INTRODUCTION The City of Playford Dog and Cat Management Plan has been prepared in order to provide a planned approach to responsibilities under the Dog and Cat Management Act 1995, and will guide domestic animal management within our community over the next five years.

1.1. Strategic Direction The City of Playford Dog and Cat Management Plan identifies strategies and actions to implement the mission, aims and objectives for domestic animal management, and relates these back to the wider Council planning architecture. The strategies within this plan have been prepared by the Health & Regulatory Services Department who are responsible for animal management within the City of Playford. This plan has been conceived by drawing information from a broad range of stakeholders, with the community asked to comment on the draft prior to adoption by the Council. This Plan contains recommendations for a wide range of actions to be undertaken by Council. These actions will enable the City of Playford Regulatory Services Team to maintain a balance between operational requirements and future directions in relation to domestic animal management. The plan emphasises a proactive combination of education, prevention, encouragement and enforcement. This 5 year Plan has a predominant focus on dogs and cats as they represent the most significant number and type of animals, and have the most significant impact on our community, our environment, our health and well being. A small section on native animals, livestock, birds and other animals has also been incorporated into the plan.

1.2. Our Mission Our mission is to promote and facilitate responsible pet ownership including animal welfare and the benefits of animal companionship. To recognise that companion animals are part of the community and contribute to the quality of life. To this end we will endeavour to enhance awareness of the needs of pets and the responsibilities of their owners whilst respecting the rights of non pet owners and recognising the need to protect the environment.

1.4.2. Encourage responsible dog and cat ownership.

1.4.8. Expenditure of registration fees in the administration or

enforcement of the provisions of the Dog and Cat

Management Act 1995 relating to dogs.

a. Conduct regular reviews of income and expenditure to ensure best practice with available funds.

1.4.9. Plan for integration of pets into urban environments.

a. Include integration of pets into urban environments, particularly with new residential housing, retirement developments and recreational areas through informed decision-making and planning that accounts for the popularity, value and place of pets in society.

1.5. Resources The funding of this Plan will be in accordance with the Annual Budget of the Council through the recurrent and project process. This will determine the rate of implementation. Individual initiatives have budget estimations detailed in the Action Plan. Section 26 (3) of the Dog and Cat Management Act 1995 requires that ‘money received by a Council under this Act must be expended in the administration or enforcement of the provisions of this Act relating to dogs’. Expenditure for the administration and enforcement of the Dog & Cat Management Act is presently derived from four principal sources, ie: general rate revenue, dog registration, expiation fees and fines for breaches of the Act. Dog registration and expiation fees are applied by Regulations under the Act, whilst fines are applied as a result of court action.

1.6. Review This Animal Management Plan will be reviewed on an annual basis.

2. Legislative Requirements The Dog and Cat Management Act was enacted in 1995 and brought in a new legal framework to South Australia covering both dogs and cats. The main objectives of the Dog and Cat Management Act being: • Encourage responsible dog and cat ownership • Reduce public and environmental nuisance caused by dogs and cats, and • To promote the effective management of dogs and cats (including

encouragement for the de-sexing of dogs and cats)

Animal control has changed substantially since the introduction of the Dog and Cat Management Act 1995. Knowledge of both animal and human behaviour is now a requirement of those working in the field. There is growing recognition that enforcement of laws will not, on its own, result in lasting, voluntary changes in behaviour. The law needs to be supplemented by a range of non-regulatory approaches such as public education, inclusion of integration of domestic pets into new residential development, improved signage, partnerships with animal welfare agencies and other initiatives. There is now considerable evidence to support our understanding of the benefits of owning pets. This implies a potentially new role for Council in harnessing the benefits of pet ownership or at least maintaining the ability of the community to continue to own dogs and cats. In this new environment, it is essential that Council take a strategic approach to managing domestic pets. This strategy will provide the Council with a sound basis and direction from which it can plan, co-ordinate and make future decisions to meet the needs of the community over the next 5 years. As a result of a review of the Dog and Cat Management Act 1995 several changes came into effect from 1 July 2004 including the requirement for councils to develop Animal Management Plans.

2.1. Responsibilities The responsibilities for dog and cat management in South Australia are prescribed in the Dog and Cat Management Act 1995. Councils are required under the Dog and Cat Management Act 1995 to administer and enforce the provisions relating to dogs within its area. Prescribed responsibilities include the appointment of a Registrar, maintenance of a dog register, the appointment of dog management officers, detention of dogs seized, penalties that can be imposed on dog owners for non compliance, and various other obligations. The provisions in relation to cat management are minimal and councils may appoint a cat management officer. A council is also able to make By-Laws relating to the management of dogs and cats within its area. City of Playford is required to pay 20% of dog registration fees to the Dog and Cat Management Board each year. The remainder of registration fees collected must be expended in the administration or enforcement of the provisions of the Dog and Cat Management Act 1995 relating to dogs. The Dog and Cat Management Act 1995 also provides for the appointment of the Dog and Cat Management Board, which has responsibility for the following:

• To plan, promote, and advise on effective management of dogs and cats in the State; To monitor councils management of their responsibilities; To issue guidelines for councils, to advise and assist Councils to undertake their responsibilities; To provide advice to the Minister;

• To keep the Act under review; • To undertake research into companion animal management and; • To provide education programs for dog management officers and community

awareness information.

