now owns Acreage Title. His legal

background and business experience gives him a familiarity with land use issues. He completed the

Virginia Certified Board of Zoning Appeals program in 2007.

ROBERT L. FOX, SECRETARY TERM EXPIRES: APRIL 25, 2021

Mr. Fox was first appointed to the BZA in 2008 as an alternate member and was appointed to regular

membership in 2011. He has resided in the City for over 20 years in the Wellington neighborhood. He

works for the U.S. Army Corps of Engineers on military construction projects. Mr. Fox is a registered

Professional Civil Engineer and a certified Project Management Professional. His background and

experience in land development design/construction projects give him a strong working knowledge of

land use and community issues. He completed the Virginia Certified Boards of Zoning Appeals Program

in 2014.

JAMES J. FLETCHER TERM EXPIRES: MAY 15, 2019

Dr. Fletcher was first appointed to the BZA in 2011 as an alternate member. In March 2014, Dr. Fletcher

was appointed to fill the regular membership position. He has resided in the City since 1974 in the Point

of Woods neighborhood, and served the City as an election official. He is Professor Emeritus of

Philosophy at George Mason University, where he was also Associate Provost and Dean for

Undergraduate Studies. Dr. Fletcher sits on the Institutional Review Board for a biotechnology company

TREGG MAYS TERM EXPIRES: MAY 23, 2022

Mr. Mays was appointed to the BZA in 2018.

JOHN SCANCELLA TERM EXPIRES: MAY 19, 2022

Mr. Scancella was appointed to the BZA in 2017 as an alternate member. He moved to Manassas in

2015 and is presently employed with the DMDC in Alexandria. He has also worked at the Library of

Congress as an Information Technology Specialist and at Boeing as a Programmer. In 2010, Mr.

Scancella received his bachelor’s degree from Franciscan University of Steubenville with a major in

Computer Science and a minor in Mathematics. He loves spending time with his wife and two sons. His

hobbies are blacksmithing, woodworking and cooking Italian food.

MICHAEL GRIFFIN TERM EXPIRES: OCTOBER 23, 2022

Mr. Griffin was appointed to the BZA in 2017 as an alternate member. He has been a resident of

Manassas for 65 years. He graduated from Osbourn High School in 1971. He retired from Prince

William Hospital in 2013 after 40 years of dedicated service. He loves sports and has coached various

youth and adult teams. He is a member of Mount Olive Baptist Church in Centerville, Virginia. Mr.

Griffin is married to Linda who works for Manassas City Public Schools. He enjoys spending time with his

wife, their children and grandchildren. After five years of relaxing and enjoying retirement, he is now

employed part-time at Walmart.

WHEREAS, on September 17, 1968, the 90th Congress authorized President Lyndon B. Johnson to issue annually a proclamation designating the week including September 15 and 16 as National Hispanic Heritage Week to honor the contributions of Americans who trace their roots to Spain, Mexico, the countries of Central and South America and the Caribbean; and

WHEREAS, on August 17, 1988, Congress amended the former resolution, authorizing the President to extend this recognition into an annual month-long celebration, from September 15 through October 15 as Hispanic Heritage Month; and

WHEREAS, Hispanic Heritage Month celebrates the achievements of Hispanic Americans in the Arts, Education, Entertainment, Government, History, Law, Literature, Medicine, the Military, Music, Politics, Science, Sports, and other endeavors; and

WHEREAS, the City of Manassas recognizes the contributions that local residents make in our community to promote Latino culture and heritage including Lourdes Kite, Cesar Brioso and Angie Carrera who worked tirelessly to help create and promote the special exhibition Bridging Cultures: The Latino Community in Manassas now on display at the Manassas Museum; and

WHEREAS, the City of Manassas Museum, in partnership with the Prince William County Chamber of Commerce and local Hispanic business leaders and residents opened the Bridging Cultures exhibition in April, 2019 and continue to provide associated programming around this special show ; and

WHEREAS, the Manassas Museum partnered with Osbourn High School Calas Club students to produce a video about the tradition of the Quinceañera and worked with students to capture stories of their idea of the American dream especially for use in the Bridging Cultures exhibition;

Public Notice: This case has been advertised in accordance with requirements of the Code of Virginia and the City of Manassas, including newspaper advertisement, adjacent property owner notification (a total of 19 mailings), and public hearing signs posted on the property.

