SUBJECT: Clarifications/Modifications/Bidder Questions

INTENT: This addendum is issued prior to the date bids are due in order to incorporate the following clarifications, additions, omissions, deletions, or changes into the Contract Documents.

Except as hereinafter specified, the work shall be in accordance with the drawings and specifications.

Bidders are to use the changed quantities of the items listed on this addendum in their proposals, and it shall become part of the Contract Documents when construction is executed.

Bidders are reminded that this addendum must be noted on the “Official City Acknowledgment Form” when they submit their proposal. A signed copy of the addendum must also be included with the bid submittal.

This addendum shall become part of the contract documents from this point forward. This Addendum consists of 6 pages and includes the following changes including the attached revised drawings:

Clarification Items

Q1. Drawing Sheet SP-1:

A.1 There are two notes indicating picnic table on conc. Pad. The picnic tables shall be Victor Stanley Model IP-3, 4-foot square top and three 42” seats, surface mounted, frame black, and recycled walnut color slats. Location to be verified in the field with City staff. The bidder shall also include in Bid costs to provide 56 recycled slats, walnut color to be turned over to the city for future maintenance/replacement stock.

Q2. Drawing Sheet SP-1:

A.2 The Bidder shall include in Bid all costs associated with providing and installing 3 new benches at the existing Fountain Gazebo. The benches shall be Victor Stanley Model 4 Bench, surface mounted, frame black, recycled walnut color slats. Location to be verified in the field with City staff.

Q3. Drawing Sheet GE-2:

A.3 Remove the two notes “10’ Square Conc. Pad” and replace with “12’-6” Square Conc. Pad”.

Q4. Drawing Sheet LS-1, LS-2, LS-4, Plant Schedule – Groundcover, Tifway 419 Sod:

A.4 Change the sod shown for the large and small dog park area from Tifway 419 Sod to Celebration Bermuda.

Q5. Drawing Sheet IR-1 & IR-2:

A.5 Modify and Add zones per the attached marked-up drawings.

Q6. Drawing Sheet IR-3 – ReUse Supply Notes:

A.6 Modify the second sentence as follows; “The irrigation system must be connected to the park side of the reuse meter.”

Q7. Irrigation System:

A.7 The Bidder shall install the necessary new irrigation and connection to the re-use line prior to abandonment of existing well and disconnection of existing electrical service. The Bidder shall maintain the irrigation system in operation throughout the entire project duration; this may require relocating or providing a temporary controller, battery and/or generator and any other items necessary to keep irrigation system operational.

Q8. Will Builder’s Risk insurance be required?

A.8 Yes, per the below requirements.

BUILDER'S RISK:

When work includes construction of and/or a major addition per City’s identification to above ground buildings or structures, including bridges, a Builder’s Risk coverage must be provided as follows:

3.5.1. Form: All Risk Coverage. Coverage is to be no more restrictive than that afforded by the latest editions by the latest edition of Insurance Services Office Forms CP 00 20 and CP 10 30.

3.5.2. Waiver of Occupancy Clause or Warranty: Policy must be specifically endorsed to eliminate any "Occupancy Clause" or similar warranty or representation that the building(s), addition(s) or structure(s) in the course of construction shall not be occupied without specific endorsement of the policy. The policy must be endorsed to provide the Builder's Risk coverage will continue to apply until final acceptance of the building(s), addition(s), or structure(s) by the CITY .

3.5.3 The minimum limits to be maintained by the CONTRACTOR are as specified in Section 8.5.

3.6.4 Loss Payee: The City of Palm Coast of Flagler County, Florida, must be included as loss payee.

3.6.5 The CITY retain the right to waive this clause and obtain this coverage at their own cost.

3.66 The Builder Risk limit will be 100% of the completed value to include any change order necessary to avoid any Co-Insurance penalty.

Amount of Insurance (See Section 3.67): 100% of the completed value with a Maximum Deductible of $50,000

Q9. Due to the thanksgiving holiday being on the 27th of November many subcontractors will be working a short week this week and the week after. Would it be possible to postpone the bid due date to 12-18-14 to compensate for this time?

A.9 No, the bid due date will not be extended at this time as 30 calendar days has been allocated for the preparation of bids.