3. Description of Area

The City of Playford covers 345 square kilometres and is the third largest council area in metropolitan Adelaide but has the second lowest population per hectare. Approximately 85% of the area is classified as open space. Playford is bounded by the District Councils of Mallala and Light, the Town of Gawler and the Barossa Council to the north, the Adelaide Hills Council to the east, the Cities of Salisbury and Tea Tree Gully to the south and Gulf St Vincent to the west. The City includes the suburbs and localities of Andrews Farm, Angle Vale, Bibaringa, Blakeview, Buckland Park, Craigmore, Davoren Park, Elizabeth, Elizabeth Downs, Elizabeth East, Elizabeth Grove, Elizabeth North, Elizabeth Park, Elizabeth South, Elizabeth Vale, Elizabeth West, Gould Creek, Hillbank, Humbug Scrub, MacDonald Park, Munno Para, Munno Para Downs, Munno Para West, One Tree Hill, Penfield, Penfield Gardens, Sampson Flat, Smithfield, Smithfield Plains, Uleybury, Virginia, Waterloo Corner and Yattalunga.

The City’s boundaries are the Gawler River, Wingate Road, Dalkeith Road, Smith Road and the South Para River in the north, Bassnet Road in the east, Airstrip Road, Hannaford Hump Road, One Tree Hill Road, Gould Creek, Little Para River, Prunus Avenue, Jarvis Road, Porter Street, Commercial Road, the Gawler railway line, the northern boundary of the Defence Science and Technology Organisation facility and the Edinburgh RAAF Base, Heaslip Road and a line to the north of St Kilda in the south and Gulf St Vincent in the west.

3.1. Demographics Playford had the fastest population growth rate in SA between 2009 and 2010. Our population has risen to 79,850, a 3% increase from 2009 to 2010, with an average of 47 people per week choosing to make Playford their home from 2006-2010.

• Approximately 4 in every 10 attacks were by unknown dogs and approximately

another 4 in 10 attacks were by dogs owned by family, friends or neighbours. • Consistently, most attacks occurred either in the street or a public park, or

another person’s house. • Approximately 1 in every 5 attacks was reported to the local council and the

severity of the injury sustained had little influence on whether the attack was reported.

• The incidence of dog attacks in South Australia over the past three years was 3.5% of the population.1

4.3. Pet Ownership in Australia

• 12 million Australians are associated with pets. • 64% of the 7.5 million households in Australia own pets. • Australia has one of the highest incidence of pet ownership in the world. • Typically, the major carer of the pet is female, married with children, living in

the suburbs and most likely employed. • 91% of pet owners report feeling 'very close' to their pet, reinforcing that pets

are an integral member of the family unit, however constituted. • Pets were a normal part of childhood for more than 83% of Australians. • Of the Australians who do not currently own a pet, 53% would like to do so in

the future.2

4.4. The Economic Benefits of Pets

The pet care industry is one of the largest in Australia. $4.62 billion is contributed to the economy annually and 44,700 people employed through the pet care industry.5

In aggregated terms, the pet care industry is among the largest in Australia - both in terms of turnover and employment.

Of the total expenditure on pets, 59% is spent on dogs and 26% on cats.6

4.5. Health Benefits of Owning a Pet

Pets offer reliable and unconditional companionship and love that can be most rewarding. The relationships between human and pet do not require the same effort as human ones, yet the rewards are love, gratitude, fun, recreational activity and companionship.

Companion animals help to counter the problems of loneliness, isolation and the sense of vulnerability. According to the Petcare Information and Advisory Service pet owners are less likely to report feeling lonely than non-pet owners and 58% of owners say they met and made friends through having pets Compared to non- pet owners:

o people who own pets typically visit the doctor less often and use less medication

o pet owners, on average, have lower cholesterol and lower blood pressure

o pet owners recover more quickly from illness and surgery o pet owners deal better with stressful situations o pet owners are less likely to report feeling lonely

It is estimated that 1999-2000 Australian cats and dogs saved $3.86 billion of current national health expenditure.9

• 88% of respondents believed that pet dogs help to deter burglars. • 92% felt very close to their pet. • 56% felt that that having their pet around helped them to meet new people and

make new friends. • 62% felt that the presence of a pet made it easier to get into conversation and

create a friendly atmosphere.10

Pets serve us in many ways - not only for companionship but also for work and as therapy. Studies have shown there is a marked increase in social contact if disabled people have an animal with them. Pets act to break down the barriers.

Pets have proved invaluable in a number of roles. Examples are: guide dogs for the blind, 'hearing' and assistance dogs for the disabled, and 'sniffer' dogs used by police and customs. Sheep and cattle dogs help with stock work. Horses help with riding for the disabled programs. Cats provide vermin control. Companion animals assist with therapy in hospitals, prisons, psychiatric institutions, nursing homes and schools.

5. CITY OF PLAYFORD & ANIMAL MANAGEMENT The City of Playford is committed to good animal management practices and recognises the importance and health benefits of animals in people’s lives. Playford’s six Community Inspectors carry out a wide range of duties daily including animal management, fire prevention, parking and litter control. Approximately 80% of a Community Inspector’s time is taken up with animal management issues across our large and diverse council area. Issues range from stray dogs, nuisance cats, wandering stock and fauna. The Community Inspector team provides a 7 day, 24 hour a day service.