PLANNING COMMISSION RECOMMENDATION

Planning Commission held a public hearing on August 7, 2019. No public comment was received. A copy of the Planning Commission minutes and resolution can be found in Attachment 4. Planning Commission recommended approval (6/0) with a recommendation that a condition be added that the permit approval shall lapse should the homeowner transfer the property. Upon further consultation with the Zoning Administrator and City Attorney, this condition cannot be included since a Special Use Permit runs with the property and only can lapse upon cessation of the use for two years or revocation of the SUP by the City Council. The SUP condition has been amended; however, to limit the home business to only a law office, rather than any office use.

STAFF RECOMMENDATION

The request, with the proposed SUP conditions and performance measures, is not anticipated to have a negative land use impact on the existing patterns of development. Staff recommends approval of SUP #2019-06, as conditioned dated September 4, 2019.

ATTACHMENT 1: STAFF ANALYSIS Background and History: The subject property, 9209 Maple Street, is a 20,000 square foot (SF) residential lot and includes a single-family detached structure constructed in 1956. The applicant has requested a special use permit (SUP) for a home business to operate a law office. The applicant is a patent attorney and senior partner of Buesse Wolter Sanks & Maire, PLLC. The proposed home business will have a maximum of three employees, not including the property owner and family members residing in the dwelling unit. The home business will have no clients to the home, and there will be no company vehicles, signage, or any other exterior evidence of a non-residential use. No physical improvements or interior modifications are proposed to the property as part of the home business, and there will be no changes to the character of the dwelling unit. Comprehensive Plan Analysis: The subject property is located in the Mathis Corridor character area of the Comprehensive Plan. The request, with the proposed SUP conditions and performance measures, is not anticipated to have a negative land use impact on the existing patterns of development.

Land Use

Manassas will maintain its existing pattern of residential, commercial, and open space land uses, emphasize improved design principles, promote mixed uses compatible with existing

neighborhoods, accommodate high quality infill and redevelopment where appropriate, and reinforce the unique and positive qualities of diverse neighborhoods.

Home businesses are commercial activities conducted within a dwelling unit that are accessory to the principal residential use where customers and/or employees come to the dwelling unit1. Home businesses are permitted in certain residential districts subject to approval of a special use permit and the performance standards provided in Sec. 130-95 of the Zoning Ordinance (See Attachment 2). Home businesses are a separate and distinct use from home occupations, which are accessory uses with no employees or customers at the dwelling unit. Home occupations are approved administratively in all residential zoning districts. The performance standards for home businesses are intended to ensure that home businesses do not change the character of the dwelling unit or exhibit any exterior evidence of a non-

residential use. The standards include, but are not limited to, a prohibition on business signs and a limit on the area of the house that may be devoted to the home business (25% of the gross floor area). The area devoted to the use is further limited by the Virginia Construction Code (Section 508.2.1), which states that the accessory use shall occupy no more than ten percent (10%) of the building area of the story in which it is located. In addition to the Zoning Ordinance performance standards, the proposed conditions are intended to further minimize impacts of traffic and parking on the residential neighborhood. The conditions prohibit on-site clients and limit the number of employees to no more than three on premise. Hours are operation are also limited to 8 a.m. to 6:00 p.m., Monday through Friday. With these performance standards and conditions, the proposed use is not anticipated to negatively impact the existing residential development.

Mobility

Manassas will have a safe, efficient, multi-modal transportation system with streets sufficient to support businesses and residents, providing public transportation and pedestrian- and bicycle-friendly facilities, while being sensitive to the design context of the City and its neighborhoods.

The applicant has adequate parking on site to accommodate employees as required by the Zoning Ordinance. The conditions require the applicant to maintain off-street parking for employees as designated on the house location survey.

PROPOSED CONDITIONS Overview:

The complete set of recommended conditions is provided in Attachment 2. The conditions, as proposed would permit the home business, subject to the performance standards for home businesses under Section 130-95 of the Zoning Ordinance. Additional mitigating conditions of the SUP are as follows:

- Condition #2 limits the number of employees on premise to three, not including family members residing in the dwelling unit. No customers are permitted.

- Condition #3 requires the applicant to maintain three off-street parking space available for employee use at all times during business hours. Employees shall be required to park in the dedicated off-street parking space.

- Condition #4 limits hours of operation from 8:00 a.m. to 6:00 p.m., Monday through Friday.

