Persons wishing to address items on the agenda will be permitted to do so during the discussion of the item. No action may be taken on non-agenda items unless authorized by law. Subject: Proposed Change to the Liability Program Manager Action for consideration: Consider the Carl Warren & Company proposal to replace Dwight Kunz as
the Liability Program Manager. Background: Carl Warren & Company (CW), ICRMA’s contract Liability and Workers’ Compensation Program Management firm, recently notified ICRMA of proposed personnel changes. Specifically, Dwight Kunz is no longer with the company. CW is proposing that Rose Nuno, the Assistant Liability Program Manager, be placed in the role of Liability Program Manager. CW is also proposing that Gordon Pennington of Venbrook Group LLC (Venbrook), CW’s new parent company, provide Liability Program Oversight and Heather Mendez serve as the Assistant Liability Program Manager for ICRMA. Because ICRMA’s contract with CW identifies several key personnel to be assigned to the account, a change in personnel requires ICRMA review and approval. Dwight has been the ICRMA Liability Program Manager since April of 2018. Previously, from July 2016 – March 2018, John Beringer served as the Liability Program Manager. Bios for Nuno, Mendez, and Pennington are attached. They will be in attendance at the Committee meeting to address questions.

Ms. Nuno has extensive prior experience working with both Mr. Beringer and Mr. Kunz. Ms. Nuno’s vast experience and skill set are the precursors to the natural progression for the assumption of the Liability Program Manager role. To further the immediate success of the transition, Carl Warren is proposing to add Ms. Heather Mendez, an experienced public entity Senior Adjuster as the Assistant Liability Program Manager. The bios for Ms. Nuno and Ms. Mendez are attached along with the bio of Mr. Gordon Pennington which was distributed previously. We look forward to further discussions at the Special Claims Committee Meeting on Thursday, April 4, 2019.

Rose Nuno has been with the Carl Warren team for 11 years and has over 20 years of
claims handling experience. Rose’s expertise involves claim handling for Public Entities
and Crane/Construction clients. She specializes in Professional Liability, General Liability,
Automobile Liability, and Property Damage claims. Rose is fluent in Spanish, both written
and spoken. Her duties at Carl Warren include, but are not limited to:
• Investigating, evaluating and negotiating claims for public sector and
crane/construction clients.
• Attending mediations on litigated files in multiple states.
Prior to joining Carl Warren, Rose was a Claim Analyst at Scottsdale Insurance Company,
a Claims Specialist III at Kemper Insurance/Broadspire Claims, a Claims Representative at
CAN Galway Insurance E&S, and a Senior Claim Representative at Bristol West Insurance.
During her time at her previous positions, Rose developed an extensive claim handling
background to which includes:
• Investigating coverage, indemnity and contractual issues to conclusion
• Handled property damage and bodily injury claims to settlement.
• Designated adjusters to specific accounts depending on expertise.
• Handled commercial lines, automobile and general liability claims in multiple states.
Rose Nuno is licensed in multiple states and has completed her AIC designation.

Heather is an energetic and enthusiastic claims professional with 15 years of
experience. She has a comprehensive knowledge of claims adjustments to include
bodily injury, special investigations, auto appraisals, CCC pathways estimations, total
loss procedures, and salvage sales of vehicles. At Carl Warren she is responsible for
complex litigated cases to include class action lawsuits, wrongful death, police alleged
excessive force, employment, dangerous condition, directors and officer’s liability for
our public entity clients. She can review and prepare files for litigation roundtable
meetings and has worked with defense attorneys and a litigation team to resolve files.
She ensures timely reviews of all bodily injury evaluations and evaluates claims for any
possible SIU involvement, potential subrogation and comparative negligence.
Prior to joining Carl Warren, Heather was a Claims Examiner at Workmen’s Auto
Insurance Company for 2 years and a Claims Supervisor at Explorer Insurance for 8
years. She developed an extensive background experience throughout her
employment to which it includes:
• Complex auto claims, policy review, coverage confirmation, evaluating Bodily
Injury claims, compliance with DOI regulations for multi-states, including Georgia,
Florida, Utah, Nevada, Nebraska, and California.
• Reviewed run-off files from multi-states to complete resolution of claim.
• Trained staff on Bodily Injury evaluations and Total Loss evaluations.
• Developed processes for handling Salvage vehicles, which included handling of
DMV documents, retention of keys and title, or other releases from lien
holder/registered owners and disposition of vehicles from salvage yard.
• Managed third party vendors for timely appraisals of vehicles and supplemental
requests improving the turnaround time for claims resolution.
Notable achievements are:
• Assisted Subrogation Department and collected over $250,000 within 4 months
• Promoted to Claims Supervisor within 5 years of employment at Explorer
Insurance.
Heather is a certified Arbitrator with Arbitration Forums completed within 2 years of
employment. She is licensed to handle claims in the state of Florida as well.

Third Party Administration
Gordon Pennington is the Executive Vice President of Third Party
Administration for Venbrook Group, LLC. Gordon has leadership
responsibility for the Third Party Administrators (TPAs). He
previously served as Vice President of Claims of a national risk
mitigation operation, with oversight responsibility of 53 internal
claims employees, and seven external TPAs, responsible for the
successful resolution of claims and litigation generated from up to
$400 million in premium annually. His responsibilities included the
creation of program specific claims processes, implementation,
compliance, trend analysis and overall results across several
complex lines of insurance, including:
• CGL and Property Program, $250 million premium
• Commercial Package Program, $65 million premium
• Garage Programs, $20 million
• Commercial Auto Programs, $90 million
• Trucking Programs, $35 million
• Dry Cleaners BOP, $5 million
Gordon has held multiple leadership roles within the insurance
industry with Fortune companies such as Contractual Product
Development and National Underwriting Philosophy Manager.
Gordon has a proven history of tailoring the claims process to meet the specific needs of unique
programs, providing maximum levels of service, risk mitigation, litigation management, and cost
containment, which directly contribute to overall profitability.
Gordon holds Bachelor Degrees in Business and Accounting from the University of LaVerne and a
Masters of Business Administration with an emphasis in Organizational Theory and Development from
California Lutheran University. He earned a professional designation of Senior Claims Law Associate
through the American Education Institute. He is instrumental in the creation, and successful
implementation of processes, and the communication of results and trends which has assisted business
partners in driving results.