5.1. Animal Welfare League Pound/Shelter

In 2003 it was recognised that the City of Playford needed a long term solution for impounding animals whilst at the same time providing good animal management practices and meeting the community’s needs. This led to the development of a modern and well designed shared pound/shelter facility between City of Playford and the Animal Welfare League (AWL) a non for profit organisation. Prior to 2003 the City of Playford owned two dog pound facilities located at two separate depot sites both of which were old and non compliant with OHS&W requirements and the Code of Practice for the Handling of Companion Animals in Shelters. The costs and risks associated with the pounds were increasing and the potential sale of both sites housing the pounds was an issue.

Both dog pound facilities were inadequate for the volume of dogs impounded and health related problems continued to persist. The parvo virus was often not detected until too late and saw the pounds frequently closed with impounded dogs being euthanased or quarantined with a private pound operator. Added to this, the private pound operator was used on a weekly basis for overflow and this had become a financial burden on the budget. Council often received complaints from the RSPCA, AWL and the dog owners who were unhappy with the conditions their dog had been kept in. There was a lack of security, no access to a wash area, toilets, first aid or vehicle wash down area for Community Inspectors after hours. There was also no impounding facility for cats, livestock or native animals. Community Inspectors would ask local farmers to hold stray livestock and native animals would often be taken home by council staff until collection by fauna rescue or national parks. All unidentified cats were taken directly to a local veterinarian and euthanased. Council staff would frequently come under fire from distressed cat owners when they discovered their pet had been euthanased. The need to address the community’s concern and future changes in cat legislation required a plan for the future. The new pound/shelter facilities opened to the public in April 2005. Both City of Playford and Animal Welfare staff work together to achieve a high standard of animal management care and practices. The Animal Welfare League supports communities by:

• Providing shelter for lost, stray & abandoned companion animals, • Assisting people to reunite with lost pets, • Assisting Local Councils with urban animal management, • Providing community education regarding animal care and responsible pet

ownership with a focus on community groups and children, • Providing other animal care support to the community, such as boarding, grief

counselling, cremation and memorial garden services, • Providing a quality pet adoption service.

In 2011 Animal Welfare League received 6103 abandoned dogs and more than 7989 abandoned cats through its Adelaide shelters.

5.2. Cats

5.2.1. By-Law & Permits The City of Playford By-Law 5 (See Attachment 2) requires cat owners to identify their cat, ensure they do not cause a nuisance and restricts the number of cats to two per property. At the Ordinary Council Meeting 25 October 2011 consideration was given to the further development of By-law No. 5 - Cats to determine if the registration of cats should be included. A decision was made that Council maintains the existing Cat By-Law no 5 without amendment. In order to ensure that Council were provided with adequate information to assist in their decision making, information was sought on other Councils and a number of other sources. Every Council in South Australia has the ability to introduce cat management By-laws, subject to the enforcement of the Dog and Cat Management Board and the Legislative Review Committee. In 2011 only 18 of the 69 South Australian Councils have Cat By-laws and only 5 (Kangaroo Island, Roxby Downs, Victor Harbor and Whyalla) have introduced cat registration. A number of Councils, including Port Adelaide Enfield, have considered the introduction of a cat by-law but have determined not to implement one, due to the complexity of compliance and the additional resources required. A significant research into cat management Australia wide was undertaken from the following sources: Australian Veterinary Association (SA Division); RSPCA; Animal Welfare League; Dog and Cat Management Board; The Cat Protection Society of SA (Inc); Cats Assistance to Sterilise (Inc); Tea Tree Gully Support Group; City of Charles Sturt; Kangaroo Island Council; Corporation of the City of Whyalla; New South Wales Department of Local Government; Victorian Department of Sustainability and Environment; Department of Primary Industries and Fisheries–Brisbane; Western Australian Local Government Association; Shire of Serpentine-Jarrahdale, Western Australia; Albury City Council; Armidale Dumaresq Council; Broken Hill City Council; Ballarat City Council; and City of Greater Geelong. Information is also drawn from ‘Options for Possible South Australian Cat Amendment Legislation - Regulatory Impact Assessment Report’ – July 2008 (prepared for the Dog and Cat Management Board of SA) and ‘Review of Strategies for Effectively Managing Unwanted Dogs and Cats in Queensland 2008’ prepared by Monash University. Cats are defined in three categories as follows:

• Owned – live within a human environment whereby they are provided with food, shelter and veterinary care,

• Stray/community cats – cats that may be wild although still live in a human environment where they are feed by residents but have no shelter or veterinary care,

• Feral – cats that live completely without human intervention. The following points were taken into account when considering the option of cat registration:

• 75% of nuisance cats impounded are strays, • Registering owned cats will not address the issue of stray/un-owned nuisance

cats, • 92% of owned cats are desexed and microchipped, therefore most owned cats

are identified and on a microchip registration data base currently, • Registration would require the cat owner to keep a collar and registration disc

on the cat (currently owners are required to have on the cat a collar and tag containing the owner’s details, under the City of Playford By-law No. 5 – Cats).

• Information from other Councils around Australia indicates that only about 25% of cat owners actually register their cats, although this is slowly increasing.

• There has been no reduction in the number of cats entering shelters due to registration across the various states.

Enforcing compulsory registration in the same manner as dog registrations provides operational issues:

• A cat on a property does not indicate ownership and ownership can be denied • Cats are not as easily restrained as dogs as they are more agile and flexible in

their use of space. • Unlike dogs, cats do not identify their owners • Cat issues do not require the urgency that a dog wandering or dog attack

requires. • Community Inspectors currently spend 80% of their time on dog related

issues. • Enforcement would require the use of traps and this would be time consuming.