In addition to compliance with all applicable zoning, subdivision, and Design & Construction Standards Manual (DCSM) requirements, the development and use of the designated property shall be subject to the following conditions:

1. This special use permit is for a home business (law office) located at 9209 Maple

Street, subject to the performance standards under Section 130-95 of the Zoning Ordinance (Attachment A).

2. A limit of three employees shall be permitted on premise at any one time, not including family members residing in the dwelling unit. No customers shall be permitted on premise.

3. Parking shall be provided for employees within the existing driveway, as designated on the House Location Survey (Attachment B). The applicant shall maintain three (3) off-street parking spaces for employee use at all times during business hours. Employees shall be required to park in the dedicated off-street parking spaces.

4. Hours of operation shall be from 8:00 a.m. to 6:00 p.m., Monday through Friday.

5. The use of this property shall be in compliance with all federal, state, and local

Sec. 130-95. Home businesses.

(a) Notwithstanding any other requirement of this chapter, a home business, where permitted, shall be subject to the following requirements.

(b) General requirements.

(1) A maximum of one home business shall be located in a single-family detached dwelling unit, and shall neither change the character of the dwelling unit nor exhibit any exterior evidence of a non-residential use.

(2) At no time shall the permit holder maintain a permanent residence off-site.

(3) At all times, the on-site operations and supervisory responsibility of the permitted activity shall rest with the permit holder.

(4) Adequate on-site parking shall be provided for employees, customers, and clients.

(5) At no time shall more than two customers or clients be on-site at the same time. Customer or client contact on-site shall be by appointment only. Customer appointments shall be limited to not more than eight appointments a day, and not scheduled before 8:00 a.m. or after 6:00 p.m. Monday through Friday, unless otherwise authorized through the approval of a special use permit.

(6) On-site business signs shall be prohibited. No business sign is permitted on any mailbox.

(7) Motor vehicles used in the home business shall conform to the following requirements:

a. No vehicle used in the home business and with a gross weight of more than 10,000 pounds, in excess of 21 feet in length, or wider than 102 inches shall be parked, garaged, or stored in any residential district.

b. No more than one motor vehicle used in the home business shall be parked, garaged, or stored in any residential district.

c. Any sign maintained on any vehicle used in a home business shall be covered or removed when the vehicle is parked overnight in any residential district.

(8) On-site storage and use of materials, merchandise, or equipment is limited to the following standards:

a. Materials associated with the home business shall be limited to just-in-time delivery and storage practices. No bulk storage on-site is permitted.

b. Exterior storage of equipment, including open trailers and other business-related equipment, materials, or merchandise is prohibited.

c. Interior use of office equipment such as a telephone, fax, computer, or other typical light office equipment necessary to the home business is permitted.

d. All bulk storage of materials, equipment, or supplies must be identified and maintained off-site in an approved storage facility.

(9) No detached accessory structure shall be used for any portion of the home business.

(10) Not more than 25 percent of the gross floor area of a single-family detached dwelling unit, inclusive of any attached garage, shall be used for a home business.

(11) Exterior changes or modification of the single-family detached structure shall be limited to the minimum handicapped accessibility requirements.

(12) The home business shall require a separate occupancy permit for the home business.

SUP #2019-06, Judith Evans Molinelli Home Business 9209 Maple Street Ms. Davis provided an overview of the applicant’s has request for a special use permit for a Home Business to allow a law firm with three employees to operate from the residence. Under the proposed conditions, no customers will be permitted to come to the residence. The request, with the proposed SUP conditions and applicable zoning ordinance performance measures, is not anticipated to have a negative land use impact on the existing patterns of development. Staff recommends approval of SUP #2019-06, as conditioned dated August 2, 2019. Planning Commission Discussion

Mr. Harrison questioned the building code restrictions that require use of only 10% of the floor space. Ms. Davis confirmed this requirement and stated that applicant has worked with the building official to ensure the area dedicated for the home business meets this requirement.

Mr. Thompson asked about the SUP in the event of a sale of the property. The Commission discussed various scenarios regarding the transfer of ownership. Ms. Davis stated that the performance standards apply and that a zoning interpretation might be needed depending upon the specific circumstance. Ms. Trautwein suggested adding the condition that the SUP is not transferrable.

Applicant Discussion Applicant, Judith Molinelli, stated that the property is her primary residence and that other law partners reside in Florida. She also supported the addition of condition that would lapse the SUP if she sells the property. There were no questions for the applicant. CITIZENS’ COMMENT TIME No citizens came forward to speak.