City of Playford already has a proactive and multi-pronged approach to cat management. Playford’s Cat By-law allows Council to take action against those creating a nuisance by keeping excessive numbers of cats, allowing their cat/s to enter another persons’ property or failing to identify their cat/s. The Dog and Cat Management Act also provides the ability to seize, detain, destroy or dispose of any unidentified cat. Identified cats must be returned to their owners and they can be expiated under the By-law. Compared to dogs, City of Playford receives minimal complaints in relation to cats:

• From July 2010 to June 2011 cat complaints logged to the Customer Request System totalled 57, whereas for the same period dog complaints totalled 2,724.

• Public nuisance is the most common complaint received by Council, ie cats fighting, soiling gardens, urinating, killing wildlife and generally being where they are not wanted.

City of Playford is the only South Australian Council that has an agreement with the Animal Welfare League (AWL) which allows residents to take stray and unwanted cats wandering on to their property free of charge to AWL. Council provides cat traps and incurs the cost of handing cats over to AWL. This cost effective strategy, whereby the residents and Council work together, has been in place since 2005. All cats re-housed through the AWL are desexed, microchipped and vaccinated. The owners of identified cats are followed up with a warning or fine. Where high numbers of cats are causing a nuisance Community Inspectors will be actively involved in their removal. The vast majority of cats impounded at AWL are classified as stray cats and are not reclaimed by owners. Between July 2010 and June 2011 of the 1208 Playford cats impounded at AWL, only 11 were reclaimed by owners. Research into cat shelter admissions across South Australia undertaken by the Dog and Cat Management Board of South Australia (DCMB) between July 2007 – June 2009 supports this:

• 27,511 cats were admitted to South Australian shelters • 75% of admitted cats could be classified as strays • Only 1.5% of all cats were reclaimed by owners

Owned cats may also be a nuisance within the community, however the statistics show that there is less likelihood that the owned cat is the source of nuisance. The South Australian DCMB report in 2009 revealed that 92% of owned cats are desexed and micro-chipped. The issue of compliance and enforcement is complex. Added to this is the fact that cats are not as easily restrained as dogs. They are more agile and flexible in their use of space, whereas a dog’s territory is usually confined to the owner’s premises. It is difficult to quantify the resources (human and financial) needed to effectively ensure that cats are controlled as intended by any proposed change to the By-law.

5.2.2. Catteries The establishment of a Cattery requires planning approval. Under Schedule 3 of the Development Regulations 1993, the keeping of domestic animals is not considered as development. However the keeping of domestic animals for commercial purposes requires a development application to Council. Public consultation may be sought, taking into consideration any impacts which the proposed development may have beyond the boundaries of a property. Consideration is given to representations received under the public consultation process in determining the appropriateness of the application by Council prior to making a decision. During the application process consultation may be required with other City of Playford departments such as the Health and Regulatory Services Team to identify issues and recommend conditions that may be applied in relation to the keeping of the animals. Approval of the application may as a result be subject to conditions determined by Council, under the development approval process. Where an application is not approved by Council the applicant has the right of appeal to the Environment, Resources and Development Court. It should be noted that Council is unlikely to grant approval for the keeping of non-domestic animals and commercial breeders within metropolitan residential areas. In the event of concerns relating to insanitary conditions Playford’s Environmental Health Team may investigate and take appropriate action under the Public and Environmental Health Act 1987.

5.2.3. Cat Impoundment Although cats are addressed in the Dog and Cat Management Act there is little in the way of effective legislation and no legislative requirement to provide cat pound facilities. As such, education is a high priority in relation to cat management within the City of Playford. Cats are not as easily restrained as dogs. They are more agile and flexible in their use of space, whereas the dog's territory is usually confined to the owner's premises. Responsible owners do not let their cat disrupt their neighbours’ lives. In the construction of new dwellings there is the scope to improve the ability to confine cats through internal courtyards and cat doors leading directly into outdoor enclosures etc.

Cat owners are encouraged to sterilise their cats, confine them to the house at night for their own protection and to prevent them from taking wildlife and breeding freely if not sterilised. Confinement of cats ensures their safety and that of surrounding wildlife, as cats hunt over a wide area. An average cat can destroy up to 16 mammals, 8 birds and 8 reptiles a year. Feral cats are domestic animals and their descendants which have gone wild. The main problem associated with feral cats is the rapid rate at which their numbers increase without natural predators or diseases to control them. Domestic cats continually feed into the stray and feral populations. While the number of domestic cats in Australia has been estimated it is difficult to estimate the number of feral cats due to the lack of research. One estimate suggests that the feral cat population could be between 5.6 million and 18.4 million.12

Residents experiencing problems with cats are advised not to feed or encourage strays, but ask neighbours if they own the cat. An identified cat caught or trapped must be released immediately. If an owner cannot be found then unidentified nuisance cats can be trapped by the person experiencing problems and taken to the Animal Welfare League. City of Playford Community Inspectors do not undertake trapping. Cat traps are available for a minimal fee and City of Playford is fortunate to have an arrangement with Animal Welfare to properly care for impounded cats. Unidentified trapped cats (without a collar with name and contact details) can be taken to the Animal Welfare League. Identified trapped cats must be released from the trap immediately and a Community Inspector notified of the cat’s identification details. Playford’s Community Inspectors will inform an identified cat owner of their responsibility and penalties and fines may be incurred.

5.2.4. Cat Registration Fees The identification of cats is essential to receive protection under the Dog and Cat Management Act and to assist:

• In the safe return of wandering cats to their owners. • Determining the owner of an animal involved in a conflict situation.

Registration fees do not currently apply to cats however, a proactive approach such as the introduction of subsidised desexing and community education programs may be far more beneficial in the long run. 12 Australian Nature Conservation Agency (1994), Cats in Australia.

The problems associated with nuisance cats are difficult and complex and there is no easy solution. Cats cause distress to residents through roaming, breeding, defecating and the destruction of wildlife. In recent times there has been a push to introduce cat registration but this will not resolve the associated issues. As is the case with dogs only responsible owners or those who have previously received a penalty or fine for an unregistered dog will register their dog. Irresponsible owners do not register their animals. The identification of a cat owner is not as simple as that of a dog owner. Dogs will often identity their owner by walking straight to them without hesitation, standing alongside them or wagging their tail when the owner is in sight. Cats do not display the same indicators. They are not as easy to capture as dogs and require some dexterity on behalf of the Community Inspector who would need to follow them over fences and on to roof tops. An increase in cat control would also mean an increase in the Community Inspector Team and Regulatory Services expenditure.

5.3. DOGS

5.3.1. By-Law & Permits The City of Playford By-Law 4 – Dogs (see attachment 3) limits the number of dogs to two per premises, sets specifications for kennel establishments and provides for control of dogs on local government land. 5.3.3. Dog Impoundment A Community Inspector’s first concern is for the safety of a dog which is found wandering and not under the control of its owner. Lost dogs are often frightened, not traffic smart and react negatively to strangers, placing the dog and the safety of the general public at risk. Dogs are impounded to ensure that they are safely contained and cared for until their owners claim them. Under the Dog and Cat Management Act there are clear legislative requirements regarding the impounding of dogs and the disposal of impounded dogs. Found dogs must be reported to Council immediately so that every attempt to reunite the dog with its owner can be made.

Impoundment fees apply for claimed dogs and penalties or fines may be issued to dog owners. Councils are required under the Dog & Cat Management Act to hold impounded dogs for a maximum of 72 hours (See appendix 4). After the 72 hour time period has elapsed unclaimed dogs are transferred to the Animal Welfare League Shelter. Dogs are temperament tested for suitability for rehousing into the community. All dogs suitable for rehousing are vaccinated, health checked and desexed before being put up for adoption by the Animal Welfare League Shelter.

5.3.4. Dog Registration Fees It is compulsory for dogs over three months of age to be registered. The identification and registration of dogs is encouraged to assist:

• In the safe return of wandering dogs to their owners. • Determining the owner of an animal involved in a conflict situation.

The Regulatory Service Department are responsible for administering the registration of dogs and the distribution of educational materials and registration renewals. All income from dog registration received by City of Playford is expended in the administration and enforcement of the provisions of the Dog and Cat Management Act relating to dogs. Monies are also expended on public safety initiatives, educational materials, related community events and recreational opportunities for pets and their owners. Councils are responsible for setting dog registration fees and rebates within a recommended range, which must be approved by the Minister. To maximise dog registrations, City of Playford will provide incentives for first time registration such as puppy packs, pooch pouch, dog leashes, free first year registration for dogs purchased from the Animal Welfare League etc. Education programs and enforcement through yearly door knocks will also contribute to reaching maximum dog registrations.

5.4. Community Education

The Dog and Cat Management Board promotes a combination of education, encouragement and enforcement as a successful method of animal management. The development of brochures, educational initiatives and regular media advertising campaigns help to promote key issues. Enforcement alone will not resolve the issues associated with dogs and cats.

Dog owners are encouraged to join a local obedience clubs (see appendix 6) to teach their dogs to be sociable, obedient and exercised. City of Playford supports obedience training through a registration rebate for a level 3 attainment.

In 2006 the Dog and Cat Management Board endorsed its own basic training standard for owners to complete in order to receive a rebate on registration fees. The Dog and Cat Management Board provided training rebate certificates to all SACA dog clubs and Delta accredited instructors in May 2006. Any dog owner wishing to apply for a training rebate from their dog registration are to provide the Council with a signed certificate from one of the above organisations.

5.5. Enforcement A number of offences for which an owner or person responsible for the control of dog can be fined is set out in the Dog and Cat Management Act. These include:

• Wandering at large, • Attacking, harassing or chasing a person or animal, • Attacking a person lawfully entering premises, • Being in a school, kindergarten or child care centre, • Being in a shop ( but not a pet shop, veterinary clinic or dog grooming parlour)

or a place where food and drink is sold or prepared, • Chasing a vehicle,

• Defecating in a public place (unless the person with the control immediately removes and disposes of the faeces).

All reported instances of conflict with any companion animal will be recorded together with the circumstances leading up to the conflict and consequently an assessment of the cause of the conflict, the degree of control and the animal and, the severity of any injuries. A person who urges a dog to attack, harass or chase any other person, animal or bird is also guilty of offence. The Dog and Cat Management Act prescribes the actions that can be taken by a Community Inspector. If a complaint is received then the Community Inspector may decide to issue a penalty or fine. If the offence is more serious or repeated they may issue a dog control or destruction order or issue a summons for the owner to appear in Court to answer to a criminal charge.

5.5.1. Excessive Barking Dogs excessively barking can be very disruptive interfering in the peace and comfort of those living in close proximity. The Regulatory Services Team deal with many barking allegation issues each year. Excessive barking allegations are processed in the following way:

• The owner of the dog is approached and advised of the complaint and advice is given on the cause of excessive barking.

• If there is a secondary complaint in relation to excessive barking a door knock of surrounding properties is undertaken to ascertain if the complaint is substantiated.

• If the complaint is substantiated there are a number of options available to Councils such as; warning notices, controlling orders, probation orders etc.

• The Process or investigating barking complaints has been endorsed by the LGA (Local Govt Association) as is considered the standard Operating Procedure across all SA councils.

5.5.2. Dog Attack/Harassment Dog attacks or harassment are a major concern and take high priority at the City of Playford. The Regulatory Services Team emphasis is on prevention and education as well as reacting to incidents and prosecution of offences. While the community enjoys the benefits of keeping dogs as pets, there will always be irresponsible owners and aggressive dogs. The Australian Bureau of Statistics indicates that the most common place for attacks to take place is the home (35%), at another person’s home (24%) or on roads and footpaths (20%).13 Dog attacks or harassment are dealt with in the following way:

• All reports of dog attack are attended to immediately; • Harassment complaints are investigated with 24 hours; • Serious injury to a person or animal may result in a destruction order or control

order. • Offences of a lesser nature may result in a control order including;

� Adequate fencing to confine the animal, � Locked access to the area where the dog is held, � Microchipping, � On a lead at all times in public, � Warning signs placed at property entrances where the dog is

held, � Muzzled in public.

5.6. Horses, Sheep, Cattle, Pigs, Goats or other

Livestock Playford’s Community Inspector Team receives on average approximately 50 calls per year to attend to livestock wandering on neighbouring properties and on roadways. Wandering livestock is a public safety issue especially when a large animal or animals have wandered onto a road. Police assistance is often sort in relation to traffic management ensuring wandering stock do not become a nuisance to road users. Council By-Law no 3 – Local Government Land states: No person shall without permission on any local government land –

(7) ride, lead or drive any horse, cattle or sheep, except on any street, road or car park or where the Council has set aside a track or other area for the use by or in connections with the animal of that kind.

Impounding facilities for livestock are located within the Animal Welfare League North Annexe at Hewittson Road, Elizabeth West. Community Inspectors can impound livestock in a safe secure enclosure until the owners can be found and notified. Animals impounded by councils are held for a period of 30 days under the provisions of the “Impounding Act 1920”, after this time any unclaimed animals may be relocated. The City of Playford is committed to ensuring all unclaimed animals are re-homed. Some provisions of the Impounding Act are no longer workable due to the time period in which it came into being and as such work has begun to amend the Act. Under Schedule 3 of the Development Regulations 1993, the keeping of domestic animals is not considered as development. However the keeping of domestic animals for commercial purposes and the keeping of non-domestic animals ie.; horses, sheep, cattle, pigs, goats or other livestock, requires a development application to Council. Public consultation may be sought, taking into consideration any impacts which the proposed development may have beyond the boundaries of a property. Consideration is given to representations received under the public consultation process in determining the appropriateness of the application by Council prior to making a decision.

During the application process consultation may be required with other Council departments such as the Regulatory Services Team or Environmental Health Team to identify issues and recommend conditions that may be applied in relation to the keeping of the animals. Approval of the application may as a result be subject to conditions determined by Council, under the development application process. Where an application is not approved by Council the applicant has the right of appeal to the Environment, Resources and Development Court. It should be noted that Council is unlikely to grant approval for the keeping of non-domestic animals and commercial breeders within metropolitan residential areas.

5.7. Native Animals With the reduction in natural habitats due to urbanisation, native animals are often forced to live in close quarters with humans. In South Australia most native Australian animals are protected and cannot be kept, sold or taken from the wild without an appropriate permit. Further information can be found at Dept of Environment and Natural resources www.environment.sa.gov.au City of Playford comprises of extensive rural areas and as such fauna wandering onto roads and property can cause concern. In most cases requests for attention to wandering fauna are either dealt with by the Playford’s Community Inspector Team or are referred to Fauna Rescue. Fauna Rescue is a volunteer organisation interested in the conservation of native Fauna. They will respond to calls from the public or Council if required to assist in the capturing, collecting, transporting and re-homing of stray fauna. For further information www.faunarescue.org.au

The City of Playford can accommodate the impoundment of some types of native animals for short periods of time at the Animal Welfare League Northern Annex in specially designed pens at the rear of the complex. Birds and animals that can be kept on residential properties must provide adequate measures to contain the animal on the property. Restrictions on the keeping of fauna depend on the type of animal or bird and could require a permit. Further information can be found at www.environment.sa.gov.au

5.8. Open Space Exercise areas where dogs can be exercised or run freely play an important part in reducing problems associated with bored dogs such as barking and aggression towards other dogs. A majority of dog attacks occur on private property. Dogs exercised in open space are less territorial and curious. The Dog and Cat Management 1995 requires dogs to be on a leash no longer than 2 metres in length whilst in all public places (a place to which the public has access). This includes places such as streets, roads, footpaths, shopping centre car parks but does not include parks and reserves unless otherwise specified by Council By-Law signs. Dog owners are reminded through education programs and enforcement that it is their responsibility to collect and properly dispose of their dog’s faeces when using open space areas. Being a responsible owner will ensure that open space areas remain available for dog exercise and protect the environment. Through this Animal Management Plan budgetary consideration will be given to the installation of dog waste bins in open space high traffic areas.

Each park, reserve and screening area in Playford has been assessed from an analysis of the activities occurring in it to determine the likelihood of potential conflict with other users. These assessments determine an appropriate category for usage. Off-leash free running activity areas are given high priority for the general physical and social needs of dogs helping to avoid other behavioural problems. Dog owners must have effective control of their dogs at all times and when off leash observe the following:

• Do not let the dog rush, worry, chase, threaten or bite any person or animal; • Remain in effective voice or hand control of the dog so as to be able to

promptly bring the dog under effective control by placing it on a chain, cord or leash if that becomes necessary;

• Be mindful of the surrounding area and place and control the dog on a leash if the dog is in close proximity to a:

� Sporting event; � Children’s play equipment; � Organised public activity, event or meeting; � Barbecue or dedicated picnic area.

Suggestions from the community regarding the adequacy of the off leash areas will be reviewed and analysed in terms of impacts on safety for the animal and potential for conflict with other users, and environmental impact.

All parks, reserves and screening areas within the City of Playford have been allocated with one or more the following four categories: 1. Future dog parks

The following sites in the City are flagged to include dog parks over the next year – Blakes Crossing (designed/built by Lend Lease) and Steabonheath Park, Andrews Farm and Jo Gapper Park at Hillbank as part of Councils Park Infrastructure and Trail Development for 2012/13 & 2013/2014 These parks have been identified as a good location for a fenced dog park where the community can exercise their dog off leash in an enclosed area.

2. On leash area

Identified on leash areas have areas that include playground equipment and sporting ground area.

3. Off leash area

Owners can allow their dogs to exercise off leash in these areas but must still keep their animal under effective control.

4. Prohibited.

Prohibited areas have been categorised as such because they are heavily used for sporting activities, predominately playground area or because dogs would cause a safety issue or environmental damage.

5.9. Planning for Pets

Urban growth in the future will impact on pet ownership with the size of backyards decreasing and smaller homes discouraging people from owning pets. It is often thought that dogs can only live happily in a large yard and it is a common misconception that dwelling type is important in successful pet ownership. Pets, in fact, can be successfully integrated into highly urbanised areas. Exercise and interaction with an owner is more beneficial (for both) than loneliness in a large backyard which leads to behavioural problems such as persistent barking. Dogs also place greater demands on available public open space. For owners to be able to exercise their dogs regularly, access is needed to public areas within easy walking distance of home. In new residential areas there is scope to improve resident’s ability to confine cats in the construction of new dwellings eg: internal courtyards, outdoor enclosures etc.

Good planning should integrate pets into urban environments, particularly with new residential housing, retirement developments, and recreational areas. The City of Playford’s City Development Department will consider integration of pets into urban environments, particularly with new residential housing, retirement developments and recreational areas through appropriate development policies and informed decision-making that considers the popularity, value and place of pets in society.

5.10 Other Animals including Birds & Bees Playford’s Health and Regulatory Services team investigate several customer requests and enquiries each year in relation to roosters, chickens, bird keeping, bees and other animals. The majority of complaints concern poultry including roosters, fowls, geese, turkeys or ducks which are found in large numbers in the rural areas of the city with smaller numbers in residential areas. These requests/enquiries are in relation to noise, wandering or excessive odour. Animal owners are required to keep animals in such a way as not to cause a nuisance or a hazard. Under Section 254 of the Local Govt Act 1999 councils can issue orders to require animal owners to abate a nuisance or hazard caused by animals. Examples include:

• Keeping an excessive number of insects, birds or other animals; • Keeping bees in close proximity to another property; • Keeping animals so as to generate excessive noise, dust or odours, or to

attract pests or vermin; Matters of excessive dust or odours are investigated by the Environmental Health Section of Council. Owners who keep animals also have responsibilities under the Public and Environmental Health Act 1986 to ensure the property is kept in a clean and sanitary condition. Council can issue Notices where the keeping of animals is causing an insanitary condition to occur. Examples of insanitary conditions include:

• Offensive odours caused by an accumulation of animal faeces on the property;

• Infestation of rodents as a result of failing to construct and maintain an adequate poultry enclosure.

By-Law made under the Dog and Cat Management Act 1995

BY-LAW NO. 5 – CATS the purpose of this by-law is to prevent the keeping of cats so as to be a nuisance or injurious to health definition In this by by-law -

“identified cat” means cat identified in the manner set out in part 3(9) of the Regulations under the Dog and Cat Management Act 1995;

“premises” means any aggregation of contiguous land (including any structures erected thereon) subject to the same occupation;

“unidentified cat” means a cat that is not identified in the manner set out in part 3(9) of the regulations under the Dog and Cat Management act 1995;

a “cat” means a cat over six weeks in age;

“keep” includes the provision of food and shelter.

to limit the number of dogs kept in premises, to set specifications for kennel establishments and to provide for control of dogs on local government land. definitions 1. In this by-law:

(1) “small dwelling” means the premises of a self contained dwelling either -

(a) commonly known as a flat, serviced flat, home unit or the like; or

(b) which is contained in a separate strata title or community title;

(2) “kennel establishment” means a building, structure, premises or area approved by the relevant authority pursuant to the Development Act 1993 for the keeping of dogs on a temporary or permanent basis.

(2) Such applications must be submitted with any fee determined to be paid by the Council and set by the Council from time to time.

(c) the kennel complies with any specifications set by the Council for kennel establishments in the area generally; and (d) any business involving the dogs is registered in accordance with the Dog and Cat Management Act 1995 pursuant to

Section 35.

(3) Signs shall be erected to denote land to which this paragraph applies, and information shall be provided to the public in a manner determined by the Council's City Manager to inform the public about such land.

1. AUTHORITY These arrangements have been prepared as a sub plan to the City of Playford Animal Management Plan.

2. SCOPE

The plan will direct the following functions; - Activation mechanisms - Responsibilities and tasks - Resourcing - Business continuity

This plan addresses the management of dogs and cats in time of disaster or emergency within the City of Playford.

3. AIM The aim of this plan is to define the roles and responsibilities of Council’s Dog and Cat Management Officers and their support staff during a disaster or emergency. Types of emergencies which would be encountered in Playford - Bushfire - Flood - Earthquake

4. OBJECTIVES

- To assist Dog and Cat Management Officers and their support staff to facilitate the management of dogs and cats in an emergency

- To identify triggers to activate this plan - To enable DCMOs to fulfil their legislative duties and to maintain service

standards and business continuity - To enable DCMOs to readily manage, access and utilise Council resources

and equipment - To provide DCMOs with relevant contacts to find specialised information,

equipment and care externally for effected animals and their owners - To allow for community members to care for their own animals in a safe

manner - To secure the assistance of community members, stakeholders and animal

welfare organisations where appropriate

5. INTERFACE WITH OTHER PLANS

This plan relates only to the management of dogs and cats in an emergency. Council is committed to the safety and protection of our community and its’ principal City of Playford Emergency Management Plan

6.1 Plan Activation The plan can be activated on the initiative of the following representatives of The City of Playford; Incident Mangement Team controller, the CEO, the General Manager Strategy and Compliance, the Team Manager Environmental Health and Regulatory Services. Upon activation, the Team Manager Environmental Health and Regulatory Services will coordinate a Control Facility and appoint an Incident Response Team and a Daily Business Team. 6.2 Daily Business Team The Incident Controller will appoint a Daily Business Team consisting of Inspectors and Administration Support Staff to maintain business continuity. The Daily Business Team will attend to incoming customer requests unrelated to the emergency with priority given to the following; - dog attacks and harassments - dogs wandering at large - contained stray dogs - stock wandering on Local Government Land - illegal burnings -school parking complaints - burning permits Anything not on this list will be dealt with as low priority. Daily Business Team Leader role description;

- To liaise with the Incident Controller to determine the designated work area - Point of Contact with Incident Response Team - To coordinate all aspects of the Daily Business Team - Manage all aspects of business continuity - Forward relevant matters to the Incident Response Team - Liaise with Council’s Customer Care Team - Liaise with pound to ensure capacity - Coordinate and assign new and existing CRS to Inspectors - Ensure pending court matters are adjourned or attended as required - Manage after hours roster to ensure continuation of service and staff

6.3 Incident Response Team The Incident Response Team will be appointed by the Incident Controller and will comprise an Incident Response Team Leader, Inspectors, Administrative staff and Customer Care representatives. They will maintain safe and orderly animal management in the emergency designated work area. Incident Response Team Leader role description;

- Liaise directly with the Incident Controller and the Council Incident Management Team

- Liaise with and monitor updates from CFS, SES, SAPOL, Bureau of Meteorology

- Collect information on the current and projected incident situation - Assess the situation, identify risks and determine priorities - Ensure briefings and debriefs are carried out at the beginning and end of

each shift - Ensure all staff are equipped with PPE - Encourage and maintain a safe workplace - Coordinate and assign CRS to inspectors and maintain knowledge of

their whereabouts - Develop and maintain staff rosters - Secure additional personnel as required - Manage Council’s supplies of equipment and resources - Facilitate assistance from external providers of animal rescue, shelter, equipment and veterinary care - Liaise with effected residents - Liaise with the pound, animal welfare organisations and stakeholders - Ensure records of impounded, lost or found dogs and cats are maintained and updated promptly and accurately - Estimate and plan for future service requirements

6.4 Animal Management Operations Centre The coordination of the plan shall occur from a central location; the Animal Management Operations Centre. This will be the Playford Operations Centre. If unavailable this may be the Council Civic Centre or another nominated location.

6.5 Public Information Council will maintain a register of impounded dogs which can be accessed by the public. A record of lost and found dogs and cats reported to Council will be taken, updated and reviewed. Members of the public that have lost their dog or cat are also encouraged to report this to their local vet, AWL, RSPCA and neighbouring Councils. Council will provide an information sheet to residents offering advice to dog and cat owners on how to prepare for and protect their pets in unexpected emergencies. 6.6 Stand Down The Incident Management Team Controller in collaboration with the Council Incident Management Team will determine when the emergency has ended. Animal Management arrangements will be scaled down. The Incident Controller and Incident Response Team Leader will assign responsibility for completion of outstanding CRS and actions. The Coordinator Regulatory Services will manage the staff roster and coordinate business continuity from this time.
